Ayes: 4 Nays: 0 Absent: 1 (Krebsbach) PULLED CONSENT AGENDA ITEMS D) APPROVAL OF FIRE MARSHAL POSITION RECLASSIFICATION Councilmember Duggan mentioned that he had spoken with staff regarding the Fire Marshal Position Reclassification description, specifically Page 18, Item 3 Essential Duties, which reads "meets with residents and business owners as requested for a variety of reasons ". Councilmember Duggan requested that it state "as requested for various fire safety related reasons ". pg 5 There being no objections by staff, Councilmember Duggan moved Adoption of the Fire Marshal Position Reclassification as amended. Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Krebsbach) H) APPROVAL OF PARK AND RECREATION DEPARTMENT REORGANIZATION Councilmember Duggan commented that this request is asking the Council to consider the creation of a new full -time position by combining two part-time positions, Recreation Programmer and Clubhouse Manager. Councilmember Duggan explained that his concern is the $17,000 increase in costs. A concern raised by a resident was that the Recreation Program Coordinator draft position does not include any accountability and he questioned what the city would be gaining by the increased expenditure. Councilmember Duggan suggested that Council accept the proposal to unite the two positions going forward but then, perhaps at the next Council meeting, a review of the Recreation Program Coordinator draft position description be undertaken so as to include accountabilities. He asked staff to clarify who can apply for this new proposed position, where would it be advertised, and what would be the deadline for applications. Acting Mayor Petschel commented that she has also received e -mails and a phone call in regards to this. It is her belief that many of the problems in the past have been due to the fact that there was not a full - time person directing things at the golf course. Councilmember Duggan expressed his concern over the additional expenditure and that the Par 3 Golf Course seems to be getting precedence over the Recreation Program. Councilmember Duggan explained that in relation to organizational structure and to get the City where it has someone running all of these programs on a full -time basis, which he supports, he believes there should be accountabilities in the description. He requested that staff explain where this opening would be advertised and what the deadlines would be. City Administrator Justin Miller replied that, if approved by Council, the posting of this position would begin on January 9, 2013 and continue for two weeks. The posting would be advertised in the City's normal outlet, the League of Minnesota Cities, and since this is a recreation type position it would be posted through the Minnesota Parks and Recreation Association to try and cast as wide of a net as possible. Depending on how many applications are received staff would review and set up interviews by the end of January or the beginning of February. The goal is to have someone start in mid - February. As for accountabilities, City Administrator Miller commented that these would not necessarily be listed in a job description, assuming that the Council is referring to goals. Goals would be of a side agreement that the City would implement with the new person, especially since goals would typically change from year to year. pg 6 Councilmember Duggan also expressed his concern that staff may be approaching an area — trying to make the golf course profitable — that they are not trained for nor are legally allowed to do. He assumed that the goals and accountabilities could be discussed during the interview process. He suggested, in light of the economy and the numbers of unemployed, that staff consider advertising in the local newspapers and on the City web -site; that a member of the Parks and Recreation Board be a part of the interviewing team; and that a work session be held before the next council meeting to discuss the job description. Staff recommended that the actions requested be approved to prevent any delays in Parks and Recreation programming and possible resulting difficulties. Councilmember Duggan explained that he is not looking at any significant policy changes but more for clarifiers. City Administrator Miller stated that should Council approve the request this evening and authorize staff to begin the posting; staff and Council could meet again next week to go over more details in the job description. Councilmember Duggan wished to make it clear that a part-time position is being eliminated; however, the new full -time position could be applied for by anyone. He also wanted to know if it would be permissible for that part-time employee to speak to the Council. Acting Mayor Petschel expressed her desire that the focus remain on the action items recommended by staff. City Attorney Tami Diehm commented that, like any agenda item, the Council has the ability to recognize members from the public who may be in attendance to address the topic. City Administrator Justin Miller reminded the Council that the topic under discussion is position related and not personal. Staff has been looking at this at an organizational level and has based their decisions on the needs of the organization and not on any specific person in either position. Ms. Barb Kasal, 565 W. Marie, is a thirty -seven year resident of Mendota Heights, as well as a retired employee of the Parks & Recreation department from the City of West St. Paul. She also does part-time work in Mendota Heights by chaperoning trips and volunteering for various city- sponsored activities. She expressed her belief that one person would not be able to handle all of the things that are in the job description. Expecting one person to handle this position will cause something to suffer, whether it would be the golf course or the programs. She also does not believe that the monetary increase is well spent tax dollars. Councilmember Norton asked for clarification that Ms. Kasal believes that the amount of duties that are put forth in the job description are perhaps too much for one full -time position to handle. Ms. Kasal confirmed this. Councilmember Norton commented that two part-time positions that do not account for all of that time would not be able to accomplish all of those duties either. Ms. Kasal replied that there would need to be seasonal staff to fill in, which both positions currently do. Acting Mayor Petschel pointed out that the City is not looking at the Par 3 as a source of income for the City. However, what is needed at the Par 3 is accountability and oversight. However, they also don't want it to become a drain on the city's economy. pg 7 Ms. Teresa Gangelhoff, Recreational Programmer for the City of Mendota Heights, gave a hand -out outlining a suggestion that she has and a highlight of some of the things that she has done in her job for the last eleven years. She understands this has been a tough decision but she echoes what was said by Ms. Kasal. Ms. Jamie Witte, daughter of Ms. Gangelhoff and an employee of Patterson Companies in Mendota Heights, commented that the job posting is focused on golf course management; however, that person would also be riding on a bus with kids. She believes a closer look at the comparison on the seasonal position and what that means for that person in the off season is needed. She also feels that the city should take into consideration the programs that have been built for the children and what would happen if those programs began to suffer. Councilmember Duggan summarized the points he heard made by the residents: • Grant writing, which is not mentioned in the job posting • Awards • Expansion of programs Councilmember Duggan restated his concerns, clarifying that he is in favor of combining the positions but there needs to be oversight over the next year to ensure that what was desired is being accomplished and to ensure the extra expenditure is worthwhile. Councilmember Duggan moved to Approve the Recreation Program Coordinator position and authorize staff to advertise for the position with suggested changes and with the City Council oversight going forward in relation to the unknown accountabilities. Councilmember Povolny seconded the motion. Acting Mayor Petschel commented she agrees with going ahead with the recommendation to eliminate the two part-time positions and create the new full -time position with this job description with the understanding that, within the next week or so, there may need to be some clarification of accountabilities. Councilmember Duggan noted that he only moved to approve the third part of staff's recommendation. Having misunderstood in thinking that the motion was for all three recommendations, Councilmember Povolny recanted his seconding of the motion. Councilmember Povolny moved Approval to Eliminate the Recreation Programmer position and separate the employee currently serving in that position, effective January 22, 2013; Eliminate the part- time clubhouse manager position; Approve the Full Time Recreation Program Coordinator position and authorize staff to advertise for the position with suggested changes and with the City Council oversight going forward in relation to the unknown accountabilities. Councilmember Duggan seconded the motion. Acting Mayor Petschel stated again this position is open to anyone to apply for; fully recognizing the skills of Ms. Gangelhoff and her contributions. Ayes: 4 Nays: 0 Ab sent: 1 (Kreb sb ach) pg 8 PUBLIC COMMENTS There were no public comments UNFINISHED AND NEW BUSINESS B) APPOINTMENTS TO OUTSIDE COMMISSIONS City Administrator Justin Miller explained that periodically the City needs to appoint representatives of elected and non - elected to outside commissions. Two of those are up for appointments at this time: NDC4 (Cable Commission): One councilmember and one citizen representative are required for a two year term (2013 -2014) Current Representation: Councilmember Duggan and Mickey Kieffer Dakota Communications Center: One primary and one alternate (both elected officials) are required for a two year term (2013 -2014) Current Representation: Councilmember Duggan (primary) and Councilmember Povolny (alternate) All of the current appointees have indicated interest in continuing to serve on these respective commissions. Councilmember Povolny moved Approval of Appointments to Outside Commissions as Recommended. Councilmember Norton seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Krebsbach) COUNCIL COMMENTS Councilmember Duggan commented that some received a memo from Dakota County regarding a Mendota/Lebanon Hills Greenway. This includes Mendota Heights between Apache and Aztec and those residents have been concerned with the CDA land that is between them. Councilmember Duggan requested City Engineer John Mazzitello note on a map where that is. He also mentioned that the meeting is next week, which would be posted on the city's web -site and elsewhere. City Engineer John Mazzitello explained that the area referred to is an alternate alignment for the new Dakota County Greenways Initiative, which is to develop a trail network that is an off -road network. Currently preponderance of the trails is adjacent to a traveled roadway. Dakota County is going through an effort, using federal grant money, to develop trails that are not associated with traveled roadways. One of the alignments they are proposing as an alternative is from the end of Apache, up the CDA property, to the corner of Mendota Plaza; which is county- owned, undeveloped property at this time. There are some other alignments shown in the greenway plan, such as the trail through the Mendota Plaza. He recalled that as a part of the PUD agreement, there were some easements recorded with the plat for a future trail that runs along the creek through Mendota Plaza. That too is part of the greenways initiative. pg 9 The upcoming meeting concerns the North Urban Regional Trail from Warrior Drive to the corner of Charlton and Marie in West St. Paul. This trail currently runs along Highway 110, which is adjacent to a very busy high -speed traveled roadway. The county is looking at alignment alternatives both in the north /south and in the east/west, to bring the North Urban Regional Trail off of roadways as much as possible. So the focus of the public meeting is on that specific portion of the greenways initiative. However, it is a county -wide program and the full map can be found on the Dakota County web page under their Parks link [http: / /www.co.dakota.mn.us]. Acting Mayor Petschel asked if the county were to put this portion of the greenway through that area, would it mean, for those residents who have the CDA property behind them, that there would be less likely for something to be built there. City Engineer Mazzitello replied that traditionally when there is a recreational use on a piece of property, such as a trail or a park, once that is established as a recreational use there are federal codes that make it very difficult for that land to be developed in the future. That is not to say it cannot be, but it makes it more difficult. Acting Mayor Petschel also asked should this project develop, who would maintain it. City Engineer Mazzitello replied it would be in the form of an agreement between the host city and the county. Acting Mayor Petschel stated that this is like another unfunded mandate. It would be hoped that the city would have more assistance in maintaining a larger trail system. Councilmember Povolny brought up his concerns of walkers using Delaware, south of Highway 110 to Mendota Heights Road. City Engineer Mazzitello acknowledged this concern. There are some severe engineering challenges to adding a trail to that portion of Delaware. This summer the county will be adding guardrails to both sides of Delaware because of the grade drop off. Additional comments on the condition of trails were said and areas for improvement were mentioned. Councilmember Duggan asked for an update on the deer hunt and coyote hunt. Councilmember Povolny asked for confirmation that there has been a cougar siting in Mendota Heights. City Administrator Miller replied that a siting has been recorded. In response to Councilmember Duggan's request, City Administrator Miller mentioned that the latest deer hunt report is on the city's web -site. Councilmember Duggan read an e -mail he received about coaching. Councilmember Norton stated that he is happy to be of service to the citizens of Mendota Heights and to be a part of this body. He is very excited for the four years to come. Acting Mayor Petschel expressed her congratulations to Councilmember Povolny and Councilmember Norton for their election to the Council. She is looking forward to this New Year and everything that the Council will accomplish. Councilmember Povolny stated he is happy to be working on the Council for the next four years, is excited to work with Councilmember Norton who is new, and with the other three that he has worked with in the past. pg 10 ADJOURN Councilmember Duggan moved to adjourn. The December meeting of the Mendota Heights Parks and Recreation Commission was held on Tuesday, January 8, 2013 at Mendota Heights City Hall, 1101 Victoria Curve. Chair Levine called to order the parks and recreation commission meeting at 6:30 p.m. The following commissioners were present: Chair Stephanie Levine, Commissioners Mary McGrory- Ussett, Ira Kipp, David Miller, Mike Toth and Pat Hinderscheid. Excused absent: Commissioner Joel Paper. Staff present: Recreation Programmer Teresa Gangelhoff, Parks Maintenance Lead Terry Blum, Assistant to the City Administrator Jake Sedlacek, Public Works Director /City Engineer John Mazzitello. Approval of the Agenda COMMISSIONER HINDERSCHEID MADE A MOTION TO APPROVE THE AGENDA; COMMISSIONER TOTH SECONDED THE MOTION. AYES 6: NAYS 0 Approval of Minutes of December 11, 2012 COMMISSIONER TOTH MADE A MOTION TO APPROVE MINUTES OF THE DECEMBER 11, 2012 MEETING; COMMISSIONER MILLER SECONDED THE MOTION. AYES 6: NAYS 0 Recreation Programmer Update Recreation Programmer Teresa Gangelhoff provided a copy of the recreation programmer's report, noting that winter programs are underway. The winter edition of the Heights Highlights newsletter will include descriptions of summer programs, which will mirror programming from 2012. Commissioner Toth asked about the fall field trip and what our capacity is for field trips. Ms. Gangelhoff explained that field trips are coordinated with the cities of West St. Paul and South St. Paul — we are allotted 20 spaces for each trip, but that number frequently flexes to respond to demand in each of the cities. Ms. Gangelhoff provided comment on agenda item 8, Recreation/Par 3 Staffing Update. Ms. Gangelhoff recommended that two separate part-time positions should be maintained, as one full -time employee would not be able to keep up with the pace of summer programming. Ms. Gangelhoff also felt that there are too many part time positions for one person to supervise. pg 12 Parks Maintenance Update Parks Maintenance Lead Terry Blum thanked the commission for the opportunity to attend the meeting, noting that input on parks maintenance is always welcome. Mr. Blum reported that there are three maintenance staff who oversee athletic fields, mowing of parks, fields and ped- ways, irrigation, facility and equipment maintenance. Mr. Blum described late spring to early fall as maintenance time, where all three staff are kept extremely busy just maintaining facilities. As much as possible, special projects and regular maintenance on equipment are addressed in late fall and winter. City Engineer/Public Works Director John Mazzitello noted that parks staff are an integral part of the public works team, frequently providing assistance to streets and utilities staff as well. Winter responsibilities include plowing cul -de -sacs, parking lots, rinks and trails. The commission expressed an appreciation for how much work the parks crew is able to accomplish. There was discussion about how requests for maintenance from the general public are received and prioritized. There was consensus that commissioners should forward comments to Mr. Sedlacek, who will maintain a reporting list for the commission, and forward requests on to Mr. Mazzitello for direction to the parks crew. The commission requested that Mr. Blum document the work flow of the parks maintenance crew in an effort to seek efficiencies and ensure that a high level of quality is maintained in our parks system. Mr. Blum also provided a brief background on lighting for ball fields at Mendakota Park. Preliminary estimates show the cost to light two fields would cost $235,000- $245,000. Mr. Sedlacek that a previous study of the issue (1995) included the following concerns: spillover of light to private properties, too much money was being spent on a single park, and the facility would serve non - residents. Mr. Blum shared images of current lighting for athletic fields, and explained that newly installed lights have less spillover to other properties. Newer lighting systems are also much more efficient and can be controlled from a remote location. It was noted that the City of Mendota Heights is rare, without a lighted municipal ball field. The commission expressed interest in discussing the idea further, asking for a photometric plan, estimated cost of operation and an analysis of the additional capacity lighted fields would bring. Par 3 Update — 2013 Programming Assistant to the City Administrator Jake Sedlacek reviewed the agenda materials relating to programs to be offered at the Par 3 Golf Course in 2013. Mr. Sedlacek shared that the programming plan was reviewed by a PGA Professional Instructor, who endorsed the program offerings, suggesting minor alterations and additional offerings. Mr. Sedlacek hopes to identify a golf instructor that can serve as a golf instruction lead, as we have for tennis and playground programs. pg 13 Commissioner McGrory - Ussett led a discussion on what a property marketing plan should include, and raised the concept of setting goals for each program offering. Mr. Sedlacek reported that the 2012 Par 3 Annual Report will be presented to the parks and recreation commission at their regular meeting in February, 2013. Trail Update - reminders Mr. Sedlacek reminded the commission that next Tuesday, January 15, 2013 will feature two interesting events regarding trails in Mendota Heights. Dakota County is holding an open house to discuss a greenway master plan for trail connections from Dodd Road and Highway 110 to Lebanon Hills Park in Eagan. This open house will be held from 6:00 -8:00 p.m. at the Lebanon Hills Regional Park Visitor Center in Eagan. On the same evening, the Mendota Heights City Council will receive a report from a contracted consultant on designs for an improved pedestrian crossing at the intersection of Dodd Road and Highway 110. The city council meeting starts at 7:00 p.m. Recreation/Par 3 Staffing Update Mr. Sedlacek reported that the city council was considering a recommendation from staff to create a new full -time recreation coordinator position. This new position would oversee recreation programming as well as clubhouse operations at the golf course. Mr. Sedlacek stressed that the parks and recreation commission has not previously been involved in discussing matters of city staffing, as with most cities, staffing decisions are a matter for city council to decide. The commission expressed concerns, as shared by Ms. Gangelhoff, that one full -time staff would not be able to complete all of the tasks assigned to this position. Mr. Sedlacek noted that hours spent by both part time positions in 2012 had been closely analyzed, and that the proposal included 290 additional hours of staff time. Several commissioners expressed their opinion that a staffing change impacting recreation and golf course programs fit under the City Code duties for the commission "Advise the city council on matters pertaining to parks and recreational development program and shall cooperate with city personnel in implementing the parks and recreation programs." The commission asked that very specific goals for performance measurement be set for the position for both recreation programs and golf course performance. Commission Comments Commissioner McGrory - Ussett wished to have three concerns noted on the public record: 1) She disagrees with the decision not to involve the parks and recreation commission in a staffing decision 2) Changes to program leadership do constitute an aspect of program evaluation pg 14 3) The city needs a matrix in place to measure performance A request was made for Mr. Sedlacek to forward a copy of the organizational chart for all city staff. The question was posed if the commission could request a work session with the city council to discuss the purpose and expectations of the commission. There was consensus by the commission to do so; Mr. Sedlacek will forward the request. Commissioner Toth thanked the group for thoughtful discussion and expressed his pleasure to continue to serve with the current commissioners. The price for the 2012 audit is $31,900. This is up just over 1% from the cost of the 2011 audit. The cost for the audit was included in the 2013 budget. I have received the audit engagement letter for the 2012 audit from KDV. BUDGET IMPACT The cost of the 2012 audit is reflected in the 2013 budget. The WHEP program assesses aspects of wetland health for specified water bodies by measuring invertebrates' type and quantity as well as vegetation growth in the wetlands. Metrics from these evaluations are then used to determine the health of a wetland. Staff is proposing to monitor two wetlands with volunteers through Dakota County WHEP: Copperfield — wetland designated as MH -2, and Field Stone Pond — wetland designated as MH -16. These water bodies are part of the City's storm water treatment system but are unique in that they were wetlands that pre -date their respective development areas as opposed to pond constructed specifically for storm water treatment. The attached JPA is a renewal of our existing agreement and will serve to continue our participation in the WHEP program. BUDGET IMPACT The City is invoiced by Dakota County for the service of monitoring these wetlands. The fees vary from year to year as established by an annual fee schedule. The fee paid by the City of Mendota Heights in 2012 was $2,310.00. The fee charges by Dakota County are paid out of the Storm Water Utility Fund. The County shall estabUsh and maintain such funds and accounts as may be required by good accounting practices. 5.3 The County may apply for and accept gifts, grants, loans and money, other property or assistance from federal or state agencies, or any other person to carry out the WHEP in Dakota County. 5.4 The County may use funds to hire and retain a monitoring coordinator, a non-profit agency, consulting firms and such other personnel as may be needed to provide the services contemplated under this Agreement. Notwithstanding the foregoing, the parties agree that WHEP is a volunteer based program and that data collection shall be performed solely by volunteers trained by the County. A total of 18 applications were received for the part-time Police Support Specialist position. Sergeant Neil Garlock, Police Support Specialist Kim Henning and part-time Police Support Specialist Sue Donovan and I interviewed 4 candidates initially and narrowed the number down to three candidates that were brought back for more in -depth interview. Police Chief Mike Aschenbrener, Police Investigator Mario Reyes and I conducted the final interviews and selected one candidate to move forward in the hiring process. The final candidate has completed the computer skills testing, physiological assessment, background check and pre - employment drug screening. It is our pleasure to recommend to you that the city appoint Trista Miller as the part-time police support specialist. Ms. Miller has over ten years of administrative support experience and will be a great addition to the Mendota Heights Police Department. Mazzitello, PE, PMP Public Works Director /City Engineer SUBJECT: Final Plans for the Trunk Highway 110 & Trunk Highway 149 (Dodd Road) Intersection Improvements BACKGROUND In June of 2009, the City's retained consultant produced a Feasibility Study on alternatives for improving pedestrian safety at the intersection of State Trunk Highway 110 and State Trunk Highway 149 (Dodd Road). The Feasibility Report analyzed four alternatives for improving safety for pedestrians crossing at this intersection, and was focused on pedestrian traffic crossing Highway 110 more so than those crossing Dodd Road. These alternatives were: 1. Take no action (do nothing alternative) 2. A pedestrian overpass (bridge) 3. A pedestrian underpass (tunnel) 4. At -grade crossing improvements at the existing intersection After hearing the report from the consultant, Council decided to pursue the option of improving the at -grade pedestrian crossings at the existing intersection. As part of the project pursuit, the City made an application with the Metropolitan Council Transportation Advisory Board for a Transportation Enhancement (TE) grant to fund the improvements. The City was awarded $484,000 of construction funds in Federal fiscal year 2013 to complete the project. In order to take advantage of the TE funds granted by the Metropolitan Council, the City needs to design, bid, and award the construction project. The TE grant does not cover design costs, but is applicable to the cost of constructing the project. The City solicited Requests For Proposals (RFP) form several area consulting firms to assist the City in designing and coordinating the project through the State Department of Transportation (MnDOT). SRF Consulting Group (SRF) was selected and has been working for the past several months to compile information and produce the design plans for the project. At the September 18, 2012 City Council meeting, SRF presented preliminary plans as well as a project status update to the Council. Several questions were asked by Council specific to the design elements of the project. Those questions were routed through MnDOT and have been incorporated into the project design where possible. Coordination through MnDOT is necessary not only because of the TE grant, but because the intersection is a MnDOT owned facility and the desired improvements must conform to MnDOT design criteria and rules. pg 40 Also included in the project is the relocation of a portion of Interstate Valley Creek Trail along the Highway 110 Right -of -Way. This portion of the trail is currently under License Agreements for the trail to cross two privately held lots, and the realignment would place the trail totally within public property. The trail realignment is not eligible for TE grant funds. The City of Mendota Heights would fund this portion of the improvement. Attached is a copy of the presentation slides SRF will be going over at the Council meeting. Although the final plans are not signed and completely ready for bidding, they are considered to be 99% complete, and any changes to the plan set prior to solicitation of bids would be cosmetic in nature and not impactful on the essence of the design. BUDGET IMPACT The cost of the intersection improvement project is estimated at $250,618.00. The TE grant would cover 80% of the construction cost. The City of Mendota Heights would be responsible for the remaining 20% of the construction cost ($50,123.60); all design costs, and the cost of relocating the portion of Interstate Valley Creek Trail, which is estimated at approximately $38,812.50. Design funds and the City's 20% matching funds are anticipated to be covered by the City's Municipal State Aid Account (MSA) and has been anticipated, identified, and budgeted as part of the City's five -year Street Improvement Plan (SIP). Trail relocation funds are anticipated to be General Fund expenditure. RECOMMENDATION Staff is recommending approval of the final plans for the Trunk Highway 110 & Trunk Highway 149 (Dodd Road) Intersection Improvements, and authorization to solicit bids for the construction of the project. If Council desires to implement the Staff recommendation, pass a motion adopting, Resolution 13 -_, "A RESOLUTION APPROVING FINAL DESIGN PLANS FOR THE TRUNK HIGHWAY 110 AND TRUNK HIGHWAY 149 INTERSECTION IMPROVEMENT PROJECT AND AUTHORIZING SOLICITATION OF BIDS FOR CONSTRUCTION," by a simple majority vote. pg 41 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2013 - RESOLUTION APPROVING FINAL DESIGN PLANS FOR THE TRUNK HIGHWAY 110 AND TRUNK HIGHWAY 149 INTERSECTION IMPROVEMENT PROJECT AND AUTHORIZING SOLICITATION OF BIDS FOR CONSTRUCTION WHEREAS, the City of Mendota Heights has identified the public safety need for improvements to the pedestrian crossings at Trunk Highway 110 and Trunk Highway 149, also known as Dodd Road; and WHEREAS, the City of Mendota Heights desires to create a pedestrian and bicycle friendly city by improving areas where pedestrian and bicycle safety concerns exist; and WHEREAS, the City of Mendota Heights completed a Feasibility Study of several alternatives to correct the pedestrian safety concerns at the Trunk Highway 110 and Trunk Highway 149 intersection; and WHEREAS, the City of Mendota Heights applied for and was awarded a Transportation Enhancement grant through the Metropolitan Council to complete the desired at -grade intersection improvements; and WHEREAS, the City of Mendota Heights, with the cooperation of a consultant engineer, has completed design plans for the improvement of the pedestrian crossing facilities at the intersection; and NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council, that the plans and specifications for the Trunk Highway 110 and Trunk Highway 149 Intersection Improvement Project be and they are hereby in all respects approved by the City; and BE IT FURTHER RESOLVED, by the Mendota Heights City Council, that the Clerk with the aid and assistance of the City Engineer be and is hereby, authorized and directed to advertise for bids for the Trunk Highway 110 and Trunk Highway 149 Intersection Improvement Project all in accordance with the applicable Minnesota Statutes, such as bids to be received at the City Hall of the City of Mendota Heights by 10:00 A.M., on a date to be identified in the solicitation documents, and at which time they will be publicly opened at Mendota Heights City Hall by the City Engineer, will then be tabulated, and will then be considered by the City Council at its next regular Council meeting. DATE: January 15, 2012 TO: Mayor, City Council and City Administrator FROM: Jake Sedlacek, Assistant to the City Administrator SUBJECT: Resolution Approving a Redevelopment Planning Grant BACKGROUND The city was recently informed that the current owner of the Fischerville Coffee Shop and Bella Boutique, located at 2156 Dodd Road, is in the process of closing both businesses. This marks the end of the third ownership of the coffee shop in as many years. The parcel is once again listed for sale by Drake Bank. Staff has been in conversation with the Dakota County Community Development Agency (CDA) to determine if the site might be an appropriate project for their redevelopment planning grant program. The CDA agreed with city staff that the Fischerville Site, along with the Old Fire Hall Site could benefit from a market analysis and redevelopment plan. CDA staff felt it would be appropriate to submit an application for a redevelopment planning grant. Attached you will find a grant application, with a resolution formalizing city council support of the application. The grant would fund a consultant planning and /or architecture firm to evaluate the sites, evaluate their best use, complete a market analysis and provide a concept plan. The grant is a one -to -one match, it is anticipated that a redevelopment plan could cost up to $20,000. City staff has been in conversation with the agent currently listing the Fischerville site; Drake Bank might also be willing to contribute to the study. As the deadline for application is extremely tight, staff is recommending that city council approve making application. If our application is approved, staff will come back to city council to outline the next steps. If, at some point after a grant decision, the city council decides not to proceed, the city could decline the grant, so long as that action is taken prior to any contract for service is approved. BUDGET IMPACT City contribution would be funding by the Industrial /Business Development fund. RECOMMENDATION Staff recommends applying for a redevelopment planning grant from the CDA. If the city council wishes to implement the recommendation, pass a motion approving RESOLUTION 2013 -06 APPROVING AN APPLICATION FOR A REDEVELOPMENT PLANNING GRANT FROM THE DAKOTA COUNTY COMMUNITY DEVELOPMENT AGENCY. The site includes an unoccupied service station and an occupied commercial building recently used for a coffee shop and retail business. The property was foreclosed upon; currently owned by Drake Bank. The site is challenged by limited parking availability and zoning non - conformities relating to maintenance, setback, and the existence of two buildings on one lot. The old service building also poses an environmental hazard, with an old grease pit to be cleaned up. The coffee shop had three owners in as many years. City staff has fielded several inquiries regarding the site, assisting potential property buyers to work through challenges of the site. The city has approached the current real estate agent, to inform them that the city owned parcels may be available if it helps the redevelopment of the Fischerville site. The Old Fire Hall site is zoned R -1, Single Family Residential. The original fire hall for the City of Mendota Heights was demolished in 1991, the site has been undeveloped since that time. In 1992 Dakota County provided correspondence that any hazardous materials had been property removed from the site. The site has been previously listed for sale as residential, with the only inquiries on the parcel proposing commercial uses. The city would like a planning study completed for the area, to conduct a market analysis and develop concepts for the best use of the private and public properties. Describe the type and scope of the planning project. The City of Mendota Heights would like to have a redevelopment plan for the privately and publicly held parcels. It appears that redevelopment is not likely to occur without a vision for the area, and /or leveraged resources. This process has come together very quickly, with the closure of the current businesses and subsequent re- listing of the Fischerville building. A preliminary cost estimate for this work is $20,000. A more reliable estimate would be defined through the RFP process, should the city be selected for funding. In preliminary discussions with the private property owner, Drake Bank, no amount was established for a private match for this project. What outcome or product will the planning project help identify? The outcome would be to determine the best use for redevelopment of the parcels Describe how this planning project fits into the pre - redevelopment activities. 2 pg 57 The site should be considered for a Redevelopment Planning Grant, as future use of the site will very likely include clearance and demolition expenses to make the site suitable for redevelopment, and will include clean up of pollution on the site. The Old Fire Hall Site is currently exempted from property taxes; any change in ownership to a private holding will have a positive impact on the tax base. The site is of some historical significance to the community and northern Dakota County. It is anticipated that any redevelopment plan would serve to improve storm water runoff, as well as access to the site from Dodd Road. Further, the city is willing to use local funds to leverage resources, which could include a contribution from the property owner.
