Held Tuesday, January 3, 2012
Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights,
Minnesota.
CALL TO ORDER
Mayor Krebsbach called the meeting to order at 7:00 p.m. The following members were present:
Councilmembers Duggan, Povolny, Petschel and Vitelli.

B) ACKNOWLEDGEMENT OF THE OUTDOOR WARNING SIREN
REPLACEMENT AND UPGRADE UPDATE
Councilmember Duggan pulled this item to find out the total cost involved and to find out whether it has
being budgeted for in 2012 or taken from 2011 budgeted dollars.
Mayor Krebsbach commented that the memo states that fifty percent of the cost of narrow banding the
siren radio is covered by Urban Area Security grant money from the Federal Department of Homeland
Security Grant.
Chief of Police Michael Aschenbrener replied that ninety -five percent of the work has been completed
and was taken from the 2011 budget; approximately $3,200 worth of work is still left to be done on the
two old sirens and those funds will be taken from the 2012 budget. The three new sirens have been
installed. The siren was removed from the roof of the fire station and placed on a new pole.
The total cost of the project is $77,085.64 plus taxes.
Councilmember Duggan moved to approve the recommendation to finish the purchasing of the sirens.

Mayor Krebsbach explained that Mr. Hugo Blackfelner was a Mendota Heights Police Officer for
twenty -five years. The letter received from Mr. and Mrs. Blackfelner stated that they `appreciate the
dedication and commitment of everyone in the department'.
Councilmember Duggan moved to accept the gift of $250 from Hugo and Susan Blackfelner.

F) ADOPTION OF, "RESOLUTION ADOPTING DATA PRACTICES POLICY
AND APPOINTING DATA PRACTICE COMPLIANCE OFFICIALS"
City Clerk Sandie Thone explained that, by state statute, the Data Practices Policy must be reviewed
annually by staff to ensure that it complies with any of the changes that have been made during the year.
The policy has been reviewed, there were no changes necessary this year, and the city's data practices
policy complies with state statutes. This is the same policy the city has had for the past few years.
There are no changes in the compliance officials from 2011.
Mayor Krebsbach explained that City Clerk Sandie Thone is the Data Practices Policy Responsible
Authority and Compliance Officer, and Police Chief Michael Aschenbrener is the Data Practices
Designee. The policy is to protect the privacy, use and dissemination of data.
Councilmember Duggan highlighted changes that he suggested be made to the wording in the policy
document. A brief discussion was had concerning minor changes to the document.
Councilmember Duggan moved adoption of, "RESOLUTION ADOPTING DATA PRACTICES
POLICY AND APPOINTING DATA PRACTICE COMPLIANCE OFFICIALS" with the
proposed amendments.

K) APPROVAL OF THE 2012 TEAMSTERS LOCAL #320 CONTRACT
Councilmember Duggan expressed his desire to make suggested changes to any future contracts to bring
them up to modem terminology. Mayor Krebsbach explained that there is a labor agreement before the
council that Councilmembers had an opportunity to comment on and respond to in closed sessions, and
now have an agreement that has been approved by the employees through their bargaining unit, the
Teamsters, and anything that is desired for the future should be part of goal setting sessions and this
contract will not be discussed at this time.
Councilmember Vitelli moved approval of the 2012 Teamsters Local #320 Contract.

B) ACKNOWLEDGEMENT OF RETIRING
AND NEW PROBATIONARY FIREFIGHTERS
Fire Chief John Maczko recognized the following retiring firefighters:
Paul Kaiser retired in August of 2011 after twenty -six years as the Fire Marshal for the city
Roy Kinglsey retired December 12, 2011 after twenty -one years of service. Mr. Kinglsey served the
department as a Captain for eleven years, then became the Assistant Training Officer, and in January
2010 was appointed Training Officer. He also served as fire investigator and fire prevention officer.
Fire Chief Maczko introduced three new probationary firefighters: Kevin Gilbert, Barry Sommervold,
and Dan Willems.

A) PLANNING CASE 2011 -33: CRITICAL AREA PERMIT
1665 LEXINGTON AVENUE, AND ADOPTION OF,
"RESOLUTION APPROVING A CRITICAL AREA PERMIT
FOR LANDSCAPING AT 1665 LEXINGTON AVENUE"
Assistant to the City Administrator Jake Sedlacek explained that there is a clause in the city code that
allows planning cases to be brought directly to the council if it is a case that is minor in nature. Staff has
discussed this planning case with the applicant and found both their work to be minor and to be of an
urgent nature because the work described in the application needs to occur when the soil conditions are
cold.
Mr. Sedlacek then described the details of the requested critical area permit and the application process
steps that have taken place. Staff reviewed the application and found it to be an improvement to storm
water management in the critical area, a minor impact to the critical area, and recommended approval.

B) APPOINTMENT OF ACTING MAYOR FOR 2012
Mayor Krebsbach has asked Councilmember Vitelli if he would continue as the Acting Mayor for 2012.
Councilmember Duggan moved approval of Appointment of Councilmember Jack Vitelli as Acting
Mayor for 2012.

C) APPROVAL OF THE 2012 -2016 SANITARY SEWER
IMPROVEMENT AND MAINTENANCE PLAN
Public Works Director John Mazzitello explained that this is the next step in the evolution of the city's
planning for infrastructure improvements. This is a five -year outlook for maintenance projects for the
sanitary sewer system. He then introduced Assistant City Engineer Ryan Ruzek to give some technical
overview about the plan and how staff came up with it.

Mr. Ruzek explained:
• That the Sanitary Sewer Improvement and Maintenance Plan (SSIMP) forecasts the needs of
the city over a five -year period
• The SSIMP is based on city adopted long range plans, goals, and policies
• The plan will be updated annually to ensure consistency and reflect the changing demands
and financial resources
• The goals of the SSIMP
— Provide a balanced program for sanitary sewer improvements
— Enable the City of Mendota Heights City Council to evaluate the needs of the entire city
objectively
— Anticipate needed sanitary sewer improvements before they become critical
— Provide a plan for sanitary sewer improvements that can be used in preparing the budget
in the coming fiscal year
The City of Mendota Heights Sanitary Sewer Collection Systems consists of:
• 73.1 miles of gravity sewers
• 1.3 miles of pressure sewers or forcemains
• 1,906 sanitary manholes
• 6 lift stations
Mr. Ruzek then gave project details for extending the life of the sewer, which included:
• Cleaning and televising, which is the first step
• Rehabilitation
— Install synthetic liner; said to increase the life of the pipe by 100 years
Mr. Ruzek stated that the projects are funded through the sanitary sewer utility fund and shared
anticipated project costs for:
• Annual sewer cleaning and televising
• Sewer lining projects
• Lift station rehabilitations
• Replacing a portion of the city trunk line
• Monitor the forcemain on Mendota Heights Road for breaks
Mr. Ruzek gave a brief overview of the Sanitary Sewer Utility Fund report.
Councilmembers asked questions regarding challenges from restaurant grease in the sanitary sewer
system, timeline for replacing the water main in Friendly Hills and the possibility of moving that project
up, assumptions made in the plan as far as increase in costs from Met Council, and sewer lining.
Councilmember Vitelli specifically questioned whether the cost increases projected for Met Council
were reasonably accurate.
Mayor Krebsbach asked Mr. Mazzitello to explain the rate increases that are included in the SSIMP and
where they are coming from. Mr. Mazzitello replied that the rate increase that was approved at the last
council meeting was a ten percent increase to cover the past two years of increases in Met Council costs.
Those increases were approximately two percent for 2011 and approximately eight percent for 2012.
The rate increase was for both years because the city did not have a rate increase at the end of 2010 for

the 2011 calendar year. Based on projected cost increases, assuming three percent for MCES and two
percent for city costs, the projected five percent annual increase is intended to cover those two increases.
These figures are for budgeting and forecasting purposes only and do not obligate the council to do
anything with regard to rates or any other revenue gathering from the residents. Staff would need to
come to council at the end of each year to adopt a resolution to increase the sanitary sewer rates for the
coming year.
Additional discussions followed as to why this is a five -year plan as opposed to a two -year plan; that the
plan is solid for 2012 and 2013; and that the 2014, 2015, and 2016 plans are flexible and dependent on
results from the annual sewer cleaning and televising projects, Met Council plans, available funding, and
other unknown factors.
Mayor Krebsbach suggested that the council acknowledge and accept the Sanitary Sewer Improvement
and Maintenance Plan report versus approving the plan itself and then get back into it on an annual
basis.
Mr. Mazzitello replied that the 2012 program is budgeted in the 2012 budget. So by acknowledging the
report now, staff moves forward with the 2012 program. The ideal timeframe is to bring this back at the
end of 2012 with the street plan — two chapters to the same document. The next step in this process will
be to develop a third plan, whether that be storm sewer, trails, water main — there will be another chapter
until staff has built the entire Infrastructure Five -Year Outlook Plan for the city.

D) MINNESOTA INVESTMENT FUND REQUEST
(DISCUSSION ITEM)
City Administrator Justin Miller explained that the Minnesota Investment Fund (MIF) awards grants to
local cities that provide loans to assist expanding businesses. All projects must meet minimum criteria
for private investment, number of jobs created or retained, and wages paid. There is a maximum of
$500,000 per grant and then the city would be able to keep part of those funds as an administrative fee.
Greater MSP, the new metro -wide economic development entity, has been in touch with an area
company that is looking to expand and who has identified an empty building in Mendota Heights.
Greater MSP approached staff in regards to participating in a Minnesota Investment Fund request.
Obviously there would be staff time and constraints to take into consideration, as well as on going
monitoring of that loan; however, the loan is negotiated between the city and the company but the
contract is between the state and the company.
As this is something new to the city, staff is looking for council input and comments.

Mayor Krebsbach had made the suggestion to City Administrator Miller that this be introduced to the
council and that further discussion could be had at the goal- setting session if council wished to pursue
this because it would affect staffing, what company or building might be the greatest benefit to the city,
what is the benefit to the city in doing this, etc.
Councilmember Duggan asked that staff do some research and come back to the council with examples
of where this has been done in other communities to ascertain what the success rate may be. He also
requested a history of the building in question — current tax, size, previous uses, etc. He would also like
information about the company that would like to move in and what their proposed use would be for the
building.
Councilmember Povolny asked if the city is on the hook if the loan goes bad. City Administrator Miller
replied that the information he received said that the state would ask the city to make due diligence to try
to collect on that loan but that it would not be a liability of the city; it would be a liability of the state.
Councilmember Petschel expressed her desire that when staff researches examples of where this has
been done in other communities, they find out how much staff time is involved and if the money they
were able to claim as an administrative fee truly does cover the cost of that staff time.
Councilmember Vitelli expressed his concerns and stated he would not support this program because of
the level of bureaucracy involved; Housing and Urban Development, the federal government, small city
development, federal funds, and State of Minnesota employees. Also, the city is the one who needs to
negotiate between the city and the business so that it is acceptable for some bureaucrat at the state; and
then if it goes bad the city is expected to make collection efforts. Councilmember Vitelli voiced his
concern about the staff time involved and questioned who on staff had the time to take this on.
Councilmembers Duggan and Vitelli expressed their desire to know what company has a desire to
expand into Mendota Heights and maybe there is some other way the city could assist with that.
City Administrator Miller explained that there is no action necessary by the council at this time. Staff
now has a clear sense of the concerns council has raised and there is more due diligence that needs to be
done. Should this start to look like something that council might want to consider, it will be brought
back for future consideration.
COUNCIL COMMENTS
Councilmember Povolny stated that he is happy to be on the council for a second year.
Councilmember Petschel commented that she was happy to read that the fashion expert at the St. Paul
Pioneer Press identified five businesses that have appeared on the metro area scene within the last year,
that have been unique and very successful, included Roe Wolfe. Roe Wolfe is located in Mendota
Heights Village along with several nice boutique type stores.

Mayor Krebsbach commented that there is a great article in the Minneapolis paper about a resident of
Mendota Heights who was a corporate executive and is now a yoga instructor at Core Power in St. Paul.
She also commented that Green Lotus Yoga has opened and is located in the Mendota Heights Village.

SYNOPSIS
Fire Calls
December 2011
The department responded to 19 calls for the month. The majority of calls were
classified as false alarms or as good intent calls. Six calls were residential in nature and
three were commercial in nature. The balance of the calls were; three grass fires, three
EMS calls, one mutual aid to Inver Grove Heights and three auto accidents with injuries.
One of the accidents required the department to extricate the driver of the vehicle with
our rescue tools.
Monthly Department Training
The members of the department were honored to have Jerry Rosendahl, Minnesota State
Fire Marshal, speak at the department drill. Jerry covered a broad range of topics related
to life safety initiatives, educational opportunities and legislative updates.
Monthly Squad Training
The monthly squad training was our annual training called Captain's Choice. This
training allows the Squad Captains a chance to address any training needs that they feel
their squad needs additional training on or address training requests they may have
received by members of their squad. Some captains also use this training as an
opportunity to review key trainings that we have done through the year.

number of rounds played, but significant maintenance costs occurred in October and November.

Operations Update
Maintenance expenses in the months of October and November included a number of tasks:
® Fairways and tee -boxes were aerified and top- seeded for the first time in over six years.
® Considerable time was required to fight grubs which invaded many metropolitan area golf
courses, forcing some clubs to close a portion of their courses.
® Our golf cart for rentals received a thorough reworking, as staff sought out and repaired an
electrical malfunction.
® Trimming of trees which fell on a private property on Evergreen Knolls.
® Installing stations to lock rental golf carts near clubhouse.
Clubhouse Update
• Staff has reviewed program offerings for the 2012 season, including programs with the City
of Eagan.
® The Cherokee Golf League hosted a tournament at the Par 3 on New Year's Eve.
• The greens committee is scheduled to meet Wednesday, January 11, and will have a full
agenda of promotions to discuss.

Purchase of Large Format Plotter /Scanner for Engineering Department
Discussion
The engineering department would like to upgrade the current plotter used for creating maps
larger than 11 "x17'. Included in the purchase is a large format scanner capable of scanning
documents up to 40" wide. The existing plotter and large format copy machine have been
discontinued and would be traded in for $100.00. With the city committing to going paperless, a
large format scanner will be necessary for creating digital copies of old construction plans. The
plotter and scanner both will have capabilities of scanning and reproducing black & white and
color drawings.
Staff researched equipment from both Cannon and Hewlett Packard. The quality and speed of
both manufacturers equipment met the goals required by the city and staff recommends going
with the Cannon as they were the cheaper of the two. The model selected is the Cannon
iPF750MFP with 40" color scanner.

DISCUSSION
The Mendota Heights Personnel Code provides two floating holidays each year to non -union
employees. The code states that the City Council, upon recommendation of the City
Administrator, may designate one of the floating holidays as a fixed date when city offices will
be closed. Over the past several years, the City Council has designated the Friday after
Thanksgiving as a floating holiday for non -union staff
Please take note that the Christmas holiday is Tuesday, December 25, 2012. Traditionally several
employees have taken a vacation day for Christmas Eve day. Staff anticipates a number of
employees will be requesting Monday, December 24, 2012, leaving a very limited number of
non -union employees covering the responsibilities of city hall. The City Council may want to
consider designating the second floating holiday for Monday, December 24, 2012.
RECOMMENDED ACTION
As provided for in the Mendota Heights Personnel Code, staff recommends that the City Council
designate Friday, November 23, 2012 as a floating holiday for non -union staff. It is
recommended that City Council also consider designating Monday, December 24, 2012 as the
second floating holiday.
ACTION REQUIRED

SUBJECT: 2012 Pay Equity Implementation Report for 2011 Compliance
DISCUSSION
Local Government Pay Equity Act, M.S. 471.991 - 471.999 and Minnesota Rules, Chapter
3920 requires local jurisdictions to submit a pay equity report to the State of Minnesota
every three years. The law requires each local government to analyze its pay structure for
evidence of inequities and to report this information to the Department of Employee
Relations.
Compensation programs have three parts:
• Pay level — the level an employer pays in comparison to other employees;
• Pay structure — the relationships among jobs in an organization; and
® Pay method — the set of policies and procedures for paying individual employees.
Pay equity is designed to address the problem of a wage structure in which there is one
pay pattern for jobs performed mostly by men and another pay pattern for jobs performed
mostly by women. Pay equity affects pay structure, not pay level or pay method. An
employer can still have a pay level that is different than other employers. The city can
still pay more to recognize individual's seniority and performance.
The attached report will be submitted to the Department of Employee Relations upon
Council approval. The city's report is due to be submitted by January 31, 2012. This
report shows data in place as of December 31, 2011.
The city has been using the "Control Data" job evaluation system since 1986. Over the
last several years, the city has worked with Ms. Ann Antonsen, Springsted Inc. to review
and assign job classification points using the "Control Data" job evaluation system. Job
classifications are assigned points based on "Benchmark Job Values" under this system.
The City of Mendota Heights Employee Position Placement and Pay Classification Plan
was also taken into consideration when assigning job points.
We are in compliance on this report. The statistical analysis test is an underpayment ratio
of 86.27 %. The minimum requirement to pass the statistical analysis test is an
underpayment ratio of 80 %. The T -Test results are used only if the city had an
underpayment ratio below 80 %. The salary range test must be either 0% or 80% or more
to pass this test. The city's salary range test is 100 %. The exceptional service pay test
must be either 0% or 80% or more to pass this test. The city's results were 0 %.
City Council is required to approve the Pay Equity Report and the Mayor is to sign it.
RECOMMENDATION
Since the 2011 Pay Equity Implementation Report must be approved by Council and
signed by the Mayor, staff recommends that the Council approve the Report so that it can
be sent into the Department of Employee Relations before January 31, 2012.
ACTION REQUIRED
If the City Council approves the 2011 Pay Equity Implementation Report, a motion
should be made to approve the report. A simple majority vote is all that is needed on this
issue.

DISCUSSION
The City of Mendota Heights is a member of the SW /WC Service Cooperative for group
health benefits plans. Through SW /WC Service Cooperative, the city makes available a
high deductible health plan combined with health reimbursement arrangement to
employees. By providing this plan, it provides more control over health care decisions to
plan participants.
The SW /WC Service Cooperative's Joint Powers Agreement includes a provision to
promote the utilization of the high deductible plan by making limited program funds
available to its members. The CCOGA Unit Incentive grant is to be used for the exclusive
purpose of assisting in funding health reimbursement arrangements for first -time
enrollees in the high deductible health plan.
The grant provides for a $350 contribution for employees enrolled in the single high
deductible plan and $750 for employees enrolled in the family high deductible plan. The
city can apply each year for the one -time grant on behalf of the first time enrollees in
high deductible plans. Once an employee receives the CCOGA Unit Incentive grant, they
are no longer eligible to receive the grant.
HR Coordinator was recently was made aware of this opportunity to apply for the grant
on behalf of employees enrolled in the city's high deductible health plan. Because the
city had never applied for the grant in the past, SW /WC Service Cooperative provided the
opportunity to apply for the grant on behalf of employees currently enrolled in the high
deductible health plan. The city currently has five employees enrolled in the single plan
and eight employees enrolled in the family plan.
The city was notified this week that we were awarded the CCOGA Unit Incentive grant
in the amount of $7,750 for employees currently enrolled high deductible health plans.
The grant is to be deposited into each of the employees' health savings accounts.
RECOMMENDATION
Staff recommends City Council acknowledge receipt of the CCOGA Unit Incentive grant
of $7,750.00. The grant is to be deposited into each of the employees' health savings
accounts. Employees currently enrolled in the high deductible single plan will receive
$350. Employees enrolled in high deductible family plan will receive $750.
ACTION REQUIRED
If the City Council acknowledges receipt of $7,750.00 CCOGA Unit Incentive grant, a
motion should be made to approve receipt of the funds to be used to assist in funding
health reimbursement arrangements for employees enrolled in the high deductible health

2012 Revised Fee Schedule
SUMMARY
Staff has reviewed the current schedule of fees adopted in February of 2011 and revised on
August 2, 2011. It is necessary to continually review and keep relevant the city's fee schedule
regarding services the city provides. Please find the proposed 2012 Revised Fee Schedule
prepared with input from staff reflecting the most current new and updated city licensing, permit
fees and service costs.
BACKGROUND
The fee schedule revisions and additions being proposed reflect the following changes from the
adopted 2011 Fee Schedule. Completely new or deleted items for 2012 include the following:
4• Rental License Fees
City council recommended that staff look into creating a rental license fee for single family
dwellings presently being licensed through the city's rental licensing process. Staff conducted a
survey of what other cities were charging for similar licenses and what services the respective
rental fees covered. Staff surveyed nine cities with rental licensing fees ranging from $25 to
over $300 depending on the services such as inspections and the number of units in the rental
property. In addition staff performed an assessment of the actual staff time and costs involved in
issuing the licenses internally. Staff has recommended that a license fee of $75 would cover our
costs and services in issuing the permits and would be fair and reasonable to the property
owners. This license fee is included in the 2012 fee schedule attached.
Dog Licensing Fees
Tr' February of 2011 city council passed an ordinance amending the dog licensing code and the
associated fees were updated and approved and adopted in the city's 2011 Schedule of Fees by
council on February 1, 2011. One of the changes in code allowed a new licensing period of
January 1 through December 31 each year. Residents were notified and the former June through
May licensing period was extended to accommodate the updated licensing period and 2011
licenses remained valid until December 31, 2011. The new fees although approved last year are
new to the schedule and are applicable for the year of 2012, effective January 1, 2012. It should
be noted the transition went very smoothly and was successful on all accounts.
Solicitor License Fees
On July 5, 2011 city council adopted Ordinance 436 Repealing and Restating Title 3, Chapter 3
of the City Code Pertaining to Peddlers, Solicitors /Canvassers and Transient Merchants.
Pursuant to the updated City Code there is no longer a licensing process for this activity. Those
required per the code to register do not pay a fee and do not receive a license. In addition, the
process has been re- located from the police department to the city clerk's office for
administration and compliance. Therefore all references to solicitor licensing fees in both
departments have been removed from the 2012 City Fee Schedule.
Park Dedication Fees
Although the park dedication fees are not new for the city and remain unaltered from previous
fees for the year 2012, they have not been included in prior year's fee schedules and have been
added to the 2012 Fee Schedule. Park dedication fees are paid by the developer /owner of lots
that have been newly created, including lot splits and developments. All park dedication fees go
into the special park fund and are utilized for improvements made to the parks and trails system.
Maps, Plans and Drawing Fees
In review of the 2011 fee schedule engineering staff found the maps /plans and drawings section
redundant and confusing. Therefore city costs were averaged and for the most part remain the
same but the format of the schedule for maps, plans and drawings is more easily understood.
BUDGET IMPACT
Conservative estimates on dog licensing fees will increase revenues in 2012 by approximately
$900 which will cover staff time and supplies with regard to the dog tags and license processing.
In 2011 thirty -four rental licenses were issued by the City of Mendota Heights for single - family
dwellings. If the number of licenses remains relatively the same the revenues for rental licensing
realized in year 2013 (the rental licensing process runs from January through December) would
be approximately $2550 which would help to cover the costs for staff time in issuing the
licenses. The process for 2012 has been completed.
RECOMMENDATION
Staff recommends the city council make a motion to adopt the attached Resolution 2012 -07

Citizen - Assisted Lake Monitoring Program (CAMP) 2010 Results
Discussion
For the past several years the City of Mendota Heights has participated in a program where area
residents and /or City staff take water samples from area lakes, send them to a lab for analysis,
and have the results sent to the Metropolitan Council for their records and pollutant tracking
programs. The Citizen - Assisted Lake Monitoring Program (CAMP) is an economical way to
broaden the water quality database for lakes within the Twin Cities Metropolitan Area.
Mendota Heights has participated in the CAMP by providing monitoring at Rogers and Le May
Lakes. Staff proposes to keep the same two lakes in the monitoring program in 2012.
The CAMP test each water body for total phosphorus, sodium chloride, and total chlorophyll -a.
In addition, volunteers measure the water clarity (turbidity), and surface water temperature. They
also fill out a data fowl that details the weather conditions at the time of the sampling.
Attached are the results from the 2010 monitoring year. Lemay Lake received a B as an overall
grade. Since 2007 the water quality within Lemay Lake has shown signs of improvement.
Rogers Lake has been tested since 2007 as well but is showing signs of deteriorating water
quality.

LeMay Lake (19 -0082) Gun Club Lake Watershed Management Organization
LeMay Lake is located in the City of Mendota Heights. It has a surface area of 34 acres and an average
depth of 1.6 m (5.1 ft). The maximum depth is 4.0 m (13 ft). The entire lake is considered littoral zone,
which is the shallow 0 —15 feet depth zone that is typically dominated by aquatic plants. Since the lake is
relatively shallow, it does not maintain a thermocline, which is a density gradient caused by changing
water temperatures throughout the water column.
On each sampling day the lake was monitored for total phosphorus (TP), chlorophyll -a (CLA), total
kjeldahl nitrogen (TKN), and secchi transparency, as well as the lake's perceived physical condition and
recreational suitability. The resulting data are summarized in tables and figures on the following page.

potential water quality trends.
The water clarity grade of C does not correlate well with the chlorophyll -a grade of A. A possible
explanation may be that the water clarity may be affected by higher levels of total suspended solids from
surface runoff from the surrounding urbanized watershed. It is possible for higher suspend solids loadings
to decrease water clarity which would decrease light penetration thereby inhibiting algal growth.

SUBJECT: Accepting Bids and Awarding Contract for the Roof Replacement at Public
Works
Discussion
The Public Works Department moved into the current facility off Lexington Avenue in June of
1979. The original roof was covered with a ballasted EPDM Roof in 1993. The roof has
developed several leaks and reports from two roofing inspectors have identified potential major
structural issues if the roof is not replaced. One major concern is water seeping into the block
walls which can freeze causing potential wall failures. The other concern is having the weight of
the double layer of roofing which was not included in the structural design of the building. ,
Council authorized staff to advertise for bids at their October 18, 2011 meeting. Four bids (see
attached resolution) were received and opened on Wednesday December 14, 2011 for the roof
replacement at public works facility. Les Jones Roofing, Inc. submitted the low bid of
$147,173.00. Their bid was lower than the Engineer's Estimate of $175,000.00.
Les Jones Roofing, Inc. installed the roof at city hall as well as other projects throughout the city.
Staff is confident Les Jones Roofing Inc. will be able to complete the project within the
parameters set forth in the specifications.
Project Financing
Staff proposes the roof replacement be paid for through the General fund.
Recommendation
I recommend that Council accept the bids and award the contract to Les Jones Roofing, Inc. for
their bid in the amount of $147,173.00.
Action Required
If City Council wishes to implement the recommendation, pass a motion adopting Resolution
No. 2012 -, A RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR

WHEREAS, pursuant to an advertisement for bids for the proposed roof replacement at
Mendota Heights public works facility, 2431 Lexington Ave S, bids were received, opened and
tabulated according to law and the following bids were received complying with said
advertisement:

1. That the bids for the above project are hereby received and accepted.
2. That the bid of Les Jones Roofing, Inc. of Bloomington, Minnesota, submitted for
the roof replacement at public works project be and the same is hereby accepted.
3. That the contract be awarded to Les Jones Roofmg, Inc. of Bloomington,
Minnesota, and that the Mayor and Clerk are hereby authorized and directed to
execute and deliver any and all contracts and documents necessary to
consummate the awarding of said bids.

SUBJECT: CEC Food and Beverage, LLC/Le Cordon Bleu Liquor License
INTRODUCTION
Pursuant to Mendota Heights City Code Section 3, Chapter 1, no person except wholesalers and
manufacturers to the extent authorized by law, shall directly or indirectly deal in, sell, or dispose
of by gift, sale or otherwise, or keep or offer for sale, any intoxicating liquor, wine or 3.2 percent
malt liquor within the city without first having received a license to do so under this chapter.
Public hearings have been scheduled for Tuesday evening, January 17, 2012 and Wednesday
evening, February 8, 2012 for an on -sale wine institutional license and an on -sale 3.2 inalt liquor
license for CEC Food and Beverage, LLC/Le Cordon Bleu located at 1315 Mendota Heights
Road, Mendota Heights, MN 55120. A public hearing notice was published in the city's legal
newspaper for the first of two public hearings required for a new liquor license.
DISCUSSION
Applications for an on -sale 3.2 percent malt liquor and an on -sale wine institutional license have
been received from CEC Food and Beverage, LLC /Le Cordon Bleu. CEC Food and Beverage,
LLC has acquired Le Cordon Bleu located at 1315 Mendota Heights Road, Mendota Heights,
MN 55120. Per Mendota Heights City Code and the Minnesota Department of Public Safety,
Alcohol and Gambling Enforcement Division the change of ownership of a licensed
establishment require a new liquor license.
CEC Food and Beverage, LLC/Le Cordon Bleu has successfully submitted all of the materials
and fees required per Mendota Heights City Code and in compliance with the Minnesota
Department of Public Safety, Alcohol and Gambling Enforcement Division for an on -sale wine
institutional and an on -sale 3.2 percent malt liquor license for Le Cordon Bleu located at 1315
Mendota Heights Road. The documentation was found to be complete and in order. The
Mendota Heights Police Department conducted a background investigation as required by
Ordinance 366, Section 7, with favorable results. Per City Code, Section 3 -1 -7 E all new liquor
license applications shall not be approved before the next regular meeting of the city council
following such hearing. This public hearing will be considered the preliminary public hearing
for approval of an on -sale wine institutional and an on -sale 3.2 percent malt liquor license for
CEC Food and Beverage, LLC/Le Cordon Bleu located at 1315 Mendota Heights Road, Mendota
Heights, MN 55120.
RECOMMENDED ACTION
Staff recommends that the city council conduct the preliminary public hearing, consider
comments from the audience and continue the hearing to February 8, 2012.

Commission Appointments
Discussion
The city council held interviews on Tuesday, January 10, 2012 to select appointees for two
advisory commissions and two watershed management organizations. There were a total of
seven applicants for seven open positions. The attached resolution details the results of these
interviews.
Recommendation
Following interviews, the city council recommended the appointment of citizens to advisory
commission and watershed management organizations.

If city council wishes to implement the recommendation, pass a motion adopting A
