CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA PARKS AND RECREATION COMMISSION MINUTES JULY 14, 1998 The regular meeting of the Mendota Heights Parks and Recreation Commission was held on Tuesday, July 14, 1998, in the Large Conference Room at City Hall, 1101 Victoria Curve. The meeting was called to order at 6:30 p.m. The following Commissioners were present: Liberacki, Linnell, Damberg, Norton and Kleinglass. Commissioner Libra arrived late. Chair Spicer was excused from the meeting. Also present were Parks Project Manager Guy Kullander, Recreation Programmer Bill Bird and Administrative Assistant Patrick C. Hollister. Commissioner Linnell served as Acting Chair of the meeting. SOMMERSET 19 LAND SALE OFFER Commissioner Linnell noted that two representatives of Sommerset were present at the meeting to present their offer. Commissioner Linnell asked the representatives to introduce themselves and explain their offer. Jr. Howard Guthmann introduced himself and Mr. Ralph Sonday, newly elected Association President from Sommerset. Mr. Guthmann said that the two Sommerset 19 buildings were built in 1971 and 1972, and that the land in question was purchased by the homeowners association in 1976. Mr. Guthmann said that the land features wetlands to the south and high ground to the north. Mr. Guthmann said that the City had a trail easement through the property. Mr. Guthmann added that Sommerset had offered the land for sale for a single-family home development, but that the deal collapsed when the City denied an application for a wetlands permit from the potential buyer. Mr. Guthmann said that since the City will not allow the site to be built on, Sommerset would like to sell the land to the City. Commissioner Liberacki said that Staff should research whether or not the land in question was required as open space for Sommerset 19's original Planned Unit Development. Commissioner Liberacki added that he felt that the City should not buy the land if it was required for the PUD. Commissioner Linnell recalled that the City had received a similar request from Ivy Falls Townhouse Association for a donation of a land parcel, and that the Parks and Recreation Commission had recommended against that transfer also. Mr. Kullander said that Staff could do more research on this parcel. Mr. Kullander said that he was under the impression that a1122 Sommerset residents were joint owners of the parcel and that the City would need consent from all 22 residents to make any type of land sale. Mr. Kullander asked if all 22 residents approved of this transfer. Mr. Guthmann said that all 22 residents would agree to the transfer. Commissioner Linnell said the Parks Fund was limited and the Parks Commission attempted to live off of the interest of the fund. Commissioner Linnell asked why the City should pay money for open space that is already open space. Commissioner Liberacki said that in general it is a good idea to acquire undeveloped parcels that are adjacent to existing parks and this parcel was, but that Staff should do more research on the history of the PUD for Sommerset 19. Commissioner Norton asked Mr. Guthmann what he expected to get for this land. Mr. Guthmann said that Sommerset 19 paid $26,000 for the land in 1976 and that Sommerset would not be interested in selling it for less money than that. Commissioner Liberacki made the motion that Staff do more research on this land and the Planned Unit Development, including DNR contour maps and wetland maps if they are available. Commissioner Kleinglass seconded the motion. AYES: 4 NAYS: 0 [Commissioner Libra arrived at this point.] BATTING CAGE REQUEST Mr. Scott Miller reintroduced himself to the Commission and said that he was once again requesting that a batting cage be added to Mendakota Park. Mr. Miller said that he wished to clarify that he is not appearing on behalf of MHAA or anyone else except himself. Mr. Miller added that he did get support from the MHAA board for the batting cage request. Mr. Miller added that the softball association was also in favor of the batting cage request. Mr. Miller said that although the Sibley fields were supposedly a joint -use facility, it was difficult to obtain keys for the facility. Commissioner Kleinglass moved to recommend that the Council authorize a contribution of $12,500 from the Special Parks Fund toward the construction of a batting cage at Mendakota Park on the condition that MHAA agree to contribute a matching $12,500. Commissioner Libra seconded the motion. AYES: UPDATES Staff provided updates on the following items: Recreation Programmer's Report Mr. Bird reported that the annual Celebrate Mendota Heights Parks! had been successful, although not as well attend as last year's event. Mr. Bird said that the petting zoo was a particularly popular attraction at the event. Mr. Bird thanked Kim Blaeser, Senior Secretary for her hard work in organizing the event, as well as all other volunteers. Friendly Hills "Tot Lot" Hearing August 4. 1998 Mr. Hollister said that the Public Hearing on the release of four City -owned lots in Friendly Hills was scheduled for the City Council meeting on August 4, 1998, Park Bench in Friendly Marsh Park Mr. Kullander reported that a bid had been awarded and that the park benches would be installed as soon as they arrive, roughly two to three weeks. Civic Center Ballfield Fence Improvement Mr. Kullander reported that a bid had been accepted for the extension of the Civic Center ballfield fence and that the work was scheduled to be performed soon. Comprehensive Plan Mr. Hollister updated the Commission on the progress in revising the City's Comprehensive Plan, Parks Report There were no comments on this item. Police Report Jr. Hollister said that due to the current vacancy in the Police Clerk/Receptionist position, the Police Report for the month of June was not available. 0 CITY OF MENDOTA HEIGHTS MEMO August 5, 1998 TO: Parks and Recreation Commission FROM: Patrick C. Hollister, Administrative Assistant SUBJECT: Sommerset 19 Condominium Association, Inc. If the Commission feels that this land would be useful for the City, the Commission may make a recommendation to the City Council that they discuss terms of transfer with Mr. Guthmann and Mr. Sonday. Otherwise, the Commission may recommend against City acquisition of this land. MARTIN GE L. MAY As you know from recent conversations, the owners of Somerset 19 have purchased a parcel of land from Mrs* wodke which adjoins their condominium property. A deed has been recorded which conveys an undivided interest in the land to each of them in the same proportions as their undivided interest in the existing condominium common area. It is the intent of the owners that this property be included as a part of the condominium common area. Accordingly, in addition to the above described deed, we prepared a so-called Amendment to Amended Declaration intended to be filed at the same time as the deed. The purpose of this document is simply to subject this new property to the same condominium restrictions and covenants as already govern the condominium property (i.e., the Minnesota Condominium Act and the Somerset 19 Amended 4eclaration). This document bears the written consent of all of the current condominium owners, and an original copy is enclosed. The Minnesota Condominium Law was amended in 1974 to require that any amendments to a condominium declaration be reviewed by the municipality. (This change in the law took place after the filing of our first Declaration amendment.) Minn. Stat. § 515.15(a) specifically states that "The declaration and any amendment or amendments thereto shall be submitted to the platting authority of the governing municipality or other governmental subdivision having jurisdiction for review." This section does not state that approval by the platting authority is a prerequisite to recording the 'amendment; however, I believe that it would be better if we got sup:" approval, possibly out of an excess of caution. Land Sale Wetland Discussion DISCUSSION: The functions and values that existing wetland areas provide are viewed differently now than they have been historically in this country. Wetlands play an important role in the environment. The scientific and political communities have determined that these functions and values are worth protecting, and this in turn has led to the adoption of recent legislation at the State and Federal level based on that premise. Current legislation is very restrictive when it comes to what activities are allowed within wetlands. No filling or draining of wetlands is allowed except under very limited circumstances. The determination and delineation of the wetland boundary in reality dictates the construction or development options available for a particular property. No one on City staff is certified to perform this wetland delineation. A wetland delineation has not been performed on this parcel to my knowledge, and therefore I can not state with certainty what activities might be allowed in this area. It is might opinion from past experience that very little, if any, development or construction activity would be permitted on this parcel under Current State and Federal wetland legislation. Hollister, Administrative Assistant SUBJECT: Public Hearing for Friendly Hills Tot Lot Vacation Discussion The City Council held a public hearing at their regular meeting on August 4, 1998 to discuss the release of four city -owned lots in the Friendly Hills neighborhood for the purpose of single-family residential development. The four lots are known as Lots 3, 4, 10, and 11, Friendly Hills Re -Arrangement and are located between Keokuk Lane and Apache Lane. Several Friendly Hills Residents appeared at the public hearing; most were opposed to vacating the lots. The Council directed Staff to relay their comments to the Parks and Recreation Commission and to conduct further research on these lots. Public Comments Those who were opposed to vacating the lots raised the following points: 1. The lots are currently used as a playground area for kickball and sandlot baseball. 2. Much of the open space in the Friendly Hills area has already been developed. 3. The four lots have a very high water table which may prohibit home construction. 4. It would be difficult for home builders to match the existing homes in the neighborhood. 5. The four lots have easement problems. 6. The four lots should be improved as public open space. 7. The four lots only take ten minutes to mow. 8. The City needs smaller open spaces, not just ballfields. 4. Possible means of covenanting the lots to make sure that the new homes fit the neighborhood Staff is currently researching the above issues. Council Action Required This is an information item only. Hollister, Administrative Assistant SUBJECT: Parks Five Year (1999-2003) Capital Improvement Plan Discussion At the June 9, 1998 meeting of the Parks and Recreation Commission, Staff recommended that beginning in 1999, the Capital Improvement Plan contain only those items from the Special Parks Fund that represent true capital improvements. Maintenance items from the General Fund would be part of the annual budget request. Staff then presented to the Commission the draft of the 1999-2003 Parks Capital Improvements Plan for further comments by the Parks Commission. The Commissioners then asked Staff to bring the CIP back to the August 11, 1998 meeting. Please see the current draft of the Capital Improvement Plan attached. The Parks Commission should make a final recommendation to the Council of the Capital Improvement Plan at their August 14, 1998 meeting. The next general members meeting will be held on Wednesday, September 23, 1998, from 12:30 to 3:30 p.m. at Parkview Plaza. There will be a planning committee meeting in early September to lay out activities, trips and events for October through February. The meeting will take place at city hall. Summer Programs: Youth Day Triers On Thursday, July 9,1998 one Mendota Heights child went on a trip to Hyland Park Chutes & Ladders and Bush Lake Beach, in Bloomington. I did not go on the trip because I was setting things up for Celebrate Mendota Heights and West St. Paul had adequate supervision. On Thursday, July 23, 1998 four Mendota Heights children and I went to the Bunker Hills Wave Pool, in Coon Rapids. Four to five foot high waves were created in a "zero depth" style pool. The waves rolled for 20 minutes with 10 minute calm breaks. Tubes were available for those who wanted to ride the waves on top of the water. Other kids chose to bob with the waves and body surf. It was a very interesting sight to see in Minnesota. Concerts in the Park "Rascals in Paradise" On Wednesday, July 15, 1998, naturalist Rachel Kroog played to an audience of 52 kids with their parents and grandparents. Her songs and stories reflected her belief in the respect for nature and respect for one an other. The concert took place at the shelter in Rogers Lake Park. "Urban Renewal Bluegrass" On Wednesday, July 22, 1998, bluegrass was heard throughout Rogers Lake Park. A trio which included a banjo, guitar and a bass played many traditional bluegrass selections as well as some Urban Renewal Bluegrass originals. A crowd of 62 people were treated to a show which ran in excess of an hour and a half. But the best touch, kind of like frosting on the cake, was the painting of the "1/10th mile" markers on the trails. These markers not only allow one to measure distance and calibrate walking speed, but are great for explaining those concepts to the grandchildren.
