RESOLUTION 2024-31
RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT OF FRITZ
ADDITION
LOCATED AT PARCEL ID: 27-02700-09-014
(PLANNING CASE NO. 2024-08)
WHEREAS, Paul Katz (the "Owner/Applicant") submitted under Planning Application Case
No. 2024-08, a request of a new subdivision plat to be titled Fritz Addition, for the property located at
Parcel ID: 27-02700-09-014 (the "Subject Property"), and legally described in attached Exhibit A; and
WHEREAS,
the
subject
property
is guided LR-Low Density Residential in the 2040
Comprehensive Plan
and
is situated
in the R-1
One Family Residential district; and
WHEREAS, Title 11-1-1 of the City Code (Subdivision Regulations) allows the subdivision of
properties, provided the resulting lots are compliant with the requirements of the applicable zoning
district; and
WHEREAS, the Owner/Applicant has requested the subdivision in order to accommodate the
conveyance of land to an adjoining property owner; and
WHEREAS, the requested subdivision would create two (2) new Outlets on the subject
property, which are designated as non -buildable on the requested Preliminary Plat and
application materials; and
WHEREAS, on May 28, 2024, the Mendota Heights Planning Commission held a public
hearing on the application request at their regular meeting, and whereupon closing the hearing and
follow-up discussion on this item, the Planning Commission recommended 6-0 (1 abstention to approve
the requested subdivision plat request on the Subject Property).
NOW, THEREFORE, BE IT RESOLVED by the Mendota Heights City Council that the
recommendation from the Plamzing Commission on Planning Case No. 2024-08 is hereby affirmed, and
the proposed Preliminary and Final Plat of FRITZ ADDITION to create two new Outlets located at the
vacant parcel identified as Parcel ID 27-02700-09-014, may be approved based on the following
findings -of -fact:
1. The proposed Outlets A and B, Fritz Addition are vacant and non -buildable parcels with no
proposed improvements.
2. The proposed Preliminary and Final Plat will not create any negative impacts to the
surrounding uses or neighborhood.
3. The proposed Preliminary and Final Plat to divide the existing parcel into two Outlets for
the purpose of conveyance is consistent with the purpose and intent of the City Code under
Title 11 — Subdivision Regulations and can be considered consistent with the
Comprehensive Plan.
4. The requirement to have the Applicant or their designee legally combine the proposed
parcels with an adjoining lot which maintains access on aCity-approved street will
eliminate the non -conforming status of the newly created parcels.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the Preliminary
and Final Plat of Fritz Addition is hereby approved, with the following conditions:
The newly created parcels, identified and described as "Outlot A" and "Outlot B" on the
attached Preliminary and Final Plat drawings shall each be combined with an adjoining
parcel which maintains access on aCity-approved street or public roadway.
The newly created parcels, identified and described as "Outlot A" and "Outlot B" are not
buildable in their current form, and must be combined with an adjoining parcel in order to
be considered part of a buildable lot.
The approval of this Plat does not predicate the approval of any future application for
future development, building, or vegetative clearing on the newly created parcel identified
and described as "Outlot B".
Adopted by the City Council of the City of Mendota Heights on this 4`h day of June, 2024.
