2020-06-01 Declaring a Local Emergency and City-Wide CurfewCITY OF MENDOTA HEIGHTS, MINNESOTA
MAYOR'S PROCLAMATION DECLARAING A LOCAL EMERGENCY
AND CITY-WIDE CURFEW
WHEREAS, I, Neil Garlock, the Mayor of the City of Mendota Heights, Minnesota, in
consultation with the Police Chief, find that the following factual situation exists:
(i) the cities of Minneapolis and Saint Paul, Minnesota, have experienced widespread
civil unrest since at least May 26, 2020;
(ii) said civil unrest has included violent and destructive acts that have placed public
safety at risk and resulted in near catastrophic property damage, requiring the full
mobilization of the Minnesota National Guard;
(iii) the City of Mendota Heights is adjacent to the cities of Minneapolis, Saint Paul,
and the Twin Cities International Airport;
(iv) Dakota County, Minnesota, through the Chair of its Board of Commissioners,
instituted an overnight curfew beginning at 8:00 p.m. on Friday, May 29, and
ending at 6:00 a.m. on Monday, June 1, 2020; and
(v) law enforcement personnel and emergency first responders for the City of Mendota
Heights have predicted potential violent and destructive acts of civil unrest to
continue and escalate without invocation of certain portions of the City's
emergency management plan.
WHEREAS, I, in consultation with the Police Chief, find this factual situation is sudden,
unforeseen, and could not have been reasonably anticipated as it currently exists;
WHEREAS, 1, in consultation with the Police Chief, find this factual situation threatens the health,
safety, and welfare of the residents of and property within the City of Mendota Heights;
WHEREAS, I, in consultation with the Police Chief, find that conditions within the City of
Mendota Heights have the potential to worsen quickly and without notice due to this factual situation;
WHEREAS, I, in consultation with the Police Chief, find that traditional governmental processes
are unable to appropriately protect the safety and property of the general public; and
WHEREAS, Minnesota Statutes, Section 12.29, authorizes a local emergency to be declared by
the mayor of a municipality or the chair of a county board of commissioners, which may continue for a
maximum of three days, and may be further continued only with the consent of the applicable governing
body.
THEREFORE, pursuant to Minnesota Statutes, Section 12.29, I, as the Mayor of the City of
Mendota Heights, Minnesota, proclaim and declare a local emergency effective as of 10:00 p.m. on
Monday, June 1, 2020. This declaration shall last no longer than three days unless extended by and
through the consent of the Mendota Heights City Council.
This Declaration immediately invokes all necessary portions of the City's emergency management
plan including, but not limited to, the establishment of a City-wide curfew for all persons within the City
of Mendota Heights from 10:00 p.m. through 4:00 a.m., during each of Monday, June 1, 2020, and
Tuesday, June 2, 2020. This curfew does not extend to people traveling to or from work, emergency
services, law enforcement, people seeking emergency medical care or fleeing danger, the homeless and
the news media.
This Declaration shall be given prompt and general publicity.
