Res 2010- 47 CUP 2020 Dodd RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 10 -47 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR THE REALIGNMENT OF THE DRIVE- THROUGH AT 2020 DODD ROAD WHEREAS, Paster Enterprises, on behalf of McDonald's Corporation has applied for a conditional use permit for the realignment of the drive through at 2020 Dodd Road [Lot 1, Block 1 Mendota Plaza; PID 27- 48400 - 010 -01] as proposed in planning case #10 -22; and WHEREAS, the planning commission held a public hearing on this application at their regular meeting on June 22, 2010; and WHEREAS, the planning commission recommended that the council approve the conditional use permit for the realignment of the drive - through as presented to the planning commission on the evening of June 22, 2010 and as shown in planning case #10 -22. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a conditional use permit for the realignment of the drive - through as proposed in planning case #10 -22 is hereby approved with the following condition: 1. The vacant area in the northwest corner of the parking lot shall be striped in order to provide additional parking stalls and make up for the eliminated parking stalls. BE IT FURTHER RESOLVED, by the Mendota Heights City Council that a conditional use permit for the realignment of the drive - through as proposed in planning case #10 -22 is hereby approved with the following findings of fact: 1. The updated drive - through should not affect the health, safety, and welfare of the occupants of the surrounding lands. 2. The revised drive - through alignment will improve traffic flow in the adjacent shopping center parking lot by consolidating access. 3. The proposed drive through layout is a compatible use within the designated land use district of the Comprehensive Plan. 4. The updated drive - through would not appear to have any impact on surrounding property value. 5. The proposal meets all other Zoning Ordinance requirements.
