RESOLUTION 2013 - 22
RESOLUTION FORMALLY ACCEPTING A PERMANENT ROADWAY EASEMENT
FROM THE OWNER OF 1669 LILAC LANE TO THE CITY OF MENDOTA HEIGHTS
WHEREAS, the City of Mendota Heights desires to follow the Minnesota State Statute
465.03, "Gifts to Municipalities," which encompasses the acceptance of real property; and
WHEREAS, the Minnesota State Statute requires a Resolution to accept gifts to
municipalities; and
WHEREAS, the City has previously acknowledged gifts with a Resolution, including the
acceptance of easements; and
WHEREAS, the City Council of the City of Mendota Heights has duly considered this
matter and wishes to acknowledge the civic mindedness of its citizens and officially recognize
their donations; and
WHEREAS, as part of City of Mendota Heights Planning Case 97 -14, The City
approved a lot line adjustment with the condition that the owner of 1669 Lilac Lane "donate an
appropriate portion of the front of his lot to the City for street right -of- way;" and
WHEREAS, the permanent roadway easement offered to the City by the owner of 1669
Lilac Lane satisfies the condition of approval placed on the 1997 lot line adjustment between
their lot and 1675 Lilac Lane.
NOW THEREFORE IT IS HERBY RESOLVED that the City Council of the City of
Mendota Heights accepts a peimanent roadway easement from the owner of 1669 Lilac Lane
consisting of 5 -feet of property as measured form the existing easterly and southeasterly property
lines. The easement area of 582 square feet of land area is to be utilized as a permanent roadway
easement for Lilac Lane.
