CALL TO ORDER Mayor Krebsbach called the meeting to order at 7:00 p.m. The following members were present: Councilmembers Duggan, Povolny, Petschel and Vitelli. PLEDGE OF ALLEGIANCE Council, the audience, and staff recited the Pledge of Allegiance. AGENDA ADOPTION Mayor Krebsbach presented the agenda for adoption. Councilmember Duggan moved adoption of the agenda. Councilmember Vitelli seconded the motion. Ayes: 5 Nays: 0 B) ACKNOWLEDGEMENT OF MAY 22, 2012 PLANNING COMMISSION MINUTES Councilmember Duggan noted that a sentence at the bottom of page three of the Planning Commission minutes reads that "He commented the Council did not feel there was enough information to approve a variance for Mr. Bader." Councilmember Duggan believed this may have been said at the Planning Commission meeting but did not feel that was the case in the Council's consideration. The Council believed there was no justification for a variance and there was no supporting hardship in relation to the request. It was based on this decision that the Council denied the request for variance. Councilmember Duggan expressed his concern on the language in the minutes. City Attorney Tami Dielun replied that there were two things Council could do; 1) note in the Council minutes of this meeting Councilmember Duggan's comments, or 2) staff could go back and review the tape of the Planning Commission meeting and suggest to the Planning Commission that they amend their minutes. After suggestions were reviewed and discussions had by the Councilmembers, City Administrator Justin Miller stated that since no action was taken at the Planning Commission meeting based on the comment made it is staff' belief that the minutes from the Planning Commission meeting are an accurate reflection of what was said by Sedlacek. . In the minutes taken from Council's meeting tonight it could be noted that the Council felt there was a mistake in the Planning Commission meeting minutes. He recommended the Council adopt the Planning Commission minutes as presented and the Council meeting minutes would reflect their thoughts about how these appear. Councilmember Duggan moved to Acknowledge the May 22, 2012 Planning Commission Minutes with the notation that Council did not feel that there was an accurate summary of their actions in relation to the variance request. Councilmember Vitelli seconded the motion. Ayes: 5 Nays: 0 Mendota Heights City Council June 5, 2012 p3 Page 3 G) APPROVAL OF PHARMACEUTICAL DROP -OFF PROGRAM JOINT POWERS AGREEMENT City Administrator Justin Miller stated that late in the day of this meeting staff found out through Chief of Police Michael Aschenbrener that the Dakota County Board, who was also prepared to approve the agreement this week, pulled this item from their agenda. Staff was not sure why this was pulled but they wanted to make sure everyone was approving the same agreement and asked that Council table this decision. There being no action necessary to table an item, the Council moved on to the next topic. J) PLANNING CASE 2012 -17, CRITICAL AREA PERMIT FOR A STORAGE SHED AT 1008 JAMES COURT Councilmember Duggan commented that item three under the NOW THEREFORE BE IT RESOLVED reads "The property is not in proximity to any bluff line." He suggested to staff that if it is not in proximity then the statement becomes unnecessary. It should only be included if it is in proximity to a bluff line. Assistant to the City Administrator Jake Sedlacek replied this finding is a very common finding in critical areas; however, if Council would like to make a change staff would entertain that. Councilmember Petschel suggested this request be granted as written and as the streamlined critical area permits come forward in the future, they include the distance to the bluff line. Councilmember Duggan suggested this permit request go forward but that the distance to the bluff line would be added for the record. Councilmember Duggan moved Approval of Planning Case 2012 -17, Critical Area Permit for a Storage Shed at 1008 James Court with the Approximate Distance to the Bluff Line Added for the Record. Councilmember Petschel seconded the motion. Ayes: 5 Nays: 0 0) APPROVAL OF ONE -STOP RIGHT -OF -WAY PERMITTING SYSTEM WITH DAKOTA COUNTY City Engineer John Mazzitello stated that this item was originated by Dakota County. Throughout all of the cities in Dakota County, contractors and companies that wish to install utilities along publicly owned right -of -way need to apply for right-of-way permits from the various municipalities. This system being developed by the county would be a one -stop shop for the contractors; where instead of having to fill out multiple permits for a project, they would only fill out one. The county would have the permit application process and the fees from all of the different cities outlined for the contractor. The contractor could fill out one permit for a project that may stretch from Eagan to South St. Paul; going through Mendota Heights, West St. Paul, South St. Paul, etc. Mendota Heights City Council June 5, 2012 Page 4 The county asked for a one-time $2,000 set-up fee from all of the cities and then there would be monthly billing based on the number of pen-nits cycled through the one-stop program to each respective city. Mayor Krebsbach asked if this would be an automatic permitting process. City Engineer Mazzitello replied that the city would still review the plans to make sure they do not conflict with anything else in its right-of-way and would receive the fees for its time in reviewing those plans. Only the permit application form would be one instead of multiple for the contractor. Councilmember Vitelli stated that he was not in support of this because the Council would be asking the residents of Mendota Heights to pay a $2,000 one-time set-up fee and $475 a year when there would be no benefits to the residents of Mendota Heights; only to the contractors. Councilmember Povolny asked how much staff time the city would save for the $40 per month. City Engineer Mazzitello replied the process to staff would remain essentially the same as it is right now. Instead of receiving the penuits from the contractor, staff would receive them from Dakota County. Staff did not foresee any time or cost savings. Councilmember Vitelli moved Approval of One-Stop Right-of-Way Pennitting System with Dakota County Without Authorization of any Payment from the City to the County. Councilmember Duggan seconded the motion. Ayes: 5 Nays: 0 P) APPROVAL OF PILOT KNOB USE PERMIT Assistant to City Administrator Jake Sedlacek stated the City has owned the parcels that make up Pilot Knob, approximately twenty-five acres, for a little over five years. The city has been heavily into the restoration of that site, is now starting to see the benefits, and is getting requests to use the site. Under the funding sources, this is not a park; this is an open space so the rules apply differently. He, along with Chief of Police Michael Aschenbrener, have been looking at what other cities have done for pennitting special events and examples of more restrictive uses. What was presented to the Council was their best draft at a Special Event Permit for Pilot Knob. The emphasis was to try to make sure there were controls in place over what groups could use the facility; but at the same time those groups have to recognize the uniqueness of the site; make sure that there is extra protections built in for the site, and that — unlike a park — no matter what, the site is open to all even though there may be an event going on. Mayor Krebsbach asked if ceremonial fires would be allowed, even though the permit stipulates no fires allowed on the site. Councihnember Petschel stated she had the same question because this is a sacred site and she would not like to think that Native Americans could not have a sacred fire on the site because this document prevents fires. Assistant Administrator Sedlacek replied that this has been a topic of many discussions — how does anyone discern one type of fire from another. Right now the document says that fires are not allowed but given the feedback, staff agrees it is something they need to figure out and are open to suggestions. P4 Mendota Heights City Council June 5, 2012 p 5 Page 5 City Attorney Tami Diehm stated that the way the permit is currently drafted it does prohibit all fires, which is a blanket prohibition. If Council desires, staff would revisit that and come back with language that would allow for ceremonial fires, it could be worked into the permit. However, enforcement of that may be a little tricky for staff but they could certainly build in the language. After discussions and suggestions took place on the topic of fires and the associated issues , Assistant Administrator Sedlacek suggested that, since there were no pending applications, staff go back and revisit this language with people that are not necessarily inside of City Hall and bring it back to the Council in two weeks. The feedback from Council was very clear and some of the concerns are valid. Staff would prefer to hone in on the specific issue and bring back a finished product rather than passing something that is not finished. There being no action necessary to table an item, the Council moved on to the next topic. PUBLIC COMMENTS Ms. Jennifer Reeves, President of the Mendota Heights Moms Club stated that her organization voted to donate $150 for trees for any of the parks that are in need of one. The Mendota Heights Moms Club has approximately forty-five members who are all moms located in Mendota Heights, West St. Paul, Lilydale, Sunfish Lake, and Mendota. The Councilmembers expressed their appreciation for the donation. Councilmember Vitelli suggested that information pertaining to the location and type of tree be provided to the organization, which the Council agreed to. Mayor Krebsbach noted two large events that happened together during the past weekend, the first being the 50th Anniversary of the Mendota Heights Police Department, which was organized by Patrol Officers Jeff VonFeldt and Peyton Fleming Officers VonFeldt and Fleming gave a report on the activities, which included a gathering of past and current police officers, reserves, and staff at the Pool & Yacht Club on Friday evening and a four -hour open house on Sunday afternoon. The second event noted as part of the Celebrate Mendota Heights Parks 25th Anniversary was the Seventh Annual 5K Run /Walk to benefit Special Olympics. Sergeant Neil Garlock organized the event and provided a report by first mentioning that the event has grown each year, this year being no exception. Over $7,000 was raised for Special Olympics — another record. There were other activities that occurred in conjunction with the Celebrate Mendota Heights Parks 25th Anniversary. Also, the Dedication and Renaming of the Civic Center Ball Field in memory of Former Mayor Chuck Mertensotto occurred. Assistant City Administrator Jake Sedlacek gave the report. PUBLIC HEARINGS A) LIQUOR LICENSE RENEWALS Mendota Heights City Council June 5, 2012 P 6 Page 6 City Administrator Justin Miller explained that this public hearing was for liquor license renewals for businesses in the city. Staff had received the applications and background checks for all of the establishments seeking renewal. Staff recommended the approvals for the following: On -Sale Liquor License including a Special Sunday License Teresa's Mexican Restaurant, 762 Highway 110 Courtyard by Marriott, 1352 Northland Drive On -Sale Club Liquor License and Special Sunday License Mendakota Country Club, 2075 Mendakota Drive Somerset Country Club, 1416 Dodd Road On -Sale Wine License Mendoberri, 730 Main Street Tonuny Chicago's Pizzeria, 730 Main Street LeCordon Bleu College of Culinary Arts, 1315 Mendota Heights Road Off -Sale Liquor License The Wine Market, 720 Main Street Mendota Liquor, 766 Highway 110 Mayor Krebsbach opened the public hearing and asked for comments from the audience and the Councilmembers. Being none, Councilmember Duggan moved to close the public hearing. Councilmember Vitelli seconded the motion. Ayes: 5 Nays: 0 Councilmember Duggan moved Approval of the Renewal of Liquor Licenses, Including Their Type, for all of the Establishments as Articulated by City Administrator Justin Miller. Councilmember Vitelli seconded the motion. Ayes: 5 Nays: 0 UNFINISHED AND NEW BUSINESS A) APPEAL OF FIRE MARSHAL DECISION, HUDSON REFRIGERATED LOGISTICS — 1460 SIBLEY MEMORIAL HIGHWAY City Administrator Justin Miller explained that this is an appeal of a decision made by the City Fire Marshal that required Hudson Refrigerated Logistics at 1460 Sibley Memorial Highway to replace recalled fire protection sprinkler heads in their building. Administrator Miller reviewed the lengthy background on this topic and also recommended that Mr. Hudson and his representative, who were in attendance, have an opportunity to state their case. 2002 and 2003 — reports received by the City from Sununit Fire Protection noted that Hudson did not have any recalled sprinkler heads Mendota Heights City Council June 5, 2012 P 7 Page 7 Beginning in 2004 and annually to present time — the Suininit Fire Protection reports do show there is a presence of recalled sprinkler heads July 2007 — the State adopted a new fire code, which was then adopted by the City in October 2007 as part of its fire code. This new fire code stated that recalled sprinkler heads were no longer allowed, whether or not the recall was voluntary, and there was no grandfathering. 2010 — the City started to make Hudson Refrigerated Logistics aware of their need to replace those recalled sprinkler heads November 2010 — Mr. Hudson requested a hearing with the City Council contesting the requirement, which for reasons that are unknown, did not come before the City Council February 2012 — Fire Marshal Jim Lee sent a letter to the company stating that they did have to replace the recalled sprinkler heads. Hudson Refrigerated Logistics again requested a hearing with the City Council, which is the first step they need to take to appeal the Fire Marshal decision. March 2012 — Fire Marshal Jim Lee and City Administrator Justin Miller met with Mr. Hudson and tried to come to a solution but were unable to do so. April 10, 2012 — the City received a letter asking for this hearing It was staff's opinion that the fire code is clear on this issue as it says that recalled sprinkler heads are not allowed per the fire code. Staff believed it was a liability for the City. Staff's recommendation was the Council uphold the Fire Marshal's decision. Administrator Miller stated there is another step in the appeal process. Mr. Hudson could appeal to the State Fire Marshal. Administrator Miller also said that Mr. Hudson has some legitimate arguments but that would be a decision more appropriately handled at the State Fire Marshal level as staff is just the interpreters of the code as it applies to Mendota Heights. Mr. Bob Lee, an attorney representing Hudson Refrigerated Logistics, explained the issue in more detail and their concerns about replacing the sprinkler heads. He explained the operations that take place in the facility and the various uses of each part of the facility. He stated the building is essentially a concrete dock with a metal roof and metal walls, which is insulated and cooled to low temperatures. Aside from the office side of the building, which is sprinkled with a different system, there are no people in this building other than the employees who are running electric pallet trucks moving the pallets of products back and forth. On a typical operational day there would be three people running pallet trucks in the part of the building affected. Mr. Lee also explained that, when the building was remodeled in 1995, the Fire Marshal at that time required them to install a sprinkler system in the ceiling and an in -rack sprinkler system in the pallet racks. Therefore, half of this warehouse has three sprinkler systems, one in between the ceiling and the roof, one in the ceiling, and one in the racks. The recalled sprinkler heads are located in one section of the ceiling and were installed during the 1995 remodel. The remaining sprinklers in the ceiling, above the ceiling, in the offices, in the front part of the dock facility, and in the freezer are fine and not subject to any recall. In the opinion of Mr. Lee and Mr. Hudson, because of the redundancy of the current sprinkler systems, there was no need to replace the recalled sprinkler heads. In 2010, the then current Fire Marshal looked at this issue and consulted the State Fire Marshal. Unfortunately, the material he provided to the State Fire Marshal was incomplete and misleading, did not explain the redundancy problem, did not mention the in- pallet system, and the information on the Mendota Heights City Council June 5, 2012 P $ Page 8 rest of the building did not describe its actual use — he described it as a storage facility in its entirety. Mr. Lee and Mr. Hudson believed this led the State Fire Marshal to come to the wrong conclusion. Mayor Krebsbach asked for clarification that they did not want this issue heard at the State level. Mr. Lee replied that Hudson was not necessarily looking for a decision to be made on this issue at the City Council level. They would prefer to work with Fire Marshal Jim Lee and City Administrator Justin Miller to prepare a stipulated set of facts and explanation as to what these sprinkler systems look like, submit that again to the State Fire Marshal and receive his guidance as to whether, in fact they have a system that is covered by the state fire code and therefore requires replacement. Additional supporting documentation and materials were presented. Administrator Miller pointed out to the Councilmembers that the topic this evening only related to the recalled sprinkler heads — not any other sprinkler heads located in other parts of the facility. The presence of voluntary recalled sprinkler heads in 2004 and all of the way to 2007 — the. City could not have ordered them to be replaced because there was not any backing, any fire code, nor any law that would have allowed that. That is why the previous Fire Marshal did not instruct them to do that. It was not until 2007, when the new fire code was adopted, that the City could begin to require those to be replaced. The voluntary recall ended sixty days before the new State Fire Code tools effect. Administrator Miller also stated that the fire code is very clear in stating that recalled sprinlder heads are not allowed. However, Hudson does have valid points that they should bring up to the State Fire Marshal if they wish to appeal. The City does not have the authority to waive that at this time. Mayor Krebsbach asked Fire Marshal Jim Lee if she was correct in understanding that what the action by the Council would be to not allow Hudson to continue to have their recalled sprinlder heads, they would be able to appeal at the State level, but the Council may have some leeway in terms of when they would expect Hudson to change those recalled sprinkler heads. Fire Marshal Jim Lee indicated that this was correct. Mayor Krebsbach asked what kind of tune -line would be appropriate. Fire Marshal Lee replied this would be negotiable but two or three years would be fine. Mayor Krebsbach asked for Fire Marshal Lee's opinion on Hudson's request for the City to join with them on any kind of documentation. Fire Marshal Lee replied he did not believe he had the leeway to do that because the fire code is very clear — no recalled sprinkler heads allowed. Administrator Miller stated that staff would be more than happy to provide any documentation that they have that Hudson may not have, to help in presenting their case. However, it would not be a joint application. Additional questions were asked by Councilmembers regarding the reason for the sprinkler head recall, if this were a new building is there sufficient fire suppressant systems in place to satisfy the State requirements, would the piping need to be replaced as well or just the sprinkler heads, and if there were requirements in place for regular testing of installed sprinkler heads. Mendota Heights City Council June 5, 2012 p 9 Page 9 Councilmember Vitelli suggested that Council ask the City Fire Marshal to clearly state the actual sprinkler needs of the facility, and then he would recommend that the City Fire Marshal support Hudson in their appeal to the State Fire Marshal by being in attendance so as to be available to provide the history from the City's and the prior City Fire Marshal's point of view of the situation. The objective that would be brought to the State would be to minimize the cost to Hudson. Then if the State says the recalled ceiling sprinkler heads need to be replaced, that would be the end of the situation. City Attorney Tatni Diehm reiterated the issue before the Council is that there is a provision in the State Fire Code, which is incorporated into the City Ordinance, that if an entity has recalled components, they need to be replaced if they are covered under the code. It was staff's position that these were covered. Attorney Diehm then read the provision from the State Statute and pointed out that staff's recommendation was that the State Fire Marshal would be in a better position to evaluate the various elements of hardship and safety to the occupants, the cost, and the substantial compliance. However, the State Fire Marshal would not hear their variance application until after the City has acted. As staff was not comfortable recommending a variance from the code, they recommended that Council inform Hudson that the City cannot offer them any relief and direct them, should they still be unhappy, to seek a variance from the State Fire Marshal. To the extent that the City could provide information and help would be fine; however, this would not technically be a joint application because the City's finding would be that compliance with the code is required. Councilmember Petschel moved to Affirm the Corrective Action Decision of the City Fire Marshal Requiring Actual Compliance with the City Fire Code and to Replace the Recalled Fire Protection Sprinkler Heads, as outlined in His February 21, 2012 Letter to Hudson Refrigerated Logistics and is Supported by Prior Communication so Noted March 17, 2010; Not to Provide Relief from Said Requirement; but to Stay any Enforcement Action Pending an Appeal to the State Fire Marshal, Assuming that Appeal is Brought Within Ninety (90) Days Councilmember Vitelli seconded the motion. Ayes: 5 Nays: 0 B) SANITARY SEWER AUTO -PAY BILLING OPTION INCENTIVE PROGRAM City Administrator Justin Miller stated that residents in Mendota Heights pay a variety of different utility bills, including sanitary sewer and stonn sewer paid to the city. These bills are routinely sent out quarterly and then the residents have the option of either mailing a check, dropping it off, or they can sign up for an automatic bill pay system, which is becoming commonplace in the market. Approximately eleven percent of the residents use the automatic system, which staff believes is very low. The more people that use an automatic bill pay system, the more residents and staff can see savings and efficiencies. To encourage use of the automatic bill pay system, staff is recommending the offering of an incentive program. If residents sign up between now and July 31, 2012 a drawing would be conducted of everyone on the system, previous users and new, and give away a free quarter's bill, up to $150. Councilmember Duggan asked if a statement could be inserted onto the bill stating that the City would recommend use of the automatic bill pay system. Administrator Miller replied that he believed this was already being done but would confirm and if it is not being done, it would be added. Mendota Heights City Council June 5, 2012p 10 Page 10 Councilmember Vitelli moved Approval of An Incentive Program to Encourage Residents to Sign Up for an Automatic Bill Pay System Councilmember Duggan seconded the motion. Ayes: 5 Nays: 0 COUNCIL COMMENTS Councilmember Vitelli commented that the Par 3 Golf Course revenues still exceed expenses and the greens fees are up $7,000 over last year; however, recreational programs are down by an equal amount. The administrative costs seem a little high. Almost every piece of equipment has had repairs. Councilmember Petschel commented that she had a discussion with City Engineer John Mazzitello earlier and asked if he could check with MnDOT to see if they could shut down the light on the east end of the bridge deck at 35E North and Highway 110. She feels the light is not necessary and it causes traffic to back up all the way to Dodd Road and beyond during rush hour. Councilmember Povolny stated he really likes the new speed cart and that the money for it was well spent. Councilmember Duggan congratulated all of the graduates in Mendota Heights from both high school and college. Mayor Krebsbach thanked everyone for the activities that took place during the last weekend. CLOSED SESSION TO DISCUSS POTENTIAL ACQUISITION OF REAL PROPERTY AT 2454 LEMAY LAKE ROAD Mayor Krebsbach stated that, pursuant to Minnesota Statute 13.d.03, council would be going into closed session to discuss potential acquisition of real property at 2454 Lemay Lake Road. Rogers Lake Play Equipment Staff recommended replacing the recalled Slalom Glider play feature with the New EVOS Poly Slide offered by Landscape Structures, Inc. (LSI), and take the $2,000 credit for play elements from LSI which can be used towards LSI products, anywhere in our park system. AYES 6: NAYS 0 Rogers Lake Skate Park Mr. Sedlacek updated the commission that the asphalt surface in the skate park had been repaired; staff is continuing to search for competitive bids to resurface the half-pipe. No commission action necessary Capital Improvement Plan Mr. Sedlacek introduced the topic as a follow up to discussions on capital improvements. The commission had previously identified the Rogers Lake Skate Park and the Mendakota Playground for improvement. Mr. Sedlacek introduced Grant Des Roches from Flagship Recreation who was prepared to present findings on potential upgrades to the play structure at Mendakota Park. Mr. Des Roches provided findings in three categories, Hazards, Broken and Non-Conforming. Mr. Des Roches also suggested updates to the structure to enhance the play experience. The cost for all suggested improvements as a retrofit to the existing playground was $70,000. Mr. Des Roches estimated full replacement of the play structure at $120,000. The commission will use this feedback for future discussion. The commission then held a discussion of playground safety inspections; staff was did not know the status of past inspections of the playground system. COMMISSIONER MCGRORY-USSETT MADE A MOTION THAT THE CITY CONDUCT NPSI LEVEL INSPECTIONS OF ALL PARKS STARTING IN MAY OF 2012, AND FOLLOWING UP AS RECOMMENDED IN NPSI STANDARDS. COMMISSIONER KIPP SECONDED THE MOTION. AYES 6: NAYS 0 Parks Celebration Planning The 25th Anniversary for the Mendota Heights Parks Celebration will be held Saturday, June 2, 2012. Publicity includes flyers to all schools, the city web page, Facebook, stories in local papers and on www.patch.com. Parks and recreation commissioners are encouraged to volunteer at the event. No commission action was necessary. Par 3 Update Mr. Sedlacek reviewed the Par 3 Report. Recreation revenues have come in lower than anticipated; other course revenues have been strong compared to 2011. Commissioners sought clarification on the nature of the equipment maintenance. Mr. Sedlacek noted that the Par 3 equipment has been replaced recently with "lightly used" machines. No commission action was necessary. Lexington Avenue Trail Update MH Parks and Recreation Commission 5-8-2012 Page - 2 P14 Mr. Sedlacek provided a summary of city council discussion on the trail gap between Wagon Wheel Trail and Tom Thumb Boulevard. City council has directed staff to improve signage at trail points on Wagon Wheel Trail and Lexington Avenue to bypass the trail gap. The commission discussed other trail concerns such as the gap on Victoria Road between the top of the hill and Highway 13. Mr. Sedlacek reported that the city engineer would be willing to attend a parks and recreation commission in the future meeting to discuss the trail system as a whole. No commission action was necessary Commission Park Visits The cornrnission picked parks for extra visits to check out the park as well as introducing themselves to residents to collect feedback. Commissioners should email their observations to Mr. Sedlacek, who will either act upon issues which need to be corrected, or compile the comments for consideration on a regular basis. Commissioner Toth asked for an update on Rogers Lake. Mr. Sedlacek stated that the upcoming city council agenda would feature two items regarding Rogers Lake. Students from St. Thomas Academy would be present their annual report on water quality, and representatives from the Rogers Lake Homeowner's Association would be making a request for city participation in a weed treatment for the lake. Mr. Sedlacek reported that the Spring Clean Up was a huge success, with over 40,000 tons of materials being diverted from landfills. Approval of the Agenda Commissioner Kipp asked if he could add a new agenda item — Chair Levine acknowledged that Commissioner Kipp's item would follow the Par 3 Update on the agenda. Approval of Minutes Mr. Sedlacek apologized that the minutes from the May 10, 2012 meeting were not available for review. Chair Levine noted that the May minutes would be placed on the July agenda for consideration. Parks Celebration Follow-Up Chair Levine invited commissioners to share their thoughts about the parks celebration, and offer feedback for planning the event in 2013. Events held Friday evening included a concert at market square park and night golf at the Par 3. Events held Saturday included the 5K Run/Walk to benefit Special Olympics at Market Square Park, which 421 individuals participated in, a new record. The Parks Celebration was held at Mendakota Park, with an estimated crowd of 500, the most in recent memory. Events on Sunday included the Police Department Open House, a tour of Pilot Knob and a Ceremony dedicating Civic Center Ball Field as Mertensotto Field at Civic Center. Staff noted several suggestions for the commission to utilize in the planning process for next year's celebration. No commission action was necessary. Skatepark Update Mr. Sedlacek and Chair Levine updated the commission on the ad-hoc meeting with skatepark users which occurred in May. The meeting resulted in a number of simple ideas for changes for MEI Parks and Recreation Commission 6-4-2012 Page - 1 P17 the park, which would fit within the proposed budget. Mr. Sedlacek felt that commission direction had been clear on the issue — quotes would be presented directly to city council for approval. No commission action was necessary. Playground Inspections Update Mr. Sedlacek presented the results of his research into playground safety inspections. Staff plans to research which parks have had comprehensive inspections, and develop a schedule to ensure that all playgrounds are inspected on a timely manner. Inspections will be funded through the Parks Maintenance Budget, no commission action was necessary. Park Visits and Projects Lists Mr. Sedlacek thanked the commission for their emails on park issues. Issues have ranged from downed trees to weeding flower gardens. The idea of a work -day in the parks was considered - seeking out tasks that could be completed by citizens, so that city staff could focus on tasks appropriate for the parks crew. Mr. Sedlacek will discuss this concept with staff for further consideration. There was discussion on the placement of trash cans at Rogers Lake Park — notably along Wagon Wheel Trail near the culvert between the two lakes, and the fishing pier. Mr. Sedlacek reported that a trashcan will be installed at the end of the fishing pier on a trial basis. Staff is keeping an eye on the shoreline along Wagon Wheel Trail to see if litter is better or worse than when trashcans are present, as in past years. No commission action was necessary on these items. Trail Updates Mr. Sedlacek reported that the trail segment on Wagon Wheel Trail, between Lexington Avenue and the bridge over Interstate 35E will be completed soon as requested by the commission at their May 2012 meeting. Chair Levine and Commissioner McGrory -Ussett reported that the north end of the Valley Park Trail remains in terrible condition. The commission asked that the city look into all options for getting paving completed in a timely manner. Par 3 Update Mr. Sedlacek provided preliminary figures on course revenues and expenditures through the end of May 2012. Greens fees are up from past years through May, offsetting recreation revenues which are lower than expected. Mr. Sedlacek also provided an update on course maintenance. The commission asked what time was committed to marketing the course — Mr. Sedlacek replied that our clubhouse manager works approximately 20 hours per week, working the counter at the clubhouse, the manager works on staff scheduling, purchasing, programming and marketing in MH Parks and Recreation Commission 6 -4 -2012 Page - 2 P18 her free time. Mr. Sedlacek is allocated four hours a week for full oversight of the course. It is possible with cost savings on clubhouse salaries this spring can be utilized free up the clubhouse manager to dedicate time towards marketing and promotion. The Swing Into Summer open house at the Par 3 will run from 9:00 a.m. to 12:00 p.m., and will hopefully garner more registrations. No commission action was necessary Turtle Crossings at Wagon Wheel S Curve Commissioner Kipp shared an image of a Blanding Turtle which had been hit by a car on Wagon Wheel Trail near the culvert connecting the two ends of Rogers Lake. Mr. Kipp expressed his concern that the new curbs on Wagon Wheel Trail create "walls" which turtles are unable to climb to exit the roadway. Mr. Sedlacek provided background on the curbing, which has been effective in eliminating parking in the area and making the street safer for citizens. The commission expressed their concern for the situation. Mr. Sedlacek affirmed that signs could be installed, but cautioned that staff would not approve any material placed within the curb. No commission action was necessary. Commission Comments Several commissioners felt the meeting was very productive, and support the idea of have the less formal format for meetings at least once a year. Commissioner Hinderscheid asked if Rogers Lake would be treated for weeds this year — Mr. Sedlacek responded that the association of property owners around the lake made the request to city council. The following commissioners were present: David Sloan, William Dunn, Sally Lorberbaum, Paul Portz, Jim Neuharth, Gina Norling and Gretchen Keenan Absent: Kevin Byrnes Also present: City Administrator Justin Miller Approval of Minutes Sloan pointed out that the word "he" should be added to the last sentence under Commission Items of Interest on the April 11°i minutes. Neuharth moved and Lorberbaum seconded that they be approved as amended — all voted in favor. North of Highway 110 Departure Complaints Sloan shared with the commission that during the spring there was an increase in the amount of complaints about departures leaving the corridor, especially north of Highway 110. He and Councilmember Petschel brought it to the attention of MAC and the FAA and they agreed that there appeared to be a problem. Further, a retired pilot who lives in the city noticed the flights as well and was able to meet with Chad Leqve and Carl Rydeen to go over the issue. According to MAC and the FAA, many of the errant departures were weather based. The commission agreed to keep monitoring the issue through the data analysis and complaint tracker. Joint ARC Meeting Review The commission reviewed the joint ARC meeting held with Eagan and Inver Grove Heights and agreed that it was beneficial. Sloan thought it was a good idea to meet again, but as issues arise. Lorberbaum and Norling both expressed interest in hosting a neighborhood meeting like Eagan does. After discussing the format and timing of such a meeting, Miller agreed to bring some ideas back to the next commission meeting. Commission Items of Interest Sloan stated that at the last NOC meeting they reviewed runway usage numbers as well as a request from a Minneapolis resident to have a mobile noise monitor located near his house. The NOC instead directed staff to draft a set of guidelines for this type of request. Dunn went over the noise monitor reports for towers in Minneapolis locations with a similar distance from the airport as the Mendota Heights towers and pointed out the data. Portz reviewed his experience as a volunteer at the recent crash exercise at the airport. Norling presented data relating to the runway use system and prevailing winds during the months of March and April and noted that the amount of traffic departing Runway 23L did. not look like it matched P20 up with the wind data she presented. She also noticed the apparent reduction in loud noise events at sensor 23, but cautioned about the March numbers as they seemed high. Neuharth explained changes to the amount of data points reflected in the charts and asked that at the next meeting the commission review them to see what improvements can be made. The family of the owner of 2454 Lemay Lake Road approached the city a few months ago about purchasing the property. The city council held a closed session on February 8111 and June 5111 to discuss the property. At the last close session, Council authorized staff to present a purchase agreement for approval. Based on recent comparable sales in the area, staff offered a purchase price of $125,000 with the city paying the pending assessment for street repairs and both parties splitting the closing costs. The family has agreed to this offer. Once this property is acquired, there will be one house remaining in the redevelopment area. When that property is added to the properties already purchased, the city will own a roughly 15 acre parcel that would be marketed for a more suitable use. The area is zoned as B -1 A (Business Park). BUDGET IMPACT Funding for the previous purchases of this nature came from the Pre -1998 Non - Increment Revenue Fund. There is sufficient funding in this account for the purchase if the city council chooses to move forward. Demolition costs would range from $10,000- $15,000, which could also be drawn from the same fund. RECOMMENDATION Staff recommends that the council authorize staff to complete a purchase agreement for the property at 2454 Lemay Lake Road in the amount of $125,000 with the city paying the pending assessment currently on record and with both parties splitting any associated closing costs. Staff further recommends that this purchase agreement be contingent on the Mendota Heights Planning Commission finding that the purchase is in accordance with the city's comprehensive plan. Golf Leagues and Camps registration is down from last year. Clubhouse staff continues to promote programs, which has resulted in a number of registrations submitted in the first week of programming. An increase in walk -up customer revenue has helped to buoy course operations. The clubhouse manager has brought in new concession lines, including sandwiches, pizza and coffee. This is part of an effort to make the clubhouse more welcoming for parents to stay during youth programs, and for all customers to stay after their round of golf. MAINTENANCE UPDATE • Following an early spring with several equipment breakdowns, all equipment is running well. Maintenance staff has been able to focus on regular activities, and have managed to work in aeration of greens and tee boxes. • Maintenance staff has requested one load of sand to fill bunkers which have settled over the winter. o The upper edges of most bunkers have eroded in recent rainstorms, and will need to be re -edged and filled with sand. • The front of the clubhouse which is showing mineral scale buildup from irrigation system overspray has been scrubbed, but will need further attention. BUDGET IMPACT The attached monthly expenditure report shows revenues and expenditures through the end of May. Through the end of May 2012 the course has taken in $45,699 in revenues; expenditures for this period total $45,286. This results in net revenue over expenditure of $413 year to date. The last time the city accepted and reviewed proposals was March 2002. At that time, the city council appointed Johnson-McCann as the city's agent of record for employee benefits. The City solicited proposals through the City's website and League of Minnesota Cities website. Proposals were received at 10:00 a.m. on Thursday, May 17, 2012. The City received proposals from AT Group, Bearence Management Group, Financial Concepts, Inc., Gallagher Benefit Services, Inc., Johnson- McCann (our cun-ent agent), National Insurance, Unison, and Wells Fargo. AT Group, Financial Concepts, Inc. Gallagher Benefit Services, Inc., and Johnson - McCann were selected to move forward to the presentation portion of the process. All four companies represent a significant number of municipalities and offer a variety of services. Each agent /broker provided a short presentation including an introduction and an overview of their proposal for agent/broker of record services to our Insurance Committee. The Insurance Committee included Mike Aschenbrener, Terry Blum, Brian Convery, Justin Miller, Kristen Schaba.cker, and Tamara Schutta. All four companies are professional and knowledgeable in employee insurance benefits and capable of assisting the City of Mendota Heights in managing its employee insurance benefits program. After reviewing the four proposals, City staff is recommending Financial Concepts, Inc. as the City's Agent /Broker of Record for the City's Employee Benefits Program. Founded in 1983, Financial Concepts, Inc. has been providing health and retirement solutions for over 25 years. Financial Concepts represents more than 30 public sector clients. They offer the full range of insurance agent services including: rate negotiation, market analysis, request for proposals, carrier management, enrollment services, problem resolution, and communication of benefits. In addition, they can serve as a consulting firm providing assistance in areas such as COBRA, Flexible Spending Accounts, Health Savings Accounts (HSA's), etc. Financial Concepts, Inc. action plan and timetable for assuming responsibilities will include a benefits audit and systems and administrative review. Their action plan also includes an employee communication and education campaign. Financial Concepts, Inc. will provide financial consulting P32 and support to assist the City of Mendota Heights with development of a strategic benefits plan, including: ® Perform separate analysis of each employee benefit plan to determine efficiency and integration. Review competitiveness of plan positioning, taking into account plan design, employee choice, and both employer and employee costs. • Recommend plan design and financial funding alternatives based on analysis and strategic objectives. ® Assist in preparation of budget projections. • Work with the City of Mendota Heights to establish a renewal strategy encompassing all components of a cost effective, high quality benefit plan for the upcoming and future benefit renewals. BUDGET IMPACT Financial Concepts, Inc. will be compensated through the built in brokerage fees. These fees are part of the city's benefit package. RECOMMENDATION Staff is recommending Financial Concepts, Inc. as the Agent /Broker of Record for the City's Employee Benefits Program. If the City Council concurs in the recommendation, a motion should be made to approve Financial Concepts, Inc. as the Agent /Broker of Record for the City's Employee Benefits Program and authorize the City Administrator to execute the "agent of record" agreement for three years. DATE: June 19, 2012 TO: Mayor, City Council, and City Administrator FROM: Justin Miller, City Administrator SUBJECT: Resolution Approving Data Practices Officials BACKGROUND Minnesota State Statute Chapter 13 regulates the collection, creation, storage, maintenance, dissemination and access to government data in govermnent entities. MN Statute 13.05 requires the goverment entity's Responsible Authority to annually update the city's Data Practices Policy and make any changes necessary to maintain the accuracy of the document. The policy identifies the types of data the city maintains and how each type of data is classified. In addition, the policy provides for written procedures to ensure data requests are received and complied with in an appropriate, permitted and prompt mariner. The city is required to have two officers to administer responsibilities set forth in the act. The required officers are the Responsible Authority and the Compliance Officer, who by state statute can be and often are the same person within a government entity. The Responsible Authority is responsible for collection, use and dissemination of any set of data. The Compliance Officer handles questions or issues with regard to data access. Lorri Smith has recently started her employment with the city as City Clerk, and I recommend that the city council designate her for both the Responsible Authority and the Compliance Officer. Police Chief Mike Aschenbrener will remain the Data Practices Designee, who will handle police department data requests. Many of our pipes are 60 years old and will soon be in need of repair. Cleaning our sewer system on a regular cycle will help extend the life of the pipes. Televising of the system will show where immediate repairs are needed. Lining pipes in need of repair with cured-in-place-pipe will extend the life of our system.. In 2002, $30,000 of damage was reported due to sewer problems. In 2006 there were four sewer backups with insurance claims totaling over $10,000. Due to the city's proactive approach beginning in 2006, payouts resulting from sewer backups totaled less than $500 in 2008. In 2011, the city successfully defended itself again a sanitary sewer backup claim due to the city's proactive approach to sanitary sewer maintenance. We want to continue preventing sewer backups and future damage expenses. The City of Mendota Heights maintains 72.8 miles of sanitary sewer pipe. Currently, Rich Burrows along with one seasonal employee cleans approximately 10 miles of pipe per year. In addition, last year the city contracted with Pipe Services Corporation for cleaning approximately 8.2 miles of the City's sanitary sewer system. and televised approximately 19.3 miles of the City's sanitary sewer system. At our current rate, we are cleaning the syste.m. every 4-6 years The proposed project is for the cleaning of approximately 4.0 miles of the City's sanitary sewer system and televising approximately 11.6 miles of the City's sanitary sewer system. The project area (see attached map) was partially cleaned and televised in 2007. The completion date for the project is October 26, 2012. BUDGET IMPACT The project costs will be funded through the Sanitary Sewer Utility Fund which has sufficient funds to cover the project costs. The 2012 city budget includes $50,000 for sanitary sewer cleaning and televising and $50,000 for sanitary sewer lining. RECOMMENDATION Staff recommends that the council approve the final plans and specifications and authorize staff to solicit quotes. If city council wishes to implement the staff recommendations, pass a motion adopting A RESOLUTION APPROVING FINAL PLANS AND SPECIFICATIONS, AND AUTHORIZING SOLICITATION OF QUOTES FOR THE 2012 SANITARY SEWER CLEANING AND TELEVISING (PROJECT #201204). This action requires a simple majority vote. The majority of calls were classified as false alarms or as good intent calls. Nine of the calls were residential in nature, three calls were commercial alarms, four were EMS calls, one was a Mutual Aid call to South Metro and five were power line /gas leak calls. Monthly Department Training The monthly department training was a ladder drill. The training focused on the proper use of the ground ladders and the aerial device on L -10. Each of the department's apparatus carries at least three different types of ladders ranging in length from 8' to 35'. Monthly Squad Training The squad training for the month focused on maintaining our proficiency with the departments ATV. The department has a six -wheel ATV that can be used for several types of calls and in all types of terrain. Firefighters practiced taking the ATV on and off the trailer, operating it, and using its fire pump. A therapeutic massage enterprise must meet all of the requirements of chapter 12 of this code. An applicant having an establishment within the city must apply for a licen.se for the premises. Each individual who provides massage must obtain an individual license. DISCUSSION Merry Elizabeth Hovey, 2659 Casco Point Road, Wayzata, MN 55391, business owner of Green Lotus Yoga and Healing Center located at 750 Main Street, #100, Mendota Heights, MN.55118 has successfully submitted the required documentation, license fee and investigation fee required per City Code for a massage therapy enterprise license. Patricia Carol West of Green Lotus Yoga and Healing Center, 3270 Alden Pond Lane, Eagan, MN 55121, has successfully submitted the required renewal application, license fee and investigation fee for a massage therapist license required per City Code. Julie Anne Olson also of Green Lotus Yoga and Healing Center, 120 River Woods Lane, Burnsville, MN 55337, has successfully submitted the required documentation and certification hours for a new massage therapist license application along with license fee and investigation fee required per City Code. Council ordered the Lemay Lake Road Neighborhood Improvements at their December 6, 2011 meeting, and directed staff to prepare plans and specifications for this street reconstruction project. Council approved the plans and specifications at their May 15, 2012 meeting. Seven bids (see attached resolution) were received and opened on Wednesday, June 13, 2012, at 10:00 a.m. for the Lemay Lake Road Neighborhood Improvements. One of the seven bidders, Northwest Asphalt, Inc., did not meet the requirements in the project specification for mobilization which states that the lump sum bid price for mobilization shall not exceed 4% of the total base bid. Northwest Asphalt, Inc. m.obilization bid price was 4.5% of the total base bid. Staff recommends summarily rejecting the bid from Northwest Asphalt, Inc. Valley Paving, Inc. submitted the lowest responsible bid of $1,331,170.60. Their bid was less than the Engineer's Estimate of $1,833,957.95. Valley Paving, Inc. is a contractor with many years of experience with an office in Shakopee, Minnesota. Valley. Paving, Inc. has completed projects in Mendota Heights in the past and Staff recommends them for this contract. The substantial completion date for the project is November 9, 2012. I expect that Valley Paving, Inc., serving in the capacity of General Contractor, is capable of meeting the completion dates and installing the proposed improvements in accordance with the plans and specifications given their experience and the amount of equipment and manpower they have at their disposal. Staff will mail out a general notice to the residents about the project after council awards the contract, inclu.ding information regarding the construction schedule. P71 Lemay Lake Road Neighborhood Improvements Project Summary The proposed project includes reconstructing Lemay Lake Road from Mendota Heights Road to Highway 13, Lakeview Avenue, Kendon Lane, Furlong Avenue, and Victory Avenue. Street reconstruction includes construction of storm sewer, concrete curb and gutter, aggregate base, bituminous surfacing, a bituminous trail along Mendota Heights Road from highway 55 to Lemay Lake Road, and hydrant replacement. Street Reconstruction: Lemay Lake Road Lemay Lake Road was constructed in 1994 as a frontage road adjacent to Highway 55. The roadway width currently varies from 36 feet to 40 feet measured from edge of roadway to edge of roadway. Lemay Lake Road has failing bituminous surfaces and is in need of reconstruction. The proposed street width is 34 feet wide face of curb to face of curb, which is generally 2 feet less wide than the existing street. The 34 feet wide street section will allow for parking only on the east side of Lemay Lake Road. The area to be posted as "No Parking" is described as: Lemay Lake Road on the west side from Mendota Heights Road to Highway 13. Stone sewer improvements will consist of adding catch basins and storm sewer pipe which will be connected to a proposed detention pond. Fire hydrants will be upgraded to meet SPRWS standards. Street Reconstruction: Lakeview Avenue, Kendon Avenue, Furlong Avenue, and Victory Avenue Lakeview Avenue, Kendon Avenue, Furlong Avenue and Victory Avenue were reconstructed in 1991. The roadway width is currently 22 feet measured from edge of road to edge of road. The pavement conditions vary along Lakeview Avenue, Kendon Avenue, Furlong Avenue, and Victory Avenue. These streets appear to be near the end of their useful life and are in need of reconstruction. At the public hearing, it was suggested that the residents desired a street width smaller than 28 feet that staff recommended for the street width. After the public hearing, staff sent the neighborhood a questionnaire to identify potential traffic /pedestrian issues, private underground utilities, tree issues and drainage /erosion issues. Based on feedback from the questionnaire, the proposed street width has been revised from 28 feet to 24 feet wide from face of curb to face of curb, which is generally 2 feet wider than the existing streets due to the addition of concrete curb and gutter. Lakeview Avenue, Kendon Avenue, Furlong Avenue will have cul -de -sacs constructed with a 30 foot radius to the face of curb. Storm sewer improvements will consist of adding catch basins and stone sewer pipe which will be connected to proposed dry basin.s. Fire hydrants will be upgraded to meet SPRWS standards. Staff anticipates that there will be additional project costs for work that is not included in this contract, such as hydrant replacement by St. Paul Regional Water Services, signage by others, and easement acquisition. These items were included in the feasibility report and are estimated to cost approximately $111,500. Staff recommends that the council accept the bids and award the construction contract to Valley Paving, Inc. for their bid in the amount of $1,331,170.60. Staff received the following request from MHAA: It is our understanding that the City of Mendota Heights has again set aside $10,000 in its current budget for the Mendota Heights Athletic Association. We rely on these funcls to offset portion of our administrative costs so that a larger percentage of our user fees can be applied 10 the actual cost of a particular .sport. By way of this letter, we are respectfully requesting the following: The $10, 000 set aside in the current budget be paid to the Mendota Heights Athletic Association at your earliest convenience. © That you consider including a like amount of $10,000 in next year's budget. We appreciate the City's willingness to support our organization. We are committed to working closely with the City and its Parks and Recreation Commission to ensure that we continue to provide quality youth athletic programs to the citizens of Mendota. As discussed at the 2012 City Council Goals Work Session, city funding of MHAA. should be met with the same level of accountability for youth safety as any other city recreation program. Amelia Olson, executive director with MHAA, has compiled data as requested on the attached compliance chart, for current sports. Ms. Olson committed to providing seasonal reports to the parks and recreation commission on MI -IAA activities, offerings and concerns. Budget Impact MHAA is requesting $10,000, as included in the 2012 City of Mendota Heights Budget. In order to process this request, White Pine Holdings, LLC needed to provide evidence of financial qualification to complete the project. Staff has attached a letter from Minnwest Bank, M.V., affirming the creditworthiness of Charles Rothstein, principal owner of White Pine Senior Living and White Pine Holdings, LLC, to complete the development of .Lot 6, Mendota Plaza Redevelopment.
