Res 2013- 29 CUP 2453 Haverton Rd FenceCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2013 - 29 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A FENCE GREATER THAN THREE FEET AT 2453 HAVERTON ROAD WHEREAS, Ed Getz has applied for a conditional use permit for a fence greater than three feet in height within the 30 foot setback at 2453 Haverton Road (PID 27- 41602 -02 -010, Lot 1 Block 2, Kensington PUD 3rd Addition) as proposed in planning case 2013 -04; and WHEREAS, the Planning Commission held a public hearing on this matter at their regular meeting April 23, 2013. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a conditional use pennit as outlined in planning case 2013 -04 is hereby approved with the following findings of fact: 1. The proposed project will not further impact traffic visibility at the Mendota Heights Road /Haverton Road intersection. 2. The proposed fence type and height are consistent with all other City Code requirements. 3. The fence is compatible with the established character in the area and will not negatively impact any neighboring properties.
