RESOLUTION NO. 10 -27
RESOLUTION APPROVING A STREET RIGHT -OF -WAY VACATION
WHEREAS, the City of Mendota Heights is the current record owner of the platted street
Walsh Lane, WAGENKNECHT'S ADDITION, Dakota County, Minnesota; described as follows:
That portion of Lot 15 lying easterly of 'the following described line: Beginning at a point on the most
easterly line of said Lot 15 at the easterly extension of a line which is 47 feet south and parallel with
the most northerly line of said Lot 15; then northwesterly 56 feet; more or less, to the curve point 128.4
feet easterly from NW corner of said Lot 15 and there terminating. All in Wagenknechts Addition,
Dakota County, Minnesota; and
WHEREAS, a notice of hearing on said vacation has been duly published and posted more
than two weeks before the date scheduled for the hearing on said vacation, all in accordance with the
applicable statutes; and
WHEREAS, a public hearing was held on said vacation on April 20, 2010 at the City Hall of
Mendota Heights; and
WHEREAS, the City Council then proceeded to hear all persons interested in said vacation and
all persons were afforded an opportunity to present their views and objections to the granting of said
petition.
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That the vacation of the street right -of -way described above situated in the City of Mendota
Heights, is in the best interest of the public and the City, and it is not detrimental to the
health, safety and welfare of the community.
2. That the above described street right -of -way be and the same is hereby vacated reserving
from said vacation a utility easement over, under and across the full extent of the herein
described street, for drainage and utility purposes.
3. That the City Clerk be and is hereby authorized and directed to prepare and present to the
proper Dakota County officials notice of completion of these vacation proceedings, all in
accordance with the applicable Minnesota Statutes.
