Res 2012-106 Approve Variance 2030 Dodd Rd LED SIgnCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2012 -106 A RESOLUTION APPROVING A VARIANCE FOR AN ELECTRONIC SIGN DISPLAY AT 2030 DODD ROAD WHEREAS, Sean Hoffman, on behalf of Mendota Heights BP, has applied for a variance to install LED gas prices on a new monument sign at 2030 Dodd Road (PID 27- 02500 -50 -020, Section 25, Twn 28, Range 23, PT OF W 1/2 OF NW 1/4 OF SW 1/4 COM ON CEN TH # 49 275 FT SW OF ITS INT WITH TH # 100 SE AT 90D 143 FT SW AT 90D 117 FT NW 149.29 FT TO CEN TH # 49 NE ON CEN 159.9 FT TO BEG SUBJ TO TH #49) as proposed in planning case 2012 -32; and WHEREAS, the Planning Commission held a public hearing on this matter at their regular meeting November 27, 2012. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that a variance as proposed in planning case 2012 -32 is hereby approved with the following findings of fact: 1. The property is unique in that numerous properties rely on changeable copy messages. 2. The practical difficulties noted by the applicant relate to the operational factors of the business, rather than the property. 3. The alternative sign technology is necessary to make reasonable use of the property. 4. The zoning ordinance permits changeable copy signs, but not the proposed technology, and as such changeable copy signs are not prohibited. 5. Although the sign would be to the proposed site under this application, approval could lead to a precedent in considering similar applications in the area.
