CALL TO ORDER Mayor Levine called the meeting to order at 7:00 p.m. Councilors Lorberbaum, Paper and Mazzitello were also present. Councilor Miller was absent. NEW AND UNFINISHED BUSINESS A)RESOLUTION 2024-25 RECOGNIZING NATIONAL PUBLIC WORKS WEEK Public Works Director Ryan Ruzek explained that the Council was being asked to approve Resolution 2024-25 recognizing National Public Works Week as the week of May 19, 2024 through May 25, 2024. Mayor Levine expressed her gratitude commenting that Mendota Heights has the best public works department. She commented that the community also echoes those positive comments. Councilor Mazzitello commented that public works professionals want to do their work and go home and do not seek out recognition. He stated that the Mendota Heights public works staff is a small team that does such a great job on all the tasks that they do. He noted that there is even a mechanic that works on all the fleet vehicles. He stated that the City is blessed to have such a great team. Councilor Lorberbaum echoed those words and suggested framing the resolution to give to the public works department. Councilor Paper also echoed the comments of praise. Mayor Levine commented that she spoke with some of the public works staff at the recent Touch a Truck Event. She commented that many cities have multiple departments, such as parks, streets, etc., but that Mendota Heights public works does work together to accomplish whatever needs to be done. She acknowledged the talent that exists within the public works department. Councilor Mazzitello moved to approve RESOLUTION 2024-25 RECOGNIZING NATIONAL PUBLIC WORKS WEEK AS THE WEEK OF MAY 19, 2024 THROUGH MAY 25, 2024. Councilor Lorberbaum seconded the motion. Ayes: 4 Nays: 0 COMMUNITY ANNOUNCEMENTS Page 2 of 205 May 21, 2024 Mendota Heights City Council Page 3 of 3 City Administrator Cheryl Jacobson provided a brief legislative update, thanking those representing Mendota Heights. She then announced upcoming community events and activities. COUNCIL COMMENTS Councilor Lorberbaum commented that there was a great crowd at the Touch a Truck Event, thanking the Parks and Recreation staff, and public works for a great event. She commented on the recent Coffee with the Council event, noting that it will continue, and invited residents to attend and share their input. She commented that Monday was world Bee Day, celebrating the importance of bees and pollinators. She noted funds that are available for native plantings which has closed for this year and will open again in June 2025. Councilor Paper noted that the Scott Patrick Memorial 5K is coming up, with over 130 door prizes already in place. All proceeds are donated to Special Olympics Minnesota. Councilor Mazzitello thanked the high school students present for attending to learn about local government. He commented that May 18th was Armed Forces Day, noting that Minnesota does not have an active duty presence but does have a robust National Guard. He commented on the decreasing trend of the population to join the armed forces. He commented that Monday will be Memorial Day and asked that everyone remember those veterans that have served, and those that have given their lives so that others can have their tomorrow. Mayor Levine thanked the members of the community that attended the work session prior to this meeting to provide input on multiple topics. ADJOURN Councilor Mazzitello moved to adjourn. Levine Mayor ATTEST: _______________________________ Nancy Bauer City Clerk Page 3 of 205 Page 4 of 205 May 21, 2024, Mendota Heights Council Work Session Page -1 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA DRAFT Minutes of the City Council Work Session Tuesday, May 21, 2024 CALL TO ORDER Mayor Levine called the work session to order at 5:00 p.m. Councilmembers Lorberbaum, Mazzitello, and Paper were also present. Councilmember Miller was absent. Other in attendance were City Administrator Cheryl Jacobson, Assistant City Administrator Kelly Torkelson, Public Works Director Ryan Ruzek, Park and Recreation Director/Assistant Public Works Director Meredith Lawrence, Community Development Manager Sarah Madden, Krista Spreiter Natural Resources Coordinator, Courtney Selstad Recycling Coordinator, City Attorney Amy Schmidt, and City Clerk Nancy Bauer. ORGANICS RECYCLING/CURBSIDE ORGANICS Park and Recreation Director/Assistant Public Works Director Lawrence reported that the last update regarding curbside organics recycling was a year ago. Currently there is one staff person at the City who works on solid waste abatement, Courtney Selstad, who is a contract employee and works 14 hours a week. Ten of her hours are funded through a grant with Dakota County. The remaining four hours are funded by the City and are devoted to working on the city’s Green Steps program. Organics initiatives currently include the drop-off location at Mendakota Park, City events collection, and organics recycling education at community events. Recycling Coordinator Selstad reported that the City of Mendota Height has the highest usage of the organic’s drop off location at Mendakota Park with 18% of the city participating. Councilmember Lorberbaum asked where the number of 18% of households that are using the drop off site came from. Recycling Coordinator Selstad responded that is the number of participants that registered through Dakota County. Recycling Coordinator Selstad reported that the Metropolitan Solid Waste Management Policy Plan released in January requires cities with a population greater than 5,000 to make residential curbside organics collection available to residents by 2030. Recycling Coordinator Selstad noted that the draft Dakota County Solid Waste Plan will be released later this summer, followed by a public comment period. She further noted that Dakota County must have a final plan submitted to the MPCA by October 2024. Dakota County is funding an organic study done with a consultant. The results of the study will be released early this summer. 6bPage 5 of 205 May 21, 2024, Mendota Heights Council Work Session Page -2 The council was made aware that the MPCA has clarified Minnesota Statue § 115A.93, subd 3(c) which states that the licensing authority shall prohibit mixed municipal solid waste collectors from imposing a greater charge on residents who recycle than on residents who do not recycle. This ruling means that everyone would be charged the same amount whether they use an organics curbside program or not. Staff reviewed the current offerings of organics recycling to either residential or commercial properties by current Mendota Heights waste haulers in other communities. Recycling Coordinator Selstad recapped the experiences from Hennepin County cities that currently have curbside organics recycling. The top cities were Minneapolis, St. Louis Park, and Golden Valley. Residents in those cities are paying an additional $3 to $10 for organics recycling depending on the hauler. Staff asked the City Council for feedback on how to move forward and asked for direction if the Council would like the City to implement a curbside organics collection program before the requirement by the County was mandated. Park and Recreation Director/Assistant Public Works Director Lawrence stated that the soonest the program could be implemented would be 2026. Funding for staff time would need to be increased a year prior to implementation to launch the program successfully. Recycling Coordinator Selstad reported that additional staff would be needed to decide how to roll out the plan, work with the haulers, and educate the public. The City Council was interested in staff planning for a 2027 roll out rather than a 2026 roll out and did not want to move forward with proposals for staffing increases for organics in 2025. The Council wanted staff to get data on how many residents used haulers that did not offer any type of organics program. The Council was not interested in funding the cost difference to residents for the program. SHORT-TERM RENTAL ORDINANCE DRAFT Community Development Manager Madden reported she would like feedback on the draft ordinance amendment within Title 3, Business and License Regulations, Chapter 5: Rental Housing which would authorize a short-term rental license requirement and application process. Staff requested feedback on the changes to the Short-Term Rental Ordinance draft. Topics for feedback included the requirement for a minimum five-night stay, conditions of the license, and the rental frequency period. The City Council discussed the dates regulation, the number of days for a minimum night stay, maximum occupancy limits, maximum guest number, maximum guest bedrooms, definition of bedroom, the term transient, the permit, the inspection process, code violations, age of renter, and homesteading the property. The Council had consensus to raise the minimum age of a renter to 25. In addition, the Council wanted to add language to include the maximum number of occupants per bedroom as two individuals (remove clause stating that accompanying children shall not count towards the occupancy limit), with a maximum of five Page 6 of 205 May 21, 2024, Mendota Heights Council Work Session Page -3 bedrooms, rented up to seven days per month for the annual limitation of short-term rental. They wanted to add, in accordance with the International Building Code, language for a definition of bedroom. They wanted to remove the minimum five-night stay. They also wanted to change the word transient to temporary guest. The Council did express interest in reviewing long-term rental licensing as well in a future discussion. Including condos in the short-term rental ordinance was discussed and it was the consensus to discuss at the next presentation on the topic. An updated version of the ordinance will be brought back at a later meeting for feedback and consideration by the Council. URBAN FOREST PRESERVATION ORDINANCE Natural Resources Coordinator Spreiter gave an overview of the proposed Urban Forest Preservation Ordinance that is part of the Natural Resources Commission work plan. The goal of the ordinance is to protect, preserve, and enhance our urban forest canopy and mitigate the loss of canopy due to emerald ash borer, and land alteration activities. She reviewed the definitions included in the ordinance such as significant tree, heritage tree, and critical root zone. She reviewed the two instances where the ordinance would be triggered. 1) Forest alteration permit would be required when removing any heritage trees or any significant trees in the following cases: Removal of any heritage tree, 33% or more of any significant and/or heritage tree are prosed for removal, any development or redevelopment project that requires a permit, a grading permit application is submitted, or a lot-split or other land use alteration. 2) Forest management plan would be required when removing significant or heritage trees: 33% or more of any significant and/or heritage trees are proposed for removal on any lot, any development or redevelopment project that requires a permit, a grading permit is submitted, or a lot-split or other land use alteration. Natural Resources Coordinator Spreiter continued by reporting that the most significant part of the ordinance was the planting of replacement trees. If less than 20% of the total significant and/or heritage trees were removed, then replacement trees are calculated by planting one tree per one tree removed. If more than 20% of the significant and/or heritage trees were removed, then mitigation would follow a formula in the ordinance which would use the total Diameter at Standard Height (DSH) in the formula. The formula considers the number of trees saved, number of trees removed, and the size of trees removed. Page 7 of 205 May 21, 2024, Mendota Heights Council Work Session Page -4 The invasive species list of trees listed in the ordinance was discussed. It was suggested that a reference for the Minnesota Department of Natural Resources or the Minnesota Department of Agricultural of invasive/noxious trees species be referenced in the ordinance. Clear cutting of a lot, permit fee, conditions for approving or denying a permit, failure to obtain a permit, enforcement, penalties, and invasive/native trees were discussed. It was suggested to do outreach to builders, developers, and tree contractors/businesses once the ordinance is approved. POLICE DEPARTMENT FLEET PROPOSAL Chief McCarthy and Sergeant McCarty joined the meeting to give an update on the Police Department Fleet Proposal. Chief McCarthy discussed the proposal to transition the City to purchased squad cars for a take home squad program as compared with the current leasing model. The City Council was supportive of moving forward with the purchasing of the 7 vehicles required to initiate the program and to plan for the full implementation as proposed which will take place over time as the City’s current leases expire. The vehicles would be paid for by the public safety funds, fund balance and siren fund. The Finance Director had indicated that there were funds in the reserves for the purchase of the seven vehicles. Delivery of the vehicles would not be until September and then they would have to be built. The proposal and benefits of the proposal were discussed, and it was the consensus to move forward with the fleet proposal. The money requested from the legislature for the police and city hall campus plans was briefly discussed. The following Commissioners were present: Chair Litton Field, Commissioners Patrick Corbett, Cindy Johnson, Brian Petschel, Brian Udell, Jason Stone, and Andrew Katz. Approval of March 26, 2024 Minutes COMMISSIONER KATZ MOVED, SECONDED BY COMMISSIONER PETSCHEL TO APPROVE THE MINUTES OF MARCH 26, 2024. AYES: 7 NAYS: 0 Hearings A) PLANNING CASE 2024-01 SPENCER MCMILLAN, 1707 DELAWARE AVENUE – PRELIMINARY AND FINAL PLAT (TABLED FROM MARCH 26, 2024 PLANNING COMMISSION MEETING) Community Development Manager Sarah Madden explained that at the regular Planning Commission meeting on March 26, 2024, a duly noticed public hearing was opened and held to consider a request for a Preliminary and Final Plat to be known as McMillan Estates, containing three residential parcels and dedication of public right-of-way. The subdivision request is for the existing property at 1707 Delaware Avenue and two vacant parcels generally located at the north end of the Ridgewood Drive cul-de-sac, all of which are owned by the applicant. The applicant requested that the item be tabled to allow additional time to work with staff and the final version of the revised application is not yet complete. The applicant has requested a further continuance, or tabling, of the application to allow additional revision and review time. Community Development Manager Sarah Madden confirmed that she would do all of the above. AYES: 7 NAYS: 0 B)PLANNING CASE 2024-06 KONCEPT IN DESIGN/CARLOS PEREZ - 670 HIDDEN CREEK TRAIL – WETLANDS PERMIT Community Development Manager Sarah Madden explained that the applicant is seeking a Wetlands Permit to allow the installation of a new in-ground swimming pool, deck, fencing, pool patio decking, and landscaping improvements. Hearing notices were published and mailed to all properties within 350-ft. of the site; no comments or objections to this request were received. Community Development Manager Sarah Madden provided a planning staff report and a presentation on this planning item to the Commission (which is available for viewing through the City’s website). Staff recommended approval of this application based on the findings and with conditions. Commissioner Johnson referenced the vegetation planting plan and asked for more details on what will occur between the line of vegetation and the creek, noting her concerns for erosion along the bank of the creek. Community Development Manager Sarah Madden commented that the proposed landscaping in that area does come to the edge of the grade drop towards the creek. She commented that this is a typical residential landscaping plan with plants and boulders. She stated that there is a condition recommended which speaks to disturbance immediately adjacent to water resource areas. Commissioner Johnson stated that still did not answer her question of what is occurring between the landscape line and creek edge. Commissioner Corbett noted that area is currently grass. Community Development Manager Sarah Madden confirmed that area is currently sodded. Chair Field opened the public hearing. Page 10 of 205 April 30, 2024 Mendota Heights Planning Commission Meeting Page 3 of 7 Carlos Perez, applicant, stated that they submitted the last part of the wetland report today as required. He stated that they are addressing the rundown retaining wall with the enhanced landscaping proposed in the area referenced as the landscaping line before the creek. Commissioner Johnson commented that if there is any disturbance below the landscaped line, she would want to see native vegetation seed mix, similar to what exists around the pond. She stated that perhaps even if undisturbed, there could be some native mix or plugs between the landscape line and creek to help prevent erosion. Mr. Perez confirmed that they could take that into consideration as that does sound like a good idea. He stated that they did count the trees and provided that data. He stated that one dead tree will be removed, along with the invasive boxelder trees. He noted that this would still remain under the future impervious surface requirements that the City will be implementing. Commissioner Johnson commented that while boxelder is native, it is aggressive and agreed that would be good to remove those trees. Seeing no one coming forward wishing to speak, Chair Field asked for a motion to close the public hearing. COMMISSIONER PETSCHEL MOVED, SECONDED BY COMMISSIONER KATZ, TO CLOSE THE PUBLIC HEARING. C)PLANNING CASE 2024-07 - STEPHANIE AND ERIK JOHNSON – 1902 GLENHILL ROAD – MISSISSIPPI RIVER CORRIDOR CRICITAL AREA (MRCCA) PERMIT Community Development Manager Sarah Madden explained that Stephanie and Erik Johnson are the applicants and owners of the property located at 1902 Glenhill Road. They are requesting a Mississippi River Corridor Critical Area (MRCCA) Permit to install a new in-ground pool in the rear yard of their existing single-family residence. Hearing notices were published and mailed to all properties within 350-ft. of the site; no comments or objections to this request were received. Community Development Manager Sarah Madden provided a planning staff report and a presentation on this planning item to the Commission (which is available for viewing through the City’s website). Staff recommended approval of this application based on the findings and with conditions. Commissioner Johnson asked if land disturbance would qualify to ask the applicant to replace with native vegetation. Community Development Manager Sarah Madden replied that the overall MRCCA standards do list mitigation efforts that can triggered, one of which is native species replacement. She stated that while the applicant has provided a landscaping plan with plants typically seen in residential landscaping, some of those plants could be swapped out with native vegetation. She stated that in previous administrative applications on this property, there were native plants included that exist in other areas of the yard. Commissioner Stone commented that this seems to be an odd sized pool, which is meant to meet the requirements for the allowed size. He asked if someone from staff would be reviewing the site to ensure the length of the pool is as described. Community Development Manager Sarah Madden commented that the applicant has been in conversation with staff about the sizing and location of the pool because of the easement, so they are aware of that. Erik Johnson, applicant, commented that while he would have loved to have a 40-foot pool, he is aware of the site constraints and therefore designed something to fit within the allowed area. He commented that they tried to include pollinator friendly plantings, but could look more towards native plantings if that is more desired. He stated that staff is comfortable with the recommendation for approval and would consider the retaining wall to be more of a landscaping feature. BACKGROUND: The Friendly Hills Neighborhood Improvements have been identified in the 2024-2028 Capital Improvement Plan (CIP) for construction in 2025 and 2026. These streets currently have deteriorating bituminous surfaces along with aging public utilities and will benefit from a rehabilitation project to preserve the public infrastructure. The Council previously authorized a professional services contract with Kimley-Horn at the March 6, 2024, meeting to rehabilitate the following streets within the Friendly Hills Neighborhood totaling 3.56 miles of roadway: Apache Street, Aztec Lane, Cheyenne Lane, Creek Avenue, Decorah Lane, Fox Place, Hokah Avenue, Keokuk Lane, Mohican Court, Mohican Lane, Nashua Lane, Navajo Lane, Ocala Court, Ocala Lane, Pontiac Place, Pueblo Drive, and Pueblo Lane. Along with bituminous resurfacing, the proposed Friendly Hills Neighborhood Improvements includes water main replacement, due to the existing cast iron pipe’s susceptibility to water main breaks and break history, as well as sanitary sewer replacement along Decorah Lane and Apache Street. In addition to the previously identified streets within the Friendly Hills Neighborhood, staff are recommending the original contract be amended to include scope and services for the additional 0.85 miles of roadway including Apache Court, Apache Lane, Havenview Court, Hazel Court, Keokuk Lane (Dodd Road to Pagel Road), and Pagel Road. 6dPage 17 of 205 Funding challenges from external sources have resulted in the need for the Friendly Hills Neighborhood Improvements to be constructed over the course of two construction seasons (2025 and 2026) rather than the initially identified single year (2025). The 2024-2028 CIP identifies the additional streets for construction in the next five years and are proposed to be included with the Friendly Hills Neighborhood Improvements project due to their location directly adjacent to the project, existing pavement condition rating, and to further manage the City’s pavement rehabilitation plan. The contract amendment specifies tasks and costs associated with splitting the construction over multiple years along with the additional street segments through the feasibility stage of the project. An additional amendment will be necessary for the additional construction observation time and to split the construction service needs into multiple years. The additional street segments are intended to be included with the project’s feasibility report and would not require a separate feasibility report to be drafted. Specific treatment methods, improvements, and project year splits will be further identified in the feasibility process. FISCAL AND RESOURCE IMPACT: The original contract amount with Kimley-Horn for providing professional services on the project is $599,885. The additional requested not-to-exceed amount of $64,300 would result in a total contract amount of $664,185. The additional roadways are estimated to raise the total construction costs to $8,675,000 (from $8,200,000) and would be split over the multiple years of the project. The amended contract total is equal to 7.7% of the total revised construction costs. Planning, design, and construction costs associated with the proposed water main improvements will be funded by Saint Paul Regional Water Services (SPRWS) based on their ownership and desire to replace the water main in conjunction with the roadway rehabilitation. The costs will be refined during the feasibility process. The project is proposed to be funded by special assessments, municipal bonds, municipal state aid, SPRWS, and utility funds. Task 2.5 – Geotechnical Investigation Up to four (4) additional standard penetration borings will be obtained to a depth of 10-feet within the new street segments. Boring logs and recommendations for pavement rehabilitation will be included in the overall geotechnical report. Task 3 – Design Stage Task 3.1 – Topographic Survey Additional topographic survey will be obtained for the final design of the new street segments added to the project. We have assumed this will be limited to survey of utility castings/structures and surface features for these street segments as no watermain or other utility replacement is proposed. Task 3.3 – Final Design We will prepare preliminary and final design construction plans for the additional street segments being added to the project. BACKGROUND: The Bridgeview Shores Street Improvements have been identified in the 2024-2028 Capital Improvement Plan (CIP) for construction in 2024 and a contract has been awarded for the proposed improvements to Bituminous Roadways, Inc. by City Council in approving Resolution 2024-21 at its May 7, 2024, meeting. The improvements include rehabilitation of the following streets within the Bridgeview Shores neighborhood totaling 0.84 miles of roadway: Arbor Court, Bridgeview Court, Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven Court, Pondhaven Lane, Westview Circle, and Westview Terrace. Staff have requested quotes from various engineering firms to provide professional services during construction of the Bridgeview Shores Street Improvements. Professional services identified for construction include construction observation, geotechnical testing and recommendations, and surveying based on final plan documents procured by City staff. Staff developed a Request for Proposals (RFP) for the Bridgeview Shores Street Improvements project and invited four engineering firms to submit proposals. Three of the four firms from which proposals were requested were unable to submit quotes due to staff availability. Page 28 of 205 FISCAL AND RESOURCE IMPACT: The proposed not-to-exceed contract price of $197,318 is budgeted for within the 2024-2028 CIP and will be charged to the project. Anticipated construction costs total $1,735,766.19 for the Bridgeview Shores Street Improvements with an estimated $99,400.50 of direct construction costs to water main improvements. Planning, design, and construction costs associated with the proposed water main improvements will be funded by Saint Paul Regional Water Services (SPRWS) based on their ownership and desire to provide maintenance to the water main in conjunction with the roadway rehabilitation. The project is proposed to be funded by special assessments, municipal bonds, SPRWS, and utility funds. This was utilized while working on the Hopkins Blake Road project as there were multiple agencies that had utility conflicts with the projects new public utilities. This project includes over 58,000 Square feet of permanent sheet piling, new bike and pedestrian walks and trails, big block, boulder, and stone retaining walls. This also included a new water main connection to complete a city loop, new storm sewer facilities with an underground treatment system, and concrete barrier. There were numerous private utility relocations that were needed with this project, and Paul worked closely with the Contractor to coordinate these relocations so they did not impact permanent work. Paul proactively coordinated with project stakeholders, and nearby residents and businesses to maintain access throughout construction. Additional responsibilities included oversight of inspection and testing staff, maintaining project documentation, contract change management, ensuring compliance to project specifications, and project closeout. CSAH 101 Reconstruction Project | Project Manager | Maple Grove, MN | City of Maple Grove & Hennepin County | 2023 Paul was the Project Manager on the CSAH 101 Reconstruction Project. The length of the project was 1.5 miles and was constructed in two phases. The project included grading, bituminous surfacing, full depth stabilized reclamation, drainage and ADA improvements. The grading included areas that were widened to add curb and gutter, full road section replacement and stabilized full depth reclamation. Bituminous trails along with ADA improvements were added along CSAH 101 for improved pedestrian mobility and safety. Drainage improvements included storm sewer, culverts and ditches. The project was paved using thermal profiling and intelligent compaction. CSAH 101 won the merit award for bituminous surfacing on a county road reconstruct from MnDOT. Consistent and continued coordination efforts on this project between contractors, public works, Hennepin County and the City of Maple Grove made this project a success. The project encompassed four developments and a golf course, so up to date scheduling and communication was crucial to deliver customer service. Mark’s responsibilities on this project included inspection of public and private utilities, coordination of contractor activities, and documentation and tracking of daily activities and project quantities, as well as communication between relevant stakeholder which involved outside contractors, city officials, and project businesses and residents. Mark worked diligently with the local businesses and the Contractor so that access was always maintained through the project with multiple stages. This project consisted of the replacement of watermain and storm sewer, roadway improvements, concrete curb and gutter, concrete and asphalt paving, and beautification of downtown North St. Paul. Street and Utility Improvement Project | Lead Inspector | North St. Paul, MN | 2022 Mark was the lead inspector on this local funded construction project which included street rehabilitation, bituminous reclamation, partial curb and gutter replacement, and storm sewer improvements. Responsibilities included working closely with survey and materials testing staff, City of North St. Paul engineering staff, and residents on the project site. Due to the project location in a residential housing area, Mark worked closely with residents on driveway access and overnight parking and was a crucial coordination task that kept the project on schedule and residents informed of their daily access. Other project work included concrete walk replacements and ADA improvements, and watermain improvements. Mark Lynch | Lead Inspector WSB Materials Testing | Materials Testing & Sampling Material Testing and Sampling will be provided by WSB’s Construction and Materials Testing (CMT) Group and will utilize our AASHTO Accredited Laboratory. With more than 15 dedicated and fully-certified MnDOT Material Testers, we provide innovative and cost-effective construction materials testing, sampling, in both public and private sectors amongst our CMT staff. WSB offers more than 100 different testing procedures for grading and base, concrete, and bituminous materials. As a company, we have provided testing services for over 50 federal, state and state-aid funded projects each year and over 150 different municipal projects in 2022 and 2023. Page 32 of 205 | 3PROPOSAL FOR CONSULTING SERVICES FOR BRIDGEVIEW SHORES STREET IMPROVEMENTS Pete is a National Society of Professional Surveyors Level III Certified Survey Technician and Survey Crew Chief with over 25 years of experience. He manages a survey crew performing preliminary design surveys, right-of-way surveys, and construction staking on large, complex transportation projects. Pete has provided construction staking services for private, municipal, county, and state entities and assures quality work flow between the owner and contractor. Pete is experienced in utilizing Trimble GPS equipment and Trimble Robotic Total Stations to ensure accurate and efficient staking procedures. He utilizes the full capabilities of his equipment and the use of detailed proposed surfaces for construction staking, allowing him to effectively respond to all project needs. Pete Bade | Survey Crew Chief 2 | Project Understanding & Approach To demonstrate our understanding of the nature of the work and ability to exceed the expectations of Mendota Heights to successfully deliver this project with the requested services, we have developed the following project understanding and approach for this Contract. Project Understanding Features of this $1.7M street project include the rehabilitation of Arbor Court, Bridgeview Court, Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven Circle, Pondhaven Lane, Westview Circle, and Westview Terrace, as well as ADA and Sidewalk improvements, drainage replacements, and watermain improvements. Other work includes close coordination with City of St. Paul’s Regional Water Services for anode bag installation and retrofit. Construction is anticipated to begin in early June of 2024 with substantial completion in the fall of 2024. Due to the project’s location, access coordination and impacts to those who live adjacent to the local streets will need to be proactively managed. This will require regular updating of project progress for public engagement needs as construction occurs. Additionally, proactive and detailed inspections will be required during ADA pedestrian ramp construction, and utility removals and installation to quickly resolve any issues that may arise during construction. Project Approach At WSB, we believe the consistent delivery of successful projects begins with establishing channels of communication before the project begins, clearly identifying roles and expectations, and proper planning. This minimizes project concerns and allows issues to be resolved both effectively and efficiently, which results in a cost- effective and high-quality project. Utilizing this proactive approach reduces the potential for delays, disputes, and the need for costly rework. Our approach to this contract will be no different. The following Work Plan/Project Approach for this Contract has been developed from the description of services and responsibilities provided in the RFP for this Contract, as well as our experience providing the requested services on projects of similar scale and understanding of the nature of work to be completed. This includes a description of the services required to successfully deliver this project to the City based on the each of the requested tasks for this Contract. To further ensure the successful delivery of this project, Paul Kyle, PE will serve as the single point of contact for the duration of the contract, as well as our Project Manager for this Contract. Following contract execution, Paul will meet with Mendota Heights to discuss staffing needs, clearly define expectations, and to develop communication and staffing protocols, beyond those described within this Proposal. He will be responsible for the overall management of our staff and resources to ensure our services are completed, as required by the City, and to meet the goals and objectives for this project. CONSTRUCTION INSPECTION Prior to the start of construction, our inspection staff will review the plans and specifications for the project to proactively identify inspection and testing needs, as well as determine any areas of concern that may present risks or challenges to the project. Once site work begins, our Construction Inspection Staff will deliver all inspection-specific tasks and deliverables as outlined in the RFP. They are accustomed to the demands of construction while working in the field and understand the expectation of working the hours determined by the Contractor. Throughout construction, our Inspector will continually provide daily on-site inspection and documentation of the Contractor’s work to ensure it adheres to the requirements and specifications provided in the project plans and contract documents. If work is determined to be non-conforming or deficient, our staff are comfortable rejecting work and working with the contractor Page 33 of 205 | 4PROPOSAL FOR CONSULTING SERVICES FOR BRIDGEVIEW SHORES STREET IMPROVEMENTS to resolve the issues to find solutions to the nonconforming work. Our inspector will coordinate with the contractor, survey crew, and material testing staff to verify when surveying and material testing needs are required on site and ensure the proper staff are scheduled to arrive to maintain the progress of work. To ensure surveying and testing needs are coordinated efficiently with contractor activities, our staff will maintain daily communication with our survey crew chief and testers. As work progresses, they will measure, document, and track contract pay items daily to be entered into the IRA in OneOffice, or software program as chosen by Mendota Heights. While working on-site, our inspection staff understand the responsibility of serving as representative of the City and ensure work is completed in their best interest. This includes maintaining a professional image on-site and communicating with adjacent property owners to answer questions and address concerns. Furthermore, they will maintain frequent communication with our Project Manager for regular reporting and to notify them of any issues that arise on site, so that all parties are kept well informed, and the most appropriate solutions are implemented. CONTRACT ADMINISTRATION Upon contract approval with WSB, we will immediately begin the process to successfully deliver the project on behalf of Mendota Heights. We will conduct a kick-off meeting with City staff to refine their expectations and outcomes so the WSB team can deliver on- site. We will inform the contractor of what is required for submittals prior to starting work on site. Prior to the start of construction, we will set clear expectations for the contractor on what both the City and WSB require on site. It is imperative to the success and quality of the project that these expectations are set with the contractor from the beginning. WSB will also require and review the contractor’s proposed schedule for constructability concerns and prepare staff to work in accordance with the schedule upon its approval. We make our expectations clear from the start of a project and maintain communication throughout to operate as part of a unified team. In doing so, we can achieve the common goals for the project, with one of our biggest being contract compliance. Responsibilities related to contract administration will be shared by field personnel on the project and will be completed in accordance with the Minnesota Statute 429 (MS429) and each of the Project- Specific Manuals. Prior to construction, our staff will prepare any forms or reports ahead of time, if possible, based on their review of the project plans and contract documents to promote organized documentation and a proactive approach to construction. They will anticipate required contractor submittals before construction begins and enforce expectations for quality and compliance of contractor work from the first day of construction. Throughout construction, our field staff will complete the necessary documentation and reporting of the Contractor’s work. This includes daily dairies, record keeping of contract line items the Project IRA, and weekly diaries. Our Project Manager will schedule and administer weekly meetings and distribute minutes thereafter. He will also create a file sharing site to allow all project team members access to project documents. Weekly meetings are a crucial tool, especially on projects with a short schedule, to ensure milestones are met and all stakeholders are adequately informed. WSB also understands the project is not complete when the contractor leaves. Our team will complete the necessary field finalizing of the project documentation in accordance with MnDOT’s Contract Administration Manual and work closely with the City to assure all needs are met. The team understands that proper close-out of the construction contract must provide the City with the following: Documents required by the 2023 Schedule of Materials Control, and Contract Administration Manual, Daily Work Reports and Daily Diaries, Material certifications, testing results, pay vouchers created at least once per month, change orders, and additional final documents including, but not limited to, final as-builts. Page 34 of 205 | 5PROPOSAL FOR CONSULTING SERVICES FOR BRIDGEVIEW SHORES STREET IMPROVEMENTS CONSTRUCTION SURVEYING Our proposed surveyor, Pete Bade will establish relationships with Mendota Heights and the Contractor’s surveying staff. These relationships will enable frequent communication and ensure that surveying oversight is coordinated to maintain schedule and progress. Additionally, he has an in-depth understanding of construction sequencing which will enable him to verify that surveying needs are met in a proactive manner. Furthermore, he will assist field staff with verifying and maintaining the as-built documentation as construction progresses. MATERIALS TESTING AND SAMPLING Once construction begins, our team will deliver all specific tasks and deliverables as noted in the RFP of this proposal. These will include material testing such as concrete air, slump and cylinders and grading and base testing including gradations, moisture and density, as well as the required bituminous material sampling all in accordance with the 2023 Schedule of Materials Control, as provided in the Contract documents. Our inspector will be responsible for the coordination of any material testing and sampling throughout construction. Prior to construction, our inspector will identify quantities for grading and base items, testing rates, and minimum number of tests required for the entire project per the 2023 Schedule of Materials Control. This document will become part of the project file and distributed as required. Once construction has begun, Paul Kyle will continually review the testing requirements as testing takes place to verify the proper number of tests are completed onsite and at the correct rates, as defined by the 2023 SMC. Paul will also oversee material testing personnel to ensure proper scheduling and coordination of material testing and sampling. Our trained and experienced inspection and testing staff will utilize visual inspection to ensure that the tests taken are representative of the material and workmanship. If visual inspection shows differing materials, or methods, then additional tests will be performed. Material quality will be managed throughout the duration of the project to ensure the highest quality roadway product is delivered to Mendota Heights. 3 | Cost Cost is provided as a separate document. The event was well attended with over 40 park goers in attendance, totaling $277.15 of ice cream purchased from Mik Mart Ice Cream truck. The application and supporting documents were noticed to the members of the Technical Evaluation Panel (TEP). One comment was received from the TEP (attached). The wetland delineation report identified one wetland basin (identified as Wetland 1) within the investigation area, consisting of .12 acres, and classified as Type 5, Open Water wetland. BACKGROUND: The applicant is proposing to install a new privacy fence in replacement of existing fencing on the property. The existing fence is a combination of wood privacy fence, and chain-link. The applicant is working with Keller Residential to furnish and install 360’ of 6’ cedar fencing with two 42” wide gates, and one additional 84” wide double swing gate. The proposed fence would enclose the side and rear yard, which contains an existing in-ground swimming pool. The proposed fence style is consistent with the code requirements for swimming pool fences. The subject property is located within the R-1 Residential Zoning district; and is situated within the Mississippi River Corridor Critical Area overlay district. According to the city’s MRCCA Mapping of this area, the subject property is located in the SR-Separated by River District. The MRCCA Map of the subject property shows a demarcated bluff line approximately 65-ft. (at its closest point) from the proposed fence location. No part of this proposed fence will impact or affect any adjacent bluff, steep slopes, or bluff impact zones (BIZ). The MRCCA Mapping system also identifies any Primary Conservation Areas (PCA), which include protected areas such as established Significant Existing Vegetative Stands or Native Plant Communities on properties inside the MRCCA district. The location of this new fence does not impact any part(s) of the adjacent PCA’s in this area. Pursuant to City Code Section 12-3-12, no building permit, zoning approval, or subdivision approval shall be issued for any action or development located in an area covered by this chapter (Miss. River 6iPage 85 of 205 Corridor Critical Area) until a site plan has been prepared and approved in accordance with the provisions of this chapter. Subpart D. of this section also includes an allowance for “Minor Developments”, which include minor improvements to a single-family property that can be approved directly by the City Council, without Planning Commission review or recommendation, and without a public hearing, but only if the minor project and plans conform to the general standards of this section. Eligible projects for an Administrative MRCCA Permit include small building additions, decks; fences; etc. All administrative approved projects must meet or comply with the following conditions (with Staff comments noted afterwards): 1.No part of the subject property shall have slopes of greater than eighteen percent (18%). Staff Comments: The new fence is being placed along the northern portion of the property and provides a perimeter along the property line encasing the rear yard of the home. According toDakota County GIS mapping, this area is fairly flat and level and the property does not contain any slopes or major gradients (over 18%). Staff believes and confirms this standard is being met. 2.No part of the project shall impact, disturb or be situated in a bluff line setback area as defined by this chapter, whether on the same parcel or on an abutting parcel of land. Staff Comments: Although the subject property is situated in the MRCCA overlay district, there are no bluffs; bluff impact zones (BIZ’s); or any Primary Conservation Areas (PCA) on this property. The replacement of the fence is minimal and minor enough to not pose any threat or negative impacts to the abutting or neighboring properties. Staff confirms this standard is being met. 3.The proposed project shall not expand the enclosed area of the principal or accessory structures by more than two hundred (200) square feet. Staff Comments: Not applicable; there is no addition proposed under this permit. Staff confirms this standard is being met. 4.The proposed project shall not increase the height of any existing structure. Staff Comments: Not applicable; there is no addition being made to any structure(s) under this permit. Staff Comment: The proposed fence is intended to follow the existing grades of the subject property, and would be consistent with the general alignment of the existing fence. There are no plans by the fence contractor or homeowner to change these grades as part of this fence project. Staff confirms this standard is or will be met. 7.The proposed project areas shall include native vegetation. Staff Comments: This permit would allow the installation of a typical residential privacy fence on the property, which is also required to enclose the swimming pool area under the City’s existing codes. There are no plans to remove any vegetation or trees to install this fence. Staff confirms this standard is being met. Based on staff’s interpretation of the intent of the Minor Development provisions of Title 12-3-1, the scope of the project does not require Planning Commission recommendation and a public hearing; and therefore, may be given full consideration and approval by the City Council. One of those calls ended up being a controlled burn and so MHFD did not need to do anything. Three of the calls were grass/brush fires that required the department to extinguish them. Medical/Extrication: 6- In March there were three emergency medical calls that MHFD responded to, as well as a vehicle accident with injuries and an accident involving a semi-truck requiring extrication of the driver. Finally, a call came in for an infant’s leg that had become entrapped in the side of a crib. Hazardous Situations: 5- One call was for a gas leak near the meter of a building’s exterior. The second call was regarding a ground mounted transformer leaking oil. The remaining three were for Carbon Monoxide calls. Service Calls: 1- In March the MHFD did receive one call for a cat in a tree. The cat was not within reach of our ladders or aerials. False Alarms/System Malfunctions: 9- MHFD responded to one system malfunction, seven unintentional alarm trips, and one sprinkler activation with no fire. BACKGROUND: In 2016, Council approved adding the job classification of Community Service Officer (CSO) to the police department. In addition to code enforcement, this non-sworn position would act as a feeder program to becoming a licensed officer within the department. In 2020, the enforcement of city code was moved out of the police department and placed under the purview of community development. With this change, the CSO position has not been filled since 2020, thereby removing the potential avenue to recruit new officers from within the agency. Currently, more and more police departments are moving toward a cadet program to aid with recruitment. These programs employ individuals with college degrees looking to pursue a career in policing but who have not completed the required education and training components to be a police officer in Minnesota. Individuals approved for these programs attend an accredited training program and, upon successful completion, transition into a police officer position within the agency. Those individuals accepted into cadet programs are compensated as full-time employees to attend the training program. Additionally, the costs to attend the training program are paid for by the agency sending the cadet. These training programs are approximately 22 weeks in length. Following the successful completion of their training program, the police cadet would be onboarded as a police officer with the City of Mendota Heights Police Department. The City’s tuition reimbursement program would apply to any repayment of costs in the case that the cadet either did not successfully 6kPage 107 of 205 complete the program or if they did not complete the required time with the department following their training. Staff is recommending a restructuring of the Community Service Officer position into a Police Cadet position within the police department and to authorize posting. This restructuring will allow for the department to recruit from that pool of individuals who meet the qualifications to be a cadet. FISCAL AND RESOURCE IMPACT: Compensation will be based on the City’s 2024 Compensation Plan and the police cadet classification would replace the CSO at a Pay Grade 2, with a pay range of $23.86-$29.33 per hour. This position would be a non-exempt, benefit eligible, 40- hour per week position. This is in-line with market rates for what other police departments in our comparison cities are offering for police cadets. Any funding needs for the cadet program would be covered by the police department budget. Additionally, this restructuring would make the city eligible for grant programs offered to cover the costs for agencies to offer a cadet program. The most recent grant awards were $50,000.00 per cadet. The intention for this position would be to feed into a full-time police officer position. This posting would replace the current authorization for posting that is currently active within the department to fill a vacant police officer position. BACKGROUND: With City Council authorization, the Oheyawahi/Pilot Knob Task Force and Dakota County applied for and received a Heritage Partnership Program grant from the Minnesota Historical Society (MHS) for the development of Phase II of the interpretation plan for the Oheyawahi/Pilot Knob Preservation site. The city and its partners were awarded a Heritage Partnership Program grant from MHS in the amount of $50,000, with a cash match of $10,000. Cash match funds will be provided by the city of Mendota Heights. Full Circle Indigenous Planning + Design was selected as the preferred consultant for the project. An Interpretive Concept Plan has been developed as a result, focusing on engagement with the Indigenous community, and furthering collaboration with the city, County and Pilot Knob Preservation Association, in order to provide a thorough and comprehensive interpretation and educational experience for school groups, tour groups and members of the public. BACKGROUND: The subject site consists of 1.39 acres (60,444 sq. ft.) of vacant land on the western edge of Mendota Heights. The parcel has never been platted and does not contain any existing improvements. The applicant has expressed an intent to subdivide the parcel for the purpose of conveyance to the neighboring property owner to the south/south-east, with the dividing line between the two proposed Outlots running east-west consistent with the existing dividing line between 1855 Hunter Lane and 1867 Hunter Lane. City Subdivision Code Section 11-3-2 allows the subdivision of parcels, provided that the resulting lots are compliant with the requirements of the applicable zoning district, including minimum frontage on a city street or road system. The existing parcel does not and will not have any direct access onto Hunter Lane to the east, or towards Sibley Memorial Highway to the west. This status is proposed to be continued, with no improvements planned on the property. The existing site conditions, including steep slopes and the property’s location within the MRCCA’s Bluff Impact Zone, would prohibit the construction of any new structures. The proposed plat identifies the parcels as non-buildable Outlots to reflect these site conditions. As part of this request, the applicant is designating the proposed parcels as non-buildable and setting them aside for future conveyance and later combination. The northern parcel will be known as Outlot A, and will remain under common ownership with the applicant. Outlot A is proposed to be .89 acres (38,621 sq. ft.) in size. The southern parcel will be known as Outlot B, and is planned to be conveyed to the adjacent property owner and later consolidated with 1867 Hunter Lane. The applicant understands that no new building rights are granted as a result of the subdivision, and the conditions listed within the attached Resolution memorialize future requirements to combine the proposed parcels with adjoining land which has access or frontage on a City-approved street. At the May 28, 2024, Planning Commission meeting, a planning report was presented. A duly noticed public hearing was held, and one member of the public spoke to the application asking clarifying questions on any future ability to build on the parcels. The applicant was also present to speak to the application and to answer questions from the Commissioners. The Planning Commission discussed the land and building restrictions that are present within Bluff zones in this area, the condition to combine the proposed parcels with an adjoining parcel with the minimum street frontage, and the City Code requirements for additional detached garage size which may be an eligibility on a future-combined parcel. A copy of the 05/28/24 planning report with attachments and an excerpt from the unapproved minutes are attached to this memo. As noted in the attachment, staff recommended approval of the Preliminary and Final Plat request. ANALYSIS Plat Standards Under Title 11, Subdivision Regulations, the intent and purpose of this section is to “safeguard the best interests of the city, and to assist the subdivider in harmonizing [their] interests with those of the city at large, this title is adopted in order that adherence to same will bring results beneficial to both parties. It is the purpose of this title to make certain regulations and requirements for the platting of land within the city pursuant to the authority contained in Minnesota statutes, which regulations the city council deems necessary for the health, safety and general welfare of this community.” City Subdivision Code Section 11-3-2 allows the subdivision of parcels, provided that the resulting lots are compliant with the requirements of the applicable zoning district, including minimum frontage on a city street or road system. The existing parcel does not and will not have any direct access onto Hunter Lane to the east, or towards Sibley Memorial Highway to the west (see image – below). The Preliminary Plat notes identify that the reason for the proposed subdivision is to accommodate the conveyance of the land to the neighboring property, and that both parcels are not intended to be created as buildable lots. A subdivision procedure, through a Preliminary and Final Plat, is required to accommodate the conveyance of land in this case, as the parcel is currently unplatted, with a metes and bounds legal description. The Subdivision Ordinance does not permit the conveyance of land by metes and bounds in cases where the parcel is less than 5 acres in area or less than 300’ in width. Generally, an Outlot is a plot of undeveloped land, sometimes without access to public roads, which is designated by a developer on a plat for future construction. As part of this request, the applicant is designating these parcels as non-buildable and setting them aside for future conveyance and later combination. Page 193 of 205 Planning Case 2024-08 (Fritz Addition – Paul Katz) Page 3 of 5 Despite being proposed as Outlots, the parcels do conform with the minimum lot size of the R-1 Zoning District. The existing parcel does not have a street frontage with which to measure lot width and by approving this subdivision, the parcels would be non-conforming due to the lack of frontage on any public street. With the applicant’s intention to later complete procedures to combine the parcels with adjoining lots, the parcels would then maintain frontage via their combination. City staff does not anticipate any issues with the continued use of the parcels as vacant and non-buildable land. The parcels status within the MRCCA and Bluff Impact Zone provide additional land restriction on the parcels, in addition to the lack of frontage on a City-approved street. Staff does not foresee any negative impacts to surrounding uses or the neighborhood with this proposal to subdivide and convey ownership of property, provided the conditions listed herein are met. Due to the nature of the division of this parcel, the applicant understands that no new building rights are granted as a result of the subdivision, which has been reflected in the conditions within the Recommendation section of this report. Staff is recommending it to be a requirement and condition of approval that the new parcels created by this subdivision action are combined with other adjoining property through a future action. The applicant and their surveyor are aware of the lot combination requirements for any future subdivision action. In order for the proposed parcels to be considered buildable, they would need to be combined with an adjoining lot which is buildable and which has access on a City-approved street. The land within these parcels will remain restricted due to the MRCCA standards for development within the Bluff Impact Zone. An adjoining buildable lot which is legally combined with one of the proposed parcels would be able to calculate their lot size and setback requirements from the revised property lines as part of any future combination. MRCCA Requirements The subject site is located within the Mississippi River Corridor Critical Area (MRCCA), within the “River Neighborhood” sub-district, and located entirely within the Bluff Impact Zone (BIZ). The entirety of the parcel also consist of two areas of existing vegetative stands for forest features and overall tree canopy coverage. The MnDNR’s mapping services indicate that all of the subject parcel contains slopes that exceed 18%, and the Preliminary Plat indicates contours that range over 100’ in elevation from the western edge of the property to the east. There are no improvements proposed on this property, as the subdivision is proposed to accommodate the conveyance, or sale, of the proposed Outlot B to an adjoining property owner and there is an intent to later combine the newly created parcels with the respective addressed parcels to the east, which have frontage on Hunter Lane. City Code Section 12-3-11 regulates Subdivision and Land Development Standards within the MRCCA. Because this application is a minor subdivision consisting of two or fewer lots, the proposal is exempt from the requirements of the MRCCA District. There are no proposed development impacts to the parcels as they are not buildable. Despite this application meeting the criteria for exemption from the MRCCA standards, staff did notify the MnDNR and National Park Service of the application which was received. The MnDNR responded that they did not have comments on the application, and no response was received from the National Park Service. REQUESTED ACTION Following the public hearing and discussion, the Planning Commission may consider the following actions: 1.Recommend approval of the Preliminary and Final Plat of FRITZ ADDITION, based on the attached findings-of-fact as noted herein; or 2.Recommend denial of the Preliminary and Final Plat of FRITZ ADDITION, based on revised findings-of- fact and conditions as determined by the Planning Commission and/or City Council; or 3.Table the plat application, and request additional information from the Applicant and/or city staff. Community Development Manager Sarah Madden commented that the application is only for the lot split and a lot consolidation would occur through another plat. She noted that this case could not meet the criteria to complete that consolidation administratively. She stated that the overall lot size, after combination, could add some flexibility to additional garage space because of the lot size. She reviewed the secondary garage requirements and size allowances based on lot size. Commissioner Corbett commented that even with the combination that could occur from two lots, it would appear the secondary garage size allowance would remain the same and no additional rights would be gained. Scott Van, 1870 Hunter Lane, commented that he is confused how these would be non-buildable but at the same time the second condition states that they could be added to lots. He was concerned as they had always been told that the bluff was non-buildable. Commissioner Petschel commented that the bluff sections would not be buildable no matter which lot they are attached to. He commented that at some point these outlots would be attached to another parcel, per his understanding. Commissioner Corbett explained that the outlots would need to be attached to another lot in order for any of that property to be buildable. Commissioner Petschel provided additional clarification that the area of the lots marked in grey could not be built upon. Seeing no one further coming forward wishing to speak, Chair Field asked for a motion to close the public hearing. He stated that combining this with another lot would not impact whether the lot would be a flag lot. Public Works Director Ryan Ruzek commented that lot A is just shy of 100 feet of frontage, by less than one foot, and therefore including that language could complicate things in the future.
