Res 2010- 39 CAP 1646 Mayfield Heights RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 10- 39 A RESOLUTION APPROVING A CRITICAL AREA PERMIT FOR AN ACCESSORY STRUCTURE AT 1646 MAYFIELD HEIGHTS ROAD WHEREAS, Mark Johnson has applied for a critical area permit for an accessory structure at 1646 Mayfield Heights Road [L 1 B 1 Mayfield Heights; PID 27- 47500- 021 -00] as proposed in planning case #10 -15; and WHEREAS, the planning commission held a public hearing on this application at their regular meeting on May 25, 2010; and WHEREAS, the planning commission recommended that the council approve the critical area permit for an accessory structure as presented to the planning commission on the evening of May 25, 2010 and as shown in planning case #10 -15. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a critical area permit for an accessory structure as proposed in planning case #10 -15 is hereby approved with the following conditions: 1. Review and approval by the City Engineer. 2. All construction activities must follow the City's Land Disturbance Guidance Document. BE IT FURTHER RESOLVED, by the Mendota Heights City Council that a critical area permit for an accessory structure as proposed in planning case #10 -15 is hereby approved with the following findings of fact: 1. The accessory building will have little or no visual impact on the Critical Area or surrounding property. 2. The project will not create issues for grading or erosion. 3. The accessory building will have minimal impact on the land as the project does not involve grade changes, significant soil loss, or altering of steep slopes. 4. The construction will not jeopardize the aesthetic integrity and natural environment of the Mississippi Critical Area.
