RESOLUTION 10 -29
A RESOLUTION APPROVING A CRITICAL AREA PERMIT FOR A SINGLE
FAMILY HOME AT 744 WOODRIDGE DRIVE
WHEREAS, Aaron and Sarah Macke has applied for a critical area permit for the
construction of a single family home at 744 Woodridge Drive [Lot 2, Block 1, Ivy Ridge
Addition; PID 27- 37780 - 020 -01] as proposed in Planning Case #10 -07; and
WHEREAS, the Planning Commission held a public hearing on this application at their
regular meeting on April 27, 2010; and
WHEREAS, the Planning Commission recommended that the Council approve the
critical area permit for the construction of a single family home as presented to the Planning
Commission on the evening of April 27, 2010 and as shown in Planning Case #10 -07.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Mendota
Heights that a critical area permit for construction of a single family home as proposed in
planning Case #10 -07 is hereby approved with the following conditions:
a. Areas of 12% slope or greater shall be indicated on an updated site plan. If
development is being proposed on slopes between 12 and 40 %, the applicant shall be
required to meet the conditions of Section 12- 3 -6.F.1
b. Adequate development practices will be maintained to ensure that gross soil losses
shall not exceed the given requirements in 12- 3- 6.F.2. This shall be reviewed and
approved by the City Engineer
c. In no case shall development increase the rate of runoff
d. The drainage and storm water retention plans shall be subject to the approval of the
City Engineer
e. No finished grades shall exceed a slope of 40%
f. Any and all erosion control storm water runoff, utility access, and similar structures
shall be designed to be maintained, cleaned out, and otherwise operated without
requiring the crossing of undeveloped lands in excess of 8% slopes with motorized
heavy maintenance vehicles and equipment, such as bulldozers, trucks, and backhoes.
g. The quality of water runoff and water infiltrated to the water table or aquifer shall be
as high after development as it was before development of the site
h. All development, drainage, and grading plans shall be reviewed and approved by the
City Engineer
i. Applicants shall obtain a building permit prior to commencing construction
BE IT FURTHER RESOLVED, by the City Council of the City of Mendota Heights
that a critical area permit for construction of a single family home as proposed in planning Case
#1.0 -07 is hereby approved with the following findings of fact:
1. Appropriate steps are being taken to minimize the visual impact on the Critical Area and
surrounding property
2. Grading and erosion control measures are being put in place, including:
• The installation of silt fencing and bio rolls;
• Curing gutters and installing drain tiles underground;
• Any required dirt storage shall be stored at the furthest location from the bluff line
3. The construction will not jeopardize the aesthetic integrity and natural enviromnent of the
Mississippi River Critical Area
4. The approval standards for the Critical Area Overlay District, as outlined in Section 12-3 -
9A
5. The Planning Commission finds that the subject property fronts on Woodridge Drive for
the purposes of the Zoning Ordinance, based on the following conditions:
a. The lot access and driveway are provided to Woodridge Drive
b. The definition of Lot Frontage in the Zoning Ordinance is not restricted by width,
and as such, the lot may be considered to qualify as a "Through Lot" with frontage
on both Woodridge and Sibley Highway
c. The discussions with the City at the time of the plat approval which created the
subject parcel suggested that the "front lot line" would be the north property line
for the purpose of applying building setbacks
d. Utilizing Sibley Highway as the front is impractical due to the heavily sloped and
wooded bluff, and the restrictions of the Critical Area
e. Utilizing Woodridge as the front permits the building site to be moved farther
from the bluff line, consistent with the intent and purposes of the Critical Area
Ordinance
