Res 2010- 55 CUP 574 Hiwatha AveCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 10 -55 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO CONSTRUCT A DETACHED GARAGE AT 574 HIWATHA AVENUE WHEREAS, Troy and Alyssa Troje have applied for a conditional use permit to construct a detached garage at 574 Hiwatha Ave [Lots 1 and 2, Block 2, Cherokee Park Heights according to the replat thereof; PID 271710002002] as proposed in planning case #10 -12; and WHEREAS, the planning commission held a public hearing on this application at their regular meeting on July 27, 2010; and WHEREAS, the .planning commission recommended that the council approve the conditional use permit to construct a detached garage as presented to the planning commission on the evening of July 27, 2010 and as shown in planning case #10 -12. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a conditional use permit to construct a detached garage as proposed in planning case #10 -12 is hereby approved with the following condition: 1. Verification that the garage meet applicable 10 foot side and rear yard setback requirements. BE IT FURTHER RESOLVED, by the Mendota Heights City Council that a conditional use permit to construct a detached garage as proposed in planning case #10 -12 is hereby approved with the following finding of fact: . The proposed structure is consistent with the intent of the conditional use permit clause allowing detached garages.
