Ord 447 Amend Code Title 3 LiquorCITY OF MENDOTA HEIGHTS Dakota County, Minnesota Ordinance No. 447 AN ORDINANCE AMENDING TITLE 3 OF THE CITY CODE, AMENDING LICENSING PERIOD FOR 3.2 PERCENT MALT LIQUOR AND THE REQUIREMENTS FOR ON -SALE INTOXICATING LIQUOR TIER TWO LICENSE WHEREAS, the City Council of the City of Mendota Heights desires to amend its Code regarding the licensing period for 3.2 percent malt liquor licenses to coincide with the licensing period for intoxicating liquor and wine licenses; and WHEREAS, the City Council of the City of Mendota Heights also desires to amend its Code regarding the requirements for obtaining an On -Sale Intoxicating Liquor License Tier Two. NOW, THEREFORE, THE CITY OF MENDOTA HEIGHTS ORDAINS: Section 1. Title 3, Chapter 1, of the Mendota Heights City Code is hereby amended as follows: 3 -1 -11: EXPIRATION OF LICENSES: All licenses for 3.2 percent malt liquor under this chapter shall expire on June 1 of cach year. All ether licenses under this chapter shall expire on June 30 of each year. 3 -1 -13: PLACES INELIGIBLE FOR LICENSE: E. On -Sale Licenses: 2. No on -sale tier two intoxicating liquor license shall be granted for a restaurant that does not have a dining area, open to the general public, with a total minimum floor area of one thousand (1,000) square feet and dining facilities for seating a minimum of one hundred fifty (4-08 50) guests at one tune. Section 2. This Ordinance shall be in full force and effect from and after its publication according to law. Adopted and ordained into an Ordinance this 2nd day of April, 2013.
