CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, April 16, 2013 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. Ayes: 4 Nays: 0 Absent: 1 (Duggan) PULLED CONSENT AGENDA ITEMS J) APPROVAL OF RESOLUTION 2013 -25, SUPPORTING LEGISLATION AUTHORIZING STREET IMPROVEMENT DISTRICTS City Administrator Justin Miller explained that the League of Minnesota Cities and other professional municipal organizations have initiated legislation to authorize Street Improvement Districts. One of the main ways that cities fund street improvement projects is through special assessments. The improvements need to show an equal benefit to the property. Where property values are lower or there are not as many properties, this has become difficult for cities to be able to conduct street improvements through that method. This resolution would support legislation authorizing street improvement taxing districts. This does not mean that it is something that the City of Mendota Heights will necessarily implement; it would simply be a tool that cities might benefit from. Councilmember Petschel moved to Approve RESOLUTION 2013 -25, A RESOLUTION SUPPORTING LEGISLATION AUTHORIZING THE ESTABLISHMENT OF MUNICIPAL STREET IMPROVEMENT DISTRICTS. Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) April 16, 2013 Mendota Heights City Council Page 2 pg 3 K) APPROVAL OF RESOLUTION 2013 -26, SUPPORT OF GRANT APPLICATION FOR TRAIL CONNECTIONS ALONG DODD ROAD City Engineer John Mazzitello explained this is a resolution that would authorize staff to seek grant applications for two identified trail gaps along Dodd Road. The first trail segment is on the east side of Dodd Road between Market Street and Marie Avenue, which has been on the books for several years. This would allow the city to have the resources available to construct the trail. The grant application is for the 2014 construction year through a MnDOT program that allows cities to obtain grants for work along state highways. The second trail segment along Dodd Road would be on the west side, between Mendota Heights Road and the interstate 494 bridge. This would connect the city's trail system to the Eagan city trail system. Councilmember Povolny moved to approve RESOLUTION 2013 -26, A RESOLUTION SUPPORTING A GRANT APPLICATION TO THE MINNESOTA DEPARTMENT OF TRANSPORTATION CORRID OR INVESTMENT MANAGEMENT STRATEGY (CIMS) PROGRAM FOR CONSTRUCTION OF TRAIL CONNECTION SEGMENTS ALONG HIGHWAY 149 (DODD ROAD) Councilmember Norton seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) M) APPROVAL OF REQUEST FOR PROPOSALS FOR SANITARY SEWER FORCE MAIN REPAIRS City Engineer John Mazzitello recalled that several weeks ago the force main in Mendota Heights Road in the industrial park broke for the fifth time in five years. Staff believes it is time to take a look at permanently repairing that force main instead of patching it. It costs the city $25,000 to $35,000 per break to patch it. This action would authorize staff to seek proposals from specialty design firms to fix the force main. From that point, staff would bring another proposal before Council to move forward with the repair. Councilmember Norton moved to authorize the request to solicit for Professional Services for the Assessment of the Mendota Heights Road Force Main, and further authorizing staff to issue an RFP. Councilmember Petschel seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) April 16, 2013 Mendota Heights City Council Page 3 pg 4 N) APPROVAL OF RESOLUTION 2013 -27, ACCEPT BIDS AND AWARD CONTRACT FOR CROWN POINT AND OVERLOOK NEIGHBORHOOD STREET REHABILITATION PROJECT City Engineer John Mazzitello stated that on April 3, 2013 staff opened bids for the 2013 street rehabilitation project, which is the Crown Point and Overlook Neighborhoods. There were six bidders for this project and the low bidder was Asphalt Surface Technologies Corporation, better known as Astech Corporation. Their bid was $583,803. Once the resolution is approved, staff would be able to give a notice to proceed to Astech Corporation, a preconstruction conference would be held, and construction could begin in approximately one month. Mayor Krebsbach asked if the indirect costs in the bid would remain the same no matter what the bituminous bid was. Engineer Mazzitello replied that the number for indirect costs was an estimate and represents twenty percent of the bid price. Councilmember Petschel moved to approve RESOLUTION 2013 -27, A RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR THE CROWN POINT & OVERLOOK NEIGHBORHOOD REHABILITATION (PROJECT #201207). Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) PRESENTATIONS POLICE RESERVE JIM KNOX, SPEED TRAILER DATA COLLECTION Chief of Police Michael Aschenbrener introduced Police Reserve Jim Knox and thanked him for the work he has done with the speed cart. He also reviewed the history behind the decision to purchase the speed cart by the city. Mr. Knox opened his presentation by thanking the city for giving him the opportunity work with the speed cart. He explained that there were a few technical issues in the beginning as the data the software provided did not look accurate. After gathering his own data with a radar gun and comparing it to the speed cart data, he realized that the speed data was accurate; however, the cart did not count cars accurately He took that data back to MPH and they tweaked the parameters the computer used in their algorithm to count cars. Other adjustments and uses of the cart were reviewed. Part of the use of the trailer is to resolve complaints from residents about cars speeding through their neighborhoods. Mr. Knox reviewed the data received from the areas tested. Councilmember Petschel expressed her appreciation for all of the work done by Mr. Knox. She also stated that it would be interesting to see how the data changes before and after a construction project. April 16, 2013 Mendota Heights City Council Page 4 pg 5 She asked what the cost would have been to the city to hire a consultant to collect the data. City Engineer John Mazzitello replied that a typical traffic study to have a consultant sit out on a street with a clicker and count the cars, which does not collect speed data, typically costs between $2,000 and $2,500 per study. The cart cost the city $18,000. PUBLIC COMMENTS There were no public comments. AWARD OF BID ACCEPT BID AND AUTHORIZATION TO ENTER INTO PURCHASE AGREEMENT, FIRE TRUCK REPLACEMENT Fire Chief John Maczko and Assistant Chief Dave Dreelan explained that bid packets were sent out to four vendors for the purchase of a new fire truck. Two bids were received. Committee members and Councilmember Povolny met to review the bids and found both bids to be acceptable. The apparent low bidder was Custom Fire. After review, the Committee recommended awarding the bid to Custom Fire Apparatus, accepting option one, which is the refurbishing of the aerial device. It was recommended that the truck be paid for through existing fund balance rather than being bonded for. Councilmember Norton expressed his appreciation to the Chief and Assistant Chief for their time. Mayor Krebsbach asked for clarification that the refurbished aerial will last as long as the new truck and then asked how long the new truck would last. Chief Maczko did confirm that the refurbished aerial will last as long as the new truck, which would be approximately twenty -five years. Mayor Krebsbach then asked about the financing and would the city get a discount because of the up- front payment. Finance Director Kristen Schabacker replied that there is a discount on the purchase price if the city pre -pays for the truck upfront. The discount would be approximately $25,200 off the bid price. Mayor Krebsbach asked about the performance bond. Chief Maczko replied that there is a performance bond and that Custom Fire Apparatus pays for that. She then asked about their past performance record. Chief Maczko explained that this is the same vendor that built the city's 2009 truck. They have actually built a number of trucks for the city over the years and have a good relationship with the city. Mayor Krebsbach asked City Administrator Justin Miller to speak about the city having the resources to pay for the truck. Administrator Miller explained that it is being recommended this be paid for out of fund balance. The city does have adequate cash reserves for this purchase, even though it is a large purchase. April 16, 2013 Mendota Heights City Council Page 5 pg 6 Mayor Krebsbach asked Director Schabacker to speak about the financing used for the purchase of the last fire truck. Director Schabacker explained that when the fire truck was purchased in 2009, the city issued ten -year bonds. The city is still paying on those bonds. Councilmember Petschel asked what Custom Fire is offering as a loaner fire truck. Chief Maczko replied that the truck they are offering as a loaner is the same type of truck the city traded in when we purchased the 2009 truck. The department is very familiar with this type of truck. Councilmember Povolny made a motion to award the bid to Custom Fire, accepting option number one, and direct staff to enter into a contract with Custom Fire to pre —pay for the truck using fund balance. Councilmember Norton seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) CITY ANNOUNCEMENTS Assistant to the City Administrator Jake Sedlacek listed some of the upcoming events in the City of Mendota Heights: • April 15 is Severe Weather Awareness Week, with April 18 being Tornado Drill Day. • May 4 — Spring Clean Up Day. • June 1 — Park Celebration from 11 — 2:00 p.m. • June 1 — 5K Run/Walk at 9:00 a.m. COUNCIL COMMENTS Councilmember Petschel acknowledged the people of Boston and stated that our hearts and prayers are with them. She also commented on potential legislation_ to require MAC and the FAA to do a complete environmental impact statement for MAC's 2020 Long -term Comp Plan. She wanted residents to understand that in order for this to be required there has to be a decibel change in key areas that would equal 1.5 decibels. There is nothing close to that in the noise testing that was done. She feels this is being done politically as it mentions area navigation in the bill. The dangerous thing here is that the cities surrounding the airport, the FAA and MAC reached a decision that would continue to allow MAC to do noise insulation to the DNL 60 and use general airport revenue to accomplish that. MSPNleadeta Heights is the only airportcity in the United States that insulates to the 60 and is the only airportcity that would be allowed to use general revenue. This bill could jeopardize that. If the legislature seeks to inflict this on the FAA, she feels they may no longer participate in the agreement. The letter that the City of Mendota Heights put together in response to this was forwarded to all of the other cities as a template for what their responses should be in light of these developments. It was also forwarded to MAC staff to be used as their talking points. She will keep the City posted as new information becomes available. The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, April 23, 2013, in the Council Chambers at City Hall, 1101 Victoria Curve at 7:00 P.M. The following Commissioners were present: Commissioners Field, Magnuson, Noonan, Roston, Hennessy and Viksnins. Those absent: Chair Norton and Commissioner Hennes. Those present were Assistant to the City Administrator Jake Sedlacek, Public Works Director /City Engineer John Mazzitello, and NAC Planner Stephen Grittman. Approval of Agenda The agenda was approved as submitted. Approval of February 26, 2013 Minutes COMMISSIONER MAGNUSON MOVED, SECONDED BY COMMISSIONER NOONAN, TO APPROVE THE MINUTES OF FEBRUARY 26, 2013, AS PRESENTED. AYES: 5 NAYS: 0 ABSENT: 2 (Norton. Hennes) Approval of March 26, 2013 Minutes COMMISSIONER NOONAN MOVED, SECONDED BY COMMISSIONER MAGNUSON, TO APPROVE THE MINUTES OF MARCH 26, 2013, AS PRESENTED. Assistant City Administrator Jake Sedlacek noted that there was not a quorum at the March 26, 2013 meeting and while there were actions to close public hearings were not formal actions and were not included in the minutes. AYES: 5 NAYS: 0 ABSENT: 2 (Norton. Hennes) Commissioner Roston asked if the commission needed to take any actions. Assistant Administrator Sedlacek replied that there were provisions in the code which allowed City Council to consider those actions. In each case the City Council continued the public hearing, closed the public hearing, and took action on the planning application. Hearing pg 9 Planning Commission Minutes April23, 2013 a) PLANNING CASE #2013 -04 Ed Getz Conditional Use Permit for a Fence at 2453 Haverton Road Planner Stephen Grittman presented the request and showed a map outlining the location of the property, a corner parcel with access to Haverton Road and Mendota Heights Road. The parcel is a single family parcel occupied by a single family home and zoned and guided for single family residential use. The applicant was seeking to construct a fence on the north side of the home, within twenty -five of the right -of -way of Mendota Heights Road. The city's zoning ordinance allows fences within the thirty foot setback to six feet in height, by conditional use permit. The proposal is to construct a decorative metal or iron looking fence five feet in height, 25 feet from the right of way. The planning staff recommended approval of this conditional use permit based on the following findings of fact: 1. The proposed project will not further impact traffic visibility at the Mendota Heights Road/Haverton Road intersection 2. The proposed fence type and height are consistent with Ordinance requirements 3. The fence is compatible with the established character in the area and will not negatively impact any neighboring properties Commissioner Roston asked, since the purpose of the ordinance is to maintain visibility, if a condition needs to be in inserted about some sort of maintenance and visibility. Planner Grittman replied that it is believed that, because of the location and construction, a separate condition is unnecessary. If the fence were to be changed in the future by any owner of the property, then the conditional use permit would need to be amended. Acting Chair Viksnins opened the public hearing and asked the applicant to come forward. Mr. Ed Getz of 2453 Haverton Road introduced himself and explained that his yard has become a short-cut for children, pets and deer in the area. Mr. Getz would like to install an ornamental fence primarily for security reasons, not for privacy reasons. Commissioner Noonan asked the applicant his reason for seeking a fence higher than 3 feet. Mr. Getz replied that he received two quotes for fences and after speaking with the suppliers he discovered that a higher fence, would improve the chances of reducing the number of deer in his yard. Seeing no one coming forward wishing to speak, Acting Chair Viksnins asked for a motion to close the public hearing. Hennes) pg 10 Planning Commission Minutes April23, 2013 COMMISSIONER ROSTON MOVED, SECONDED BY COMMISSIONER NOONAN, TO RECOMMEND APPROVAL OF CONDITIONAL USE PERMIT FOR A FENCE AT 2453 HAVERTON ROAD AS REQUESTED BASED ON THE FINDINGS OF FACT DETAILED IN THE STAFF REPORT. AYES: 5 NAYS: 0 ABSENT: 2 (Norton. Hennes) Acting Chair Viksnins advised that the City Council would consider this application at its May 7, 2013 meeting. Discussions a) NAC CASE 254.04 — 13.06 Amendment to City Code Pertaining to Garages Planner Grittman presented potential changes to City Code regarding garages, noting that the draft language is intended to serve as a framework for discussion, rather than as a recommendation from staff. Planner Grittman also noted that the current regulations encourage attached garages, which is common in single family residential communities. Several commissioners shared the opinion that a maximum garage size of 1,500 square feet in area was sufficient for residential properties. The commission felt that garages matching the footprint of the home could result in garages that were bigger than would be desired. Commissioner Roston asked staff to provide language which would require an accessory structure to match the principle structure. Assistant to the City Administrator Sedlacek provided examples of how draft language regarding the size of a detached garage would apply to the range of housing in Mendota Heights. The commission had mixed opinions on 10% of the rear yard as a standard. Commissioner Roston asked staff to clarify language on the total area for accessory structures, and how it applied to properties with one or two accessory structures. Commission members supported the notion of a fixed lineal foot standard for garage doors. Feedback included support for 36' as included as the draft, and support for 30' and going up to 36' by conditional use permit. Commissioner Noonan expressed concern that allowing four single garage doors could result in an "industrial feel." Commissioner Hennesey commented that she is in support of the underlying objective here to reduce outside storage and asked if there is a standard approach across the region. Mr. Grittman replied that each community approaches the problem differently, but the 10% of lot size was fairly common. pg 11 Planning Commission Minutes April23, 2013 Commissioner Magnusson noted that the city may want to consider maintaining a preference for attached garages, which may be reflected by allowable sizes. Commissioner Magnusson inquired as to the status of a similar code amendment which would have changed requirements for non - residential properties in residential zones. Mr. Sedlacek reported that the referenced amendment was not passed by city council. Commissioner Magnusson supported the change to allow two double garage doors, and did not support the idea for larger garages or more garage door allowance for requests where the garage was not visible from the right of way. Acting Chair Viksnins asked Planner Grittman to explain the next steps going forward. Planner Grittman replied that staff would refine the proposed ordinance changes given the comments received and bring it back at the next Planning Commission meeting for further discussion. If the Commission could coalesce around some certain ideas then they could call for a public hearing at the following meeting. Mr. Sedlacek requested commission feedback the number of garages allowed. The city code currently allows one garage, either attached or detached. The drafted language would allow for two garages and limit the allowable accessory structures down from three to two. Commissioner Roston supported the idea of allowing two garages to limit outside storage. Acting Chair Viksnins welcomed comments from the public. Mr. Don Wagner, 718 Stanwich Lane, currently has a two car garage and would like to construct a second garage. Mr. Wagner had considered the idea of adding onto the home but due to expense and aesthetics a detached garage is the preferred alternative. A second, detached garage would allow for continued open access to the back of the yard from either side of the garage. Commissioner Noonan asked about the size of Mr. Wagner's current garage. Mr. Wagner replied that it is currently an attached 24 x 24 [576 square feet] two car garage with one garage door. The second, detached garage he is looking to build would be approximately 22 x 22 [484 square feet] due to the setback requirements, with one garage door. Staff thanked the commission for their discussion and feedback on the issue. b) Amendment to City Code Pertaining to Signs Assistant to the City Administrator Jake Sedlacek introduced the topic, noting that there had been lengthy discussions regarding City Code pertaining to signs at the end of 2012. City Council discussed the topic at their goal setting meeting, directing staff to proposed changes to modernize the sign code. Commissioner Magnuson asked how this ordinance would characterize flashing signs. Mr. Sedlacek replied that flashing signs are not permitted within any district. Currently, any source of light including LED's must be diffused. pg 12 Planning Commission Minutes April23, 2013 Commissioner Hennessy supported the draft language, and asked staff to consider language regarding banners. Mr. Sedlacek noted that banners could be considered as a temporary sign. Commissioner Noonan also supported the draft language, and asked staff to include language to prohibit flag signs, which seem to be growing in popularity. Commissioner Roston sought clarification regarding holiday greeting signs in residential districts. Planner Grittman stated that he has seen sign regulations that specifically exempt holiday displays from the sign regulations, which could be included as an exempted sign. Commissioner Roston also advised staff to focus on sign standards, rather than any specific technology. Commissioner Magnuson asked that staff also provide language allowing certain wall signs for non- residential uses located within residential districts. Acting Chair Viksnins asked about regulating logos or symbols. Assistant Administrator Sedlacek replied that the city may regulate the area of signs, manner of construction, and how they are lit but staff would advise strongly against looking at the content of that sign. Planner Grittman, offered clarification on cabinet signs, stating that some communities prohibit internally lit cabinets as they may broadcast light rather than sign messages. Kennedy signed public law 87 -762 designating May 15th as Peace Officers' Memorial Day, and the week in which May 15 falls as National Police Week. The law was amended by the Violent Crime Control and Law Enforcement Act of 1994, Public Law 103 -322, signed by President Bill Clinton, directing that the flag of the United States be displayed at half -staff on all government building on May 15th each year. While the actual dates change from year to year, National Police week is always the calendar week, beginning on the Sunday of the week which includes May 15th. National police week for 2013 is scheduled to be observed from Sunday, May 12th, 2013 through Saturday, May 18th, 2013. National Police Week Honors the service and sacrifice of law enforcement officers killed in the line of duty while protecting our communities and safeguarding our democracy. There are approximately 900,000 law enforcement officers currently serving in communities across the United States, including the dedicated members of the Mendota Heights Police Department. There are nearly 60,000 assaults against law enforcement officers reported each year. The first recorded in the line of duty death of a law enforcement officer occurred in 1791. Since that time over 21,000 law enforcement officers have died in the line of duty in the United States, 231 from the State of Minnesota and 6 from Dakota County law enforcement agencies. ACTION It would be a great honor to have the Mayor and City Council if they so choose to proclaim May 12th 2013- May 18th, 2013 National Police Week. I have drafted and attached the proclamation to this memo if they so choose to salute the service of law enforcement officers past and present in our community and across the nation. Mazzitello, PE, PMP Public Works Director /City Engineer SUBJECT: Ordinance Amending City Code to Establish a No Parking Zone on the West Side of Pueblo Lane BACKGROUND The Traffic Safety Committee (TSC) has been researching the possibility of instituting no parking on the west side of Pueblo Lane, across from Friendly Hills Park as a measure to increase pedestrian safety. By limiting parking to the park side of Pueblo Lane, pedestrians will no longer be crossing the street to get to their vehicles, greatly minimizing the potential for pedestrian related accidents. The TSC presented this proposal to Council at their April 2nd meeting with the explanation that the TSC was in the process of surveying the residents along this section of Pueblo Lane to get their opinions on the parking restriction. Staff sent letters to the nine affected property owners and had responses from four of them. All four responses favored the parking restriction. The attached ordinance will codify the parking restriction in Title 6 of City Code. BUDGET IMPACT The City of Mendota Heights has No Parking signs available, and these signs would be installed by City staff. Any materials needed for the installations that are not currently in stock will be purchased out of the street signs and posts line item in the street department budget. There are sufficient funds in this line item to account for any expenses. The concern had to do with the currently uncontrolled intersection at Karl Hohenstein Place and Main Street. Traffic southbound on Karl Hohenstein Place cannot see to the right, around the building on the corner with Main Street. Although there has been no accident history at this intersection, after review the concern and the intersection, the TSC recommended to Council at their April 2nd meeting that a stop sign be installed for the southbound lane on Karl Hohenstein Place. The TSC further recommended that a cautionary sign be placed below the stop sign stating, "cross traffic does not stop." Stop signs are required to be codified in City Code, and all the streets in The Village at Mendota Heights are public right -of -way and the responsibility of the City. The attached ordinance will codify the Stop sign location. BUDGET IMPACT The City of Mendota Heights has a stop sign available, and the sign would be installed by City staff. The property is guided and zoned medium density residential, Planned Unit Development and used as a single - family home. Steve Grittman of NAC Planning presented the request to the planning commission at their regular meeting April 23, 2013. This type of fence request is allowed with a conditional use permit. Under the conditional use permit, a fence may be placed up to the property line. In this request, the applicant is seeking to place the fence at a setback of 25' from the property line. Mr. Getz explained to the commission that he was seeking the fence to limit the number of deer in his backyard, and for an added sense of security. Mr. Getz replied to a question from the commission that he had considered a 3' fence, but prefers a fence that is 5' in height. The Zoning Ordinance states that fences in such required yards cannot exceed 36 inches without the granting of a conditional use permit. The applicant's property is a "corner lot" and is accessed from the east via Halverton Road. The proposed fence is to be an ornamental metal type and would enclose the rear yard area of the site. Analysis: The applicant is proposing to fence the rear yard of his property. Because the fence segment along the north property line lies within 30 feet of a public right -of -way (Mendota Heights Road) and exceeds 36 inches in height, the processing of a conditional use permit is required. At its closest point, a fence setback of 25 feet from the Mendota Heights Road right -of -way line is proposed. pg 35 According to the applicant, the fence segment along Mendota Heights Road will sit atop an existing berm and within an existing tree line. It is the applicant's hope that the proposed fence will secure the subject property and discourage pedestrians from "short cutting" across his corner lot (a pedestrian trail presently exists alongside Mendota Heights Road). Gates to the fenced rear yard are proposed from the east, on the north and south sides of the residence. The gate locations do not obstruct access to the home's driveway and are considered acceptable. According to the Ordinance, no fences, structures, manmade berms, or plantings may exceed thirty 36 inches in height above the center grade of the intersection within any front or side yard area on a corner lot which may interfere with the visibility across the corner. The proposed fence will not impact visibility at the Mendota Heights Road/ Haverton Road intersection. Existing vegetation in the area may be any issue, and the applicant should work with City staff to optimize visibility in this location. The city originally issued bonds for Lexington Heights Apartments in 1983. The bonds have had amendments in 1991, 1999 and 2003. At this time they are requesting that the city call for a public hearing on the refunding of these bonds scheduled for June 4, 2013. Staff and bond counsel have been researching the fees that have been paid in the past for the issuance of these bonds. These bonds are a refunding and do not count towards the $10,000,000 bank qualified money that the city is allowed to issue annually. These bonds are conduit financing and are a pass through for the city. They are not an obligation of the city. BUDGET IMPACT The city has received a $2,500 deposit to cover any costs we may incur. Any unused money will be returned once the issue is final. There will be a fee charged to Lexington Heights Apartments for the refunding of this issue. The fee will be determined at a later date once all research has been completed. Mendota Heights resident and Par 3 clubhouse worker Thomas Clifford is interested in one of the golf course maintenance worker positions. Staff met with the Thomas to discuss the position and expectations. Staff is recommending Thomas Clifford for the golf course maintenance worker position. His hourly rate for the seasonal golf course maintenance position will be $10.00 per hour. BUDGET IMPACT As noted above. RECOMMENDATION City staff recommends that city council appoint Thomas Clifford for seasonal golf course maintenance position for the 2013 golf season. If council concurs in the recommendation, a motion should be made to approve the appointment of Thomas Clifford for the golf course maintenance worker position. SUBJECT: Approval of Plans and Specifications and Authorization to Advertise for Bids for 2013 Sanitary Sewer Cleaning and Televising Project BACKGROUND Our sanitary sewer system is aging. Many of our pipes are 60 years old and will soon be in need of repair. Cleaning our sewer system on a regular cycle will help extend the life of the pipes. Televising of the system will show where immediate repairs are needed. Lining pipes in need of repair with cured -in- place -pipe will extend the life of our system. In 2002, $30,000 of damage was reported due to sewer problems. In 2006 there were four sewer backups with insurance claims totaling over $10,000. Due to the city's proactive approach beginning in 2006, payouts resulting from sewer backups totaled less than $500 in 2008. In 2011, the city successfully defended itself again a sanitary sewer backup claim due to the city's proactive approach to sanitary sewer maintenance. We want to continue preventing sewer backups and future damage expenses. The City of Mendota Heights maintains 72.2 miles of sanitary sewer pipe. Currently, Rich Burrows along with one seasonal employee cleans approximately 10 miles of pipe per year. In addition, last year the city contracted with Overline & Son, Inc. for cleaning approximately 4.0 miles of the City's sanitary sewer system and televising approximately 11.6 miles of the City's sanitary sewer system. At our current rate, we are cleaning the system every 4 -6 years The proposed project is for the cleaning of approximately 3.2 miles of the City's sanitary sewer system and televising approximately 12.9 miles of the City's sanitary sewer system. The project area (see attached map) was last cleaned and televised in 2008. The completion date for the project is November 1, 2013. pg 52 BUDGET IMPACT The project costs will be funded through the Sanitary Sewer Utility Fund which has sufficient funds to cover the project costs. The 2013 city budget includes $62,000 for sanitary sewer cleaning and televising and $110,000 for sanitary sewer lining. Staff does not anticipate exceeding the budgeted amounts. RECOMMENDATION Staff recommends that the council approve the final plans and specifications and authorize staff to advertise for bids. If city council wishes to implement the staff recommendations, pass a motion adopting RESOLUTION 2013 -31 APPROVING FINAL PLANS AND SPECIFICATIONS, AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE 2013 SANITARY SEWER CLEANING AND TELEVISING (PROJECT #201304). These licenses will expire on May 31, 2013. Renewal applications have been received from the following businesses: On -Sale 3.2 percent malt liquor licenses: • Mendota Heights Par 3 located at 1695 Dodd Road, • Mendo Restaurant Group, Inc., dba Mendoberri located at 730 Main Street, • Windy City Pizza LLC dba Tommy Chicago's Pizzeria located at 730 Main Street, • CEC Food and Beverage LLC, dba LeCordon Bleu, 1315 Mendota Heights Road. Off -Sale 3.2 percent malt liquor licenses: • Northern Tier Retail LLC dba SuperAmerica located at 1080 Highway 110, • Northern Tier Retail LLC dba SuperAmerica located at 1200 Mendota Heights Road All of the required documentation has been received. Background investigations have been conducted resulting in no negative findings on the above applicants. There have been no liquor law violations within the past year. It should be noted that on April 2, 2013, the City Council amended the City Code to change the licensing period for 3.2 percent malt liquor to the period of July 1 through June 30 of each year. If approved, these licenses will be effective through June 30, 2014. SUBJECT: Accept Bids and Award Contract for Hunter and Orchard Neighborhood Improvements BACKGROUND Staff identified the Hunter Lane Neighborhood Improvements as a 2013 street reconstruction project in the 2012 -2016 Street Improvement Plan (SIP). The Glenhill Road Neighborhood Rehabilitation was identified as a 2013 street rehabilitation project in the 2012 -2016 SIP. Due to the close proximity of these projects to each other, staff proposes to combine these two neighborhood improvements into one project to reduce redundancies, staff time, and would produce lower unit prices during construction due to the project size. The combined project will be called the Hunter and Orchard Neighborhood Improvements. Council ordered the Hunter and Orchard Neighborhood Improvements at their October 16, 2012 meeting, and directed staff to prepare plans and specifications for this street reconstruction project. Council approved the plans and specifications at their March 19, 2013 meeting. Four bids (see below) were received and opened on Wednesday, May 1, 2013, at 10:00 a.m. for the Hunter and Orchard Neighborhood Improvements. NAME OF BIDDER Northdale Construction Company, Inc. McNamara Contracting, Inc. Bituminous Roadways, Inc. Arnt Construction Company, Inc. AMOUNT OF BID $1,537,313.21 $1,544,928.53 $1,586,186.90 $1,632,818.14 Northdale Construction Company, Inc. submitted the lowest responsible bid of $1,537,313.21. Their bid was less than the Engineer's Estimate of $1,718,481.25. Northdale Construction Company, Inc. is a contractor with many years of experience with an office in Albertville, pg 73 Minnesota. Northdale Construction Company, Inc. has completed projects in Mendota Heights in the past and Staff recommends them for this contract. The substantial completion date for the project is September 27, 2013. I expect that Northdale Construction Company, Inc., serving in the capacity of General Contractor, is capable of meeting the completion dates and installing the proposed improvements in accordance with the plans and specifications given their experience and the amount of equipment and manpower they have at their disposal. Staff will mail out a general notice to the residents about the project after council awards the contract, including information regarding the construction schedule. Street Reconstruction — Hunter Lane, Orchard Place, and Culligan Lane (East) The project includes reconstructing the niral sections of Culligan Lane, Hunter Lane and Orchard Place. The horizontal alignment of these streets will remain approximately the same. The proposed street width on Hunter Lane and Orchard Place is 29 feet wide from face of curb to face of curb with surmountable curb were permissible and B618 barrier curb where necessary, as directed by the city council. Culligan Lane shall match the existing urban section with a proposed street width of 30 feet wide from face of curb to face of curb with B618 barrier curb, as directed by the city council. Due to storm water drainage and public safety, staff is proposing to constnict the project with B618 (barrier) curb on the entire length of Hunter Lane, the entire intersection of Hunter Lane & Orchard Place, the intersection of Orchard Place & Orchard Circle, and the intersection of Orchard Place and Lexington Avenue. Surmountable curb is proposed on the remaining sections of Orchard Place only. Storm sewer improvements will consist of adding catch basins and storm sewer pipe and connecting to the existing storm sewer system. St. Paul Regional Water Services (SPRWS) has recommended replacing the existing water main and hydrants on Hunter Lane, Orchard Place and Culligan Lane. Street Rehabilitation — Culligan Lane (West), Glenhill Road, and Veronica Lane Proposed improvements for the existing urban street section of Culligan Lane, Glenhill Road, and Veronica Lane will include the reclamation of the existing bituminous roadway and the placing of a 2.5" bituminous base course and a 1.5" bituminous wear course over the reclaimed pavement material, curb and gutter repair, and catch basin repair. Disturbed boulevard areas will be restored with topsoil and sod. Driveways that are disturbed due to the street rehabilitation will be replaced in kind. Street Rehabilitation — Orchard Circle Proposed improvements for the existing urban street section of Orchard Circle will include milling of a 6 -foot wide strip adjacent to the existing curb and gutter and placing a 1.5" bituminous overlay extending over the entire width of the roadway, curb and gutter repair, and pg 74 catch basin repair. Driveways that are disturbed due to the street rehabilitation will be replaced in kind. Sanitary Sewer Proposed improvements for the Veronica Lane Sanitary Sewer Lift Station will include leaving the existing structure in -place while replacing the existing top slab and access hatch and replacing the pumps, controls, piping, and electrical components to ensure continued reliability and code compliance.
