A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A RESTAURANT AND CAFE
AT 1315 MENDOTA HEIGHTS ROAD
WHEREAS, Jeffrey Brim on behalf of Northmarq has applied for a conditional use permit for a
restaurant and cafe at Le Cordon Bleu, 1315 Mendota Heights Road [That part of Lot 7, Block 1, Mendota
Heights Industrial Parlc, lying South of the Easterly extension of the South line of Lot 5, Block 1, Mendota
Heights Industrial Park, through said Lot 7 to the East Line of said Lot 7. (PID #27- 48300- 071 -01) and Lot 6,
Block 1, Mendota Heights Industrial Park, Dakota County, Minnesota; PID27- 48300 - 060 -01] as proposed in
planning case #10 -33; and
WHEREAS, the planning commission held a public hearing on this application at their regular meeting
on November 23, 2010; and
WHEREAS, the planning commission recommended that the council approve the conditional use permit
for a restaurant and cafe as presented to the planning commission on the evening of November 23, 2010 and as
shown in planning case #10 -33.
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a conditional use
permit for a restaurant and cafe as proposed in planning case #10 -33 is hereby approved with the following
conditions:
1. The restaurant and cafe CUP would terminate in the event that the culinary trade school ceases
operations at this site;
2. The hours of operation for the restaurant shall be limited to: Monday through Friday 11:00 a.m. to
10:00 p.m., Saturday and Sunday 6:00 a.m. to 10:00 pan. the proposed house of operation for the cafe
shall be Limited to Monday through Sunday 6:00 a.m. to 10:00 p.m.;
3. The school shall reserve adequate parking spaces for the exclusive use of restaurant and cafe
customers;
4. The applicant shall apply for and receive a building permit prior to any construction work.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that a conditional use permit for
a restaurant and cafe as proposed in planning case #10 -33 is hereby approved with the following finding of fact:
1. The proposed restaurant and cafe training facilities are consistent with the intent of the zoning
ordinance allowing trade schools in the subject zoning district.
2. The use will not create traffic concerns for the area that cannot be addressed through current
roadways.
3. The proposal adds no additional burdens on public safety or public facilities in the area.
4. The proposed use is consistent with current and future land uses in the area.
Adopted by the City Council of the City of Mendota Heights this seventh day of December 2010.
