Minutes of the Regular Meeting
Held Tuesday, March 5, 2013
Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Mayor Krebsbach called the meeting to order at 7:00 p.m. The following members were present:
Councilmembers Duggan, Povolny, Petschel. Councilmember Norton arrived at 7:01 p.m.

PRESENTATIONS
A) DARTS INVITATION TO "POWER & POSSIBILITIES OF AGING" COMMUNITY
CONVERSATION
Colleen Fritch, spokesperson from DARTS, explained that on March 21, 2013 DARTS and the City of
Mendota Heights are hosting a community conversation on aging. This event will take place from 6:30
p.m. to 8:30 p.m. at the Mendakota Country Club.
She explained there will be more people retiring this decade than in the last four decades combined,
which is the reason for the community conversation on "Power & Possibilities of Aging ". Experts
participating in the event include a DARTS expert on transportation, resource specialist on in -home
services, a wellness expert from Anytime Fitness, a Dakota County Public Health representative, a
Dakota County Community for a Lifetime representative, and Access Solutions on home modifications.

B) ST. THOMAS ACADEMY STUDENT WATER QUALITY REPORT
Mr. Tony Kinzley, teacher of AP Environmental Science at St. Thomas Academy, stated there were
approximately forty students who participated in the water quality study of Rogers Lake, which were
required to prepare a formal group presentation. The winning group presented the findings to the City
Council.
Mr. Charlie Johnson explained that the students tested six different sites on Rogers Lake over a ten week
period. They performed twelve different sets of testing and collected nine different tests at each site,
equating to over 650 pieces of total data, analyzed and averaged that data to one number per test. The
average score for each test mainly fell in the GOOD range, which shows the healthiness of Rogers Lake.
There were three that were borderline high: change in temperature, total phosphate, and total solids.
Mr. Joe Mahowald spoke about the positive aspects received from the lake this year in regards to
dissolved oxygen, fecal coliform, biochemical oxygen demand, pH, nitrate, and turbidity. All fell in the
acceptable range.
Mr. Chad Hansen shared aspects of the lake that have opportunities for improvement which included the
change in temperature, total phosphates, and total solids.
Mr. Kevin Muckley explained the ways to decrease the phosphates and total solids in the lake, including
proper application and minimal use of fertilizers within the neighborhoods surrounding the lake,
sweeping yard waste and fertilizers from the pavement and the gutters along the streets and driveways,
picking up pet and goose waste, maintaining buffer zones between the yards and the lake front, and
using organic de -icing substitutes. The overall quality of the lake is 75.93, which is a GOOD rating.
Councilmembers commented on how much they appreciated the testing and reports that the students
provide each year. They also commented on the efforts that the city has made and will make in the
future to continue to improve the quality of Rogers Lake.
CONSENT CALENDAR
Mayor Krebsbach presented the consent calendar and explained the procedure for discussion and
approval. Councilmember Norton moved approval of the consent calendar as presented and
authorization for execution of any necessary documents contained therein, pulling item E) Approval of

Councilmember Duggan commented that he received many calls about the decision made on the raising
of racing pigeons and that a lot of cities (i.e. New York City, Chicago) have lots and lots of pigeons.

for Accessory Structure, 1815 Valley Curve Road, Planning Case 2012 -34.

UNFINISHED AND NEW BUSINESS
A) PLANNING CASE 2013 -01; ORDINANCE AMENDMENT AND CONDITIONAL USE PERMIT
FOR ADULT DAYCARE, 1385 MENDOTA HEIGHTS ROAD, ORDINANCE 446 AND
RESOLUTION 2013 -14
Assistant to the City Administrator Jake Sedlacek explained that this planning application has two
actions related to it. The first is to determine if an adult daycare, as a use, fits within the I— Industrial
zone. Currently, daycare centers for either youths or adults are allowed in most business zones but
daycare use of any type is not allowed in an industrial zone. The request is whether or not the City
would allow an adult daycare in the industrial zone, which would require a code amendment. The
applicant has proposed that the code be amended to add Adult Day Care as a conditional use permit.
The language proposed for the code amendment was reviewed by the Planning Commission at their last
meeting and was recommended for approval making sure that daycare uses in the industrial zone would
be limited to those for people eighteen years of age or older.
Mayor Krebsbach asked for a definition of a daycare. City Attorney Tami Diehm commented that the
generally accepted definition would be a place where people gather during the day but nobody resides.
Assistant to the City Administrator Sedlacek stated the definition of a daycare center in the zoning code
is "a facility which, for gain or otherwise, regularly provides one or more persons with care, training,
supervision, habilitation, rehabilitation, or development guidance on a regular basis for periods of less
than twenty -four hours per day in a place other than the persons own home ".
Mayor Krebsbach asked if there is any definition for license and if there was any staff to client ratio
requirements. Councilmember Petschel pointed out that there is a definition in the code amendment that
indicates they must be licensed by the State of Minnesota and that the licensing, in terms of number of
employees and relation of employees to individual, would be covered by the licensing.
Assistant to the City Administrator Sedlacek also noted that the staff to client ratio is something that is
entirely within the jurisdiction of the state as licensing requirements are defined and enforced by the
state; therefore, it is not something that a city would weigh in on.
Councilmember Duggan asked if the separate entrance would be wide enough to accommodate a gurney
if ambulance service is necessary. Assistant to the City Administrator Sedlacek answered that this would
be part of the licensing requirement and part of the state inspection of the facility prior to issuing a
license.
Councilmember Duggan also asked if there would be adequate bathroom facilities and the appropriate
Sewer Availability Charge (SAC) charge. Assistant to the City Administrator Sedlacek replied that the
bathroom facilities would be covered under the state licensing requirements and the SAC charges be
covered by the building permits.
Mayor Krebsbach asked if this facility would be specific to a particular group of people or if it would be
open to any who might want to participate in adult daycare. Assistant to the City Administrator replied
that both the ordinance and the conditional use permit do not specify any particular group served except
that they would need to be over eighteen years of age.

Councilmember Duggan moved adoption of Ordinance No. 446, An Ordinance Amending Titled 12,
Chapter 1, Section G of the City Code to Accommodate Adult Daycare in Mendota Heights in the
Industrial Area.

Assistant to the City Administrator Sedlacek stated that the planning application is for a Conditional Use
Permit (CUP) for an adult daycare. The site is at 1385 Mendota Heights Road and is two parcels. The
request is to have an adult daycare facility at the location, a current existing space which has been vacant
for some time. The use is a mix of both office and the daycare facility. The applicants have provided
detailed drawings of what the interior of the building might look like. The applicants have described
traffic impact as having regular office workers on site but they will also bring clients to the site primarily
using their own vans, generally from mid - morning to mid - afternoon. The traffic impact for this request
is very minimal. The Planning Commission did recommend approval of the Conditional Use Permit.
Mayor Krebsbach asked if this daycare facility would be open to anyone who wishes to attend. Mr. Yorn
Yan, Executive Director of the United Cambodian Association of Minnesota, commented that the
daycare is targeted for South Asian Seniors but would be available for anyone to attend. The association
provides transportation because ninety -five to ninety -six percent of their clients do not drive. He does
not believe that traffic will be an issue because they have three vans that they would use to provide
transportation to and from the facility.
Councilmember Duggan asked what the estimated number of adults would be that would be using the
facility. Mr. Yan replied that they expect about twenty to twenty -five adults a day, three days per week,
from 9:00 a.m. to 1:00 p.m. Councilmember Duggan then asked how many staff members would be
present. Mr. Yan answered that each staff member would be responsible for four participants; so there
would be four to five staff members on hand. This ratio is determined by the State of Minnesota.
Councilmember Duggan asked about the food service provided. Mr. Yan replied that the meals would
be prepared at a licensed restaurant, brought to the site on a daily basis, and then warmed up at the
facility before serving. All of this would be regulated by the State of Minnesota.
Councilmember Duggan also asked about the `chronic disease self - management and diabetic sessions'
listed on the activity roster as these are highly intensive and require skilled personnel. Mr. Yan answered
that they do have a registered nurse available for the clients on location each day that the daycare is open
for two hour sessions.
Councilmember Petschel made the observation that she is delighted they are moving into the business
park and commended them for providing what must be a much needed service to South Asian seniors.
Councilmember Duggan moved adoption of Resolution 2013 -14 Approving a Conditional Use Permit
for an Adult Daycare at 1385 Mendota Heights Road.

B) APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT
FOR BIDS FOR FIRE TRUCK REPLACEMENT, RESOLUTION 2013 -17
Fire Chief John Maczko and Assistant Fire Chief Dave Dreelan explained that the Fire Department has
had a capital replacement plan for a number of years with an overall goal of replacing five major pieces
of equipment. The department purchases a major piece of equipment every five years.
The 1978 fire truck was scheduled to be replaced in 2014; however, the existing motor is not
functioning. The bid specs have been designed to ensure that the city is obtaining a piece of equipment
that will serve very well now and into the future, as is compatible with the equipment that is already
there. The truck that is proposed to be purchased is very much comparable to the truck that was
purchased in 2009 in chassis, in firefighter complement, in the pump, roll -up doors, and basically a
model that would support the moving of a piece of equipment from the old truck onto this new one.
It was noted that Councilmembers Povolny and Norton were part of the sub - committee that investigated
the purchase of this truck.
At this point, the department is requesting to be able to move forward with bidding the truck, schedule a
pre -bid conference for Thursday, March 7, and schedule the bid opening for April 4. Current budget is
estimated at $550,000 and the successful bidder will actually receive the existing truck and be expected
to dispose of it accordingly. The department is also asking in the bidding process for the successful
bidder to provide a loaner vehicle until the new truck is delivered.
Councilmember Povolny stated the department did a good job of putting together the bid specifications.
He feels they were very complete and thorough and believes it should be ready to bid.
Councilmember Norton echoed Councilmember Povolny's comments and asked Chief Maczko to
discuss the value of the old truck. Chief Maczko replied that the secondary market for these types of
trucks is typically for rural departments and the size of the water tank that rural departments want or
need is much different than what is available in an urban environment. Repairing the engine on the non-
working vehicle would be approximately $27,000 and it is questionable if they could get that amount for
the trade in.
Anticipated delivery of the truck would be at the end of 2013 or early 2014.
Mayor Krebsbach asked about the timeline for the financial commitment. Finance Director Kristen
Schabacker replied that there would be an amount due when the bid is awarded for the chassis, which
would provide the city with significant savings. Typically, there is a six month lead time from when the
bid is awarded to when the chassis is delivered. The balance would be due upon delivery of the truck.
Councilmember Duggan asked if there is an estimated cost for the use of a loaner. Chief Maczko replied
that there is currently not an estimate on the use of a loaner, but builders have made available trade -ins
for use as loaners and the cost of those depends on what the market is able to bear.

Further clarifying questions were asked and answered in regards to refurbishing the old Squrt or
purchasing a new one.
Mayor Krebsbach asked what is ahead after this purchase. Chief Maczko replied that the next unit in the
plan is the heavy rescue equipment.
Councilmember Povolny moved to approve Resolution 2013 -17; Approving Specifications and
Authorizing Advertisement for Bids for a 1500 GPM Engine with 55' Squrt.

COUNCIL COMMENTS
Councilmember Povolny commented that St. Thomas will be playing in the state hockey tournament this
weekend. He also asked about the front end loader. City Engineer John Mazzitello replied that the front
end loader is scheduled to be delivered by the end of March.
Councilmember Duggan commented that since there has been so much snow this year, he is sure the fire
department would appreciate it if residents would adopt a fire hydrant and shovel it out to make it easier
to reach should there be a fire in the neighborhood.
Since the Council would not be meeting until afterwards, Councilmember Duggan wished everyone a
Happy St. Patrick's Day.
Councilmember Petschel stated that the Mendota Heights Moms Club is going to be sponsoring a
community blood drive. The blood mobile will be in front of the Kraus home on March 23 from 9:30
a.m. to 2:30 p.m. Daycare will be available, appointments can be scheduled in advance, and walk -ins
are welcome. Ms. Kraus can be reached at p.kraus @comcast.net
Councilmember Petschel also commented on the two perfect ACT scores at St. Thomas Academy, one
by Connor Plunket and one by Walker Lee. 1.7 million Juniors take the ACT test and there are only 781
perfect scores.
City Administrator Justin Miller expressed his appreciation to the public works department for their
ongoing work all winter, especially over the past night.
Mayor Krebsbach stated, with great sadness, that there was a fatality off of Delaware and expressed
condolences to the family.
Mayor Krebsbach also thanked NDC 4 and Town Square Television for covering the State of the City
Address and for the work of staff in preparation.
Mayor Krebsbach also wished all of the residents a Happy St. Patrick's Day.

PARKS AND RECREATION MEETING
March 12, 2013
The March meeting of the Mendota Heights Parks and Recreation Commission was held on
Tuesday, March 12, 2013 at Mendota Heights City Hall, 1101 Victoria Curve.
Chair Levine called to order the parks and recreation commission meeting at 6:30 p.m. The
following commissioners were present: Chair Stephanie Levine, Commissioners Mary McGrory-
Ussett, Ira Kipp, Joel Paper, Pat Hinderscheid and Michael Toth. Excused absent:
Commissioner David Miller. Staff present: Recreation Program Coordinator Sloan Wallgren,
Public Works Director John Mazzitello and Assistant to the City Administrator Jake Sedlacek.
Approval of Minutes of February 12, 2013
Commissioner McGrory -Ussett made a motion to approve minutes of the February 12, 2013
meeting; commissioner Hinderscheid seconded the motion.

Introduction of Sloan Wallgren
Mr. Wallgren introduced himself as the city's new recreation program coordinator, having
started on Monday, March 4, 2013. Mr. Wallgren has experience in both recreation
programming and golf course management. Commissioner Hinderscheid commented that he
participated in interviews, was impressed with both finalists, and was very pleased that Mr.
Wallgren has joined the city.
North Urban Regional Trail Plan
Mr. Mazzitello introduced Chris Hartzell from Dakota County who has been providing updates
to the public on the process to define routes for the North Urban Regional Trail.
Mr. Hartzell provided a presentation on the North Urban Regional Trail, defining five options for
trail alignments in the area of Marie Avenue and Delaware Avenue. The county intends to create
a Greenway, where trails are located in natural environments rather than along roads. Mr.
Hartzell stated that Dakota County would maintain the regional trail and answered a number of
questions from the commission.
Commission comments on the North Urban Regional Trail alternatives included the following:
• The county is encouraged to work with School District 197 early in the process.
• One commissioner felt that Option 3, taking the trail through Dodge Nature Center
property was the best route.

• One commissioner felt that the nature center property needs to be undisturbed as habitat
for a number of animals.
• One commissioner felt that Option 1, placing the trail on the western side of Henry Sibley
High School property was the best option.
Mr. Hartzell thanked the commission for their time and input, and mentioned that a third open
house on the topic will be held on Wednesday, March 27, 2013 at West St. Paul City Hall.
Recreation Programming and Facilities Update
Mr. Sedlacek reviewed the agenda materials, recognizing Mr. Wallgren for getting our
Recreation Flyer distributed to more local schools than it has in the past. Mr. Sedlacek also
invited commissioners to attend the Junior Golf League registration on Monday, March 18 from
5:00 -7:00 p.m. at City Hall.
The commission had questions about the upcoming community conversation on aging — Mr.
Sedlacek reported that the event was led by DARTS, and should result in a work plan for the
community to plan for the growing number of families dealing with aging issues.
The Mendota Heights Parks celebration will be June 1, 2013: Mr. Wallgren reported that the
event will feature activities for all ages, including a new attraction - an obstacle course and
display by the Army National Guard.
Mr. Sedlacek reported that no maintenance requests for parks had been received since the past
meeting.
Mendakota Park Playground Update
Mr. Sedlacek recapped discussion from May 2012, when a presentation was made to the
commission on an update to the play equipment at Mendakota Park. The commission
recommended that $70,000 be included in the 2013 budget to refurbish the playground. Mr.
Sedlacek asked the commission to revisit the issue before issuing a request for proposals on the
project. A replacement structure could run in the range of $140,000 - $160,000. The commission
supported refurbishing the playground, hoping that the project may be completed this spring.
Commissioner Hinderscheid made a motion directing staff to develop a request for proposals to
refurbish the playground at Mendakota Park. Commissioner Paper seconded the motion.

The commission welcomed Mr. Wallgren to the commission, and wished him well in the new
position.

The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday, March 13,
2013 at 7:00 p.m. at 1101 Victoria Curve, Mendota Heights, MN.
The following commissioners were present: David Sloan, Kevin Byrnes, Jim Neuharth, Sally Lorberbaum, and
William Dunn

Approval of Minutes
Lorberbaum made a motion, seconded by Dunn, to approve the February 13th minutes as submitted - all voted in
favor.
Sunfish Lake Representative Vacancy
Chair Sloan reminded the commission that Gretchen Keenan, the former Sunfish Lake at -large representative to
the NOC, had submitted her resignation. The commission discussed how to involve the new Sunfish Lake
representative and agreed to wait a few months and discuss it at a future ARC meeting.
Review of 2012 Actual Noise Contour Report
Miller presented key findings of the MAC's "2012 Actual Noise Contour Analysis" and pointed out areas of
interest to Mendota Heights. Of note was that the contours continue to shrink as operations remain lower than
the 2007 forecast and planes are quieter in general. Also of note is that residential areas along Lemay Lake
Road were once in the 60 DNL but now show readings lower than 60. No action was required.
Acknowledge Receipt of Various Reports /Correspondence
The monthly reports for January 2013 were acknowledged and commissioners updated their respective areas of
focus. Neuharth discussed the Six Sigma literature he presented at the last meeting and made several
suggestions about how the commission should react when certain measurements reach outside the upper control
limits. Miller and Neuharth agreed to meet before the next meeting to discuss how to improve the charts
presented to the commission.
The commission also discussed inviting a speaker to our next meeting. Miller indicated he would review the
list of speakers that was generated by the commission and discuss with Chair Sloan who to invite to the April
meeting.

Dunn made a motion, seconded by Lorberbaum, that the meeting be adjourned. All voted in favor. Meeting
adjourned at 8:00 pm.

Fire Calls
The department responded to 10 calls for the month. The majority of calls were classified as false alarms
or as good intent calls. Three were residential in nature and three were commercial in nature. There were
two car fires, one trash fire and one EMS call.
Monthly Department Training
The monthly department training was dedicated to satisfying our OSHA mandated training Firefighters
received training in the areas of Blood Borne Pathogens, Employee Right to Know, Pre Plans and Lock
Out -Tag Out Procedures. OSHA is one of the three agencies that dictate our training requirements, the
others being the National Fire Protection Association (NFPA) and the State of Minnesota Fire
Certification Board.
Monthly Squad Training
The squad training for the month was rope and knot training The fire department has over 1,500 feet of
rescue and utility rope. Rescue rope is used for any operation that would result in serious injury or death
if the rope broke. Utility rope is general purpose rope that is used to hoist tools and to tie off equipment.
Our water rescue rope is somewhere between utility rope and rescue rope, it has qualities of both, but its
primary design requirement is to float. The training focused on tying basic utility knots, life safety knots
and rigging mechanical rope rescue systems.

SUBJECT: Temporary On -Sale Liquor License for St. Thomas Academy
INTRODUCTION
Pursuant to City Code, no person except wholesalers and manufacturers, shall directly or
indirectly deal in, sell, or dispose of by gift, sale or otherwise, any intoxicating liquor, wine or
3.2 percent malt liquor without first having received a license to do so. Temporary On -Sale
Liquor licenses can be granted only to clubs and charitable, religious or nonprofit organizations
that have been in existence for at least three years. No organization shall be granted more than
two temporary liquor /special event licenses in any calendar year. No license shall be issued for
more than three days. The licenses are subject to final approval by the Director of Alcohol and
Gambling Enforcement.
DISCUSSION
St. Thomas Academy, located at 949 Lake Drive, is planning to hold their annual Community
Auction Gala at St. Thomas Academy on April 20, 3013, in the school's cafeteria and
gymnasium. The event will take place from 5:00 p.m. to 12:00 a.m. They have requested a
Temporary On -Sale Liquor license to allow for the sale of alcoholic beverages at the event.
Please find the request from St. Thomas Academy attached. Security will be present during the
entire event. St. Thomas Academy has successfully submitted an application and certificate of
insurance for liquor liability.
It should be noted that Temporary On -Sale Liquor licenses have been issued in the past to St.
Thomas Academy and many other charitable, nonprofit and religious organizations within the
city with no incidents or negative reports.
RECOMMENDED ACTION
Staff recommends the City Council approve a Temporary On -Sale Liquor License for St.
Thomas Academy for April 20, 2013, subject to approval of the Director of Alcohol and
Gambling Enforcement.

BACKGROUND
The Mendota Heights City Council adopted a resolution in April 2011 approving a conditional
use permit for a temporary garden center at the Mendota Plaza. Linder's is requesting a renewal
of that conditional use permit to locate a temporary garden center in the same location as last
year, with the same footprint and signage.
This would be the thirteenth year Linder's Flower Marts would have a location at Mendota
Plaza, only missing the 2010 gardening season due to the redevelopment of the site.
The attached resolution carries forward the conditions of approval from 2011 and reflects the
requested extension.
BUDGET IMPACT
None.
RECOMMENDATION
If city council wishes to approve the request to renew the conditional use permit, pass a motion
adopting RESOLUTION 2013 -19 RENEWING A CONDITIONAL USE PERMIT FOR A
TEMPORARY GARDEN CENTER AT 750 HIGHWAY 110. This action requires a simple
majority vote.

A RESOLUTION RENEWING A CONDITIONAL USE PERMIT FOR A
TEMPORARY GARDEN CENTER AT 750 HIGHWAY 110
WHEREAS, Linder's Garden Centers, on behalf of Paster Enterprises, has applied for a
conditional use permit for a temporary garden center at 750 Highway 110 (PID 27- 48401 -020-
01; Lot 2 Block 1 Mendota Plaza Expansion) as proposed in planning case 2011 -07; and
WHEREAS, the Mendota Heights City Council adopted resolution 2011 -24 approving
the requested conditional use permit on April 5, 2011; and
WHEREAS, Linder's Greenhouses faithfully complied with all of the conditions of the
conditional use permit: and
WHEREAS, Linder's Greenhouses has requested a renewal of the conditional use permit
for 2013.
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a
conditional use permit for a temporary garden center at 750 Highway 110 as proposed in
planning case 2011 -07 is hereby renewed with the following findings of fact:
1. The temporary garden center, with conditions as recommended, is consistent with the
intent of the shopping center development approval.
2. The garden center will be able to be served with existing public utilities and
infrastructure
3. The garden center will not interfere with the operation of the shopping center as
approved by the city.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the
approval is subject to the following conditions:
1. The garden center shall be located as depicted on the submitted site plan.
2. Garden center sales operations shall be allowed from April 15 through July 20, 2013.
3. All equipment associated with the garden center use shall be removed from the
premises no later than 10 days from the date garden center closes.
4. Hours of operation shall be from 8:00 a.m. to 8:00 p.m. daily.
5. All signs shall conform to the sign regulations contained in the Zoning Ordinance,
including all necessary sign permits.
6. Fencing shall consist of a fence as shown in the application materials around three
sides of the garden center.
7. Trash shall be removed from the garden center area on a daily basis.
8. Any necessary utilities such as electricity and water shall be supplied by the Mendota
Plaza Shopping Center.

This letter is written to the City of Mendota Heights as a request for a renewal of our
permission to operate a Flower Mart at the Mendota. Heights Plaza. Enclosed in this
package please find information, drawings and letters relating to Linder's "Flower Mart" at
the Mendota Plaza. This will be the thirteenth successful year we have operated at this
location.
In 2013 we would like to propose a selling season that would be from approximately April
15 thru July 20. We appreciated the opportunity to try the Summer /Fall concept at this
location last year but we have decided not to continue with the Summer /Fall stores this
year We will arrive and begin set -up prior to the opening date. As approved in 2011we
are planning to operate our store in the northeast corner of the parking lot as detailed on
the attached site plan. We think this location has worked very well and seems to have little
or no impact on the traffic flow in the lot.
Hopefully I have provided enough information about Linder's and our 2013 proposal to
satisfy any of the questions you may have about Linder's doing business in Mendota
Heights again this spring. We are eager to continue being a part of beautifying this area of
the Twin Cities with Linder's grown flowers and plants, and are proud to be a part of your

BACKGROUND
In 2003, a contractual agreement between the cities of Mendota Heights, West St. Paul and
Eagan provided for a School Resource Officer (SRO) for Independent School District (ISD) 197.
At that time, a West St. Paul police officer provided the service and the other participating cities
reimbursed West St. Paul. In April of 2004, WSPPD notified the district of the need to reassign
the officer to investigations.
ISD 197 and the Mendota Heights Police Department immediately responded to the need to have
an officer assigned to the high school. Day shift officers covered this need while a joint grant
application was completed. Late in 2004, we learned the application was denied as we did not
meet the criteria to receive federal reimbursement to have an officer at the school.
A contract was then agreed upon for the SRO to service ISD 197. Some minor changes to the
contract have occurred since the original 2004 -2005 contract was signed and the contract has
served both parties well. The contract is billed on actual expenses only. The SRO is assigned to
normal patrol duties during the summer months.
The Memorandum of Understanding (MOU), which details all the working relationships, has
received some minor changes which reflect on the positive outcomes and goals the school
district, the SRO and the police departments are hoping to accomplish.
The contract has been reviewed by both the city and school district attorneys. The school board
authorized the Superintendent to sign the Service Contract and MOU on March 4, 2013.
BUDGET IMPACT
This is a budgeted item. There are no changes to the budget impacts.
RECOMMENDATION
If Council desires to implement the recommendation, pass a motion authorizing the Mayor and
Clerk to sign Resolution 2013 -20 and the Contract to provide service to ISD 197; "SCHOOL
RESOURCE OFFICER CONTRACT FOR SERVICE."

SRO CONTRACT
School Resource Officer
Contract for Service
This School Resource Officer Contract for Service (the "Agreement ") dated this 4th day
of March, 2013, is made pursuant to Minnesota Statute 471.59, by and between the City
of Mendota Heights ( "City ") and School District 197, West St. Paul/Mendota
Heights/Eagan ( "School District ").
1. Purpose
The City and School District wish to participate in a School Resource Officer (SRO)
Program (the "Program ") between the City of Mendota Heights Police Department and
School District 197. Both the City and School District feel that a this more formalized
approach to the School Liaison Officer Program will is needed to improve understanding
and promote mutual respect between police, school, staff, counselors, parents, and
students. The purpose of this agreement is to set forth, in writing, the terms and
conditions, to create, fund, and implement the position of a police school liaison
officer(s) ( "PSO ").
2. Funding
The School District will fund the actual expense incurred by the City related to the hiring
of the PSO. Without limiting the generality of the foregoing, the City and School District
acknowledge that the following costs will be paid by the School District (collectively, the
"Costs "):
A. Officer's salary;
B. Officer's related benefits, including, but not limited to sick time, vacation and
disability pay;
C. Training and set at a flat rate of $1200 year; and
D. Equipment (police equipment and squad) costs set at a flat rate of $4500 per year.
In the event that the contract is extended beyond 2016, the Costs for such years will be
agreed to by both parties based upon the actual amount of the Costs.
In the event the School District or the City should receive a grant or special funding to
offset the Costs, the amount billed to the School District will reflect the alternative
funding and will result in the amount paid by the School District being adjusted
accordingly.
3. Services
The City shall provide the services of a police officer or officers and related support
services and supplies to assist the School District in establishing and maintaining the
Program at the assigned school(s). The PSO(s) will have the duties as described on a
separate MOU between the City and the School District and attached hereto and made a

part hereof as Exhibit A (collectively, the "Services "). The School District agrees to
provide office space, telephone, cell phone, computer and printer which are necessary for
the PSO(s) to provide the Services.
4. Payment
The City shall provide billing to the School District for the Services on a semi - annual
basis, with invoices being provided on each July 1 and January 1. Invoices will be due
and payable by the School District no more than thirty (30) days after receipt of the same.
5. Term
This Agreement shall commence on the 1st day of September, 2012, and shall end on the
30th day of June, 2016. Thereafter, the Agreement may be renewed for additional two
year periods as agreed by both parties.
6. Contractor
The City through its Chief of Police will remain free to exercise judgment and
professional expertise in determining how to best provide the Services described in this
Agreement. The City acknowledges that no withholding for state or federal benefits or
taxes will be made from the payments made to the City by the School District. The City
also acknowledges that it has sole obligation to comply with state, local and federal tax
provisions with regard to the Services and the independent contractors hired by the City
to perform the Services.
The City and any PSO who performs the Services for the District agree that the PSO shall
not accrue any continuing contract rights and the officer specifically waives any right to a
continuing contract. The City agrees that if the PSO makes any employment claim or
brings any employment action of any kind, the City will be solely responsible for the
defense and payment of any claim as the PSO is not an employee of the District.
7. Scheduling
The duty hours of the school liaison PSO are flexible and will be primarily
coordinated with the school clay and /or activities during the normal school year.
The PSO officer will make daily contact with the police department for the purpose
of keeping abreast of incident reports and other city activities. During non - school
periods, such as summer break, the PSO's duties and schedule will be determined
by the Chief of Police and the district is not billed for that time.
8. Termination of this Agreement
This Independent Contract will run through 2016 but the costs associated with the
Program shall be reviewed annually by both parties. Notwithstanding the four (4) year

term of the contract, either party may terminate the Agreement by providing written
notice to the other party no less than six (6) months prior to the planned termination date.
9. Temporary Emergency Reassignment
The School District acknowledges that the PSO may be occasionally called upon to
respond to emergencies within the community. If, in the discretion of the Chief of Police,
it becomes necessary to remove the PSO from the district for more than periodic
assistance to respond to emergency calls, the Chief will inform the School District
officials in advance of this action. Should the liaison officer be removed from his duties
in the district, the district will not pay for the officer's salary or benefits during that
absence.
10. Security / Linking
The PSO office will be locked and secured by a key issued only to the PSO. The PSO
will be provided a suitable computer, monitor and printer and any other items or services
necessary, at the expense of the School District, so that the PSO will have full access to
the networked to the Mendota Heights Police email system and School District 197's
email and network system at all times the PSO is working pursuant to this Agreement.
11. Indemnification
Each party is responsible for its own actions. Both parties' liability shall be limited by
applicable law and nothing in this Agreement shall be interpreted in any way that reduces
or limits either parties statutory protections or liability limits.
12. Amendments
This Agreement contains all the full understanding and agreements between the parties
and may not be amended except in writing agreed to and executed by both parties. If any
provision of this Agreement is found invalid by a court or agency, it shall not invalidate
any remaining provisions.
13. Data Practices
Sharing of data will be done only pursuant to the Minnesota Data Practices Act and the
Family Educational Rights of Privacy Act. Any data shared between the two parties to
this Agreement will be maintained in the accordance with all applicable state and federal
laws. Because the City and the officer(s) are not employees of the District, any violation
of the state or federal law in this regard is the sole responsibility of the City and the
officer and each agrees to hold the District harmless if a claim or action arises because of
the City's actions or omissions.

SRO CONTRACT
12. Discrimination
The City and School District agree not to discriminate in providing services under this
Agreement on the basis of race, sex, creed, national origin, age, or religion. The parties
agree not to discriminate as required by any and all applicable state and federal laws.
13. Interpretation
This Agreement shall not be construed more strictly against one party than against the
other merely by virtue of the fact that it may have been prepared by counsel for one of the
parties, it being recognized that both the City and the School District have contributed
substantially and materially to the preparation of this Agreement.
14. Construction
The headings of the sections and subsections of this Agreement are for convenience and
reference only and do not form a part hereof, and in no way interpret or construe such
sections and subsections. Wherever the context requires or permits, the singular shall
include the plural, the plural shall include the singular and the masculine, feminine and
neuter shall be freely interchangeable.
15. Parties in Interest
This Agreement shall be binding upon and inure to the benefit of the parties' respective
heirs, representatives, successors, and assigns. This Agreement is for the sole benefit of
City and the School District and no third party is intended to be a beneficiary of or have
the right to enforce this Agreement.
16. Attorneys' Fees
In the event of litigation between the parties in connection with this Agreement, the
prevailing party (i.e. the party whose position is substantially upheld by the court) shall
be entitled to recover its reasonable attorneys' fees and costs from the non - prevailing
party. The obligation in the immediately preceding sentence shall survive the expiration
or earlier termination of this Agreement.
17. Definitions
If any date herein set forth for the performance of any obligations by the parties or for the
delivery of any instrument or notice as herein provided should be on a Saturday, Sunday
or legal holiday, the compliance with such obligations or delivery shall be deemed
acceptable on the next business day following such Saturday, Sunday or legal holiday.
As used in this Section, the term "legal holiday" means any state or federal holiday for
which financial institutions or post offices are generally closed in the State of Minnesota.
The term "including" shall mean including, as an example, without limiting the generality
of the foregoing.

18. Counterparts
This Agreement may be executed in any number of counterparts, each of which shall be
deemed to be an original, but all of which together shall constitute one and the same
document. A signature page to any counterpart may be detached from such counterpart
without impairing the legal effect of the signatures thereon and thereafter attached to
another counterpart identical thereto except having attached to it additional signature
pages.
19. Governing Law
This Agreement shall be construed as to both validity and performance and enforced in
accordance with and governed by the laws of the State of Minnesota.
20. Headings
The headings contained herein are for convenience of reference only and do not affect,
define, describe or limit the scope or intent of this Agreement or any of its provisions.

Memorandum of Understanding
SCHOOL DISTRICT 197 and Mendota Heights Police Department
RE: School Resource Officer (SRO) is a Police Officer provided under contract to
School District 197.
Reports to Administrative Sergeant and Chief of Police and works directly with
school staff.
Job Duties
The SRO will work towards carrying out the mission of the Mendota Heights
Police Department within the school community. The SRO will act in their
capacity as a Police Officer to provide a safe learning environment, to prevent
crime, and to investigate and solve crimes.
Additionally the SRO will:
- Follow all policies and procedures of the Mendota Heights Police
Department (MHPD).
- Follow the MHPD chain of command.
- Work closely with the school administration and staff.
- Work with building facilities personnel on issues related to building
security.
- Refer school disciplinary actions to school administration.
- Work closely with school staff to identify pre - delinquent youth (at risk) and
will assist in targeting the appropriate resources necessary to prevent
delinquent acts.
- Work closely with school administration in planning emergency

The engineering department would like to purchase a new pickup truck to replace a 1999 pickup.
BUDGET IMPACT
In the 2013 Engineering Budget, there is $29,000 budgeted to purchase a new truck, topper and
light package. Staff has received two quotes for a new 2013 F150 super cab pickup truck. The
one quote was off the state contract in the amount of $24,888.92 and the other quote was from
Inver Grove Ford in the amount of $24,750.00. Both quotes do not include applicable tax and
license fees. The prices do include the trade in value for the old truck. This leaves $4,250 for
the purchase of a topper and light package at a later date.
RECOMMENDATION
Staff recommends that the City Council authorize a purchase order to be made to Inver Grove
Ford for $24,750.00 plus tax and license fees.
If the City Council concurs with the recommendation, they should pass a motion authorizing
staff to execute a purchase order for the purchase of a new 2013 F150 super cab pickup truck in
the amount of $31,000.00 plus tax and license fees.

Valley Park
BACKGROUND
In 2002, the City funded (with the support of a fifty- percent matching grant from the Metro
Greenways Planning Grant Minnesota DNR) development of a Natural Resources Management
Plan for the city. One of three focus areas in the plan was Valley Park where communities of
invasive plants were identified and management recommendations were presented. In addition to
buckthorn, other invasive species identified are: black locust, Siberian elm, garlic mustard,
burdock, sweet clover, thistle, Amur Maple, spotted knapweed, and more.
Great River Greening began invasive species removal in 2009 in Valley Park. Mature plants
have been cut and cleared from infested park areas and follow -up treatment is required to keep
the species under control. Spraying of newly emerging one or two year old plants has proven to
be very effective.
BUDGET IMPACT
City Council has annually included funding in city budgets for `Control of Invasive Plants' in
City Parks. The funding amount in the 2013 City Budget in the Parks Maintenance Budget for
this effort is $20,000.00.
Great River Greening has prepared the attached work/control /task/cost estimate to address the
invasive plants and has prioritized where their efforts should be concentrated. Their proposal
for Valley Park consists of $4000.00 for garlic mustard control and $6000.000 for buckthorn
control. Prairie Restorations was not responsive to the request for a quote on this work.
RECOMMENDATION
If the City Council wishes to control invasive plant species in Valley Park, authorize the City
Administrator to issue a `not -to- exceed' Purchase Order in the amount of $10,000.00 to Great
River Greening to begin immediately on invasive plant removals and control.

Garlic mustard
In 2012, the garlic mustard control was sustained with spring cutting and fall spraying.
Infestation is on a decline, which is typical for this stage of control of an advanced
infestation. Spread to the north is relatively contained; spread to the south along
between the trail and the creek is fully contained. An established population of modest
size was discovered in the southeast corner in winter 2012, controlled and smothered
with chip to limit spread.
For 2013, we propose to continue with spring cutting and fall spraying of garlic mustard
for control (containment and reduction) in main central infestation. $4,000
Buckthorn Control
In 2012, buckthorn was removed from most of the perimeter of the Central Oak Knob.
This included cutting, stacking and stump treating by our crew as well as two corporate
volunteer events of 15 volunteers each. With matching funds*, >1,000 Penn Sedge plugs
were plugged into the hillside, and aggressive woodland seed spread, with volunteers.
With the drought in the wetland, most buckthorn piles hauled off. In 2013 we propose
to burn the remaining piles with a volunteer event on Sat Feb 23 (we will pull all
necessary permits), and then continue with buckthorn removal in the SW portion of the
Central Oak Knob, which will open up the view of the Central Oak Knob from the
recreation trail. We will spread aggressive native seed to begin the re- vegetation
process.
Buckthorn sprouts will also be controlled via foliar spraying in the previous treatment
areas.

BACKGROUND
City Council authorized the purchase of a replacement portable generator at their October 30,
2012 meeting. The new Kohler generator purchased from Total Energy has been delivered to
the city. Several modifications need to be done to the generator prior to the unit being placed
into service. These modifications were predicted and were to be performed once the city took
possession of the unit.
The necessary modifications include:
• Disconnect and reuse existing cord set from old portable generator (purchase new
connectors)
• Fabricate and install cord storage box
• Perform a test run at each lift station
• Provide two general use receptacles
• Provide three exterior LED lights
Total Construction & Equipment, Inc. has supplied a quote of $8080.00 to complete the work
and ready the generator for active service.
BUDGET IMPACT
The Sanitary Sewer Utility Fund had $55,000.00 budgeted for the replacement trailer mounted
generator. The generator unit cost was $33,500.00 leaving a balance of $21,500.00. The
proposed modifications are quoted at $8080.00. Staff is also researching the value of the
existing generator which will be placed in the state surplus auction.
RECOMMENDATION
Staff recommends authorizing a purchase order for Total Construction & Equipment, Inc. for
$8,080.00.

SUBJECT: Dakota County North Urban Regional Trail (NURT) Realignment and
Greenways Study
BACKGROUND
For the past several years, Dakota County has been developing a greenway network through the
County. They have received grant money through the Metropolitan Council for planning and
execution of the network. The history of the greenways program will be provided through the
presentation made by Mr. Chris Hartzell, the County's project manager for the NURT
realignment portion of the greenways plan. A copy of a condensed version of Mr. Hartzell's
presentation is attached.
The NURT is a County facility that, when complete, will connect the Big Rivers Regional Trail
(BRRT) with the Mississippi River Regional Trail (MRRT) by running through Mendota
Heights, West Saint Paul, and South Saint Paul. The NURT is nearly complete and one of the
remain connections to be made is from Warrior Drive and Mendota Road in Mendota Heights to
Garlough Environmental Magnet School in West Saint Paul.
There are number of realignment alternatives being analyzed as part of this connection, three
north -south alignments, and two east -west alignments. Both east -west alignments are in West
Saint Paul, and two of the three north -south alignments are in Mendota Heights. The three north -
south alignments consist of:
Option 1 — School District 197 property at Henry Sibley High School (parallel to Warrior
Drive and Marie Avenue)
Option 2 — The existing trail along Delaware Avenue
Option 3 — Dodge Nature Center Property in West Saint Paul between Delaware Avenue
and Charlton Street south of Marie Avenue
Mr. Hartzell from Dakota County will be able to present these alternatives in greater detail
during his presentation. The County is in the information gathering stage of the selection
process, so a formal action is not required at this time. The County would like input from the
Council and your thoughts on the proposed alignment alternatives. The attached presentation
slides provide some background on the project. The presentation Mr. Hartzell will be making at
tonight's Commission meeting will provide more detail on the alignment alternatives.

Also attached to this staff memo is the decision matrix being used to evaluate the different design
alternatives. This matrix is still in draft form, but it provides an indication as to how the different
alternatives are being evaluated. Cost estimated listed in the matrix are extremely preliminary
and are only presented as approximations of construction cost.
At a recent meeting of the Project Management Team (PMT), a group of technical staff of
stakeholder groups including Dakota County, West Saint Paul, and Mendota Heights, it was
agreed to report to the County Board of Commissioners that Option 3 (the Dodge Nature Center
alignment) is the best fit for the greenways project from a purely technical standpoint. However,
Option 1 (the Henry Sibley alignment) is a plausible alternative that has the potential to meet
most of the criteria of the greenways grant.

None
RECOMMENDATION
There is no official action necessary at this time. Staff recommends Council listen to the report
from Dakota County and offer any comments the Council may have.

BACKGROUND
The Mendota Heights Par 3 Golf Course has been maintained by a private contractor for the past
four years. At the close of the 2012 golf season, city staff felt it was appropriate to consider all
options for golf course maintenance, including contracting, partnering with other local courses,
or directly supervising maintenance staff.
Staff has been in contact with local golf courses about partnering to provide maintenance
services. As a result, the City of Inver Grove Heights (Inverwood Golf Course) has submitted a
proposal to maintain the golf course, irrigation system and equipment for the 2013 golf season.
Attached you will find a copy of this proposal, which has been vetted by staff for both cities.
The contract reflects a comprehensive maintenance plan, within our current budget.
The turf conditions at the Par 3 Golf Course have improved each year under city ownership. The
attached proposal brings a wealth of knowledge and resources to the Par 3, and will maintain the
level of play our customers have come to expect. Inverwood intends to utilize and maintain our
existing equipment, but may also bring their equipment to the Par 3 as needed.
BUDGET IMPACT
The proposed contract is all inclusive and totals $48,600. This includes all course and equipment
maintenance, chemical applications, and a management fee. Any repairs to city -owned
equipment over $500 would need prior approval by the City of Mendota Heights. Staff finds the
proposed contract to be reasonable in terms of scope of work and value and is consistent with
expenses incurred over the past several years.
RECOMMENDATION
If city council wishes to implement this recommendation, pass a motion authorizing staff to enter
into a maintenance contract for the Par 3 Golf Course. This action requires a simple majority
vote.

Scheduling
Specific work days will be determined by the Contractor and remain the same throughout the operational
season. Application scheduling will occur a minimum of seven (7) days in advance with communication
between the Contractor and Mendota Heights staff. Changes to the maintenance schedule based on
weather interruptions are situational by nature and will need to be communicated on that basis.

2. Inver Wood Golf Course will select and provide two (2) laborers to execute the weekly
maintenance duties for the 31-week period, three (3) days per week for a total of 93 days.
Laborers will have a minimum of two (2) full seasons of maintenance experience for all defined
tasks.
3. is included for all turf applications, topdressing procedures, and irrigation
system operation. Superintendants hold all current pesticide and fertilizer
application licenses.
4. Additional laborer staff for special projects such as annual aerification, irrigation system
shutdown, and tree removal will be provided as required with on-site supervision. Costs for these
procedures are included within this proposal.
Proposed Contract Terms:
1. Reporting: Contractor shall provide a report to the City of Mendota Heights contact on a monthly
basis on course conditions, previous and upcoming maintenance activities.
2. Insurance Property: City of Mendota Heights to provide Certificate of Insurance in order to
indemnify the Contractor in the event of natural disaster and/or business interruption.
3. Insurance Liability: Contractor will provide Certificate of Insurance in order to indemnify the City
of Mendota Heights from general liability claims.
4. Insurance Personnel: All personnel wages, taxes, and benefits to be provided by City of Inver
Grove Heights/Inver Wood Golf Course. In addition, the Contractor will provide Certificate of
Insurance in order to indemnify the City of Mendota Heights from claims.
5. Equipment: Inver Wood supervisory staff may elect to remove existing golf course maintenance
equipment owned by the City of Mendota Heights to the Inver Wood Golf Course maintenance
facility for purposes of repair. In addition, Inver Wood supervisory staff may elect to provide
additional maintenance equipment for routine or specialized uses. Transport of equipment to be
insured by the Contractor.
6. City of Mendota Heights Maintenance Equipment - Emergency Repair: The City of Mendota
Heights acknowledges that unforeseen equipment repairs may occur, and reserves the right to
provide timely approval of any large equipment repair in excess of $500.00.

7. Irrigation System - Emergency Repair: The City of Mendota Heights acknowledges that
unforeseen irrigation system repairs may occur, and reserves the right to provide timely approval
of any large irrigation system repair in excess of $500.00.
8. Fuel to be provided and delivered by the City of Mendota Heights, Public Works Department.
9. Term: Golf course maintenance - April 1, 2013, or as soon as weather permits, and ending
November 3, 2013. Winter season equipment maintenance December 1, 2013 through
December 31, 2013.
10. Management Fee: All-inclusive flat fee - $48,600.00. All supervision, labor, and general
expenses included. Invoicing to take place in nine (9) equal monthly payments of $5,400.00 for
the period April through December, payable by the end of each month (invoice terms: net 30
days).
11. Termination: Either party may terminate this contract upon 30 days written notice.
12. Renewal: Upon mutual agreement of both parties after conclusion of the golf season.

SUBJECT: Approval of Plans and Specifications and Authorization to Advertise for Bids
for Hunter and Orchard Neighborhood Improvements
BACKGROUND
Staff identified the Hunter Lane Neighborhood Improvements as a 2013 street reconstruction
project in the 2012 -2016 Street Improvement Plan (SIP). The Glenhill Road Neighborhood
Rehabilitation was identified as a 2013 street rehabilitation project in the 2012 -2016 SIP. Due to
the close proximity of these projects to each other, staff proposes to combine these two
neighborhood improvements into one project to reduce redundancies, staff time, and would
produce lower unit prices during construction due to the project size. The combined project will
be called the Hunter and Orchard Neighborhood Improvements.
Council ordered the Hunter and Orchard Neighborhood Improvements at their October 16, 2012
meeting, and directed staff to prepare plans and specifications for this street reconstruction
proj ect.
This project includes reconstructing the rural sections of Culligan Lane, Hunter Lane and
Orchard Place. This project also includes rehabilitating the urban sections of Culligan Lane,
Glenhill Road, Orchard Circle, and Veronica Lane. The proposed project also includes
rehabilitating the Veronica Lane sanitary sewer lift station.
Plans and specifications are available in the Engineering Department.
Street Reconstruction — Hunter Lane, Orchard Place, and Culligan Lane (East)
The project includes reconstructing the rural sections of Culligan Lane, Hunter Lane and Orchard
Place. The horizontal alignment of these streets will remain approximately the same. The
proposed street width on Hunter Lane and Orchard Place is 29 feet wide from face of curb to
face of curb with surmountable curb were permissible and B618 barrier curb where necessary, as
directed by the city council. Culligan Lane shall match the existing urban section with a
proposed street width of 30 feet wide from face of curb to face of curb with B618 barrier curb, as
directed by the city council.

Storm sewer improvements will consist of adding catch basins and storm sewer pipe and
connecting to the existing storm sewer system. St. Paul Regional Water Services (SPRWS) has
recommended replacing the existing water main and hydrants on Hunter Lane, Orchard Place
and Culligan Lane.
Street Rehabilitation — Culligan Lane (West), Glenhill Road, and Veronica Lane
Proposed improvements for the existing urban street section of Culligan Lane, Glenhill Road,
and Veronica Lane will include the reclamation of the existing bituminous roadway and the
placing of a 2.5" bituminous base course and a 1.5" bituminous wear course over the reclaimed
pavement material, curb and gutter repair, and catch basin repair. Disturbed boulevard areas will
be restored with topsoil and sod. Driveways that are disturbed due to the street rehabilitation
will be replaced in kind.
Street Rehabilitation — Orchard Circle
Proposed improvements for the existing urban street section of Orchard Circle will include
milling of a 6 -foot wide strip adjacent to the existing curb and gutter and placing a 1.5"
bituminous overlay extending over the entire width of the roadway, curb and gutter repair, and
catch basin repair. Driveways that are disturbed due to the street rehabilitation will be replaced
in kind.
Sanitary Sewer
Proposed improvements for the Veronica Lane Sanitary Sewer Lift Station will include leaving
the existing structure in -place while replacing the existing top slab and access hatch and
replacing the pumps, controls, piping, and electrical components to ensure continued reliability
and code compliance.
Project Schedule
The Engineering staff has substantially completed the plans and specifications for this project.
The next step is to advertise for bids. A proposed schedule for the remainder of this project is
shown below:

BUDGET IMPACT
The total estimated construction cost from the feasibility report for the Hunter and Orchard
Neighborhood Improvements is $1,919,356.75, not including indirect costs for legal,
engineering, administration, and finance. The Hunter and Orchard Neighborhood Improvements
are proposed to be financed by special assessments, municipal bonds, and utility funds.

WHEREAS, the City Engineer reported that the proposed improvements and
construction thereof were feasible, desirable, necessary, and cost effective, and further reported
on the proposed costs of said improvements and construction thereof; and
WHEREAS, the City Council has heretofore directed the City Engineer to proceed with
the preparation of plans and specifications thereof; and
WHEREAS, the City Engineer has prepared plans and specifications for said
improvements and have presented such plans and specifications to the City Council for approval.
NOW THEREFORE BE IT RESOLVED; by the Mendota Heights City Council as
follows:
1. That the plans and specifications for said improvements be and they are hereby in all
respects approved by the City.
2. That the Clerk with the aid and assistance of the City Engineer be and is hereby,
authorized and directed to advertise for bids for said improvements all in accordance with
the applicable Minnesota Statutes, such as bids to be received at the City Hall of the City
of Mendota Heights by 10:00 A.M., Wednesday, May 1, 2013, and at which time they

At the February 19city council meeting, a Request for Proposals (RFP) for city attorney
services was approved. It was suggested at that time that a committee of two city
councilmembers be named to review the proposals so that a more manageable number of firms
could be interviewed for final consideration.

The deadline for submittals is Thursday, March 21. Interviews are tentatively planned for the

week of April 8, although no dates or times have been established yet. In order to keep on
schedule, the review committee would need to meet and make recommendations on finalists by
the end of March.
It is anticipated that we will receive five to ten proposals. The number of firms selected to
interview is up to the city council. The proposed schedule, as outlined in the RFP, is:
