RESOLUTION 10 -06
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR THE LOCATION OF
WIRELESS ANTENNA AND EQUIPMENT AT 894 SIBLEY MEMORIAL HIGHWAY
WHEREAS, Lawrence Coleman on behalf of Clear Wireless, LLC has applied for a conditional
use permit for the location of wireless antenna and equipment at 894 Sibley Memorial Highway [Lot 1
Block 1, Riverwood Place 2nd Addition; PID 27- 64251- 010 -01] as proposed in Planning Case #09 -40;
and
WHEREAS, The Planning Commission held a public hearing on this application at their regular
meeting on Decmeber 22, 2009; and
WHEREAS, The Planning Commission recommended that the Council approve the conditional
use permit for the location of wireless antenna and equipment as presented to the Planning Commission
on the evening of December 22, 2009 and as shown in Planning Case #09 -40;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights that a conditional use penult for the location of wireless antenna and equipment as
proposed in Planning Case #09 -40 is hereby approved with the following conditions:
1. A building permit must be approved prior to construction.
2. The applicant shall provide an abandonment bond to the City as required by Section 12 -1J-
6.H.l.b of the Zoning Ordinance
3. The proposed antenna shall comply with all FCC regulations. The applicant must submit
proof of any applicable federal, state, or local licenses to the council prior to receiving a
building permit.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that a
conditional use permit for the location of wireless antenna and equipment as proposed in Planning Case
#09 -40 is hereby approved with the following findings of fact:
1. The City encourages new wireless service antennas to be located on existing towers or
support structures
