Res 2013- 16 Deny CUP for 1815 Valley Curve RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2013 - 16 A RESOLUTION DENYING A CONDITIONAL USE PERMIT FOR AN ACCESSORY STRUCTURE GREATER THAN 144 SQUARE FEET 1815 VALLEY CURVE ROAD WHEREAS, Vince Nonnemacher has applied for a conditional use permit for an accessory structure greater than 144 square feet to be used as a pigeon loft at 1815 Valley Curve Road (PID 27- 64000 -02 -010, Lot 1 Block 2 Ridgewood Park) as proposed in planning case 2012 -34; and WHEREAS, the Planning Commission held a public hearing on this matter at their regular meeting February 26, 2013. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a conditional use permit as outlined in planning case 2012 -34 is hereby denied with the following findings of fact: 1. The accessory building is proposed to house a use that is not permitted in the zoning district 2. The proposed accessory building will be inconsistent with the character of the surrounding neighborhood 3. The use and maintenance of the proposed accessory building will conflict with other neighborhood principal and accessory activities 4. The proposed accessory building, with the applied conditions will constitute a use of residential property that is not commonly found in residential areas of the community 5. The proposed use does not fit within the city zoning ordinance definition of domestic animals Adopted by the City Council of the City of Mendota Heights this fifth day of March, 2013.
