Res 2010- 41 Variance for 1857 Dodd RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 10-41 A RESOLUTION APPROVING A FIVE FOOT VARIANCE TO THE SIDE YARD SETBACK ABUTTING A STREET FOR THE REBUILDING OF A DETACHED GARAGE AT 1857 DODD ROAD WHEREAS, Dorothy Haffely has applied for a five foot variance to the side yard setback abutting a street for the rebuilding of a detached garage at 1857 Dodd Road [Lot 38, Somerset Hills; PID 27- 71050- 380 -00= as proposed in Planning Case #10 -16; and WHEREAS, the planning commission held a public hearing on this application at their regular meeting on May 25, 2010; and WHEREAS, the planning commission recommended that the council approve the five foot variance to the side yard setback abutting a street for the rebuilding of a detached garage as presented to the planning commission on the evening of May 25, 2010 and as shown in planning case #10 -16. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a five foot variance to the side yard setback abutting a street for the rebuilding of a detached garage as proposed in planning case #10 -16 is hereby approved with the following conditions: 1. The detached garage shall match the home in color and materials. BE IT FURTHER RESOLVED, by the Mendota Heights City Council that a five foot variance to the sideyard setback abutting a street for the rebuilding of a detached garage as proposed in planning case #10 -16 is hereby approved with the following findings of fact: 1. The totality of circurnstances including but not limited to the location of the existing deck, landscaping, age of the property and driveway create a unique condition on the property and represent a hardship to putting the property to reasonable use without variance to the 30' setback.
