Regular meetings of the City Council are cablecast on NDC4/Town Square Television Cable Channel 18/HD798 and online at TownSquare.TV/Webstreaming Page 2 of 109 August 13, 2025, Mendota Heights City Council Work Session Minutes Page - 1 6.a CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA DRAFT Minutes of the City Council Work Session Tuesday, August 13, 2025 Pursuant to due call and notice thereof, a work session of the Mendota Heights City Council was held at Mendota Heights City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. CALL TO ORDER Mayor Levine called the work session to order at 4:30 p.m. Councilors Lorberbaum, Mazzitello and Paper were in attendance. Councilor Maczko was absent. Others present included: City Administrator Cheryl Jacobson, Assistant City Administrator Kelly Torkelson, Finance Director Kristen Schabacker, Public Works Director Ryan Ruzek, Assistant City Engineer Lucas Ritchie, Community Development Manager Sarah Madden, Park and Recreation Director/Assistant Public Works Director Meredith Lawrence, and City Clerk Nancy Bauer. FY 2026 PROPOSED BUDGET REVIEW City Administrator Jacobson began with a review of the Administration budget, noting a 6.61% increase in the budget from 2025. The increase reflects investments in staff and core operations. Councilor Lorberbaum asked about city hall rent. Finance Director Schabacker responded that it was for the various departments to pay into the city hall fund to help cover the costs of utilities, maintenance, etc., for city hall. Mayor Levine asked about the auditor costs and whether it was time to go out for an RFP. Finance Director Schabacker responded that the increase for auditing services included the cost for the actuarial company for one of the footnotes of the audit. She added that it would be up to the council if an RFP was requested. Mayor Levine asked about the salary reclassifications for administration. City Administrator Jacobson responded that there were two positions in administration that were proposed to be reclassified. City Administrator Jacobson noted the IT budget is down from 2025. Assistant City Administrator Torkelson added that some projects were deferred for 2026, and hardware upgrades occur on a cyclical schedule. Page 3 of 109 August 13, 2025, Mendota Heights City Council Work Session Minutes Page - 2 Councilor Lorberbaum asked when new computers were purchased. Assistant City Administrator Torkelson responded that computers are on a five-year replacement schedule. City Administrator Jacobson stated that the proposed City Hall budget is down nearly 19%, with no major changes to the budget for 2026. City Administrator Jacobson reported a 15.31% proposed increase in the Community Development budget, including funds for the 2025 Comprehensive Plan update and increased code enforcement prosecutions. Community Development Manager Madden noted the Comp Plan update will take at least three years. Councilor Paper asked about a consultant, and Community Development Manager Madden said that it will be decided in 2026. Councilor Paper asked about the cost of the large packets produced that had gone out recently and if the costs were recovered with application fees or through the required escrow. Community Development Manager Madden stated that the fees will be revisited when reviewing the fee schedule. City Administrator Jacobson stated that Council could move towards electronic packets as part of an efficiency and sustainability effort. Councilor Mazzitello offered to switch to electronic packets when staff were ready to move forward. City Administrator Jacobson stated that the proposed building official budget had a minimal increase and covered contracted inspection services through Inspectron. Councilor Mazzitello asked how the contracted inspection services were going. Community Development Manager Madden responded that she has had very few complaints. City Administrator Jacobson stated that Engineering is proposing a 5.41% increase and highlighted the request for asset management software. Assistant City Engineer Ritchie provided background on the proposed asset management software, noting that the system would be utilized by multiple departments. Public Works Director Ruzek reported on the budget request to replace a 2013 F-150 within the Engineering Department. City Administrator Jacobson stated that the Streets Department has a small increase of 2.3% and noted that the salt budget has decreased. City Administrator Jacobson stated that there are a number of capital requests coming from the Streets, Parks and Utility departments. Public Works Director Ruzek reviewed public works budget requests, including the replacement of the city’s oversized wheel loader, a new truck- mounted message board, replacement of the existing aprons and bollards at the public works building, and installation of a building access control system at the public works building. Public Works Director Ruzek reviewed the utility fund, noting that the software support line item is for the SCDA system that had been added to all the lift stations. Page 4 of 109 August 13, 2025, Mendota Heights City Council Work Session Minutes Page - 3 Councilor Mazzitello asked for the balance of the utility fund. Finance Director Schabacker responded that there was $2.2 million as of December 31, 2024. City Administrator Jacobson reported a proposed 3.29% increase to the stormwater utility fund, aiming to improve one pond per year. Public Works Director Ruzek added that a consultant inspected 60 ponds this year, a task done every five years. Public Works Director Ruzek reviewed the streetlight maintenance budget, noting it covers the industrial park and is charged back to the districts. The budget is down 21.51% due to pole replacements and LED conversions. Finance Director Schabacker reported the fund balance is just under $75,000. City Administrator Jacobson stated that the parks budget was proposed to increase 1.52%. Capital requests were reviewed. City Administrator Jacobson reviewed Special Parks Fund budget requests. Parks and Recreation Director/Assistant Public Works Director Lawrence reported that the Parks Commission reviewed capital projects. Their top priorities were adding water to the dog park and tot lot. After discussion, it was the consensus not to add water to either. Parks and Recreation Director/Assistant Public Works Director Lawrence reviewed the remaining budget requests, including the replacement of hockey boards at Wentworth Park, expansion of the Wentworth basketball court, Valley Park playground replacement and a refresh of the Valley Park picnic shelter. Staff and council discussed the possibility of applying for a MN DNR matching grant to offset some of the costs of these projects. Mayor Levine asked if Dakota County could help fund Valley Park improvements. Parks and Recreation Director/Assistant Public Works Director Lawrence said funding would require designating the park as a trailhead, which involves meeting certain conditions. Parks and Recreation Director/Assistant Public Works Director Lawrence discussed the Commission’s recommendation to add a bocce ball court to the city’s park system. Councilor Mazzitello asked if it would be one or two courts. Parks and Recreation Director/Assistant Public Works Director Lawrence stated that one or two courts were being considered and noted that funds could be used from the Special Parks Fund to fund the bocce ball court(s). Assistant City Administrator Torkelson stated that Park AEDs are a budget request coming from the Employee Safety Committee. Parks and Recreation Director/Assistant Public Works Director Lawrence described how the park AEDs would work. City Administrator Jacobson stated the AEDs are recommended for Wentworth Park, Friendly Hills Park, Kensington Park, and Mendakota Park. She stated she had discussed with the Page 5 of 109 August 13, 2025, Mendota Heights City Council Work Session Minutes Page - 4 Mendota Heights Community Foundation if they would consider funding the park AEDs. Councilor Lorberbaum reported they would be interested but did not have the funds currently. City Administrator Jacobson stated that there is a budget request for the Oheyawahe Interpretive Plan – Phase IV. It is a $10,000 request as part of the larger Oheyawahe project. City Administrator Jacobson stated that a John Deere Gator was requested by the Parks Department, and it would be a new piece of equipment. Public Works Director Ruzek stated that it is a versatile piece of equipment. It is proposed to have a plow attached to assist in plowing snow. It could also be outfitted with a tracked machine in the winter to groom the trails for cross country skiing at the Par 3. City Administrator Jacobson stated that the Recreation budget is proposed to increase just under 10%. The increase reflects the expansion of existing offerings. Parks and Recreation Director/Assistant Public Works Director Lawrence stated that nature-based programming is being added to the recreation budget. Parks and Recreation Director/Assistant Public Works Director Lawrence stated that there is about a $50,000 operating surplus at the Par 3. She highlighted that rounds played this year are up, as well as camp attendance and concessions. She relayed that the tee time software is working great. City Administrator Jacobson stated that there is a proposed 6.53% increase to the budget for the Par 3. Mayor Levine asked for the fund balance of the Par 3. Finance Director Schabacker responded that at the end of last year it was $158,000. Parks and Recreation Director/Assistant Public Works Director Lawrence discussed a request to purchase a standby generator for the golf course maintenance garage. Mayor Levine asked about the irrigation system. Parks and Recreation Director/Assistant Public Works Director Lawrence stated that it is working well. In a couple of years, the underground piping will need to be replaced at an estimated cost of $700,000. City Administrator Jacobson reviewed the Recycling budget and its proposed changes. Parks and Recreation Director/Assistant Public Works Director Lawrence stated that the city is working through a Joint Powers Agreement with the cities of West St. Paul, South Saint Paul, Mendota Heights, Lilydale, and Sunfish Lake for recycling services. Staff propose increasing the hours to 20 hours a week for the Recycling Coordinator. The impact on the budget is about $5,000. It was the consensus to move forward with the request. City Administrator Jacobson reported that Natural Resources has its own budget this year, with a proposed 6.78% increase. Key projects include a climate action and resilience plan and landscape ordinance. Page 6 of 109 August 13, 2025, Mendota Heights City Council Work Session Minutes Page - 5 Councilor Mazzitello asked how the franchise fees collected for natural resources are incorporated into the budget. Finance Director responded that they are incorporated into the general fund. Mayor Levine asked about the cell tower revenue. Finance Director replied that St. Paul Water Regional Water Services and the city split the funds received from the cell tower revenues. Councilor Paper left the work session meeting. Councilor Mazzitello asked about the Community Development budget request stating there is a request for the 2025 Comprehensive Plan and asked if that was included in the budget figures. Finance Director Schabacker replied that included in the budget numbers were the Minnesota Paid Family Leave expense, the 2025 Comprehensive Plan expense, and the Recycling Coordinator position expense. Mayor Levine asked about the timeline for approving the budget. City Administrator Jacobson explained there is one more work session scheduled for further budget discussion with the preliminary budget to be approved at the September 16, 2025, City Council meeting. It was the consensus to hold one more work session on September 3 at 4:00 pm. City Administrator Jacobson reviewed the entire list of budget requests and confirmed the council’s direction for inclusion in the 2026 preliminary budget. After discussion regarding the 2026 levy, Finance Director Schabacker stated the preliminary levy showed a 3.44% increase. Councilor Mazzitello stated this number showed fiscal responsibility. Finance Director Schabacker stated the proposed levy tax rate would be 38.362. The median home of $551,000 in 2026 will see approximately $78.62 in an annual increase with the proposed budget. CALL TO ORDER Mayor Levine called the meeting to order at 6:00 p.m. Councilors Lorberbaum and Paper were also present. Councilors Mazzitello and Maczko were absent. PLEDGE OF ALLEGIANCE Council, the audience, and staff recited the Pledge of Allegiance. AGENDA ADOPTION Mayor Levine presented the agenda for adoption. Councilor Lorberbaum moved adoption of the agenda. Councilor Paper seconded the motion. Ayes: 3 Nays: 0 PRESENTATIONS A)SWEARING IN CEREMONY FOR MENDOTA HEIGHTS FIREFIGHTERS Fire Chief Dan Johnson commented on the process that firefighters complete, including the in-house fire academy, all certifications, and their 12-month probationary period, as well as continued training. Training Captain Becky Johnson introduced new firefighters Brandon Rebhan, Joe Fabiano and their guests who attended the meeting. They were then sworn in. B)RECOGNITION AND PRESENTATION OF LIFE-SAVING AWARD Police Captain Wayne Wegener provided information on a situation that took place on June 2nd when the department received a call related to a person in crisis attempting to jump from the Mendota bridge. Officers responded and, with the help of others, were able to rescue the individual and bring them to safety. The Officers and residents who responded were presented with Life-Saving Awards. PUBLIC COMMENTS No one from the public wished to be heard. NEW AND UNFINISHED BUSINESS A) METROPOLITAN COUNCIL DISTRICT 15 REPRESENTATIVE VICTOR OBISAKIN INTRODUCTION Victor Obisakin, the Metropolitan Council representative for District 15, introduced himself and provided information on his committee assignments and the Metropolitan Council. He noted that he plans to meet with mayors, commissioners, City development staff and will maintain open lines of communication to bring Metropolitan Council resources to the communities he serves. The Council welcomed Victor Obisakin and looked forward to working with him. COMMUNITY ANNOUNCEMENTS City Administrator Cheryl Jacobson announced upcoming community events and activities. COUNCIL COMMENTS Councilor Lorberbaum thanked all heroes who were recognized tonight for saving a life. She also congratulated and thanked the two new firefighters and their families for their commitment to the Page 9 of 109 August 19, 2025, Mendota Heights City Council Page 3 of 3 community. She commented on Heights Fest, which included wonderful events. She commented that a number of people attended the most recent Coffee with the Council. Councilor Paper commented that Mendota Heights has amazing people in its community, which is part of what makes the city great. He stated that he is eager to work with Mr. Obisakin and looks forward to working with him. Mayor Levine thanked the two new firefighters, recognizing their commitment to the community. She also recognized the four Officers and two community members who stepped in when someone needed help. She thanked City staff for their work on Heights Fest, noting that the food truck fest was her favorite event. She hoped to see residents at the concert in the park the following night, which will feature a local group from Mendota Heights. She commented that she received a letter from the League of Minnesota Cities, stating that Senator Matt Klein was recognized as a 2025 Legislator of Distinction. Councilor Lorberbaum noted that typically the City sponsors the concerts in the park, but this week the event is sponsored by the Mendota Heights Community Foundation and thanked the organization. CELL TOWER ANTENNA PROPOSAL – WENTWORTH PARK Public Works Director Ruzek reported that the city was approached by a representative from a third-party consultant to install a new cellular antenna at Wentworth Park. Buell Consulting later joined in to work on the proposal. The consultants represent Vertical Bridge, which is a partner of Verizon Wireless, and they construct cellular tower antennas and then lease the space back to Verizon Wireless. Public Works Director Ruzek stated that the last cell tower antenna application the city received was in 2007 for Wentworth Park and City Hall. The applicant was T-Mobile, and the application was withdrawn due to public engagement during the process. Public Works Director Ruzek reviewed the map that was included in the packet, showing two possible locations at Wentworth Park for a proposed cell tower antenna. The impacts on park activity, potential rent and terms of a lease agreement were highlighted. S. Buell stated he is with Buell Consulting, which has been in business since 1991 and is local to the area, and then explained his company’s role in locating and negotiating the installation of cellular towers. Page 11 of 109 August 19, 2025, Mendota Heights City Council Work Session Minutes Page - 2 Mayor Levine asked how cellular service works. S. Buell explained that devices connect through cell tower antennas and that coverage can be affected by obstacles and antenna placement. Mayor Levine asked about cell phone connections. S. Buell reported that voice data is also digital data and uses similar frequencies. For digital voice, you do need a constant connection. Public Works Director Ruzek explained that cell tower antennas require fiber optic lines underground to work. He also noted that the shape of the land, such as valleys like near Valley Park, can affect cell coverage. Director Ruzek asked if coverage maps were available. S. Buell said coverage maps are considered proprietary information. He added that open-source data online may show coverage gaps. Mayor Levine asked what area would benefit from the new antenna. S. Buell said it would mainly serve the north end of the city and relieve pressure on nearby overused towers. Councilor Lorberbaum said she spoke with a resident in the Avenues and asked if that resident would notice an improvement. Director Ruzek responded that the new antenna would make a major improvement. Councilor Lorberbaum asked if the property owners were aware of this discussion. Public Works Director Ruzek stated not directly since a formal proposal had not been received. Councilor Lorberbaum asked how tall the cell tower antenna could be. S. Buell responded as tall as would be allowed. Mayor Levine asked how tall the existing trees were by the proposed sites. Public Works Director Ruzek responded 60 to 80 feet tall. Councilor Lorberbaum asked if other consultants were being considered. Director Ruzek said no and noted that a cell tower antenna is not critical to providers’ networks. Councilor Paper thanked S. Buell and said the project addresses a major coverage gap in the north end. He noted concerns from Avenues residents about cell service and stated the antenna will be a significant benefit for the community. He emphasized that the antenna is needed more by the community than by the cell companies and described the project as a major benefit for the city. Councilor Paper asked about moving the proposed antenna closer to the Williams property and what space is needed for installation. S. Buell said the full 75x75 feet may not be required but could be needed during construction. Councilor Paper asked about an estimated timeline for the project. S. Buell stated that if the project goes as planned, the Verizon equipment would be installed in early 2027. Buell stated the first step would be to have a fully negotiated lease agreement. Councilor Paper asked what could stop the project. S. Buell replied that it could be stopped if a lease agreement could not be negotiated. Councilor Paper asked when other carriers would be approached to locate on the cell tower antenna. S. Buell stated that it usually happens when the site is ready for construction and explained how that would work. Councilor Paper asked if small cell tower antennas would be placed on the proposed cell tower antenna. S. Buell stated he did not think they would be needed. Councilor Paper asked if the proposed antenna would help with coverage in Valley Park. S. Buell stated he did not know if it would. Public Works Director Ruzek stated that a post coverage map would be beneficial. Mayor Levine stated that this is a Council priority. City Administrator Jacobson asked if the difference between a monopole and a monopine pole could be described. Images were shown of the different types of poles. S. Buell described the differences between the two types of poles and offered locations where they could be seen nearby. He also stated that a monopine pole is more expensive to construct. The different pole types were discussed along with the advantages and disadvantages of each. Mayor Levine asked if Wentworth Park was the best spot to install a new cell tower antenna. S. Buell stated that after studying the area, it was determined to be the best spot and fit. It would be located on city property, on a large parcel, and it would not be too close to any owner’s property lines. Mayor Levine stated that it seemed to be the consensus to move forward in good faith and to prepare for the next step. City Administrator Jacobson asked about rent, pole type, and the lease. S. Buell explained the lease would be with Vertical Bridge (Towers LLC), the proposed tower owner, with Verizon as the first tenant paying rent and encouraging others to join. It was discussed what type of pole was preferred. It was the consensus to use a monopole, but more discussion was needed as two council members were absent. Councilor Paper asked if notices sent to residents regarding this issue could be extended beyond the 350 feet. Public Works Director Ruzek stated that it could and has been done in the past. Councilor Paper asked if notices set at 1250 feet would reach First Avenue. Different boundary lines were shown on a map to show the intended recipients of the notices. Buell explained the initial terms of the agreement and stated that carriers prefer lower annual rent increases, around 1.5%, as higher rates over time make sites harder to sustain. Councilor Paper asked if 2% was unrealistic for an annual increase. S. Buell responded that it was not unrealistic. ADJOURNMENT Councilor Paper made a motion to adjourn the work session, and the motion was seconded by Councilor Lorberbaum. Motion carried 3-0. Approval of Agenda The agenda was approved as submitted. Approval of June 24, 2025 Minutes COMMISSIONER STONE MOVED, SECONDED BY COMMISSIONER NATH TO APPROVE THE MINUTES OF JUNE 24, 2025. AYES: 6 NAYS: 0 Hearings A) PLANNING CASE 2025-11 POT MAMA’S MSO LLC, 1155 CENTRE POINTE DRIVE – CONDITIONAL USE PERMIT Community Development Manager Sarah Madden explained that Pot Mama’s MSO LLC has applied for a Conditional Use Permit (CUP) for a cannabis retailer location, located in the B-1 General Business zoning district at 1155 Centre Pointe Drive. Hearing notices were published and mailed to all properties within 350 feet of the site; no comments or objections to this request were received. Community Development Manager Sarah Madden provided a planning staff report and a presentation on this planning item to the Commission (which is available for viewing through the City’s website). Staff recommended approval of this application based on the findings and with conditions. Commissioner Johnson asked if there is a maximum size for retail space in B-1. Commissioner Johnson asked if there would be consumption on site, noting the reference to a social boutique within the Commission packet. Commissioner Corbett commented that a retail use would not allow consumption on site. Community Development Manager Sarah Madden confirmed that this would only be retail sales. She explained that the social aspect would be through engagement and community building, which is found within the business plan. She explained that the event license would be a separate process through the State. She commented that an event within the retail space would be allowed and would be different. She explained that the business plan mentioned things like women’s groups as an example of social events. Chair Field opened the public hearing. Andrew Katz, 1960 Walsh Lane, asked if any data was provided related to whether there would be increased police activity or police calls from this type of business. Chair Field commented that there was no information of that type within the staff report. Community Development Manager Sarah Madden replied that the level of data was not provided as part of the application. She stated that the majority of security requirements and review will be done through the State license review through the Office of Cannabis Management (OCM). She reviewed the role of the City in reviewing this type of license. Vicky Katz, 1855 Hunter Lane, commented that she has conflicting feelings as she believes there are benefits to regulation that would allow this type of business, but this also brings to mind a stereotypical image of potential customers. She stated that Mendota Heights is a family-oriented community, and she would not want to see this business bringing in unwanted customers from other communities. She asked the Commission to ensure that the request is well vetted before allowing the business into the community. Scott Van, 1870 Hunter Lane, commented that he was not aware that this type of business was allowed in Mendota Heights and believed that the applicant should be present. Commissioner Corbett stated that there is no subjectivity to this decision as the State regulations cannot be changed. He stated that the application complies with all regulations. Chair Field commented that this would be the only cannabis retailer allowed. Community Development Manager Sarah Madden confirmed that if the licensee fully completes the process, this would be the only retail business allowed in Mendota Heights. B)PLANNING CASE 2025-12 M&M HOME CONTRACTORS, 1867 HUNTER LANE – MISSISSIPPI RIVER CORRIDOR CRITICAL AREA (MRCCA) PERMIT Community Development Manager Sarah Madden explained that M&M Home Contractors is the applicant and owner’s representative of the property located at 1867 Hunter Lane, and has requested a Mississippi River Corridor Critical Area (MRCCA) Permit to construct a new single- family home located at 1867 Hunter Lane. She commented that the setback of the prior home is generally consistent with the proposal. Commissioner Johnson commented that it seems that the new home would be closer to the bluff than the previous home, and similar to the home at 1875 Hunter. Community Development Manager Sarah Madden confirmed that the new home would be slightly more setback and generally centrally located on the lot. Chair Field noted that the applicant is not present. He stated that the Commission could open the public hearing or consider other action. Community Development Manager Sarah Madden replied that the public hearing was noticed for tonight. She stated that if the Commission desires to table the request, she would still ask them to open the public hearing tonight. Chair Field opened the public hearing. Chair Field cautioned that the applicant is not present, and their input may change the input of public speakers. He noted that members of the public are only allowed to speak once, and therefore members of the public may want to hold their input for a time when the applicant is present. Commissioner Corbett stated that members of the public can speak tonight, and if they want to speak again at the next meeting, they could still do that. Commissioner Johnson stated that residents chose to attend tonight, and they should be allowed to speak again at the next meeting if this item is tabled. Commissioner Stone agreed that members of the public who chose to attend tonight should speak. John and Theresa Cosgriff, 1875 Hunter Lane, commented that they are supportive of the build and are looking forward to having neighbors. He commented that there is a small spring that runs down through the area identified in yellow. He wondered if there was information available relating to tree removal and whether that could include a tree inventory. He asked if solar panels would be planned for the home and whether that would include utility work to the street. Commissioner Corbett confirmed that they would be leaving the public hearing open as the applicant is not here to address questions. Seeing no one further coming forward wishing to speak, Chair Field asked for a motion to close the public hearing. Further discussion: Chair Field asked that staff advise the applicant about the concern that was raised relating to trees and landscaping. Commissioner Johnson commented that she feels that this application is incomplete as details are missing from the landscaping plan. Commissioner Corbett asked if there is a requirement for a detailed landscaping plan as part of the application process. Commissioner Johnson confirmed that it is part of the requirements provided to the applicant that a detailed landscaping plan must be included. Commissioner Stone commented that he would think that a house of this scale would have more landscaping than two trees and would hope that the landscaping plan would be provided at the next meeting. Commissioner Corbett agreed that there should be a plan, but also recognized that this is a crude layout and the type of flowers someone is going to plant is not a detail people often plan for at this level of planning. He stated that he wanted to ensure that there is an actual requirement for that level of detail. Community Development Manager Sarah Madden commented that the Commission has debated this issue before, and it comes down to a difference in interpretation of the minimum requirements. She stated that while minimal, the applicant has provided a plant schedule that identifies two swamp white oaks as the two trees. She stated that it is not a full landscape schedule of all perennial beds, which would be a preference of the Commission, but the minimum landscape requirements of the City would be for two overstory trees, and the applicant has met that requirement. Commissioner Johnson stated that while she understands and appreciates that, the intention of the applicant is to plant more. She stated that if the intention is to have just two trees and sod, then Page 19 of 109 July 22, 2025 Mendota Heights Planning Commission Meeting Page 6 of 8 this would be acceptable. She noted previous applications that sailed through smoothly because of the level of detail that was provided for landscaping. Commissioner Corbett commented that there seems to be a discontinuity between the requirements of City Code and the desire expressed by Commissioner Johnson. He stated that he would not want to base the process on a preference for a previous application that included very detailed information about landscaping. Commissioner Stone asked why every little detail would need to be decided if the minimum requirement has been met. He noted that anyone can install additional landscaping on their property after the minimum requirements are met. Commissioner Corbett commented that he does not want this to be subjective. He commented that changes can always be made to landscaping after the fact. Commissioner Nath commented that without written requirements in Code, the issue is very subjective. He stated that he would see this to be a complete landscaping plan as it meets the requirements of the City Code, although Commissioner Johnson would like to see more information. He noted that while Commissioner Johnson would deem this landscaping plan as incomplete, he would consider it to be the bare minimum. He stated that while he would love a more detailed landscaping plan, it is not required under Code. Commissioner Johnson stated that a tree inventory would be important. Commissioner Corbett asked if it is required. Commissioner Johnson was unsure and asked that staff follow up on that. AYES: 6 NAYS: 0 C)PLANNING CASE 2025-13 ST. AUGUSTINE SCHOOL, 1345 MENDOTA HEIGHTS ROAD – CONDITIONAL USE PERMIT Community Development Manager Sarah Madden explained that St. Augustine School is seeking a Conditional Use Permit (CUP) for the property located at 1345 Mendota Heights Road. The CUP would allow for the use of space as a middle and secondary private school, or 6th – 12th grades, at the former Sanford Brown College site, within the space previously used by Interim Use Permit in 2017-2019 for Minnehaha Academy. Community Development Manager Sarah Madden commented that the use is only listed within the business district and not the industrial district. She noted that the previous trade school use was listed. She stated that the property is currently zoned B-1, general business. Chair Field believed that there were regulations for small class sizes with the previous user, Minnehaha Academy. He asked if there would be an ability to cap the number of students. Community Development Manager Sarah Madden commented that if the expansion of the school were necessary to occupy additional space in the building, an amendment would be needed for the CUP. She commented that a condition could be added, but was unsure of the language that would be used and the onus that could be placed on the applicant and staff. Chair Field stated that perhaps a cap on the number of students could be added to the conditions that would trigger a review. Community Development Manager Sarah Madden commented that it could be written as a condition, but there could be enforcement issues. She noted that the enrollment could expand past 40 students and still be within the fire code occupancy for the building. She noted that there would be other triggers that would require a review/amendment, including parking and the need for additional space. She stated that the applicant can provide additional information on the vision for the school and small classroom size. Bill Faulkner, representing the applicant, stated that the vision for the school is to keep the classrooms small. He stated that they would love to have that issue with expanded enrollment, but in that case, they would prefer to expand the size of the school rather than the size of the classroom. BACKGROUND: The Police Cadet program maximizes the city's recruitment efforts by attracting top candidates who are still in the process of completing the required training to become a licensed police officer. With the completion of his program requirements, staff are recommending the promotion of James Walrath from Police Cadet to Police Officer with the City of Mendota Heights effective September 10, 2025. FISCAL AND RESOURCE IMPACT: This position was authorized by the City Council to allow the city to leverage available funds through the State's IC POET program that provided $50,000 of funding to support the training of the police cadet. The City Council authorized this position when the position was initially authorized for posting and again with the authorization to hire the police cadet position. This position has been included as a temporarily budgeted item in the 2026 budget meaning that in the case of turnover of an existing staff member, the department will not replace the position. Costs for the 2025 salary will be covered by the Police Department budget. James Walrath will be compensated at step 1 of the pay schedule set forth in the 2024-2025 LELS Labor Contract with a pay rate of $38.13 per hour. Crawford Door does all of the overhead door maintenance at City facilities, and as such, staff did not solicit a second quote on the garage door portion of this project. BACKGROUND: The City of Mendota Heights maintains approximately 77 miles of sanitary sewer pipe, including 6.5 miles of Sanitary Interceptor Line. Much of this system is aging, with many pipes approaching 60 years in service, and will require ongoing maintenance and future repairs. To extend the useful life of the system and identify needed improvements, the City follows a regular maintenance program that includes a combination of cleaning and televising. Televising provides detailed condition assessments, allowing staff to identify locations in need of immediate or future repairs. City policy establishes a goal of televising the entire sanitary sewer system on a 10-year cycle, with cleaning performed as necessary based on inspections and condition assessments. To meet this goal, staff typically inspect and televise 7–9 miles of pipe annually. For 2025, the Sanitary Sewer Cleaning and Televising Project includes approximately 8.8 miles of sanitary sewer, primarily located in the northern portion of the City. When repairs are necessary, cured-in-place pipe (CIPP) lining is an effective method to extend the useful life of the system without full excavation. The 2025 Sanitary Sewer Rehabilitation Project consists of lining approximately 10,144 feet of sanitary sewer pipe and reinstating 141 lateral connections within the Friendly Hills Neighborhood. This project area was identified through the City’s routine inspection and assessment program. BACKGROUND: The City of Mendota Heights installed a 24” storm sewer culvert in 2014 in response to flooding at 1760, 1762, and 1770 Dodd Road. These properties are part of the Pine Creek Estates, which was developed in 1997 and included an undersized 15” culvert that discharged into a drainage ditch. The 2014 culvert installation followed the existing drainage ditch and included a bend at the property line between 1770 and 1780 Dodd Road. A plat application was approved for the 1770 Dodd Road property in 2022 titled the Audrey Addition, which subdivided the property into two parcels. The application data only included the two ends of the pipe and did not capture the bend. Due to this issue, portions of the storm sewer were outside the platted drainage easement on private property (see attached map). A new home was constructed at 1770 Dodd Road, and the homeowner intended to install a swimming pool. The storm sewer outside the easement would need to be relocated into the easement to allow for the pool construction. Staff consulted with the city legal department and were advised to work with the homeowner to relocate this line. The homeowner provided an engineered plan to the city and is asking for reimbursement of 50 percent of the relocation costs. FISCAL AND RESOURCE IMPACT: The final invoice for the relocation is $22,614. The Council is asked to approve a reimbursement of $11,307. The reimbursement will be funded by the storm water utility fund. Debt service will be paid from special assessments and taxes. The City intends to levy a total of $1,916,582 in special assessments to benefitting property owners, of which $745,892 is anticipated to be collected in pre-paid assessments. The remaining assessments will be collected over a 10-year period from 2026 through 2035. They will be repaid at a rate equal to 2% over the True Interest Cost of the Bonds, using an equal principal repayment structure. Authority: The Bonds are being issued pursuant to Minnesota Statutes, Chapters: •429 – Improvement Bonding Authority •475 – General Bonding Authority Because the City is assessing at least 20% of the project costs, the Bonds can be a general obligation without a referendum and will not count against the City’s debt limit. The Bonds will be general obligations of the City for which its full faith, credit and taxing powers are pledged. Term/Call Feature: The Bonds are being issued for a term of 12 years. Principal on the Bonds will be due on February 1 in the years 2028 through 2037. Interest will be due every six months beginning August 1, 2026. Basis for Recommendation: Based on your objectives, financial situation and need, risk tolerance, liquidity needs, experience with the issuance of Bonds and long-term financial capacity, as well as the tax status considerations related to the Bonds and the structure, timing and other similar matters related to the Bonds, we are recommending the issuance of Bonds as a suitable option. Method of Sale/Placement: We are recommending the Bonds be issued as municipal securities and offered through a competitive underwriting process. You will solicit competitive bids, which we will compile on your behalf, for the purchase of the Bonds from underwriters and banks. An allowance for discount bidding will be incorporated in the terms of the issue. The discount is treated as an interest item and provides the underwriter with all or a portion of their compensation in the transaction. If the Bonds are purchased at a price greater than the minimum bid amount (maximum discount), the unused allowance may be used to reduce your borrowing amount. Premium Pricing: In some cases, investors in municipal bonds prefer “premium” pricing structures. A premium is achieved when the coupon for any maturity (the interest rate paid by the issuer) exceeds the yield to the investor, resulting in a price paid that is greater than the face value of the bonds. The sum of the amounts paid in excess of face value is considered “reoffering premium.” The amount of the premium varies, but it is not uncommon to see premiums for new issues in the range of 2.00% to 10.00% of the face amount of the issue. This means that an issuer with a $2,000,000 offering may receive bids that result in proceeds of $2,040,000 to $2,200,000. For this issue of Bonds we have been directed to use the net premium to reduce the size of the issue for the project. The resulting adjustments may slightly change the true interest cost of the issue, either up or down. The amount of premium can be restricted in the bid specifications. Restrictions on premium may result in fewer bids, but may also eliminate large adjustments on the day of sale and unintended impacts with respect to debt service payment. The City is already obligated to provide such reports for its existing bonds, and has contracted with Ehlers to prepare and file the reports. Arbitrage Monitoring: The City must ensure compliance with certain sections of the Internal Revenue Code and Treasury Regulations (“Arbitrage Rules”) throughout the life of the issue to maintain the tax- exempt status of the Bonds. These Arbitrage Rules apply to amounts held in construction, escrow, reserve, debt service account(s), etc., along with related investment income on each fund/account. IRS audits will verify compliance with rebate, yield restriction and records retention requirements within the Arbitrage Rules. The City’s specific arbitrage responsibilities will be detailed in the Nonarbitrage Certificate (the “Tax Compliance Document”) prepared by your Bond Attorney and provided at closing. The Bonds may qualify for one or more exception(s) to the Arbitrage Rules by meeting 1) small issuer exception, 2) spend down requirements, 3) bona fide debt service fund limits, 4) reasonable reserve requirements, 5) expenditure within an available period limitations, 6) investments yield restrictions, 7) de minimis rules, or; 8) borrower limited requirements. An Ehlers arbitrage expert will contact the City within 30 days after the sale date to review the City’s specific responsibilities for the Bonds. The City is currently receiving arbitrage services from Ehlers in relation to the Bonds. The existing 750 Main Street building has two tunnels for vehicles, which are signed as one-way access. To accommodate the proposed pickup window, the new tenant would like to reverse the one-way configuration of the west tunnel. A traffic study was completed by a registered professional engineer from a local consulting firm. The study involved a 48-hour data collection of existing traffic movements and recommendations to provide for the reversing of traffic in the west tunnel. The east tunnel is not proposed to have changes or improvements completed. Based on the study, there are 12 cars per day that use the west tunnel. The proposed location is part of the existing Village at Mendota Heights development in the northeast quadrant of the Market Street and Linden Street intersection (see Figure 1). The main objectives of the study are to review existing traffic operations within the study area, assess existing circulation patterns at the site, review the proposed changes to circulation patterns, and provide recommendations regarding circulation, signing, and striping to deliver safe and efficient operations for all modes of transportation. The following information provides the assumptions, analysis, and study findings offered for consideration. Existing Conditions Existing conditions were reviewed to establish a baseline to identify any potential issues and opportunities, as well as determine improvement alternatives. The evaluation of existing conditions includes a review of traffic volumes, current travel patterns, and existing utilization and compliance of the tunnel one-way functions, which are summarized in the following sections. Existing signage and pavement markings are in place to support and reinforce the one-way configurations. •The west tunnel is currently configured as a one-way road in the southbound direction. Vehicles exit the tunnel at a T-intersection with Main Street, which is a two-way roadway. Note, this tunnel used to have a drive-thru window for a pharmacy in the southbound direction. •The east tunnel currently operates as a one-way road in the northbound direction, providing access from Main Street to the northern parking lot. The tunnel aligns with the one-way driveway to the south, ensuring a consistent and coordinated traffic flow. Existing Traffic Volumes Traffic volumes in the tunnels were used to evaluate usage, direction compliance, and any other potential concerns. While instances of wrong-way driving were observed at both tunnels, overall compliance was high. Over a 48-hour period, one (1) wrong-way vehicle was recorded in the west tunnel and two (2) were observed at the east tunnel. Proposed Development The proposed Happy Joe’s Pizza and Ice Cream development is planned for the westernmost portion of the building, extending to the west tunnel. A pick-up window is proposed to be installed within the tunnel, allowing customers to pick up pre-ordered pizzas. Note, this window is NOT intended to be an order window for drive-thru traffic and there is not ordering board, it is pick up window only of orders that are ready. To accommodate this feature, the one-way traffic flow of the tunnel would need to be reversed, enabling vehicles to approach the pick-up window on the driver’s side. Note, the tunnel pavement width is wide enough (approximately 16 to 18 feet) to allow for a vehicle to pass, if necessary. Page 71 of 109 Mendota Heights Site Review August 25, 2025 Page 4 of 6 Recommendations After analysis of the data collected as part of the study the following improvements are recommended and can be seen in Figure 2 below: •Based on the minimal existing volumes at the west tunnel, reversing the direction of traffic flow in the west tunnel from the existing southbound one-way configuration to a northbound one-way configuration, would pose minimal operational or safety issues in the study area. o To accommodate a drive-thru, the sidewalk/curb on the west side of the tunnel will need to be shrunk to allow vehicles to get close enough to the pick up window (see below). •It is recommended that the direction of traffic flow in the east tunnel remain northbound to minimize changes to the site layout. The east tunnel currently experiences higher traffic volumes, and reversing its direction could lead to driver confusion and potential safety concerns, especially given that the driveway south of the tunnel is already configured for northbound one-way traffic. •Given the low existing traffic volumes through the west tunnel (averaging 12 vehicles per day), impacts to overall traffic flow are expected to be minimal. Vehicles affected by the change will be able to utilize either Market Street to the west or Karl Hohenstein Place to the east, to route to Main Street or to head off the site. Pick Up Window Page 72 of 109 Mendota Heights Site Review August 25, 2025 Page 5 of 6 •No queuing concerns are anticipated at the proposed pickup window during peak times, as the window is designated solely for order pickup and not for placing orders. Note, the roadway width within the tunnel is wide enough to allow for a vehicle to pass, if necessary. •To ensure a smooth transition and minimize driver confusion, temporary installation of bold signage is recommended at the tunnel access points to clearly communicate the change in traffic direction. This signage should remain in place for six (6) months to one (1) year, allowing drivers time to adjust to the new layout. After this period, more subtle, permanent signage, similar to what currently exists, should be sufficient. •Updated pavement markings, including directional arrows, are also recommended to reinforce the new traffic flow. BACKGROUND: Dakota County, in partnership with the Cities of Mendota Heights and West St. Paul, is planning to reconstruct Delaware Avenue in 2027 between Marie Avenue and Dodd Road. As part of this project, the City has evaluated the Dorset Road intersection. Currently, the Dorset Road approach to Delaware Avenue has a slope that exceeds the City’s maximum allowable roadway grade of 6%. This condition presents long-term safety and maintenance concerns. The County project provides an opportunity to address this issue. In June 2025, City staff sent letters to impacted residents along Dorset Road and Mears Avenue seeking feedback on a potential modification to the intersection. The proposed modification would remove the existing connection of Dorset Road to Delaware Avenue and replace it with a cul-de-sac, bringing Dorset Road into compliance with City roadway standards for maximum grade. A trail connection between the cul-de-sac and the future Delaware Avenue multi-use trail is also being considered. The City received considerable feedback from the letter, with residents expressing both support for and opposition to the removal of the Dorset Road and Delaware Avenue intersection. Alternatively, the intersection could remain in place with reconstruction of approximately 185 feet of Dorset Road to reduce the roadway grade. However, the roadway grade would still exceed the City’s maximum standard for a public roadway. Roadway grades are permitted to exceed the City’s maximum where adjacent topography warrants, as determined and recommended by the City Engineer. There are warranted roadways within the City that currently exceed allowable grades due to existing topography of which will continue to be Page 75 of 109 evaluated as reconstruction and design opportunities present themselves. On August 26, 2025, the Planning Commission held a public meeting and heard additional comments from residents. All residents who spoke at the meeting expressed support for removal of the intersection. Following the public comment period, the Planning Commission voted unanimously to recommend removal of the intersection and construction of a cul-de- sac. FISCAL AND RESOURCE IMPACT: None at this time. The City’s share of project costs will be funded through Municipal State Aid (MSA) funds, regardless of which intersection alternative is recommended. The site is located on the west side of Hunter Lane and generally southeast of Sibley Memorial Highway and adjacent wooded vacant lots. The property is located within the Mississippi River Critical Corridor Area (MRCCA), and therefore the construction of a new single-family home requires a MRCCA permit. The existing lot is vacant, but previously was developed with a single-family home, demolished in 2023. The proposed project is to construct a new 8,907 sq-ft home on the property, generally located centrally on the lot and consistent with neighboring existing homes and the prior constructed home. The proposed improvements are located outside of the Bluff Impact Zone (BIZ) and bluff setback, located at the rear of the property. The applicant is also proposing to construct two rock infiltration trenches on site; one at the rear of the property, and one north of the existing driveway in the front yard. A full landscape plan has been provided, which illustrates two new overstory trees planted in the front yard, consistent with zoning requirements, as well as foundation plantings and perennials surrounding the new home. At the July 22, 2025, Planning Commission meeting, a planning report was presented. A duly noticed public hearing was opened and three members of the public spoke to the application. The Commission discussed the landscaping improvements on site, and requested additional information from the applicant. The public hearing was tabled while open, and at the August Page 79 of 109 26, 2025, Planning Commission meeting, the public hearing was held where one resident spoke for the application, and then closed after providing the opportunity for any interested parties to speak. The applicant was present at the August 26 meeting and available to answer questions of the Commission. The Commission discussed the revised landscaping plan and thanked the applicant for providing additional details. There was also discussion on the distance of the improvements from the BIZ and other Primary Conservation Areas (PCA). A copy of the 08/26/25 planning report with attachments and an excerpt from the unapproved minutes are attached to this memo. As noted in the attachment, staff recommended approval of the application request. Following their discussion, the Planning Commission affirmed the staff recommendation and voted unanimously (6-0) to recommend to the City Council approval of this MRCCA Permit with findings-of-fact and certain conditions, as outlined in the attached [draft] Resolution. A duly noticed public hearing was opened at the July 22nd Planning Commission meeting. Two residents representing one household spoke in favor of the proposal, and one resident spoke inquiring about tree removal and any plans for additional utility work for the construction of the home. City staff have received one written comment related to this item, which was included in the staff report. During discussion of the application, the Commission expressed concerns with the available details on the proposed landscaping for the new home site and requested additional information from the applicant. The applicant was unable to attend the July 22nd meeting, but has provided updated landscaping plans and details, which were included in the packet. An updated survey was also provided, illustrating the location of existing trees on the property. Hearing notices were published and mailed to all properties within 350 feet of the site; one written comment was received. Community Development Manager Sarah Madden provided a planning staff report and a presentation on this planning item to the Commission (which is available for viewing through the City’s website). Staff recommended approval of this application based on the findings and with conditions. Commissioner Johnson referenced a comment made at the last meeting related to a potential intermittent stream and asked if there was any information on that. Community Development Manager Sarah Madden stated that there is no confirmation of the existence of the intermittent stream. She noted that this is one parcel of three owned by the same property owner, so the stream could be located on an adjacent property if it does exist. Commissioner Johnson asked if the rate of stormwater flow had been reviewed. Public Works Director Ryan Ruzek commented that the rates are not factored in for the single- family home construction, and a measure of abstraction is required, and noted that this request meets that requirement. Commissioner Johnson referenced the primary conservation area on the western edge of the property and asked staff to identify that area. Acting Chair Stone commented that the public hearing from the last meeting was tabled and, therefore, is still open and invited comments from the public. The applicant confirmed that he is available to answer any questions. Commissioner Johnson thanked the applicant for updating and providing more detailed information, noting that because this is an MRCCA permit, there are more requirements. Theresa Cosgriff, 1875 Hunter Lane, noted that she and her husband submitted a written comment to the Mayor on this topic. She noted that this lot has sat vacant for many years in rough condition. She stated that the neighborhood has been updating, and people have been reinvesting in their properties, and she believed that the new home would assist in that vision for the neighborhood. She stated that she and her husband built their home five years ago and enjoyed the flexibility of working with the Planning Commission and City Council, and asked that this applicant be provided with the same flexibility. Seeing no one further coming forward wishing to speak, Acting Chair Stone asked for a motion to close the public hearing. The total area of this property is 2.25 acres and contains three parcels owned in common, however this application's impact area includes the addressed property of 1867 Hunter Lane, an R-1 zoned property .92 acres in size. The subject property is part of the Colliton Place subdivision, and is currently vacant as the prior home was demolished in 2023. The prior home was accessed from a long driveway that remains in place today with access from Hunter Lane to a point generally centrally located within the lot. There is also a portion of the neighboring driveway to the north which is located on this parcel and which is subject to a Page 88 of 109 driveway easement agreement. The subject property is located within the Mississippi River Critical Corridor Area (MRCCA), and therefore the construction of a new single-family home requires a MRCCA permit. Analysis: The existing lot is vacant, but previously was developed with a single-family home. The proposed project is to construct a new 8,907 sq-ft home on the property, generally located centrally on the lot and with deep setbacks consistent with neighboring existing homes and the prior constructed home. The proposed home will be accessed by a reconstruction of the existing driveway, with a proposed circle drive closer to the new home. The proposed improvements are located outside of the Bluff Impact Zone (BIZ) and bluff setback, located at the rear of the property. The applicant is also proposing to construct two rock infiltration trenches on site; one at the rear of the property, and one north of the existing driveway in the front yard. The applicant has also indicated that they will be planting two new overstory trees in the front yard, consistent with zoning requirements. The proposed site plan, and layout of the home is consistent with the base requirements of the zoning ordinance. The proposal meets minimum setback requirements for the R-1 zoning district, and 21.5% of the site would be covered by impervious surface, meeting the City's zoning requirements. 5.MRCCA Critical Area Permit Per Title 12, Chapter 6 Critical Area Overlay District a Critical Area Permit is required for the subject project. The proposed rock infiltration garden is located 10-ft from the BIZ, and approximately 40-ft from the nearest significant existing vegetative stand. Subject to Section 12-6A-9 Vegetation Management No, does not meet criteria as no significant vegetative removal required as part of the proposed improvements. Subject to Section 12-6A-11 Land Alteration Standards and Stormwater Management Yes. A new home construction is permitted but stormwater must be diverted from any BIZ area. Must include Site Plan and Page 89 of 109 Requirements Landscape Plan As described in Section 12-6A-4 C.3., the Separated from River (SR) sub-district describes the management purpose as, “...provides flexibility in managing development without negatively affecting the key resources and features of the river corridor. Minimizing negative impacts to primary conservation areas and minimizing erosion and the flow of untreated storm water into the river are priorities…” As indicated on the attached GIS maps, the Bluff Impact Zone (BIZ) crosses and covers the far western end of the site, within the first 40-ft of the rear yard. As shown on the Site Plan and Landscape Plan, the applicant will construct a new single-family home and seed/sod the entirety of the site, install two rock infiltration trenches, add additional circle drive immediately in front of the home, and plant two new overstory trees. As proposed, the new home will be setback approximately 102-ft from the BIZ boundary, with the proposed rear deck approximately 78-ft from the BIZ. There is an additional Primary Conservation Areas on the site, as the nearest significant vegetative stands are located directly west of the property in the large vacant wooded hillside. The attached MRCCA Map illustrates the boundary of a Significant Existing Vegetative Stand of Midwestern White Oak – Red Oak Forest, which crosses the rear of the property approximately 10-ft in, and more than 100-ft from the proposed new home. The infiltration area in the rear yard is outside of all Primary Conservation Areas, and has been proposed to comply with the City’s stormwater and land disturbance requirements which are requirements of the Building Permit process. Per Code Sect. 12-6A-12, the Detailed Site Plan must be drawn to scale and the proposed project accurately described through narrative and supporting maps and/or plans. The plan set for the new home is attached to this report, and the Site Survey and Landscaping Plan are included. The proposed new home location is sited on a relatively flat area of the lot, consistent with the prior home on site, and there are no significant grades. As noted on the attached plans, there are retaining walls proposed north of the new home, and west of the rear of the home in areas where a change in grade is present. Restoration of the site once the construction is complete is planned and described as sodded and irrigated. The Applicant provided a revised Landscape Plan, dated 8/7/25, which illustrates that there are 15 trees preserved on site, three new trees proposed to be planted, and a number of foundation plantings including native, ornamental, and pollinator-attracting perennials as well as shrubs. Interagency Review Under the MRCCA Ordinance, the city is required to submit the MRRCA permit request to the MnDNR and the National Park Service (NPS). The plan set and project information was transmitted to both agencies for their review and comment. At the time of this report the NPS has responded noting that they have no comments, but no correspondence has been received from MnDNR. Staff will provide a verbal update of their correspondence at the Planning Commission meeting. Alternatives: 1.Approve the MRCCA-Critical Area Permit request for 1867 Hunter Lane, which would allow for the construction of a new single-family home and associated improvements based on the findings-of-fact that the proposed project is compliant with the policies and standards of the MRCCA Overlay District and City Zoning Code standards, with certain conditions; or 2.Deny the MRCCA-Critical Area Permit request for 1867 Hunter Lane, based on the Page 90 of 109 revised or amended findings-of-fact that the application does not meet certain policies and standards of City Code as determined by the Planning Commission; or 3.Table the request and request additional information from staff and/or the applicant; Staff will extend the review period an additional 60 days, in compliance with Minnesota State Statute 15.99. Staff Recommendation: Staff recommends approval of the MRCCA-Critical Area Permit request for 1867 Hunter Lane, with the following conditions: 1.
