Held Tuesday, January 9, 2024
Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights,
Minnesota was held at 7:00 p.m. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota.
CALL TO ORDER
Mayor Levine called the meeting to order at 7:05 p.m. Councilors Lorberbaum, Paper, Mazzitello, and
Miller, were also present.

H) APPROVE THE PURCHASE OF FIRE EXTINGUISHER TRAINING SYSTEM FOR PUBLIC
EDUCATION
Mayor Levine recognized this purchase as she believes that this is important for residents to know about.
Councilor Miller commented that this opportunity has been awarded to the Fire Department through
generous donations from the Coss Family. He stated that these funds will be used to purchase a simulator
that will help to educate firefighters and the community on how to use fire extinguishers. He stated that
this is an investment in the Fire Department and the community as they will be able to educate people on
how to safely put out fires.
Councilor Miller moved to approve THE PURCHASE OF FIRE EXTINGUISHER TRAINING
SYSTEM FOR PUBLIC EDUCATION.

Councilor Lorberbaum commented that the report mentions that the vendor will begin work at 6:00 a.m.
but after speaking with staff she has discovered that suggested start time is related to a subcontractor and
work will not begin in the neighborhood at 6:00 a.m.
Councilor Lorberbaum moved to approve PROFESSIONAL SERVICE CHANGE ORDER FOR
EMERSON AVENUE STREET IMPROVEMENTS.

NEW AND UNFINISHED BUSINESS
A) RESOLUTION 2024-04 APPROVING A WETLANDS PERMIT AT 947 WAGON WHEEL
TRAIL (PLANNING CASE NO. 2023-29)
Community Development Manager Sarah Madden explained that the Council was being asked to adopt
Resolution 2024-04 approving a Wetlands Permit to allow the permitting and construction of a new single-
family dwelling at 947 Wagon Wheel Trail.
Councilor Lorberbaum asked why there were two votes of opposition from the Planning Commission and
whether those were related to the lack of landscaping plan.
Community Development Manager Sarah Madden replied that the discussion was heavily focused on the
landscaping plan and that there was not a separate document identified as a landscaping plan. She
confirmed that the two votes in opposition were from Commissioners that desired a separate landscaping
plan rather than references to landscaping on other plans. She confirmed that a separate landscaping plan
has since been provided.
Councilor Paper referenced the garage doors and commented that those seem too wide.
Councilor Lorberbaum commented that the home itself is not being approved at this time, as the request
is for the Wetlands Permit.

Community Development Manager Sarah Madden confirmed that the home itself will come forward at a
future time to be reviewed during the building permit process.
Councilor Paper asked how far irrigation would go, whether that would just be for the sod, or extend
further.
Sean Doyle, applicant, commented that they plan to irrigate the whole yard although they have not laid
out the arrangement yet but confirmed that the area that will be hydroseeded will be irrigated.
Councilor Paper moved to approve RESOLUTION NO. 2024-04 APPROVING A WETLANDS PERMIT

City Administrator Cheryl Jacobson provided background on this item. The Council was being asked to
consider ordinances implementing Utility Franchise Fees in the City of Mendota Heights.
Councilor Mazzitello thanked Xcel Energy for their assistance and support throughout this process.
Councilor Miller moved to adopt ORDINANCE NO. 583 APPROVING GAS FRANCHISE
AGREEMENT AMENDMENT, ORDINANCE NO. 584 APPROVING THE GAS FRANCHISE FEE
ORDINANCE, ORDINANCE NO. 585 APPROVING ELECTRIC FRANCHISE AGREEMENT
AMENDMENT, AND ORDINANCE NO. 586 APPROVING ELECTRIC FRANCHISE FEE
ORDINANCE.
Councilor Mazzitello seconded the motion.
Further discussion: Councilor Mazzitello commented that this topic was extensively discussed through a
series of workshop meetings which is why there is not much discussion tonight. He believed that this is
a good agreement that will help the City diversify its revenue stream.
Mayor Levine agreed, noting that most residents will see an annual fee of $24 while even the largest
commercial/industrial user would see no more than $600 annually. She stated that this will also put
Mendota Heights in -line with the other communities that have established franchise fees. She also made
the comment that this is a small way for the City to diversify its revenue.

C) AUTHORIZE PROFESSIONAL SERVICES CONTRACT FOR THE PARK SYSTEM MASTER
PLAN
Parks and Recreation Manager Meredith Lawrence provided background information and explained that
the Council is asked to authorize a professional services contract with Confluence/PROS for the
development of a city-wide Park System Master Plan for a not to exceed amount of $85,970.
Councilor Paper asked for more information on the equity analysis.
Parks and Recreation Manager Meredith Lawrence explained that the equity analysis would look at the
city as a whole, where people live, and where their access to parks and recreation would be. She stated
that this would look to expand park opportunities to all residents to ensure there are recreation activities
within walking distance.
Councilor asked the range of the bids received.
Parks and Recreation Manager Meredith Lawrence provided the range of base bids along with the alternate
bids.
Councilor asked what was lacking in the second proposal.
Parks and Recreation Manager Meredith Lawrence replied that each bidder had something that stood out.
She commented that the recommended bid stood out because of their knowledge and expertise in parks
planning along with the financial piece.
Mayor Levine commented that this would be about $11,000 over the budgeted amount. She agreed that
the financial component is important and was unsure why that was not included in the base bid. She also
believed that implementation and prioritization is important but also is linked to the equity analysis as that
would determine the priority. She asked how prioritization could be completed without the equity
analysis.
Parks and Recreation Manager Meredith Lawrence replied that the financial piece was included in the
RFP, but the RFP did not include a dollar amount. She stated that consultants then reached out asking the
budget which staff provided. She stated that piece of the financial element were included in the RFPs but
this stood out as it included more detail and information. She recognized that there are a lot of desires but
those are dependent on the budget. She stated that equity would be completed at the beginning of the
project so that those results could be tied into the remainder of the process. She stated that although equity
was stated as something that was important, it was not a requirement. She stated that the equity analysis
would go deeper than the requirements of the RFP.

Councilor Miller asked if there is thoughts as to where the additional $11,000 could come from.
Parks and Recreation Manager Meredith Lawrence replied that this funding would come from the special
parks fund. She stated that two projects were recently bid that use that fund and both were under budget,
therefore that provides the necessary funding. She noted that having this master plan in place will also
make the City more eligible for outside grant funding opportunities as that is often a requirement.
Councilor Lorberbaum moved to authorize PROFESSIONAL SERVICES CONTRACT WITH
CONFLUENCE/PROS FOR THE DEVELOPMENT OF A CITY-WIDE PARK SYSTEM MASTER
PLAN FOR A NOT TO EXCEED AMOUNT OF $85,970.

COMMUNITY ANNOUNCEMENTS
City Administrator Cheryl Jacobson announced upcoming community events and activities.
COUNCIL COMMENTS
Councilor Paper commented that public works has done a great job on the trails and the system remains
exceptional.
Councilor Lorberbaum commented that interviews were held for the vacant position on the Natural
Resources Commission. She expressed gratitude for the number of qualified individuals that applied and
hoped that those not chosen would continue to apply for positions that arise.
Councilor Miller wished everyone a happy new year.
Councilor Mazzitello noted the upcoming Coffee with the Council at which he and Councilor Lorberbaum
will be available to have informal conversations with residents and encouraged residents to attend. He
also noted the upcoming Future Cities Competition which will be held on January 20th. He also noted the
passing of Sue Polka, who was a city staff member from 2003 through 2008 and served a long and
recognized career in public service and public works.
Mayor Levine commented that the temperatures are going to drop in the coming week and encouraged
residents to pull out winter clothing and to be safe. She also encouraged residents walking in the evening
to wear reflective clothing.

Minutes of the Parks and Recreation Commission Work Session
December 12, 2023
Pursuant to due call and notice thereof, a work session of the Parks and Recreation Commission, City of
Mendota Heights, Minnesota was held at 1101 Victoria Curve, Mendota Heights, MN 55118.
CALL TO ORDER
Chair Jaffrey Blanks called the meeting to order at 4:40pm. Commissioners Jo Schifsky, Michael Toth,
Tica Hanson, Michelle Muller and Dan Sherer were also present. Commissioner Steph Meyer was absent.
City staff present included Meredith Lawrence, Parks and Recreation Manager, Ryan Ruzek, Public
Works Director and Willow Eisfeldt, Recreation Program Coordinator.
Parks and Recreation Manager Lawrence stated that the goal of the work session is for staff to be made
aware of the commission's strategic planning initiative priorities for 2024. Parks and Recreation
Manager Lawrence provided an update on the Park System Master Plan --Request for Proposals and the
Community Center Feasibility Study, which are projects that will continue into 2024 from 2023.
RE -MANEUVERING EXERCISE
Parks and Recreation Manager Lawrence lead the commissioners through a re -maneuvering exercise.
Commissioners each shared their thoughts in regards to the City's parks and recreation
accomplishments, in -progress projects, and barriers/setbacks from the last year. Staff and the
commissioners discussed how this analysis will impact the 2024 work plan priorities.
PRACTICAL VISIONING EXERCISE
Parks and Recreation Manager Lawrence lead the commissioners through a practical visioning exercise.
Commissioners each shared their 2024 priorities in regards to the seven initiatives listed in their
strategic plan:
1. Sustainable source of funding for Parks and Recreation
2. A leading community with invested partners
3. Greater connection to the natural environment
4. A safe, connected, walkable and bikeable community
5. Vibrant and diverse community programming
6. Active recreational facilities for all ages
7. Effective two-way communication with an informed community
Parks and Recreation Manager Lawrence thanked the commissioners for their time and insight. She
noted that staff will begin compiling the information into a Draft 2024 Parks and Recreation Work Plan
to be reviewed by the commissioners at their January, 2024 meeting.
The commission adjourned the meeting at 6:20pm.

The December meeting of the Mendota Heights Parks and Recreation Commission was held on
Tuesday, December 12, 2023, at Mendota Heights City Hall, 1101 Victoria Curve.
1. Call to Order — Chair Jaffrey Blanks called the meeting to order at 6:30 p.m.
2. Roll Call — The following Commissioners were present: Chair Jaffrey Blanks,
Commissioners: Tica Hanson, Michelle Muller, Jo Schifsky, Dan Sherer, and Michael Toth;
absent: Commissioner Stephanie Meyer and Student Representative: Meg Murphy. Staff
present: Parks and Recreation Manager Meredith Lawrence, Recreation Coordinator Willow
Eisfeldt, and Public Works Director Ryan Ruzek.

7. Acknowledgement of Reports
Chair Blanks read the titles of the three updates (Par 3, Recreation, and Park Improvement
Updates) and polled the Commissioners for questions.
7.a Par 3 Update
Parks and Recreation Manager Meredith Lawrence stated that with the course closed for the
season they are already prepping for a potentially early opening in the spring. She stated that
seasonal jobs for the course will be posted in January of 2024. She provided details on well
pump malfunction caused by a power outage. She stated that the course was closed on
October 27th and reported a recording setting number of rounds of golf this season. She
reviewed some of the potential capital improvement projects and equipment purchases for
2024.
7.b Recreation Update
Recreation Coordinator Willow Eisfeldt provided details on the events included in Frozen Fun
Fest coming in February. She also highlighted other upcoming events, activities, and youth
programming. She stated that she has also began to work on the summer programming
opportunities.

Parks and Recreation Manager Meredith Lawrence provided an update on the progress of the
2023 park improvement projects. She also reviewed the 2024 list of projects.
Commissioner Toth asked staff for an update on what happened with the concrete pad at the
skate park.
Public Works Director Ryan Ruzek provided an update on the concrete pad work and the
corrections that were done in attempt to prevent water from pooling.
Ms. Lawrence noted that the repair work that was done was completed by the contractor and
there was no additional cost.
8. New Business
8.a Wentworth Park Pickleball Discussion
Parks and Recreation Manager Meredith Lawrence stated that the City currently has 12
pickleball courts for residents to use within Mendota Heights at Friendly Hills and Marie Parks.
She noted that the intent tonight is to discuss the potential to add pickleball courts within the
hockey rinks at Wentworth Park and receive input from the public. She stated that a notice
letter was sent to residents within 750 feet of the park boundary and noted that staff has not
received any written comments prior to the meeting. She stated that she did meet two residents
in person that were in favor of the project. She anticipated that the project would have a cost of
about $30,000.
Commissioner Sherer commented that the asphalt base is fairly new and therefore would seem
to provide a good base. He asked the difference between the surfacing at Marie and Friendly
Hills.
Ms. Lawrence replied that Friendly Hills has not been repaved for some time, therefore when
the acrylic surface was applied it was not as smooth. She noted that as they continue to apply
the acrylic surface, that base will become smoother.
Chair Blanks invited residents to provide input.
Kevin Byrnes, 740 Wentworth, stated that he supports the addition of the pickleball courts but
recognized that there are concerns with noise as that has become a hot topic as of late. He
asked that staff and the Commission monitor usage and noise once the courts are installed. He
was unsure when the lights would be used in the spring and fall and whether trees or other
screening could be added if needed in the future. He asked if there have been any concerns
with noise from the other parks with pickleball.
Ms. Lawrence replied that there was one complaint received from a neighbor to Marie Park and
no complaints from Friendly Hills. She stated that at this time there are not plans to utilize the
lights at Wentworth Park and confirmed that would be a separate discussion. She stated that
staff did discuss potentially adding trees along the trail to provide additional screening.
Craig Schulte, 734 Wentworth, also spoke in favor of the project noting that he also enjoys
pickleball. He stated that he shared the same concern with noise, noting that noise tends to
travel quite far because of a lack of trees. He stated that they hear a lot from the hockey rink
during the winter months. He asked if noise studies have been done at the other pickleball
courts.

Ms. Lawrence replied that they have done a non-professional study at both locations and did not
find the decibels to be at a rate that is higher than allowed by ordinance. She stated that has
not been done at this site, but the homes are further away from the rinks at this location than at
Friendly Hills. She confirmed that noise abatement measures were reviewed mainly for Marie
Park, but determined not to be feasible and costly. She stated that staff is looking to plant
additional trees at both Friendly Hill and Marie parks.
Commissioner Hanson commented that she lives across from Marie Park and has played at the
courts for several years. She stated that the pickleball courts have become a gem in the
community, with people that have not exercised in decades began to play. She stated that
people have become more active in the neighborhood and because of that sense of community,
people tend not to complain about their neighbors. She hoped to see the resident on the courts
in the spring.
Mr. Schulte asked if the courts would have the same operating hours as the park.
Ms. Lawrence replied that the courts would be open based on regular park hours. She
commented that play typically begins around 8 a.m. at the other parks and ends naturally with
dusk.
Commissioner Sherer asked if hockey was part of the noise comparison done by staff,
wondering whether that is louder than pickleball.
Ms. Lawrence stated that the study compared tennis, pickleball, and basketball noise. She
stated that hockey was not included but that could be attempted this winter season for
comparison. She noted that Wentworth is the most used hockey rink during the winter months.
Mr. Ruzek commented that the hockey rink is in a bit of a valley and staff hoped that would help
to alleviate the noise. He commented that a hockey puck is probably a bit louder than
pickleball, but it would be likely that they would hear some noise from pickleball as well.
Commissioner Muller asked for clarification from the resident on whether they support the
addition of the courts.
Mr. Byrnes commented that generally he supports the addition of the courts, but is aware of the
trend on the topic of pickleball noise and therefore wanted to ensure there would be some
follow-up after the courts are installed. He stated that the road also generates noise so he was
unsure how much noise would be heard from the courts. He stated that he does like the idea of
people using the park more.
Commissioner Muller commented that this seems to be a good location and the asphalt seems
to be in good condition for the surfacing. She believed that this would become a popular
location.
Commissioner Sherer asked when they would get to the point of saturation.
Chair Blanks commented that they do continue to see a desire for pickleball and therefore does
not believe they have reached that point. He stated that the discussion tonight is whether this is
the right location.

Commissioner Muller commented that this is a cost affordable project that would use special
park fund dollars rather than tax dollars.
Commissioner Toth felt that the hours of usage should be considered and whether that should
be limited to something such as 10 a.m. to 7:30 p.m.
Chair Blanks commented that typically the court hours align with the park hours and because
lighting is not proposed, play will be guided by the hours of light available.
Ms. Lawrence commented that the park hours are 6 a.m. to 10 p.m. and when the lights at
Marie Park have been utilized those can be used until 9 p.m. She stated that she has not seen
anyone play pickleball at 6 a.m. at Marie Park. She believed that it would be difficult to have
park hours and then different hours for the courts. She commented that would be difficult to
enforce.
Mr. Ruzek noted that if court hours are going to be implemented at Wentworth, the same would
be recommended for all courts.
Commissioner Schifsky commented that there have not been complaints at the other courts that
have generated those concerns.
Chair Blanks stated that because there has not been an issue as of yet, he would not want to
create rules for something that does not yet exist. He stated that if an issue arises, they could
address the issue at that time.
Commissioner Sherer stated that Wentworth is also used for youth baseball in the summer and
that creates noise. He asked if there would be an issue with parking in those summer months
when there is baseball.
Mr. Ruzek replied that there is parking allowed on Wentworth Avenue or along the driveway and
noted that there are parking stalls along the hockey rink.
Commissioner Hanson commented on the times when the courts are busy at Marie Park, noting
that often pickleball players walk to the courts from the neighborhood.
Commissioner Muller asked about the lighting for winter.
Ms. Lawrence stated that the lights will begin to utilize the push button system for lighting of the
rinks, which are allowed to be on until 9 p.m. She stated that rink flooding occurs after 9 p.m.,
but staff utilizes lighting that faces away from the homes.
Commissioner Schifsky commented that there will be signs with QR codes in the parks and if
there are concerns, those can be used to provide feedback.
Ms. Lawrence noted that residents can also call staff directly.
Commissioner Toth commented that in the winter homes are closed up, whereas they are more
open in the summer. He suggested pickleball play end at 8 p.m. He asked the distance of the
rink to the homes.

Mr. Ruzek replied that the closest home is 140 feet. He stated that at Friendly Hills the closest
home is 111 feet.
Ms. Lawrence stated that the topography between the locations is also very different.
Chair Blanks recognized that the surface is level between the rink and homes at Friendly Hills
whereas the courts are more depressed compared to the homes at Wentworth.
Ms. Lawrence commented that when complaints are received from residents, staff works to
remedy those issues to the best of their ability. She commented that people that purchase
homes near parks recognize that there will be noise from the parks. She stated that if concerns
arise, staff would work with those residents. She believed that it would be difficult to put
restrictions on the hours for this park when those do not exist for other parks.
Mr. Byrnes commented that he believes that there will be more non-resident usage at
Wentworth compared to the other parks. He was unsure if that would impact the usage profile
differently than the other parks.
Ms. Lawrence commented that some West St. Paul residents could use this park because of the
proximity. She stated that non-residents do use other parks as well and Mendota Heights
residents also use parks in other communities.
Motion Blanks/second Schifsky, to recommend approval of the installation of six pickleball
courts at Wentworth as presented, noting that staff has the ability to review if it becomes a

8.b Park Bench Donation -Valley Park
Chair Blanks recused himself from this discussion.
Parks and Recreation Manager Meredith Lawrence stated that this donation is from the family of
Chair Blanks. She provided information on the park bench donation program and stated that
the City has received a donation from the Harper -Grace Memorial Fund for a bench to be
installed at the Valley Park picnic shelter and bituminous trail, highlighting the proposed
location. She stated that staff does not have any issues with the proposed location, noting that
this park does not have a bench near this site. She read the proposed plaque language. She
stated that the City is grateful for the donation and staff recommends approval.
Commissioner Sherer stated that this looks like a fantastic location.

BACKGROUND:
In the month of September, the course had a total of 2,043 rounds of golf played. In the month of
October, the course had a total of 1,168 rounds of golf played and a total of $13,487 in monthly
revenue. The 2023 year-to-date revenue total including October is $294,923. The course's October
expenditures totaled $20,161. The year-to-date expenditure total is $224,501. As of now the course is
showing a $70,422 operating surplus.
Included in the maintenance and repairs line item are the following capital items/projects that were
completed and paid for:
• Patio Furniture: $8,195.03
• Carpet Replacement in Clubhouse: $4,483.41
• Maintenance Building Fence: $5,318.10
• Chemicals/Fertilizer: $20,825.67
• Sidewalk Work: $2,800
Not included in this financial report is $72,543 in capital projects that are being funded through the
golf course's fund that include the following: window replacement for the clubhouse, furnace/AC for
the clubhouse, top dresser replacement and sand pro replacement.

ACTION REQUEST:
Approve the Pay Equity Compliance Report and authorize staff to submit the Pay Equity
Implementation Report to the State of Minnesota by January 31, 2024.
BACKGROUND:
The Local Government Pay Equity Act requires local government jurisdictions to submit a pay equity
report to the Minnesota Department of Management and Budget (MMB) every three years. The City's
next report is due January 31, 2024, for wages as of December 31, 2023. The goal of the Local
Government Pay Equity Act is to require employers to establish "equitable compensation relationships"
between male and female dominated job classifications of similar value.
Pay equity, sometimes referred to as comparable worth, is a method of eliminating discrimination
against women who are paid less than men for jobs requiring comparable levels of expertise. Achieving
pay equity usually means that all jobs have been evaluated and given points according to the level of
knowledge and responsibility required of the job and that salary adjustments will be made if it is
discovered that a female dominated job is consistently paid less than male dominated jobs with similar
point values.
The Pay Equity Compliance Report is comprised of three tests — Statistical Analysis Test, Salary Rate
Test and Exceptional Service Pay Test. The City is found to be in compliance with pay equity based on
the following results:
1. Statistical Analysis Test: The minimum required to pass the statistical analysis test is an
underpayment ratio of 80% The City's underpayment ratio is 86.54%.

2. Salary Range Test: The result must either be 0% or 80% or more to pass this test. The result for
the City's salary range test is 112.12%.
3. Exceptional Service Pay Test: To pass this test the result must either be 0% or 80% or more to
pass this test. The City's results were 0.
As indicated above, staff expects the Minnesota Department of Management and Budget to find the
same, and to notify the City that it is compliant later this year. The pay equity rules require the governing
body of each jurisdiction to review and approve the submission of the Pay Equity Implementation
Report.
FISCAL AND RESOURCE IMPACT:
No pay adjustments are required at this time as the report indicated that the current pay system was
compliant with requirements for pay equity.

in Brainerd Minnesota, May 1-3. The program is designed for City and County managers, and
management assistants.

Estimated lodging and registration expenses will be $898 each for the City Administrator and the

Authorize a purchase order with C&H Sport Surface, Inc. for the resurfacing of the Marie Park
Pickleball Courts within the ice rink for a not to exceed amount of $26,985.
BACKGROUND:
Included in the Marie Park ice rink is six pickleball courts for use in the Spring, Summer and Fall months.
The court surface is quickly deteriorating and resurfacing work is necessary to ensure a safe playing
surface for users.
The scope of the project includes cleaning the surface and removing loose materials, scraping and
grinding crack edges, filling and blending cracks using crack filler, patching and blending areas of low
depth, priming the necessary areas to enhance bonding to the new surface application, applying two
coats of black acrylic, sand filled resurfacer and two coats of light blue textured acrylic coating. In
addition, the contractor will line six sets of 2" white regulation pickleball lines.
The project is estimated to be completed in June or July of 2024.
FISCAL AND RESOURCE IMPACT:
Included in the FY2024 budget was $30,000 for this project. Staff received the following bids:
• C&H Sport Surface: $26,985
• SurfacePro: $28,500
C&H Sport Surface has done work for the City of Mendota Heights in the past and staff has been
happy with their final product.

Approve the purchase of a new athletic line striping machine from Tiny Mobile Robots.
BACKGROUND:
The Public Works Parks Department is tasked with laying out and striping soccer, football, and lacrosse
fields in the parks primarily for organized youth sports in the community. This work has been done
mainly by hand, with a considerable amount of time spent laying out, stringing, and striping fields at
the start of each new season. Lines are then restriped weekly due to irrigation and mowing.
To improve efficiency and accuracy, staff has researched different equipment available to do this job.
Due to a limited number of vendors offering this type of technology, two quotes were received:
Tiny Mobile Robots
Turf Tank
$39,900 (no subscription plan)
$51,000 + 4,000 subscription plan
Staff found the Tiny Mobile Robot to be the best fit to achieve the city's goals. This piece of equipment
will reduce the timeframe for getting fields ready initially and throughout the season, and use less paint
in the process. The Tiny Mobile Robot comes with an extra battery, solenoid, and pump. They will also
take the unit during the winter and calibrate the unit as part of the purchase.
FISCAL AND RESOURCE IMPACT:
This purchase was included in the FY2024 budget in the amount of $40,000, with funds available from
the General Fund balance.

BACKGROUND:
The City's Advisory Commissions include the Planning Commission, Parks and Recreation Commission,
Airport Relations Commission and Natural Resources Commission. Members of city advisory
commissions are appointed by the Mayor and City Council.
The City Council accepted the resignation of Nissa Tupper from the Natural Resources Commission,
creating a mid-term vacancy on the commission. The city sought applications from interested residents
between December 7 and December 29. The city council interviewed the four applicants on January 9.

APPROVING AN APPOINTMENT TO THE NATURAL RESOURCES COMMISSION
WHEREAS, the City Council of the City of Mendota Heights benefits from the active
participation of citizens in representing the City on boards and commissions; and
WHEREAS, the Natural Resources Commission serves as an advisory body to the City
Council. The Commission advises the Council on matters pertaining to natural resources,
sustainability, the environment and climate stewardship; and
WHEREAS, a vacancy with a term expiring January 31, 2025 exists on the Natural Resources
Commission; and
WHEREAS, applications from interested residents were sought and interviews were
conducted; and
WHEREAS, the City Council recognizes the excellent qualifications of Mendota Heights
resident Liz Sheets to serve on the Natural Resources Commission.
NOW, THEREFORE, BE IT RESOLVED by the Mendota Heights City Council that it
hereby appoints Liz Sheets to the Natural Resources Commission to fill a commissioner term expiring
January 31, 2025.

Fires: 4 For the month of October the fire department responded to a car fire, a pickup truck
fire, and an asphalt sealcoating trailer fire. In addition, the department responded to a structure fire
that was caused by embers (from a fire in the fireplace) landing on the cedar roof. The homeowner
observed the smoldering fire and was able to keep the majority of the fire in check on three sides
until the fire department could get on the roof to complete extinguishment.
Medical/Extrication: 6 The fire department responded to six calls that were medical in
nature, a vehicle accident with injuries, as well as to an incident requiring extrication in a home.

Hazardous Situations: 7 October had the fire department respond to three carbon
monoxide calls, one powerline down, one powerline arcing incident, as well as two calls for the smell
of gas.
False Alarms/System Malfunctions: 8 Eight of the calls were coded as false alarms. One was
a malfunction, six calls were deemed unintentional trips, and one was a false alarm other in nature.
Good Intent: 3 Under good intent we had three good intent calls; one was for a hazardous
material release investigation.

access being made via the department UTV and other equipment. This drill was held on the trail

Fires: 2 The Mendota Heights Fire Department responded to and extinguished a vehicle fire that
occurred on a private road at a cemetery in December. In addition, they were called to a burning Xcel
power pole that also needed to be put out (after Xcel arrived and was able to kill the power on the
pole).
Medical/Extrication: 7 Three calls were medical in nature and four calls were involved extrications
(one from a vehicle at an accident scene and three were for people trapped in stalled elevators).
Hazardous Situations: 7 In December, the fire department responded to an overheated fan
motor, an arcing power transformer, as well as to five "smell calls" four for the smell of natural gas
and one for the smell of sewer gas call.

and its features to mitigate potential emergency scenarios.

This drill was the introduction to flowing water with Ladder 11. Included were the correct procedures
to properly set up and flow water with the new truck and to use the aerial in both its "Rescue" mode

ACTION REQUEST:
Adopt Resolution 2024-06 Ordering Street Improvement Project for Bridgeview Shores.
BACKGROUND:
The preparation of a feasibility report for the Bridgeview Shores Street Improvements which is
required to follow the Minnesota Statutes Chapter 429 process was authorized by the Mendota
Heights City Council by adopting Resolution 2023-55 at the City Council meeting held on September
5, 2023. The Statute 429 process is required because the city intends to assess a portion of the
project.
The feasibility report for the Bridgeview Shores Street Improvements was accepted by the Mendota
Heights City Council and called for a Public Hearing on January 23, 2024 by adopting Resolution
2023-98 at the December 19, 2023, city council meeting. The recommendation of the feasibility
report was to proceed with this project.
The proposed streets to be rehabilitated are Arbor Court, Bridgeview Court, Mendota Heights Circle,
Monet Court, Monet Lane, Pondhaven Court, Pondhaven Lane, Westview Circle, and Westview Terrace
Based on our observations, as well as the city's pavement management system, a majority of these
streets have deteriorated to the point where it is no longer cost effective to patch the street and
rehabilitation is necessary.
The feasibility report indicates the estimated costs for the project, along with preliminary assessment
estimates. At the end of the feasibility report, a project financing summary is included to show project
cost splits and funding sources to be utilized. The total estimated cost of the project is $2,763,591
including indirect costs.

A Neighborhood Informational Meeting was held on January 11, 2024 to provide the property owners
an opportunity to discuss the projects in an informal setting prior to the Public Hearing. Staff
presented the proposed improvements, project costs, estimated assessments and answered resident's
questions. 17 residents attended the informational meeting representing 12 properties.
Some concerns were expressed by the properties along Monet that the assessments should be
calculated differently to account for town home and smaller lots in their neighborhood.
FISCAL AND RESOURCE IMPACT:
Street improvement projects are proposed to be assessed to the benefiting property owners. Pursuant
to the City's Street Rehabilitation and Reconstruction Policy, the benefiting properties should be
assessed 50% of the street reconstruction and rehabilitation costs. The following tables show the
estimated unit assessments based on the City policy.

Residential assessments for the project are calculated to be $12,267 for the street improvements.
Staff is proposing that this assessment be capped at $7,500 to align closer to recent street
improvement assessments. Staff is hopeful that competitive bids will be received on the project
reducing the assessment to residential properties.

The project is showing a Municipal Levy of $1,756,279. The city is also proposing to construct the
Emerson Avenue Street Improvements in 2024 which is showing a Municipal Levy of $948,691. The
two projects combined would have a levy amount of $2,704,970. The city may also bond for a portion
of the assessments. Staff is hopeful that both projects have been conservatively estimated and that
actual bid prices will be substantially below the estimates. The indirect costs on this project will also
be reviewed which could provide an additional reduction of $110,000.
The total project cost is estimated at $2,763,592. The assessment amount of $705,000 is equivalent to
40.1 % of the bond amount. Minnesota Statutes Chapter 429 Special Assessment Bond Issue requires
that a minimum of 20% of the total bond issue amount be recovered through special assessments.
As the project is designed and competitively bid, the calculated assessment amount will be updated
leading up to the adoption of the assessment roll. The improvements are necessary to allow for safe
and reliable street and utility services within the City of Mendota Heights. The project will be
competitively bid to allow for a cost-effective improvement. The feasibility study has provided an
overall analysis of the feasible improvements for consideration within this project area. Therefore, the
proposed improvements within the areas outlined in this report are necessary, cost effective, and
feasible from an engineering standpoint.

A RESOLUTION ORDERING OF IMPROVEMENT PROJECT FOR THE BRIDGEVIEW
SHORES STREET IMPROVEMENT PROJECT (PROJECT #202406)
WHEREAS, on December 19, 2023, the Mendota Heights City Council authorized the holding
of a public hearing (the "Hearing") under Minnesota Statutes, Chapter 429, as amended (the "Act"), to
discuss and consider various street rehabilitation projects, storm water infrastructure improvement,
aggregate base, concrete curb and gutter improvements, bituminous surfacing, and appurtenant work
(collectively, the "Improvements"), in and along portions of the following streets Arbor Court,
Bridgeview Court, Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven Court, Pondhaven
Lane, Westview Circle, and Westview Terrace (collectively, the "Assessment Area"); and
WHEREAS, also on November 21, 2023, the Council received a feasibility report on the
Improvements from the Public Works Director (the "Feasibility Report"), which report explored the
feasibility and estimated costs to provide the Improvements under the Act; and
WHEREAS, the estimated costs of the Improvements, as detailed in the Feasibility Report, is
$2,763,592, and will be financed from a combination of available City Utility Funds, Special
Assessments, Saint Paul Regional Water, and general obligation improvement bonds; and
WHEREAS, the Public Works Director has held neighborhood informational meetings in
January, to give each neighborhood in the Assessment Area a summary of the Improvements, and the
necessity of such Improvements to the general overall health of the City; and
WHEREAS, ten days' mailed notice and two weeks' published notice of the Hearing was given,
as required by the Act, and the Hearing was held on the date hereof, at which time all persons desiring to
be heard were given an opportunity to be heard thereon; and
WHEREAS, a reasonable estimate of the total amount to be assessed, and a description of the
methodology used to calculate individual assessments for affected parcels within the Assessment Area,
has been made available for the Hearing.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Mendota
Heights, Minnesota, as follows:
1. The Improvements are necessary, cost-effective and feasible as detailed in the Feasibility
Report. Specifically, the Improvements are necessary to update the City's street
infrastructure system, as many streets were originally constructed more than 30 years
ago, and contain pavement that has been continually patched, overlaid, seal coated, and
slurry sealed, but now is in need of rehabilitation. The repair of associated aging water
infrastructure concurrently with the street reconstruction is additionally recommended for
project efficiency. Finally, the Improvements are feasible from an engineering
standpoint.
2. The Improvements are hereby ordered. The Council shall let the contract for all or part
of the Improvements, as authorized by Section 429.041, Subdivision 1 of the Act, no later
than December 31, 2025.
3. The Improvements have no relationship to the City's Comprehensive Plan.

4. The Public Works Director shall prepare plans and specifications for the making of such
Improvements, which plans and specifications shall be placed on file at the City upon
completion.
5. The Council declares its official intent to reimburse itself for all or a portion of the costs
of the Improvements from the proceeds of tax-exempt bonds. The City has a reasonable
expectation that it will issue one or more series of tax-exempt bonds in the estimated
maximum principal amount of $2,763,592 to finance the Improvements, and the City will
make reimbursement allocations with respect to such original expenditures for the
Improvements from the proceeds of the Bonds.

INTRODUCTION
Authorization
The preparation of this report was authorized by the Mendota Heights City Council by adopting
Resolution 2023-55 at the September 5, 2023, City Council meeting. This project has been
designated as City Project No. 202406. The improvements to Arbor Court, Bridgeview Court,
Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven Court, Pondhaven Lane,
Westview Circle, and Westview Terrace are located in Section 35 & 36, Township 28, Range 23.
Scope
This report addresses the feasibility of street rehabilitation for the urban sections of Arbor Court,
Bridgeview Court, Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven Court,
Pondhaven Lane, Westview Circle, and Westview Terrace. Engineers opinions of estimated
costs for the associated improvements are noted herein and project funding strategies have been
developed in this report.
Location
The proposed street rehabilitation area is shown in Appendix A.
Resident Input
An informational letter and questionnaire were sent to the ninety-five (95) residents of the
neighborhood on September 25, 2023, to inform them of the project. Fifty-eight (58) of the
questionnaires were returned, for a 61 % return rate. The two key issues that were asked in the
questionnaire were drainage and traffic/pedestrian related issues. The letter, questionnaire,
summarized responses spreadsheet and individual resident responses are shown in Appendix B.

Furthermore, the existing urban street section for Arbor Court, Bridgeview Court, Mendota
Heights Circle, Monet Court, Monet Lane, Pondhaven Court, Pondhaven Lane, Westview Circle,
and Westview Terrace include concrete curb and gutter, storm sewer, sanitary sewer, and water
main. The roadway width currently measures 33 feet, from face of curb to face of curb, for all
streets. Arbor Court is an exception, which measures 30 feet, face of curb to face of curb. All
streets included were constructed with a pavement section consisting of a 3.5" bituminous
surface over a 6" aggregate base.
The storm water for Arbor Court, Bridgeview Court, Mendota Heights Circle, Monet Court,
Monet Lane, Pondhaven Court, Pondhaven Lane, Westview Circle, and Westview Terrace drains
into an existing storm sewer system. The existing storm sewer system drains east to Copperfield
Ponds and eventually to Friendly Hills Marsh. The proposed project falls within the Lower
Mississippi River Watershed District.

Court, Pondhaven Lane, Westview Circle, and Westview Terrace currently have a failing
bituminous surface and are in significantly poor condition. All of these streets appear to be near
the end of their useful life and the cost to maintain and repair these roadways are steadily
increasing. Overlaying or seal coating the existing pavement is no longer a feasible alternative.

These streets no longer meet the City's minimum design standards and it is no longer cost
effective to continue to repair these streets.
Based on the extent of fatigue cracking, a rehabilitation of Arbor Court, Bridgeview Court,
Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven Court, Pondhaven Lane,
Westview Circle, and Westview Terrace is recommended by our pavement management system.
Street rehabilitation will consist of reclaiming the existing bituminous roadway and then
placement of a new bituminous surface over the reclaimed pavement material. Pavement cores
have been obtained for these streets that verify the existing street cross-section and that the
material will be suitable for pavement reclamation.
Water Main
St. Paul Regional Water Services (SPRWS) has recommended maintenance operations for the
ductile iron water main pipe on Arbor Court, Bridgeview Court, Mendota Heights Circle, Monet
Court, Monet Lane, Pondhaven Court, Pondhaven Lane, Westview Circle, and Westview
Terrace. Maintenance operations shall include, but not limited to, fire hydrant replacement, gate
valve replacement, and sacrificial anode cathodic protection installation.
Storm Sewer
Arbor Court, Bridgeview Court, Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven
Court, Pondhaven Lane, Westview Circle, and Westview Terrace have existing storm sewer. As
part of rehabilitation, all storm sewer manhole castings shall be reset. This includes replacing all
concrete rings and infiltration protection installation. The storm sewer pipe is currently in good
condition, with no need for replacement.
Sanitary Sewer
The sanitary sewer located within the limits of the project site was cleaned and televised as part
of Mendota Heights City Project MH2O2004 in 2020 on Arbor Court, Bridgeview Court,
Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven Court, Pondhaven Lane,
Westview Circle, and Westview Terrace. Eight -inch polyvinyl chloride (PVC) sewer pipes are
located throughout the project area. Overall, the pipes throughout the proposed project site are in
good condition with very few instances of leaking located near the manholes. As part of
rehabilitation, all sanitary manhole castings shall be reset. This includes replacing all concrete
rings and infiltration protection installation. This project does not include replacing any of the
existing sanitary sewer lines.
Concrete Sidewalks
Bridgeview Court and Monet Lane were constructed with a 5' wide concrete sidewalk along the
west boulevard. Monet Court and Pondhaven Lane were constructed with a 5' wide concrete
sidewalk along the south boulevard. Westview Terrace was constructed with a 5' wide concrete
sidewalk along the east boulevard.
Private Utilities
Providers of privately -owned gas, electric, communications and cable television utilities are
present in the neighborhood.

PROPOSED IMPROVEMENTS
Roadway Rehabilitation
Arbor Court, Bridgeview Court, Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven
Court, Pondhaven Lane, Westview Circle, and Westview Terrace
The rehabilitation of Arbor Court, Bridgeview Court, Mendota Heights Circle, Monet Court, Monet
Lane, Pondhaven Court, Pondhaven Lane, Westview Circle, and Westview Terrace require a 7-ton street
design to meet the City's Street Rehabilitation Policy. Proposed improvements for these streets will
include the reclamation of the existing bituminous roadway and the placing of a 2.5" bituminous base
course and a 1.5" bituminous wear course over the reclaimed pavement material. By using the reclaimed
pavement material as a base, there is a cost savings and structural benefit versus importing a new
aggregate base material. This method should rehabilitate the streets to like new condition and extend the
life of the pavement an additional 20-30 years with continued preventative maintenance. See Appendix
A for project area. See Appendix B for the rehabilitation typical section.
Any damaged concrete curb and gutter along these streets will also be replaced as part of the roadway
restoration. Driveways that may be disturbed due to the street rehabilitation will be replaced in kind
based on disturbance limits. Disturbed boulevard areas will be restored with topsoil and sod.
The existing right-of-way is 60 feet wide throughout the project. No additional right-of-ways
acquisitions are anticipated with this project.
Water Main
As mentioned before, SPRWS has recommended maintenance operations for the remaining ductile iron
water main pipe on Arbor Court, Bridgeview Court, Mendota Heights Circle, Monet Court, Monet Lane,
Pondhaven Court, Pondhaven Lane, Westview Circle, and Westview Terrace. This includes fire hydrant
replacements and cathodic protection installed to prolong the life of the existing 6" ductile iron pipe.
Storm Sewer
As mentioned before, the existing storm sewer is in satisfactory condition. This project does not include
replacing any of the existing storm sewer lines. All storm sewer castings will be reset to proper grade,
including ring replacement. Installation of 5 sump manholes at catch basins prior to outlet structures.
Additional storm water improvements including, but not limited to, rain gardens will be considered on
an individual basis, based upon homeowner interest and storm water design feasibility after the
Informational Meeting scheduled on January 10, 2024.
Concrete Sidewalk Improvements
As part of Bridgeview Shores Street Improvements, seventeen (17) pedestrian ramps are proposed to be
updated to current ADA standards. An additional pedestrian ramp is proposed to be installed at the
trailhead of the path connecting Bridgeview Court and Havenview Court to the north.

Private Utilities
No utility companies have indicated they will be making improvements to their distribution networks in
conjunction with our proposed improvements.
Funding
Per the City's Street Rehabilitation and Reconstruction Policy it is proposed that the benefiting property
owners will be assessed for the street rehabilitation. The property tax levy will be used to finance the
City's portion of the street rehabilitation. Storm sewer and water main funds will come from their
respective utility accounts.
Feasibility
From an engineering standpoint, this project is necessary, cost-effective, feasible and can be
accomplished as proposed.
FUNDING SOURCES AND SPECIAL ASSESSMENTS
The area proposed to be assessed is every lot, piece, and parcel within the city limits benefiting from
said improvement, whether abutting or not, within the following described areas:
Arbor Court, Bridgeview Court, Mendota Heights Circle, Monet Court, Monet Lane, Pondhaven
Court, Pondhaven Lane, Westview Circle, and Westview Terrace.
Specific property descriptions included in the above -described area, but not inclusive, are as follows:
Bridgeview Shores 1st Addition, Bridgeview Shores 2nd Addition, Mendota Meadows
Subdivision, and Mendota Woods Subdivision.
The roadway improvement costs can be assessed on a unit basis to the benefiting properties as per the
Street Rehabilitation and Reconstruction Policy adopted by the City council on June 16, 1992. The
following section discusses the assessment distribution for the street improvements based on the City's
policy.

The following costs were prepared based upon an Engineers Opinion of Estimated Costs (Appendix D)
and are subject to change, depending on the final design of the project, soil conditions, bids received,
and actual work performed.

Hold a public hearing to amend the fee schedule for 2024. Following the public hearing, adopt
Ordinance 587 Amending the fee schedule for 2024, and approve the summary publication of
Ordinance 587.
Approval of the Ordinance requires a simple majority vote of the Council.
Approval of the Summary Publication of the Ordinance requires a 4/5th vote of the Council.
BACKGROUND:
Per Mn State Statues 462.353, sub. 4, the adoption of a fee schedule requires a public hearing to allow
citizen input. The public hearing notice was published on January 13, 2024, has been posted on the
city hall bulletin board, and posted on the City's website.
Fees are reviewed annually by staff to ensure that rate structures reflect the cost of services provided.
Any fee schedule changes are proposed by the department charging the fee.

ORDINANCE NO. 587
AN ORDINANCE AMENDING THE FEE SCHEDULE
The City Council of the City of Mendota Heights, Minnesota, does hereby ordain:
Section 1.
Policy and Purpose. By the enactment of this Ordinance, the City Council intends to
establish fees and charges required by the City Code and to comply with Minnesota
Statues 462.353, subd. 4.
Fees and Charges. The fees and charges for the City for the year 2024 are set forth in
"Exhibit A" hereto attached.
Application. Where a direct conflict exists between the amount of a fee or charge set by
any provisions of the City Code and a fee or charge set by this Ordinance, the fee or
charge set by the Ordinance applies.
Section 2.
This Ordinance shall be effective immediately upon its passage and publication.
Adopted and ordained into an Ordinance this 23rd day of January, 2024.

Authorize a purchase order for the Wentworth Park Pickleball Court addition by C&H Sport Surface
for a not to exceed amount of $23,550.
BACKGROUND:
The Parks and Recreation Commission has recently discussed the need for more pickleball courts within
Mendota Heights. Currently there are six pickleball courts within the Marie Park ice rink and six pickleball
courts within the Friendly Hills ice rink that are utilized in the Spring, Summer and Fall.
The Commission directed staff to send a notice to residents within 500 feet of the Wentworth ice rink
to solicit feedback on the addition of pickleball courts within the park. Two residents attended the
December 12 Parks and Recreation Commission meeting and provided comments and asked questions
regarding the proposed project, but were not formally in favor or against the proposed improvement.
The Commission recommended unanimous approval of the project moving forward without the usage
of nighttime light use at this time.
Staff solicited quotes for this project and received two bids for the project. The final product would be
the same surface as the Marie Park and Friendly Hills Park pickleball courts. Staff has decided to move
forward with a four -coat acrylic surfacing, which will provide quality courts for an estimated five to
ten-year lifespan.
The quote includes surface inspection and cleaning, court inspection and repair for chips, cracks
and dings, surfacing and painting. The contractor will also line six pickleball courts within the rink
with USTA approved white line paint. Mendota Heights Public Works will install the footings and net
posts for the six courts.

This project is estimated to be completed in June or July of 2024.
FISCAL AND RESOURCE IMPACT:
Included in the FY2024 budget was $30,000 for this project from the Special Parks Fund. Staff has
received the following bids for this project:
• C&H Sport Surface: $23,550
• SurfacePro: $26,500
C&H Sport Surface has done work for the City of Mendota Heights in the past and staff has been
happy with their final product.
