Res 2010- 31 Wetlands Permit 790 Ridge PlaceCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 10-31 A RESOLUTION APPROVING A WETLANDS PERMIT FOR NATIVE PLANTINGS, TWO PLANK BRIDGES AND INVISIBLE FENCING AT 790 RIDGE PLACE WHEREAS, Maureen Haggerty has applied for a wetlands permit for native plantings, two plank bridges over, and two wires for invisible fencing within the creek at 790 Ridge Place [Somerset hills L -25 ex beg NW cor E on N line 130 ft SW to pt on N line of S 100 ft which pt is 110 ft E of W line of S 100 ft to W line L -25 W on N line to beg; PID 27- 71050- 251 -00] as proposed in Planning Case #10 -10; and WHEREAS, the Planning Commission held a public hearing on this application at their regular meeting on April 27, 2010; and WHEREAS, the Planning Commission recommended that the Council approve the wetlands permit for native plantings, two plank bridges over, and two wires for invisible fencing within the creek as presented to the Planning Commission on the evening of April 27, 2010 and as shown in Planning Case #10 -10. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Mendota Heights that a wetlands permit for native plantings, two plank bridges over, and two wires for invisible fencing within the creekas proposed in planning Case #10 -10 is hereby approved with the following conditions: 1. The invisible fence wire shall be buried an not laid on top of the ground throughout the yard 2. The invisible fence wire shall be placed entirely on the applicant's property and shall not be located in the undeveloped right -of -way 3. the Land Disturbance Guidance Document shall be adhered to 4. Specifics on the native plantings shall be provided to the City by the applicant 5. Exposed or eroded soil on the property shall be re- vegetated with appropriate wetland buffer plantings and grasses 6. All issues related to grading, drainage and erosion control of the site shall be subject to the review and approval of the City engineer, and 7. Previous CUP approval conditions continue to apply to existing or proposed traditional fencing on property. BE IT FURTHER RESOLVED, by the City Council of the City of Mendota Heights that a wetlands permit for native plantings, two plank bridges over, and two wires for invisible fencing within the creekas proposed in planning Case #10 -10 is hereby approved with the following findings of fact: 1. The project involves insignificant dirt- moving and no addition of impervious surface 2. The potential for erosion will be minimal 3. The addition of natural vegetation will help in treatment of stormwater runoff before it reaches the stream area 4. The proposal will not result in any negative impacts to the wetland 5. The proposal does not appear to interfere with wetland water quality 6. The proposal will not adversely impact the surrounding environment 7. The proposed project meets the intent and is consistent with the Wetlands Ordinance Adopted by the City Council of the City of Mendota Heights this 4th day of May 2010.
