Res 2010- 54 Liquor License for Fischerville GrillCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 10 -54 A RESOLUTION GRANTING A TIER -TWO ON -SALE AND SUNDAY ON -SALE LIQUOR LICENSE TO COMPLETE BEVERAGE SERVICE FOR USE AT THE FISCHERVILLE GRILL WHEREAS, the Mendota Heights City Council held public hearings on July 6, 2010 and July 20, 2010 to hear comments on a tier -two on -sale and Sunday on -sale liquor license application from Complete Beverage Service D.B.A. the Fischerville Grill for property located at 2156 Dodd Road (the "Property ") WHEREAS, the City Council heard comments from residents both in support of and in opposition to the liquor license being granted at this location; WHEREAS, the City Council expressed a munber of concerns related to the preliminary site plan that was presented as well as the ability of the applicant to meet all appropriate city code and ordinance requirements at this location including, but not limited to, parking requirements, automobile circulation, lighting, odor control, safety, landscaping, elevation in relation to earth fill, engineering /drainage issues, land contamination issues and hours of operation; and WHEREAS, the City of Mendota Heights limits the number of liquor licenses it issues within the city. NOW THEREFORE BE IT RESOLVED, that the City of Mendota Heights does hereby grant the tier -two on -sale and Sunday on -sale liquor licenses to Complete Beverage Service D.B.A. the Fischerville Grill for property located at 2156 Dodd Road. BE IT FURTHER RESOLVED, that this approval is expressly conditioned upon the following: 1. The applicant must successfully obtain a real property interest in the Property through purchase or lease no later than December 31, 2010; and 2. The applicant must provide evidence that its operation at this location will meet all applicable zoning ordinance and city code requirements including, but not limited to, requirements related to parking, circulation, lighting, odor control, safety, landscaping, elevation in relation to earth fill, engineering /drainage issues, land contamination and hours of operation. 3. The applicant must obtain a certificate of occupancy no later than December 31, 2010. Adopted by the City Council of the City of Mendota Heights this third day of August 2010.
