The Chair and Vice Chair take office immediately following their election and hold office until their successors are elected and assume office. The current chair is Gina Norling and the current Vice Chair is Arvind Sharma. Item #2 CITY OF MENDOTA HEIGHTS AIRPORT RELATIONS COMMISSION January 18, 2023  6:00 p.m. City Hall  1101 Victoria Curve The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday, January 18, 2023 at Mendota Heights City Hall, 1101 Victoria Curve. 1.Call to OrderChair Norling called the meeting to order at 6:02pm. The following commissioners were present: Chair Gina Norling, William Dunn, DavidSloan, Jim Neuharth, Kevin Byrnes and Jeff Hamiel. Absent (excused): Arvind Sharma.Staff present: City Administrator Cheryl Jacobson and Parks and Recreation ManagerMeredith Lawrence. 2.Approval of Agenda Motion by Dunn/Second by Neuharth to approve the agenda. Motion passed 6-0. 3.Approval of Minutes a.Approve of Minutes of the November 16, 2022 Regular Meeting Commissioner Sloan asked for clarification on the discussion of the term limits and new attendance policy that the City Council will implement in 2023. City Administrator Jacobson responded that staff will be bringing back amendments to the Airport Relations Commission Rules of Order which will implement the term limits, attendance policy and some other commission housekeeping items at the March meeting. She explained the commissioners will have the ability to have up to three, four-year terms, which results in a maximum of twelve years on the commission. Current commissioners are “grandfathered in” meaning their first four-year term will begin in 2023. She also noted that staff will be looking to stagger the expiration of the terms moving forward. Motion by Dunn/Second by Sloan to approve the minutes. Motion passed 6-0. 4.Public CommentsNone. 5.Unfinished and New Businessa.ARC Work Plan Review City Administrator reviewed the 2021-2022 Airport Relations Commission StrategicPriorities and Work Plan. The Commissioners discussed updating the document andCommissioner Neuharth recommended working on the 2023-2024 work plan at theMarch meeting. Ms. Jacobson added that the Natural Resource Commission andParks and Recreation Commission have been developing their respectivecommission’s plans and she could provide those as a reference. Item #4a City Administrator Jacobson asked if a Commissioner wanted to provide an update to the City Council. Chair Norling volunteered to present to the City Council at an upcoming meeting on the work the ARC has done. City Administrator Jacobson noted that her and Chair Norling attended the Noise Oversight Committee meeting on January 18, 2023. Ms. Jacobson noted that a representative from the FAA discussed that MSP will be working to decommission the VOR program with Area Navigation (RNAV) and Performance Based Navigation (PBN) replacing the legacy ground-based system. Commissioner Hamiel provided his thoughts on the RNAV system and Commissioner Sloan noted he thinks the RNAV system will greatly benefit the residents of Mendota Heights. b.ARC Rules of Order City Administrator Jacobson noted that included in the packet are the Commission’s Rules of Order that were last approved in 2010. She noted she will be changing the Rules of Order to Bylaws at the March meeting and there will be updated information regarding terms, term limits, absenteeism, and dates/times of meetings. Chair Norling voiced her concerns regarding the public comment and public hearinglanguage in the current Rules of Order. She asked staff to clarify this in the newBylaws. City Administrator Jacobson announced that the City Council approved theappointment of Bruce Bobbitt to the Commission. His first meeting will be in March. c.Resident Question Regarding Airplane Fuel Dumping Chair Norling presented a resident inquiry she received from Councilor Lorberbaumregarding the dumping of airplane fuel. She noted Michelle Ross’ response was wellwritten and helpful. Her only concern was that the response cites a MPCA ambient airquality monitoring report from 2002, which is not recent. Commissioner Hamiel discussed his experience flying and the rare practice of dumping airplane fuel. He noted that airlines know if they had to dump fuel and that data could be requested. Chair Norling asked how the commissioners would like to move forward with this resident inquiry. Commissioner Neuharth recommended reaching out to the resident with the information provided in the packet. City Administrator Jacobson noted that Councilor Lorberbaum did not have a name or contact information of the resident with concerns. Commissioner Dunn recommended forwarding the information in the packet to Councilor Lorberbaum in case she runs into the resident in her neighborhood again. The commissioners in attendance agreed with this idea. City Administrator Jacobson stated that Councilor Lorberbaum had already received theresponse information. 6.Acknowledge Receipt of Reports and Correspondencea.Review of Airport Operational Statistics (link:https://www.macenvironment.org/reports/) i.Complaint InformationCommissioners present reviewed the compliant information. ii.Runway Use InformationCommissioner Neuharth noted some concerns on the 12L and 12 R total operations charts. He recommended pulling out some segments of the data that are poisoned due to COVID-19 impacts on the airline’s runway use. He noted once he pulls out this data from the population the data will be more normal. iii.Turboprop Information Commissioner Neuharth shared that there was no turboprop report to share. iv.Noise Monitor Information Commissioner Dunn noted that flights and noise are down. b.News Articles Chair Norling volunteered to take over the commission duties related to News Articles moving forward. 7.Commissioner CommentsChair Norling thanked Commissioner Byrnes for his years of service to the AirportRelations Commission. 8.Adjourn Meeting Motion by Neuharth/Second by Sloan to adjourn the meeting. A number of updates are needed to bring them to current Commission structure and practices. Item #6a Rules of Order – Mendota Heights Airport Relations Commission, April 14, 2010 MENDOTA HEIGHTS AIRPORT RELATIONS COMMISSION RULES OF ORDER In accordance with the City of Mendota Heights Ordinance No. 290, “Establishing An Airport Relations Commission,” the following rules of order are adopted by the Airport Relations Commission to facilitate the performance of its duties and the exercising of its functions as a Commission created by the City Council. SECTION 1. MEETING 1.1 – Time. Regular meetings of the Commission are held on the second Wednesday of each month at 7:00 P.M., unless otherwise agreed to and so stated in the agenda. When the regular meeting day falls on a legal holiday, there is no meeting that month unless otherwise noted. 1.2 - Special Meetings. Special meetings may be called by the Chairperson or the Secretary. 1.3 – Place. Meetings are held in the City Hall Large Conference Room, 1101 Victoria Curve. 1.4 – Public. All meetings and hearings, and all records and minutes are open to the public. 1.5 – Quorum. A majority of Commission members constitute a quorum for the transaction of business. When a quorum is not present, the Chairperson may adjourn the meeting for the purpose of hearing interested parties on items on the agenda. No final or official action is taken at such a meeting. However, the facts and information gathered at such a meeting may be taken as a basis for action at a subsequent meeting at which a quorum is present. 1.6 – Vote. Voting is by voice. Commission members voice votes on each issue are recorded. In the event that any member shall have a financial interest in a matter before the Commission, the member shall disclose the interest and refrain from voting upon the matter, and the secretary shall so record in the minutes that no vote was cast by such member. SECTION 2. ORGANIZATION 2.1 – Membership. The number of members of the Airports Relations Commission is established by the City Council. Appointments are made by the Mayor and approved by the City Council. Rules of Order – Mendota Heights Airport Relations Commission, April 14, 2010 2.2 – Absenteeism. A Commission member with three unexcused absences per year is dropped from the Commission and the Secretary then informs the City Council so that another appointment is made. An absence is excused if the member notifies the Secretary or Chairperson before 4:00 P.M. of the day of the meeting that the member will be unable to attend. Minutes of the meetings will record whether the absent member was excused or not excused. In the event of excessive absenteeism, the commission may recommend to the Mayor and City Council that they seek replacement of a commission member. 2.3 – Election of Officers. At the February meeting each year, the Commission elects from its membership a Chairperson and a Vice-Chairperson. If the Chairperson retires from the Commission before the next organizational meeting, the Vice-Chairperson becomes Chairperson. If both Chairperson and Vice- Chairperson retire, new officers are elected at the next meeting. If both Chairperson and Vice-Chairperson are absent from a meeting, the Commission elects a temporary Chairperson by voice vote. The Secretary to the Airport Relations Commission is appointed by the City Administrator from the City Staff. 2.4 – Tenure of Officers. The Chairperson and Vice-Chairperson take office immediately following their election and hold office until their successors are elected and assume office. 2.5 – Duties of Officers. The Chairperson, or if absent, the Vice-Chairperson presides at meetings, appoints committees and performs other duties as may be ordered by the Commission. The Chairperson conducts meetings so as to keep them moving as rapidly and efficiently as possible and reminds members, witnesses and petitioners to discuss only the subject at hand. The Chairperson is a voting member of the Commission. The Secretary is responsible for recording the minutes, keeping records of Commission actions, conveying Commission recommendations to the City Council and providing general administrative and clerical service to the Commission. SECTION 3. MISCELLANEOUS 3.1 – Public Comment. The ARC does not hold public hearings, but may from time to time have public comment. Items not previously scheduled on the agenda may be heard prior to business section of the meeting. 3.2 – Amendments or Suspension. These By-laws may be amended or suspended with the approval by voice vote by a majority of the members of the Commission. 3.3 – Adoption. These By-laws were duly adopted by the Airport Relations Commission of the City of Mendota Heights on this 14th day of April, 2010. Originally Adopted April 14, 2010 Page 1 Amended XXXX, 2023 BYLAWS OF THE MENDOTA HEIGHTS AIRPORT RELATIONS COMMISSION ARTICLE 1. ORIGIN AND PURPOSE Section 1. Origin. The Mendota Heights Airport Relations Commission (the “Commission”) was created pursuant to Ordinance No. 290 adding Title 2, Chapter 4 of the Mendota Heights City Code on April 20, 1993. Section 2. Purpose. The Commission is established to act as an advisory group to the Mayor and City Council and shall: a)advise the City Council on matters pertaining to airport noise and operations at Minneapolis St. Paul International Airport. b)monitor proposed rules, procedures and programs which impact the air noise situation within the city and make recommendations to the City Council regarding strategies to mitigate the city’s air noise exposure. c)have such other duties and powers as granted by the City Council from time to time. ARTICLE 2. MEMBERSHIP Section 1. Number and Appointment. The Commission shall consist of seven (7) residents of the city, appointed by the Mayor with the consent of the majority of the members of the City Council. Section 2. Terms. Terms of members shall commence on February 1 and shall terminate on January 31 of each term year. Members shall serve terms of four (4) years. The terms shall be staggered so that terms of at least two members shall expire each year. No member shall be appointed to more than three (3) consecutive full terms. Section 3. Resignation. A member may resign at any time by delivering a written resignation to the Commission Chair and Secretary. Originally Adopted April 14, 2010 Page 2 Amended XXXX, 2023 ARTICLE 3. OFFICERS AND DUTIES Section 1. Designation of Officers. The officers of the Commission shall be Chair and Vice Chair. At the annual meeting each year, the Commission shall elect from its membership a Chair and Vice Chair. The Chair and Vice Chair shall take office immediately following their election and hold office until their successors are elected and assume office. Section 2. Chair. The Chair shall preside at all meetings of the Commission and shall have the right to vote on all matters of business. The Chair appoints committees and performs other duties as may be ordered by the Commission. Section 3. Vice Chair. The Vice Chair shall perform the duties of the Chair in the absence or incapacity of the Chair. Section 4. Absences and Vacancies. If both the Chair and Vice Chair are absent from a meeting, the Commission shall elect a temporary Chair by voice vote. Should the office of Chair or Vice Chair become vacant, the Commission shall elect a successor from its membership at the next regular meeting and such election shall be for the unexpired term of said office. Officers may also delegate the duties of their position to other Commissioners as deemed appropriate by the Commission. Section 5. Secretary. The Secretary shall be assigned to the Commission by the City Administrator. The Secretary shall serve as the staff liaison to the Commission and shall be responsible for recording the minutes, keeping records of Commission actions, conveying Commission recommendations to the City Council and providing general administrative and clerical support to the Commission. ARTICLE 4. MEETINGS OF THE COMMISSION Section 1. Annual Meeting. The annual meeting of the Commission shall coincide with the regular meeting held in March of each year. Section 2. Regular Meetings. Regular meetings of the Commission shall be held on the third Wednesday of odd numbered months and begin at 6:00 pm at City Hall, unless otherwise agreed to and so stated in the meeting notice. The Commission may, by a majority vote, change its regular meeting date and time for any reason provided proper public notice is given. A schedule of regular meetings shall be kept on file at Mendota Heights City Hall. Originally Adopted April 14, 2010 Page 3 Amended XXXX, 2023 Section 3. Special Meetings. Special meetings may be called by the Chair or Secretary. The calling of such meetings shall be in accordance with the procedures established in the Minnesota Open Meeting Law, Minnesota Statutes 13D. Section 4. Quorum. A majority of members shall constitute a quorum for the purpose of conducting business. When a quorum is not present, the Chair may open the meeting for the purpose of hearing from interested parties on items on the agenda. No final or official action may be taken at such a meeting. The facts and information gathered at such a meeting may be taken as a basis for action at a subsequent meeting at which a quorum is present. Section 5. Attendance. Attendance of members at regular meetings is expected. Absences in a calendar year should not exceed two consecutive meetings or more than 25 percent of the total meetings. Members unable to attend a meeting should contact the staff liaison, who will inform the Chair if a quorum cannot be attained and the meeting will be cancelled. Members will receive a notification from the City Administrator after two consecutive or two total absences. If the City Administrator determines there are extenuating circumstances in a case of a member who has not met the attendance requirements, the City Administrator may grant a waiver to the attendance requirement. If a member exceeds the allowable number of absences and extenuating circumstances do not exist, the City Administrator shall notify the Mayor and City Council and the member shall be deemed to have voluntarily resigned from the Commission and the seat vacant. The vacancy shall be filled as soon as possible for the unexpired portion of the term by the Mayor with the consent of the majority of the members of the City Council. Section 6. Conducting Meetings. All Commission meetings shall be conducted using parliamentary procedure. Section 7. Manner of Voting. The voting on all questions coming before the Commission may be by unanimous consent or by roll call if requested by a member, and recorded into the official record. In the event that any member shall have a financial interest in a matter before the Commission, the member shall disclose the interest and refrain from voting upon the matter, and the Secretary shall so record in the minutes that no vote was cast by the member. Section 8. Official Record. The minutes of all meetings of the Commission, once approved, shall constitute the official record of all actions of the Commission and the journal required to be maintained by Minnesota Statutes Chapter 13D. At the January ARC meeting, the Commission deferred its work on its 2023 workplan in order to tailor its plan to the city council’s priorities. The Council is still working on codifying its priorities for the next two-year cycle (2023-2024). One such component is the VOR, or Very High Frequency Omnidirectional Range, which is a ground-based aircraft navigation system. There are 900 VORs across the United States. The FAA aims to decommission approximately 30% of the VORs by 2030. Flight procedures currently using VORs will be updated to satellite based Area Navigation (RNAV) technology. The MSP VOR is located on the north side of the airport near Highway 62 and 28th Avenue South and is scheduled to be de-commissioned in the summer of 2025, as such new RNAV departure procedures will be established for MSP. The FAA has indicated that the new RNAV departures will replicate existing procedures to the extent possible. ACTION REQUIRED The City Administrator will provide an update, dependent upon information received as part of the Noise Oversight Committee meeting held earlier in the day.
