RESOLUTION 10 -23
A RESOLUTION AUTHORIZING THE TRANSFER OF CERTAIN PROPERTY
TO MENDOTA MALL ASSOCIATES, LLP
WHEREAS, Planning Commission in the City of Mendota Heights, Minnesota
( "City ") held a public hearing on July 22, 2008 to consider various approvals requsted
by Mendota Mall Associates, LLP, a Minnesota limited liability partnership ( "Mendota
Mall Associates ") for property located at 750 Highway 110 in the City ( "Project "); and
WHEREAS, the City Council voted on January 20, 2009, pursuant to City
Council Resolutions 09 -10 and 09 -11 to approve, among other things, a Preliminary
Planned Unit Development and Preliminary Plat for the Project; and
WHEREAS, the City Council voted on April 19, 2009, pursuant to City Council
Resolution 09 -29 to approve, among other things, a Final Planned Unit Development,
Final Plat and a Development Agreement by and between Mendota Mall Associates and
the City (collectively, the City Approvals); and
WHEREAS, pursuant to the City Approvals, the City agreed to transfer certain
property to Mendota Mall Associates which property is legally described on Outlot A,
Mendota Heights Senior Housing Addition ("Property"); and
WHEREAS, the City Approvals required the City to execute a quit claim deed to
effectuate the transfer of the Property.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights hereby ratifies the execution of the Quit Claim Deed by the
Mayor and Deputy City Clerk on March 19, 2010 and hereby authorizes the Mayor and
City Clerk or Deputy City Clerk to execute any and all additional documents which may
be necessary to finalize the transfer of the Property.
