SUBJECT: Review of the Wentworth Warming House Layout
COMMENT:
INTRODUCTION
The Council is asked to discuss its preference for preceding with the Wentworth Warming House
Improvements.
BACKGROUND
The City Council has previously directed that the warming house at Wentworth Park be replaced, and
include expanded features like restrooms and a larger meeting space. Staff has met with several
companies and received three quotes that may be considered for this replacement.
DISCUSSION
The ideal dimensions for this space would be a building that is approximately 30 feet wide by 32 feet
long with an 8 foot overhang. An initial architectural rendering using concrete block construction
(July, 2019 estimate) was $512,000. A later estimate based on residential frame construction was
$385,000.
Unfortunately, both of those were in excess of the initial budget of $150,000.
Staff then reached out to builders, identifying the proposed budget amount. The feedback received
was that this budget for this size of a building would be able to fund a pole style building. The
proposals received were:
Pole Style Construction (Proposal from Structural Buildings) $135,000 to $145,000^
Pole Style Construction (RAM Construction Services)) 211,294
Precast Concrete (walls only; add $100,000 est. for finished structure) 126,000
^ Price depends on finish options
Based on its submittal of the most cost-effective proposal, a representative from Structural Buildings
will be present at the workshop to describe their proposal and finishing options in more detail, and
answer questions.
BUDGET IMPACT
If Council desires to proceed with the pole style building, some upgrades may be desired which
would bring the costs closer to $175,000. All options will require a separate contract to extend sewer
and water from Wentworth Avenue.
ACTION REQUIRED
If Council desires to proceed with this improvement, a preferred option should be determined. A
contract would be brought to a future Council meeting for approval.

Division 1 – General Requirements
1. Schedule:
o Construction schedule will be submitted upon acceptance of this contract
proposal.
2. Special Requirements:
o Civil Engineer by owner.
o Any additional work required by the City, County or State will be at
additional a charge.
3. Allowances:
o Allowances –: These allowances are for the cost to the Contractor for the
materials, labor and equipment delivered to the site and all required taxes.
Allowance adjustments to be clarified as selections are finalized.
o Allowance adjustments to be in writing.
4. AWA (Additional Work Authorization)
o AWA, the Owner may order AWA (changes in the work) consisting of
additions, deletions, or modifications, with the Contract Sum and the Contract
Time being adjusted accordingly. All such changes shall be authorized in
writing and signed by the Owner and by the Contractor prior to the execution
of the work.
5. Building permit.
o Any permits required are not included in this scope of work and are the
responsibility of MH.
6. Drawings.
o Structural Buildings to supply engineered drawings.
7. Owners:
o The term “Owner” as used in this Contract is understood to be MH or it’s
agent.
8. Contractor:
o The term “Contractor” as used in this Contract is understood to be Structural
Buildings, Inc., its sub-contractor or agent.
9. Work:
o The term “work” as used in this Contract includes labor, material, tools, and
equipment or transportation necessary for the construction of this project

10. Supervision:
o The Contractor shall supervise and direct the work and shall be solely
responsible for all construction and for coordinating all portions of the work
under this Contract.
o The Contractor shall enforce discipline and good order among its workers.
11. Material:
o All materials and equipment incorporated in the work will be new unless
otherwise specified and all work will be of good quality.
12. Substitutions:
o If materials or equipment become unavailable, subsequent to the execution of the
Contract through causes beyond the control and without the fault of the
Contractor, the Contract time shall be extended by an AWA (Change Order).
o The Contractor may need to substitute materials or equipment. If the required
material becomes permanently unavailable, the difference in cost of the
substituted material will be credited or charged to the Owner but shall not be
executed prior to written consent of the Owner.
o The Contractor may not substitute materials or equipment without prior written
consent of the Owner, which shall not be unreasonably withheld. The Owner,
however, reserves the right to substitute materials or equipment of substantially
equal character.
13. Sub-Contracts:
o The Contractor may contract with others to perform any or all portions of the
work. Contracts between the Contractor and the Sub-Contractor shall be in
accordance with the terms of this Contract.
o The execution of sub-contracts shall not relieve the Contractor of any obligations
to the Owner with respect to performance of the work or other items related to the
faithful performance of the Contract.
14. Separate Contracts:
o The Owner has the right to let other Contracts in connection with the project
which are not covered by this Contract, provided the Contractor is notified and

such Contracts shall not alter or vary the terms of this Contract. The Contractor
shall cooperate with any other Contractors.
15. Unforeseen difficulties:
o If the Contractor encounters unusual soil or water conditions, buried utility lines,
obstructions, inaccurate surveys or descriptions or any other difficulties not
apparent at the time this Contract was executed, the Contractor shall notify the
Owner of such difficulties and initiate an AWA (Change Order).
16. Delays:
o The Contractor shall execute the work with adequate personnel, materials and
scheduling so as to complete the work within the time stated in this Contract.
o If the Contractor is delayed in the process of the work by strikes, fire, or severe
weather conditions, unusual material or transportation delays, or other causes
beyond his control, the Contract time may be extended by Change Order without
penalty to the Contractor. Claims for additional time or additions to Contract
sums shall be presented in a timely fashion and require written, consent and
approval by execution of a Change Order signed by the Owner or its
representatives.
17. Payment:
o The payment schedule is to be determined between Owner and Contractor.
o Final payment shall be made upon substantial completion or occupancy,
whichever occurs first. The term substantial completion shall be understood to
mean ready for occupancy. Minor touch up, adjustments and finish details, which
may still be required, shall not be cause for withholding final payment. The
actual value of unfinished work may be retained by the Owner until the work is
completed.
o If payment is not made as agreed, a SERVICE CHARGE of 1-1/2% per month
(18% annual) will be imposed and a reasonable amount of costs and attorney’s
fees expended to enforce these terms.
o Use of the project constitutes acceptance.
Division 2 – Site Work
1. Site work.
o Demolition of existing structure is NOT included in this scope of work and is

the responsibility of MH. This can be negotiated to be included.
2. Excavating
o An allowance of $5,000 is included in this proposal for site preparation
3. Finish Grading
o Finish grading is the responsibility of MH
4. Landscaping.
o Landscaping is the responsibility of MH
Division 3 – Concrete
1. SBI to install 4” concrete slab with a broom finish inside the building. No
exterior concrete is included in this proposal.
Division 4 – Masonry
1. Concrete Unit Masonry: Warming house will have Versetta stone on the exterior
to a height of appx. 38” up from the bottom of the walls and posts (per plan)
Division 5 – Metals
1. Architectural/ Structural Metals: Roof steel to be 26 GA, Wall steel to be 29 GA
on exterior of building. Interior of building to use interior liner steel
Division 6 – Wood and Plastics
1. Rough Carpentry; to be performed to industry standards or better and in
compliance with Minnesota State Building code
2. Lumber. To be purchased from a licensed lumber dealer
3. Finish Carpentry: Interior walls are covered with interior steel liner panels that
are white in color
4. Architectural Woodwork: N/A
Division 7 – Thermal and Moisture Protection
1. Roofing/walls
o Poly vapor barrier on walls and ceilings of entire building

o This Budget Proposal is prepared based off of the “Working Plan” provided by
MH

SUBJECT: Marie Avenue Rehabilitation
COMMENT:
INTRODUCTION
The Council is asked to comment on improvements to the Marie Avenue Rehabilitation.
BACKGROUND
Staff and TKDA have been working on the final design elements for Marie Avenue.
1. The original scope of work included possible trail improvements to Lexington Avenue
due to a residents concerns the city received in 2017. Due to the costs ($250,000-
$350,000) and impacts to the trees along Lexington Avenue, this portion of the
improvement is no longer included in the project. This improvement could be considered
as a stand-along project in the future.
2. Additional graphics show how bump-outs would be constructed at Eagle Ridge Drive and
Walsh/Lilac and is showing a new trail from Victoria Road to Marie Park on the north.
3. The final graphic relates to the pedestrian underpass. Due to cost increases, Dakota
County is now proposing to have the existing underpass remain for walkers, and then
construct a new at-grade crossing for bicyclists.
Additional information will be provided to Council when staff asks to approve the plans and
solicit bids.

The Council may provide feedback to staff on the proposed improvements.

2020 City Council Issues
(Identified at 1/2/2020 Work Session Meeting)
Summary and Status—February 19, 2020
1. Bourn Property Resolution. Possible considerations:
a. Commercial or Mixed Use--Garlock
b. Public Use Area--Paper
c. Have a neutral third party identify highest and best uses--Duggan
Status: There is still an unsolicited proposal for Commercial/Industrial. To reach a resolution
on this in 2020, the Council should first decide on the preferred end use. A process to
determine what/how development should take place can then be determined.
2. Natural Resources Issues
a. Resolve Advisory Group Status--Petschel
b. Find full funding for an Update of the Natural Resources Plan--Miller
c. Surface Water Quality—Identify and Implement Management Plan--Duggan
Status: RFP for Natural Resources Plan will be on the 2/18/2020 City Council agenda to
approve for distribution. Scope of services to be determined by responses received. $75,000
budgeted in FY 2020.
3. Historic Pilot Knob Area
a. Resolve Acquisition of available Valencour Property--Garlock
b. Preserve bluff area of HPK, including Old Sibley Memorial Highway--Petschel
c. Work to keep Old Sibley Memorial Highway open to through traffic--Garlock
Status: Historic Pilot Knob Task Force appointed by the Council in January; initial meeting of
the Task Force is scheduled for March 4th. There is a willing seller of the Valencour property;
Phase 1 Environmental Review completed, and County currently doing value appraisal.
Funding for City portion of acquisition cost to come from Village proceeds, and possible
Natural and Scenic Area grant (application due 3/27/2020).
Currently working with MNDOT and other agencies on future of Old Sibley Memorial
Highway; last meeting held December 16th.
4. Recreation Issues
a. Construct dugouts at Mendakota Pak baseball/softball fields--Paper
b. Update City’s Trail System—better mapping and signage, mile markers for
emergency responders, call boxes--Miller
Status: One quote has solicited and received on Mendakota Park dugout construction. Need
prioritization to proceed. Signage and mile markers can be done by Public Works. Will need
to get a cost estimate first.

5. Traffic Issues
a. Dodd and Delaware—Do local and regional planning to prepare for future
traffic volumes, bicycle and pedestrian movement--Miller
b. Identify and prepare for traffic impacts on Dodd to be caused by Viking Lakes
commercial development.--Duggan
Status: Dakota County is updating the Regional Traffic Management Plan for this area
(northwestern Dakota County, including Dodd and Delaware). Need Council consensus on
planning and preparation, vs. implementation. Currently have the KLJ study from 2017
regarding impact on Dodd Road; will need to monitor Viking Lakes development progress for
more specific Dodd Road traffic impacts.
6. Commercial Issues
a. Negotiate a joint commercial plan and marketing for Village, and Mendota
Plaza Commercial area--Petschel
b. Be prepared to regulate Small Cell Wireless—Paper
Status: The Village properties are in the process of being sold. Once the ownership status has
been finalized, discussion of joint branding between the new owner and Paster Properties
may be approached.
The City has adopted an ordinance governing small cell technology in the public right of way.
However, that ordinance will likely not be adequate should multiple providers desire to locate
in the same confined area.

SUBJECT: City Administrator Evaluation Process
Comment:
Introduction:
At the February 19th Council work session meeting, the Council will be asked to discuss, and establish a
process for the City Administrator’s annual evaluation. The actual evaluation would be held at a later date,
which would be determined.
Background:
My work anniversary date with the City is February 22nd, which is typically when the evaluation would
take place. At the February 19th work session, the Council will be asked to determine the structure for the
evaluation of the City Administrator. It is assumed that each Councilor will be willing to complete a written
evaluation.
There are two options for the actual evaluation meeting:
1. If a quorum of Councilors are to be present, the evaluation may be held in a closed session. The
applicable portion of the law (MSA 13D. 05, subd. 2)states:
“A public body may close a meeting to evaluate the performance of an individual who
is subject to its authority. Before closing a meeting, the public body must identify the
individual to be evaluated. The public body must summarize the conclusions of the
evaluation at its next open meeting. An evaluation meeting must be open at the request
of the subject of the meeting. “
2. Two members of the Council (less than a quorum) could be appointed to collect the completed
evaluation forms from other members of the City Council, and then meet with the City
Administrator to review the results.
At the work session, I will distribute an evaluation form and background information to each of the
Councilors for use in completing the evaluation.
Action Required:
The City Council should decide on a format for the City Administrator’s Annual Evaluation—either in a
future closed session, or by a committee.
