Christine Lusian, City Clerk CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 202342 RESOLUTION APPROVING LOT LINE ADJUSTMENT AT 1941 GLENHILL ROAD PLANNING CASE NO.2023=021 WHEREAS, Michelle Culligan, on behalf of Lawrence and Mary Culligan, made an Application for Lot Line Adjustment as proposed under Planning Case No. 2023-02, and for the property located at 1941 Glenhill Road, as described in Exhibit A; and WHEREAS, the subject property is guided Low Density Residential in the 2040 Comprehensive Plan, situated in the R-1 One Family Residential District and in the Mississippi River Corridor Critical Area (MRCCA); and WHEREAS, Title 11-1-S.0 of the City Code Subdivision Ordinance) allows the subdivision of parcels, provided that the resulting lots are compliant with the requirements of the applicable zoning district; and WHEREAS, the Applicant proposes to subdivided the Subject Property into two parcels, Parcel A and Parcel B, which are legally described and illustrated on attached Exhibit B; and WHEREAS, Parcel A is approximately 5.8 acres and will be a vacant lot; and WHEREAS, Parcel B is approximately 1.12 acres and will be combined with the existing homestead located at 1941 Glenhill Road; and WHEREAS, the subject parcels are located within the Mississippi River Corridor Critical Area and are subject to the standards within this section of the City Code. Title 12-341.15.2 (Critical Area Subdivision and Land Development Standards); and WHEREAS, Title 12-3-11.B.2 Critical Area Subdivision and Land Development Standards provides an exception of the subdivision and land development standards if it is a minor subdivision that consists of two (2) or fewer lots and this Application for Lot Line adjustment creates no new lots; and WHEREAS, on January 24, 2023 the Mendota Heights Planning Commission conducted a public hearing on the proposed Lot Line Adjustment application, and whereupon closing the hearing, recommended unanimously to approve the lot line adjustment on the subject property, with certain conditions and find -of -fact to support said approval. NOW, THEREFORE, BE IT RESOLVED by the Mendota Heights City Council, that the recommendation from the Planning Commission on Planning Case No. 2023-02 is hereby affirmed, and the Lot Line Adjustment requested for the property located at 1941 Glenhill Road, is approved based on the following findings -of -fact: 1. The proposed lot line adjustment request meets the general purpose and intent of the City Code and is considered consistent with the Comprehensive Plan. Res 2023-12 Po e 1 2. Approval of the lot line adjustment will have no visible impact on the subject properties; and poses no threat or creates any negative impacts on the character of the neighborhood. 3. The proposed adjustment does not cause any non -conformities on either parcel, based on the applicable zoning district standards for lot size and frontage requirements. BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the Lot Line Adjustment requested for the property located at 1941 Glenhill Road is hereby approved, with the following conditions: 1. Applicant shall file lot/parcel combination documents with Dakota County indicating then y defined Parcel B created by this lot line adjustment shall be added to or combined with 1941 Glenbill Road, Parcel ID Number 2741251-01-010. 2. Any future improvements or development on the subject parcels shall be subject to MRCCA review and all necessary permits must be obtained. 3. All transfer or deed documents which convey the portion of lands under the lot line adjustment and lot split process shall be recorded with Dakota County.
