Project Manager, will fill in for me at the meeting. As you are all familiar with Guy, and are
aware of his knowledge on the various parks and recreation issues, I feel that I am leaving you
in capable hands.
If there are any matters that you wish to discuss with me, I will be available on Friday,
July 7th, or upon my return from vacation, on July 17th.

At the request of Commissioner Norton, the May 9, 1995 minutes have been placed on
your agenda for reconsideration. Commissioner Norton would like to address a few passages
in the discussion of Dakota County's CIP from the May 9, 1995 meeting and request some
changes be made. As a member of the ipajority that voted to approve the minutes, under
Robert's Rules of Order (at least as I understand them), Commissioner Norton reserves the
right to reconsider an item already passed on.
The Commission may wish to address the general nature of the Parks and Recreation
Minutes and provide any direction to staff. Although I will not be present for the meeting,
Guy Kullander can relay any directions provided by the Commission.
Reconsider the May 9, 1995 minutes and provide staff with ady appropriate directions
regarding the minutes.

MAY 9, 1995
The regular meeting of the Mendota Heights Parks and Recreation Commission
was held on Tuesday, May 9, 1995, in the City Hall Large Conference Room,
1101 Victoria Curve. The meeting was called to order at 6*30 o'clock P.M. The
following members were present: Spicer, Kleinglass, Libra, Damberg, Liberacki,
Norton and Linnell. Also present were Administrative Assistant Kevin Batchelder
and Parks Project Manager Guy Kullander.
APPROVAL OF MINUTES
Commissioner Libra moved approval of the April 11, 1995, minutes with
corrections.
Commissioner Damberg seconded the motion.

COMMISSION COMMENTS
Commissioner Kleinglass stated that he felt the previous meeting in April
was a very good meeting because controversial issues generated a good
discussion. Commissioner Liberacki inquired about having the Police Chief
at the June meeting to address the vandalism issue. Commissioner
Damberg stated the graffiti and destruction in our parks is serious and was
wondering if the Commission can do more to address this issue.
Commissioner Damberg stated the Commission does not want to just sit
there and see this happen without being proactive.
The Commission discussed people practicing golf in the parks and a broken
window that was reported. The Commission discussed regulatory signage
in the parks. Mr. Ram Muthyala, of 699 Apache Lane, stated that he does
not want to limit park use but that he wants people to respect his private
property and not golf in the direction of his home.
CAPITAL IMPROVEMENTS PLAN

Parks Project Manager Kullander stated that in his discussions with people
involved in tennis, their response has been that ball machines have generally
replaced bang boards due to the cost of a ball machine being about $200.
Or. Muthyala stated that he feels a ball machine and a bang board wall
serve two different purposes.
Commissioner Kleinglass inquired if there was a'fence in a strategic location
that we could experiment with a plywood tennis wall. Kullander stated that
it would have to be structurally based to support for wind load.
Commissioner Damberg inquired of Brian Muthyala if there were other
youths interested in using this tennis wall. Brian Muthyala stated yes, that
he has approximately a dozen friends that play tennis and that they are
interested.
Commissioner Kleinglass moved to recommend that City staff look at
providing a tennis wall at a minimal cost in the City. Commissioner
Kleinglass stated that it was nice that someone approached the Parks and
Recreation Commission to ask for a neighborhood improvement.
Commissioner Damberg seconded the motion.

CAPITAL IMPROVEMENT PLAN CONTINUED
Parks Project Manager Kullander distributed a handout describing funds
available for park and trail improvements in the coming years. This handout
included the 1995 City Budget, remaining referendum projects, items
approved by City Council in 1995 that are not in the Budget and
improvements funded by the Special Park Fund in 1995. This list also
included Special Park Funds committed in 1995, Mendakota Park
assessments, Kensington turf improvements, anticipated additions in 1995,
and referendum fund expenditures and balance to date. Estimates were also
provided for park improvement projects that have been newly placed on the
agenda.
The Parks Commission reviewed the new improvement items that have
recently been suggested. Chair Spicer stated that Valley View Heights Park
basketball court should be addressed and that Mr. Dave Ayers had
contacted him and stated that a particular neighborhood resident is in the
concrete business and could provide the City with an estimate on the cost

City must receive quotes from contractors based on plans and specifications

that it appears the City Council is using the Special Park Fund to pay for
replacement items such as bridges in Wentworth Park. The Commission
discussed the spending down of the Special Park Fund.
The Parks Commission reviewed the improvements funded by the General
Fund in the 1995 Budget. The Commission reviewed the improvements
funded by the Special Park Fund in 1995. The Commission was of the
consensus to delay the installation of Wentworth Park grills for $600 and
the Wentworth Park picnic shelter for $18,000 until 1996 with the caveat
that this project would begin its planning stages in January so it could be
built in the early summer of 1996.
Commissioner Linnell stated that the enlarging of the skating area at
Wentworth Park should be looked at if the warming houses are being
switched between Ivy Falls and Wentworth Park. The Commission directed
staff to look at the possibility of enlarging the skating area at Wentworth
Park. The Commission directed staff to add Wentworth Park rink
enlargement to the 1995 Special Park Budget. The Commission discussed
the Wentworth Park bridges and culverts which are estimated to be
'25,000 from the Special Park Fund in 1995. The Commission felt that this
was a priority item and that it should be addressed in 1995.
Commissioner Liberacki inquired about resurtacing the tennis court at
Roger's Lake Park as funded in the 1995 General Fund Budget.
Commissioner Liberacki stated that he had. visited the tennis courts in the
City and that Roger's Lake tennis court was still in good condition and that
he felt that Valley Park tennis court was in very poor condition.
Administrative Assistant Batchelder stated he had received a phone call
from a resident upset about the condition of Valley Park tennis court
surface.
Parks Project Kullander stated a resurtacing contractor will be visiting the
tennis courts in Mendota Heights in the next week to prioritize the courts for
resurfacing. Kullander stated that resurfacing involves sealing the cracks
and adding a top coat of 1 /4 inch of colored asphalt.
Commissioner Liberacki inquired about sweeping the trails and seal coating
the Mendakota Park trail. Liberacki inquired if it would be better to overlay
as opposed to seal coating. Kullander stated the slurry seal machine will not
it on the City bike trails and that seal coating has proven to be more cost
effective than overlay. Commissioner Linnell stated that this issue had been
examined by the Parks Commission during last year's discussion.
Commissioner Liberacki inquired about sweeping trails and Parks Project
it at that time. The Commission directed staff to review the success that
other cities may or may not have had with paving a rink for rollerblading.
Commissioner Liberacki stated that he feels there is a general lack of picnic
tables in City parks. Parks Project Manager Kullander stated that the City
budget includes the purchase of ten picnic tables in 1995 and that the City
has a general supply of picnic tables that the park crews move.around as
requested. Commissioner Liberacki stated that there should be more picnic
tables near the ball diamonds for use by the parents attending games.
Commissioner Libra stated that Ivy Falls Park could definitely use some
picnic tables near the ball diamonds. The Commission directed staff to
include picnic table purchases on the 1996 CIP list.
The Commission directed staff to put together these pieces of their
discussion on the Capital Improvement Plan for review at the June meeting
at which time the Capital Improvement Plan for 1996 through the year 2000
would be put into final draft form for City Council review.
DAKOTA COUNTY CAPITAL
IMPROVEMENT PLAN
Administrative Assistant Batchelder stated that Dakota County was seeking
comments on its Capital Improvements Plan. Commissioner Norton stated
that the County's Capital Improvement Plan includes a massive development
scheme for Lebanon Hills Park to which there is organized opposition.
Norton stated she feels the County is making these capital improvements at
Lebanon Hills Park because the Cities of Eagan and Apple Valley are putting
political pressure on the County. Norton stated that $2 million is budgeted
for expenditures in Lebanon Hills Park and that she feels this money would
be better spent on acquisition of additional park land. Commissioner
Norton stated that Thompson Park is the only County park in northern
Dakota County and that it is very small and does not meet the needs of
northern Dakota County.
Commissioner Norton stated that the City has approached Dakota County
about purchasing park land on the Resurrection Cemetery site but that the
County has ignored this site in their acquisition program. Norton stated that
the County Park Policy is not to acquire any more park land until existing
parks are developed.
Commissioner Damberg stated she felt Dakota County was unwise in not
making acquisitions at this time while the land may still be available.

Heights Park.
Batchelder stated that the City Council had met with neighbors in
Bridgeview Shores regarding the trail extension as part of the Mendota_
Heights Road/Dodd Road traffic signal project. Batchelder stated City
Council had directed staff to contact the contractor regarding whether this
project could be put off until the fall under the terms of the contract.
Batchelder stated the City and the contractor,are currently discussing doing
this project later in the year during the fall.
TRAIL STENCILING
The Commission decided to set aside a night or an afternoon in June in
which they could tour the park and participate in trail stenciling.
VERBAL UPDATES CONTINUED
Administrative Assistant Batchelder stated that finding a civic group or
organization to operate the concession stands at Mendakota Park has been
very difficult because while many people would like to do the concessions
on the big weekend tournaments there are not many groups who are willing
to do the Monday through Friday night time periods. Batchelder stated that
the City Council had told staff that if no civic groups or booster groups
could be found to upgrade the concessions stand, thm it should be
advertised for a private vendor. The Commission inquired if lease money
through a private vendor situation could go into the Special Park Fund or be
earmarked for park projects.
Commissioner Norton reported that on the pond at the corner of Marie and
Lexington Avenue a resident had built a path down to the pond including
stone steps. Norton stated that she feels this stairway was unattractive, and
inquired if it was on park land and in a designated Wetland. IThe
Commission directed staff to have the Code Enforcement Office look at the
construction of a pathway to the pond at Marie and Lexington.
The Commission discussed the vandalism at the Marie Park warming house.
Administrative Assistant Batchelder informed the Commission that Acacia
Cemetery had approved our request for the use of up to 300 stones to
include in our projects in North Kensington Park and Ivy Hills Park

The regular meeting of the Mendota Heights Parks and Recreation Commission
was held on Tuesday, June 13, 1995, in the City Hall Large Conference Room,
1101 Victoria Curve. The meeting was called to order at 6:30 o'clock P.M. The
following members were present: Spicer, Kleinglass, Libra, Damberg, Liberacki,
Norton and Linnell. Also present were Administrative Assistant Kevin Batchelder
and Parks Project Manager Guy Kullander. Guests were Steve Shimek, Volunteer
Horticulturalist, Mr. and Mrs. Mike Johnson and Ms. Susan Linnell.

DISCUSSION OF PRIVATE IMPROVEMENTS
ON PUBLIC PARK LAND
Administrative Assistant Kevin Batchelder stated that a Parks and
Recreation Commission had asked staff to investigate private improvements
consisting of trail construction and removal of vegetation on City property
leading to the pond at the corner of Marie Avenue and Lexington Avenue.
Batchelder stated that Parks Project Manager Kullander had looked at the
plat maps and determined that the trail is approximately 80' to 100' into the
park land which is controlled by the City. He stated that the Code
Enforcement Office had sent a notice to the homeowner, Mr. Mike Johnson,
of 1085 Bwana Court, informing him that the path was on public property
and was possibly in violation of the Wetlands Ordinance. Mr. Johnson's
response to the letter from the Code Enforcement Office had been to
request an appearance on the Parks and Recreation Commission agenda to
discuss this situation.
Batchelder stated there are two issues involved in the location of this private
trail. He stated that the trail encroaches onto City property, which is an

wetlands property. Mr. Johnson stated that it is his desire to keep this area
wild and that he has planted many wildflowers and other vegetation in this
area. Mr. Johnson stated that he is scared that a child could approach the
pond in the area of mud left behind by the City crews and that this is more
of a dangerous situation than his path. Johnson stated that he is irritated
that the path has been there for five years and that only now when he has
added new wood chips has the City contacted him to say that this path is
not allowed.
Commissioner Norton stated that she raised this issue at the last Parks and
Recreation Commission meeting due to her concern that private
improvements had been made on City property. Mr. Johnson stated that he
did not realize it was City property.
Commissioner Damberg inquired if it was correct that Mr. Johnson had
stated a City inspector had approved this wood chip path. Mr. Johnson
stated that Public Works Director Jim Danielson had visited his rear yard at
the time he was removing vegetation to construct this trail. Johnson stated
the inspector had informed him that it was necessary to keep this area
natural. Mr. Johnson stated that he felt wood chips were the most natural
pathway material.
Chair Spicer stated that what is at issue here is really a legal question
regarding wetlands and wetlands permit. Spicer stated it that is the
Planning Commission's prerogative and requires an application for a
Wetlands Permit, Mr. Johnson inquired what is it that the City wants him to
do. ;
Chair Spicer inquired of the Parks and Recreation Commission what they
wanted to do about this issue. Spicer stated there are a lot of alternatives
for recommendations but he believes there should be two issues that are
addressed. Chair Spicer stated the first issue is the use of park or open
space property, controlled by the City, for use as a private pathway. Spicer
stated the second issue is a Wetlands Permit issue and is the Planning
Commission's prerogative. Commissioner Norton stated she feels there is
another issue, that being a liability issue involved in neighborhood children
using this path down to a pond on City property. Chair Spicer stated that
this may be an attractive nuisance to the area with the children feeding the
ducks.
Mr. Johnson complained about the dredging of the pond and stated that this
project had killed many turtles in this area.

inquired if the City was going to be an obstructionist in this improvement
process.
Mr. Johnson stated that he could have had 300 people attend this meeting
to support him and stated that he cleans up trash around this pond every
summer.
Chair Spicer stated that there is a motion on the table as it relates to the
Parks Commission duties regarding a private path on City park property.
Commissioner Libra inquired if any fill had occurred in this area other than
the placement of wood chips.
Commissioner Norton stated that she is also upset about the dredging, but,
it will be restored after final grading has been done on this project.
Commissioner Norton stated that dredging is not the issue before the Parks
and Recreation Commission but that the path is the issue the Commission
should be addressing. Norto. stated that in her opinion, the path is not a
natural state for the wetlands area and that it should not be on public
property.
Commissioner Libra stated the fifteen feet around City streets is boulevard,
however, that is being maintained and mowed by all of the property owners
whose front yards go out to the City streets. Commissioner Linnell stated
that is a right-of-way vs. an ownership issue. Libra stated that wild natural
growth around a pond area does not necessarily look more beautiful than
landscaping improvements that could be made by hbmeowners. Libra
stated that Copperfield has restrictions around the pond and that they may
prove detrimental as the natural growth takes over and restricts everybody's
ability to view the pond or access the pond.
Batchelder stated that the City's Wetlands Ordinance does not prohibit
people from doing landscape projects around wetlands areas, it only
requires that they seek a permit in order to do so.
Chair Spicer called the vote and asked that the motion be reread.
Administrative Assistant Batchelder stated that Commission Damberg had
moved that the path can be maintained until such time as the Wetlands
Permit can be sought and obtained. Commissioner Liberacki had seconded
the motion.

INTRODUCTION OF
VOLUNTEER HORTICULTURALIST
Chair Spicer introduced Mr. Steven Shimek, of Mendota Heights, who had
recently been appointed by the City Council as the City's Volunteer
Horticulturalist. Mr. Shimek described his involvement regarding tree
inspection and certified landscapers at the time the trees were installed at
Mendakota Park. Following this, Mr. Shimek offered his services to the City
Council who had accepted him as a Volunteer Horticulturalist. Mr. Shimek
stated that he has worked with City staff on providing better tree
specifications for our Boulevard Tree Planting Program and other projects
that the City is involved in that require tree installation. Shimek stated that
he is a Horticultural Consultant and works for the State of Minnesota as a
Forester. Mr. Shimek stated that he is a member of the State Shade Tree
Advisory Commission and is involved with of the Tree City USA program.
Mr. Shimek stated that he had received twelve or thirteen calls since the
growing season has begun and that he is concerned that the City is using
him to do individual tree inspections for homeowners. Mr. Shimek stated he
was under the impression that his volunteer horticultural position was to
help the City with tree management issues and policies and that if
homeowners need tree inspections that there are referral businesses that
can do that for them.
Mr. Shimek discussed how he can help the Parks and Recreation
Commission by providing assistance on project bidding and grant money
that may be available on a cost share basis for future park projects.
Commissioner Liberacki stated he feels this new position is a valuable
resource to help the City to deal with forestry issues and policieshowever,
he agrees with Mr. Shimek that we should not be wasting his tim, e with
individual tree forestry advice. Mr. Liberacki stated that he feels that the

working with the Mendota Heights Athletic Association and the softball
groups to discuss possible baseball use at Mendakota Park and whether the
reservation system could be adjusted to allow Mendota Heights youth to
play baseball at these fields. Chair Spicer stated that he has had phone
calls from Mendota Heights Athletic Association representatives about this
issue and that he feels if play is to be expanded at Mendakota Park, perhaps
the City should look into installing lights at the park in order to extend the
use of those fields.
Commissioner Norton was excused at 8:00 o'clock P.M.
The Parks and Recreation Commission was of the consensus to schedule
trail stenciling for Sunday, June 25th at 10:00 A.M. and directed staff to
provide stencils and paint. Commissioner Liberacki volunteered his little red
wagon to carry the paint and supplies as the Parks Commission walks the
trails and stencils the distance markers.
Administrative Assistant Batchelder stated that the bids are being prepared
for Ivy Hills Park and North Kensington Park. He described the changes in
the plan to the Ivy Hills Park Landscape Plan by Mr. Hagstrom at the request
of City Council.
Parks Project Manager Kullander stated that City Council had approved
bidding out the stone work for these two parks separate from the landscape
improvements. Batchelder stated that City. Council had forwarded the Parks
and Recreation Commission comments on the Dakota County Capital
Improvements Plan to Dakota County. Kullander stated that City Council
has approved a tennis court resurfacing bid including the patching and
sealing of other courts. Kullander stated that Ivy Hills Park and the
Mendakota Park basketball courts would receive resurfacing this year.
Kullander stated the plan was to resurface Valley Park next year, as per the
Capital Improvements Plan.
Commissioner Linnell stated that he is concerned that the adjustments made
to the Ivy Hills Park Landscape Plan included too many trees and that this
has the potential of harming the wildflower and prairie plantings. Kullander
stated that the trees could be put into the bid as add alternates and City
Council can determine whether these should be installed at the time bids are
received.
Commissioner Linnell stated that the Community Education Department has
contacted him about their desire to have a member of the City's Parks and

Subject: Vandalism in the Parks
In recent months, the Commission has been discussing vandalism occurrences in the
City's Park System and the Commission has requested that Dennis Delmont, Police Chief,
visit with them to discuss what the Commission can do to address this issue. Mr. Delmont
will be present on Tuesday evening to provide his insights and suggestions to the Commission.
The Parks and Recreation Commission, in earlier discussions, desired to address the
types and frequency of vandalism incidences, the cost of vandalism in the parks, how
vandalism cases are handled, possible preventative measures regarding both vandalism and
safety in the parks, and the patrolling of parks.
The Commission should discuss with the Chief what future actions or recommendations
can be made to deter vandalism and increase the safety in our park system.

Park Ordinances - Discussion of Park Policies
At previous meetings, the Commission has discussed the need
for a comprehensive Park Ordinance that addresses and updates the
rules, regulations and policies in the Parks and Recreation system
in Mendota Heights. At tonight's meeting I would like to review
the Ordinances that we currently are operating under. Attached are
copies of:
1. Ordinance No. 109, AN ORDINANCE ESTABLISHING THE PARKS AND
RECREATION COMMISSION;
2. Ordinance No. 913, AN ORDINANCE REGULATING THE USE OF PUBLIC
PARKS IN THE CITY OF MENDOTA HEIGHTS AND IMPOSING PENALTIES
FOR VIOLATION THEREOF;
3. Ordinance No. 1101, Section 4. VEHICLES ON PARKWAYS, IN PARKS
OR UPON PUBLIC GROUNDS;
4. Ordinance No. 301, Section 6. PARKS, OPEN SPACE AND PUBLIC USE
of the Subdivision Ordinance;
5. Ordinance No. 915, AN ORDINANCE REGULATING THE OPERATION OF
SKATE BOARDS ON PUBLIC AND PRIVATE PROPERTY IN THE CITY OF
MENDOTA HEIGHTS.
In addition to reviewing the current Park Ordinances, the
Parks and Recreation Commission should begin planning to review
park policies. With the addition of new park facilities throughout
the City of Mendota Heights there is a need to consider new
policies to address the myriad of park issues that we will be faced
with, new and old, from the reservation of tennis courts to the
issue of field rental.
The intent of tonight's meeting is to take the first step in
the direction of establishing a comprehensive set of goals and
objectives, policies, rules and regulations, operating procedures
and ordinances. We certainly won't be able to discuss all Park
policies this evening, however, we can begin to list policies that
need to be addressed, revised or established so that they can be
tackled in upcoming meetings.
ACTION REOIIIRED
Review Ordinances and begin to plan for comprehensive policy
review for the Mendota Heights Parks and Recreation System.
The Commission shall, in performing the aforementioned duties and responsibilities,
exhibit the initiative in formulating policies which will be responsive to the anticipated
need and objectives of the community.
SECTION 4. MEETINGS
The Commission shall hold at least one meeting each month at a time regularly esta-
blished and approved by the Village Council and shall hold such special meetings as
may be necessary for the conduct of its business. The Commission shall adopt rules for
the transaction of business and shall keep a record of its resolutions, transactions and
findings, which record shall be maintained as a public record. The Commission shall
submit to the Village Council a true and correct copy of all of its minutes, recommen-
dations and other reports.
SECTION 5. COMPENSATION
The members of the Parks and Recreation Commission shall serve without compensation
but shal I have the right to be reimbursed for expenses incurred in the performance of
their duties.
SECTION 6. VACANCIES
Any of the following may cause the office of a member to become vacated:
6.1 Death;
6.2 Disability or failure to serve, as shown by failure to attend four regularly
scheduled meetings in any one calendar year;
6.3 Removal of residence from the Village, or
6.4 Resignation in writing.
Vacancies shall be filled as soon as possible for the unexpired portion of the term by
the Mayor with the consent of the majority of the members of the Village Council.
SECTION 5. OPEN FIRES PROHIBITED
No person shall build a fire in any area in a public park except in
fireplaces or receptacles duly provided for said purpose or in such
areas as may be specifically designated or marked for open fires.
Fires must be attended at all times and extinguished aftez�:use.
SECTION 6. RULES OF CONDUCT
6.1 Gambling, excessive use of alcoholic beverages, or abusive,
boisterous, profane or indecent language, or conduct, in
any public park is prohibited.
6.2 No person shall behave in a reckless manner which would
endanger any person within a public park or the property of
any such person.
6.3 No person shall disobey any responsible lawful •order or
direction of any park employee, police officer, or other
person designated by the City Council to give such orders
or directions.
SECTION 7. CERTAIN EQUIPMENT AND ACTIVITIES
7.1 In all areas where swimming and wading are permitted the
City Council, with the advice of the Parks and Recreation
Commission, shall by resolution prohibit the use of such
equipment as it deems dangerous to persons engaging in
such activities. ,
7.2 The Council or its.duly designated agent shall determine
what activities are dangerous and shall be authorized to
prohibit such dangerous activities.
7.3 No person shall participate in any scheduled -group activity
without written permission. Any group wishing use of any
park facility for a particular purpose shall first obtain a
permit from the City Council or its designated representative.
The Council may adopt an application form to be used for this
purpose which may contain a requirement for an indemnity bond
to protect the City from any liability or property damage.
7.4 No person involved in any park event or in any use of the
public parks shall commit an unfair discriminatory practice,
deny another person access to, admission to, utilization of,
or benefit from any such events or park use because of race
sex, color, creed, religion or national origin.
SECTION 8. ANIMALS IN PARKS
Within a public park:
8.1 No person shall kill, trap, hunt, pursue, or in any manner

to a parking lot from a public street which shall designate one-way traffic
for entrance and exit and the driver of any vehicle entering or leaving
such lot shall comply with any signs so posted.
3.4 Notice of Collision. In the event that any person who drives a motor
vehicle upon such a parking lot or parking area becomes involved in a
collision between the vehicle he is driving and any other .vehicle or
vehicles, parking upon said lot or area, such driver shall leave a notice
upon each unattended vehicle with which he has collided, giving his name,
address and license number. Failure on the part of any person to comply
with this paragraph shall constitute a violation of this ordinance.
SECTION VEHICLES ON PARKWAYS, .IN PARKS OR UPON PUBLIC GROUNDS
Regulations. The operator, driver, owner or person in charge of any
vehicle propelled, used or driven over or upon the streets and roads
of the City must observe �11 of the following regulations upon all
parkways and .within the limits of all parks and upon any publicly owned
grounds in said municipality:
4.1(1) No vehicle shall be left standing or parked except in designated parking
spaces, -and vehicles must be parked so that an unobstructed view into
the interior of the vehicle may be had at all times, and no curtains,
papers or coverings of any kind shall cover or conceal the front, rear,
or side windows of any parked vehicle.
4.1(2) No vehicle shall be left standing or parked upon any foot path or in any
area in which'parkinq is restricted.
4.1(3) No person shall be in any park, and no person shall remain in or leave
any vehicle in any park, or upon any parkway or public grounds between
the hours of eleven o'clock p.m. and six o'clock a.m, of the following
morning. Nothing in this section shall apply to persons traveling
upon established driveways of parks, or upon parkways.
SECTION 5. PERSON
5.1 The term "person" as used in this ordinance shall mean and include
individuals, partnerships, associations or corporations.
SECTION 6: Any person failing to comply with the provisions of this ordinance
shall be guilty of a misdemeanor and upon conviction thereof shall be punished
by a fine of not to exceed Five Eundred Dollars ($500.00) or by imprisonment
for not to exceed ninety '(90) days.

WHEREAS, said open•space contributions or cash contributions
must be used for the purpose of maintaining and protecting open
space or developing existing public open space; and
WHEREAS, it is deemed advisable that the cash contribution be
based on a standard contribution formula.
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights, that Resolution No, 8016 be amended in
its entirety; and
BE IT FIIRTHER RESOLVED that the following park contribution
formula shall apply to all requests for platting, replatting or
division of existing lots for which a cash contribution is deemed
appropriate by the City Council:
a. Property owner or .developer shall contribute a minimum of $750
for each residential lot created as a result of plat, replat
or lot division approval; and
b. Cash contributions in the case of commercial/industrial plats,
replats or lot divisions shall be at least ten (lo) percent of
fair market value of the gross area created as a result of the
plat, replat or lot division; and
/ BE IT FURTHER RESOLVED that the contribution shall be payable
upon approval of the plat, replat or lot division or in a manner as
outlined in the Subdivision Ordinance.

Subject: Discussion of Capital Improvements Plan for 1996 to 2000
Last month the Commission discussed the Five Year Capital Improvements Plan and
directed staff to make some changes to the document and to research some new items for costs
and feasibility. Attached is a revised Capital Improvements Plan (CIP) for years 1995 thru
2000. &
New requests that have been investigated include a tennis "bang board" and a basketball
halfcourt for Valley View Heights Park. Please see attached memos from Guy Kullander for
estimates and feasibility on these two new requests. The resurfacing of the tennis courts has
been adjusted in priority based upon recommendations received from two contractors who bid
on the project. (City Council authorized the low bidder to proceed with resurfacing Ivy Hills
Park and to seal cracks on the other tennis courts at their meeting on June 6, 1995.)
Changes in the CIP include moving the Wentworth picnic shelter and grills to 1996,
moving the Friendly Hills picnic shelter to 1997, adding the Wentworth rink enlargement to
1996 and striking the Hagstroin4Ung Tennis Courts from the list. Picnic table purchases were
added to the 1996 list.
Guy has estimated that it may cost between $20,000 to $40,000 to build two new youth
sized baseball fields, depending upon whether these fields are built at the Mendota Plaza or at
the Center Point site. The Commission should consider including this estimated cost in the
CIP. Guy will have more information available on Tuesday evening. The tennis "bang
board" and the basketball court at Valley View Heights Park should also be considered.
The Commission should discuss the draft 1996 to 2000 Capital Improvements Plan and
consider a recommendation to City Council.

Subject: Tennis "Bang Board" at Friendly Hills Park
The commission asked for an analysis of the feasibility of
constructing a bang board on one of the tennis courts in
Friendly Hills Park,
Construction Details:
Bang board would be constructed using pressure treated 3/4 inch
plywood, 2"x4" support members and 2"x6" treated cap and end
trim. Unit would be 42 feet long and 6 feet high with "net"
painted on interior side (36 feet by 36 inches high). Unit
would be raised off the existing court surface to allow drainage
and supported by exterior (outside fence) supports and fastened
to existing fence posts that••are spaced ten feet on center.
Approximate cost would be $1500 to $2,000.
Before making a final decision the commission should also consider
the following items:
1. All our tennis courts are double courts. Use of the bang
board may distract a match on the adajcent court.
2. The bang board may alter the wind currents at the end of
court where it is installed.
3. This would be a visual distraction to an oppnent::atthe
other side of the net
4. This is a "target" for vandalism (artists),
5. It should not be a safety concern because it would only
portrude into the court area 6" from the fence.
6. Maintenance on unit would be every two or three years
depending on how well the paint weathers.
ACTION REQUIRED
If the commission desires to recommend the construction of a
band board at Friendly Hills Park the should include this
improvement in the Five Year Improvement Plan.

Subject: Discussion of Pond at Lexington and Marie
At last month's meeting, the Commission met with Mr. Mike Johnson, of 1085 Bwana
Court, regarding a trail that has been installed from his property to the pond that is within City
open space at the corner of Marie Avenue and Lexington Avenue. The Commission (on a 5-2
vote) moved that the path could be maintained until such time as a Wetlands Permit could be
sought. (Please refer to June 13, 1995 minutes.)
After consulting with city staff regarding the Wetlands Permit, Mr. Johnson has
decided not to seek a Permit and has agreed to not maintain the path in the future, so that it
may return to its natural state.
The real intent of this memo, however, is to discuss the other motion by the
Commission to recommend that the City budget $3,000 from the Storm Water Utility Fund for
additional plantings for the restoration of this pond. At the time of this action, the
Commission and staff were unaware that any landscape plans had been made for restoration of
the pond. Following the meeting, this issue was discussed with Mr. James Danielson, Public
Works Director, and it was discovered that the pond dredging project, budgeted for $10,000,
had included $1,500 for plantings and restoration of the pond area.
The recommendation from the Parks and Recreation Commission was not carried to the
City Council because of this pre-existing plan to plant trees and landscape. The Commission
should discuss whether this plan, which they were unaware of, is sufficient or whether the
recommendation should remain as made in June.
On Thursday, July 6, 1995, Mr. Danielson will provide the City Council with an
update of this project. It is hoped that this information will be available for inclusion in this
packet.
Discuss the restoration of the pond at Marie and Lexington Avenues and provide any
appropriate direction to staff.
