Res 2023-11 Adjust Lot Line 1170 Dodd RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA �7 �lYl]SIJI_YS17\(r�lydc?Si it RESOLUTION APPROVING LOT LINE ADJUSTMENT AT 1170 DOD" ROAD [PLANNING CASE NO.2023=011 WHEREAS, Henry (Vic) Holec made an Application for Lot Line Adjustment as proposed under Planning Case No. 2023-01, and for the property located at 1170 Dodd Road, as described in Exhibit A; and WHEREAS, the subject property is guided Low Density Residential in the 2040 Comprehensive Plan and situated in the R-1 One Family Residential District; and WHEREAS, Title 11-3-2 ofthe City Code (Subdivision Ordinance) allows the subdivision of parcels, provided that the resulting lots are compliant with the requirements of the applicable zoning district; and WHEREAS, the Applicant proposes to subdivide the Subject Property into two parcels, Parcel A and Parcel B which are legally described on Exhibit B; and WHEREAS, Parcel B is approximately 0.6 Acres and will be combined with the Holec's existing homestead at 8 Beebe Avenue; and WHEREAS, Parcel A is approximately 3.69 Acres and will be a vacant lot; and WHEREAS, on January 24, 2023 the Mendota Heights Planning Commission conducted a public hearing on the proposed Lot Line Adjustment application, and whereupon closing the hearing, recommended unanimously to approve the lot line adjustment on the subject property, with certain conditions and find -of -fact to support said approval. NOW, THEREFORE, BE IT RESOLVED by the Mendota Heights City Council, that the recommendation from the Planning Commission on Planning Case No. 2023-01 is hereby affirmed, and the Lot Line Adjustment requested for the property located at 1170 Dodd Road, is approved based on the following findings -of -fact: 1. The proposed lot line adjustment request meets the general purpose and intent of the City Code and is consistent with the Comprehensive Plan. 2. Approval of the lot line adjustment will have no visible impact on the subject properties; and poses no threat or creates any negative impacts on the character of the neighborhood. 3. The proposed adjustment does not cause any non -conformities on either parcel, based on the applicable zoning district standards for lot size and frontage requirements. BE IT FURTHER RESOLVED, by the Mendota Heights CityCouncil that the Lot Line Adjustment requested for the property located at 1170 Dodd Road is hereby approved, with the following conditions: 1. Applicant shall file lot/parcel combination documents with Dakota County indicating the newly defined Parcel B created by this lot line adjustment must be added to or combined with 8 Beebe Avenue, Parcel ID Number 27-71150-04-060. 2. All transfer or deed documents which convey the portion of land under the lot line adjustment and lot split process shall be recorded with Dakota County. No single-family development will be allowed or approved on the proposed Parcel B at any time. Adopted by the City Council of the City of Mendota Heights this 7th day of February 2023.
