The following Commissioners were present: Chair Lally, Commissioners Field, Hennes, Povolny, and Viksnins. Those absent: Commissioners McManus and Norton. Those present were City Administrator David McKnight, Assistant to the City Administrator Jake Sedlacek, Acting Public Works Director/City Engineer Ryan Ruzek, and NAC Planner Carie Ful -man. Minutes were recorded by Carla Wirth. Election qt'Chair and Vice Chair Chair Lally called for nominations for the position of 2010 Planning Commission Chair. While a vote was taken, there was no formal motion (or second) to approve the minutes, the minutes of the December 22, 2009 and January 26, 2010 will be brought to the March 23, 2010 Planning Commission meeting. The Planning Commission agreed with the request of Chair Lally to consider Item 6a prior to Item 5 Hearings PLANNING CASE #10-02 Jane Landreville 2455 Bridgeview Court Wetlands Permit for a Fence Planning Commission Minutes February 23, 2010 Planner Carie Fuhrman explained that Jane Landreville is seeking a Wetlands Permit in order to install a fence to enclose a portion of the rear- yard and to construct a set of stairs off the rear yard deck. The subject site is located at 2455 Bridgeview Court and zoned R-1, One Family Residential. The Wetlands Ordinance requires that any land alteration or construction within 100 feet of any designated wetland requires approval of a Wetlands Pen -nit. Ms. Fuhrman used a map to identify the subject site, noting the parcel is located at the end of Bridgeview Court, which is a cul-de-sac, and west of Friendly Hills Middle School. It is a triangular-shaped parcel with a wetland located in the northwest corner. The parcel slopes down from the location of the home towards the wetland. The rear portion of the parcel is unimproved and contains natural vegetation. An 18 to 25 foot wide natural vegetation buffer is located between the improved lawn and the wetland area. Ms. Fuhrman stated the proposed fence will be approximately 18 to 20 feet from the wetland edge at its nearest point and the proposed deck stairs will be at least 70 feet from the wetland edge. The fence material is black aluminum, classic style fence with a 3/4 rail puppy panel at the bottom, which will be located around the improved lawn area. The other portion of fence will be a black vinyl -coated chain link fence, which will be located through the wooded area. She used a site map to describe the intended alignment of the proposed fences and advised the applicant has indicated the purpose of the fence is to help keep both the family dog and the public utilizing the bike path safe from each other. Ms. Fuhrman stated the applicant is also applying to construct a set of stairs off the existing deck, which is located on the rear side of the home. The steps would be no wider than four feet and run directly behind the attached garage towards the east side property line and be approximately 80 feet from the wetland. The applicant has chosen this location to place the stairs because the area immediately adjacent to the deck, in the center of the rear yard, is 16 or so feet lower than the deck elevation and would require a more intrusive staircase. She noted the purpose of the Wetlands Ordinance is to ensure that alternations within the buffer area adjacent to wetlands do not degrade or threaten the water quality of the wetland area. Ms. Fuhrman stated the Planning Commission may either approve the Wetlands Permit based on findings that the proposal will not result in any negative impacts to the wetland and that the request is consistent with the Wetlands Ordinance; or, deny the Wetlands Permit based on a finding that the application is inconsistent with the intent of the Wetlands Ordinance, Ms. Fuhrman stated planning staff recommends approval of the requested Wetlands Permit for the installation of the fence and construction of the deck stairs as both projects will not result in any negative impacts to the wetland. The applicant has shown consideration for alternative locations for both the fencing and stairs, but the proposed locations appear to meet the intent of the Wetlands Ordinance and will not degrade or threaten the water quality of the wetland. Commissioner Viksnins asked if the entire fence would require the Wetlands Permit. Ms. Fuhrman used a map to identify an area closer to the house that may be outside the 100 foot setback. Jane Landreville, applicant and owner of 2455 Bridgeview Court, stated her agreement with staff s recommendation and findings. Commissioner Hennes asked if the fence would be necessary along the wetland. Ms. Landreville stated the fence is necessary to keep their family dog, a Welsh Terrier, out of the wetland water and wooded area. She explained that since they have an eight to ten foot high buffer, the fence cannot be viewed unless standing in her yard. Chair Lally opened the public hearing. Seeing no one corning forward wishing to speak, Chair Lally asked for a motion to close the public hearing. AYES 5 NAYS 0 Chair Lally advised the City Council would consider this application at its March 2, 2010, meeting Presentation of Open Meeting Law and Data Practices Act City Administrator David McKnight referenced the Minnesota Counties Insurance Trust, Resource Briefing, June 2006, and presented an overview of the Open Meeting Law, a law in Minnesota that applies to local government organizations and its members. Commissioner Viksnins asked if a violation results should an applicant call a Commissioner. Mr. McKnight explained why that would not be considered a violation of the Open Meeting Law. Commissioner Viksnins noted the information says the public body must make available for inspection, in the meeting room, at least one copy of the agenda and other written materials distributed to all board members. Mr. McKnight stated that is correct and pointed out the location of this information near the entrance to the meeting room. Mr. McKnight presented information on the Data Practices Act and advised the City keeps all of the Planning Commission data. He advised both the Open Meeting Law and Data Practices Act apply to the Planning Commission even though members are appointed and not elected. Commissioner Field asked whether documents presented at public meetings by the applicant are retained for the City's records. Mr. McKnight stated staff will assure those documents are retained. Verbal Review Assistant to the City Administrator Jake Sedlacek gave the following verbal review: PLANNING CASE #10-01 Clear Wireless, LLC Conditional Use Permit Approved by the City Council as recommended by the Planning Commission. City of Mendota Heights Comprehensive Plan Approved by the City Council as recommended by the Planning Commission and submitted to the Metropolitan Council this afternoon. Mr. Sedlacek announced that the Dakota County Transportation staff will host a neighborhood meeting on Thursday, February 25, 2010, from 4-6 p.m. at Trinity School to discuss the status of the Dakota County Regional Visioning Study. Mr. Sedlacek also announced the Annual Spring Clean Up Day on May 1, 2010, at Mendakota Park. Commissioner Hennes requested an update on the Zoning Code. Mr. Sedlacek advised that the Zoning Code Update will be considered and public hearing held at the Commission's March meeting. AYES NAYES Respectfully submitted, Carla Wirth, Recording Secretary 0 MENDOTA HEIGHTS PLANNING COMMISSION RULES OF ORDER In accordance with the City of Mendota Heights Ordinance No. 108, "Establishing A Planning Commission:, the following rules of order are adopted by the Planning Commission to facilitate the performance of its duties and the exercising of its functions as a Commission created by the City Council SECTION 1. MEETING 1_1 — Time. Regular meetings of the Commission are held on the fourth Tuesday of each month at 7:00 P.M., unless otherwise agreed to and so stated in the agenda. When the regular meeting day falls on a legal holiday, there is no meeting that month unless otherwise noted. 1.2 - Special Meetings. Special meetings may be called by the Chairperson or the Secretary. 1_3 — Place. Meetings are held in the City Hall Council Chambers, 1101 Victoria Curve. 1.4 - Public. All meetings and hearings, and all records and minutes are open to the public. 1_5 — Quorum. Four Planning Commission members, at the beginning of the meeting, constitute a quorum for the transaction of business. When a quorum is not present, the Chairperson may adjourn the meeting for the purpose of hearing interested parties on items on the agenda. No final or official action is taken at such a meeting. However, the facts and information gathered at such a meeting may be taken as a basis for action at a subsequent meeting at which a quorum is present. 1.6 — Vote. Voting is by voice except as otherwise stated herein. Commission members voice votes on each issue are recorded. In the event that any member shall have a financial interest in a matter than before the Commission, the member shall disclose the interest and refrain from voting upon the matter, and the secretary shall so record in the minutes that no vote was cast by such member. SECTION 2. ORGANIZATION 2.1 — Membership. The number of members of the Planning Commission is 6, -0" established by the City Council. Appointments are made by the Mayor and Qopl approved by the City Council. U RULES OF ORDER/ MENDOTA HEIGHTS PLANNING COMMISSION 3/23/2010 2.2 — Absenteeism. A Commission member with three consecutive unexcused absences is dropped from the Commission and the secretary then informs the City Council so that another appointment is made. An absence is excused if the member notifies the secretary or Chairperson before 4:00 P.M. of the day of the meeting that the member will be unable to attend. Minutes of the meetings will record whether the absent member was excused or not excused. 2.3 — Election of Officers. At the February meeting each year, the Commission elects from its membership a Chairperson and a Vice -Chairperson. If the Chairperson retires from the Commission before the next organizational meeting, the Vice -Chairperson becomes Chairperson. If both Chairperson and Vice - Chairperson retire, new officers are elected at the next meeting. If both Chairperson and Vice -Chairperson are absent from a meeting, the Commission elects a temporary Chairperson by voice vote. The Secretary to the Planning Commission is appointed by the City Administrator from the City Staff. 2.4 — Tenure of Officers. The Chairperson and Vice -Chairperson take office immediately following their election and hold office until their successors are elected and assume office. 2.5 — Duties of Officers. The Chairperson, or if absent, the Vice -Chairperson presides at meetings, appoints committees and performs other duties as may be ordered by the Commission. The Chairperson conducts meetings so as to keep them moving as rapidly and qefficiently as possible and reminds members, witnesses and petitioners to discuss only the subject at hand. The Chairperson is a voting member of the Commission. The secretary is responsible for recording the minutes, keeping records of Commission actions, conveying Commission recommendations to the City Council and providing general administrative and clerical service to the Commission. SECTION 3. PUBLIC HEARINGS 3.1 — Purpose of Hearings. In compliance with City Ordinances, the purpose of a hearing is to collect information and facts in order for the Commission to develop a rational planning recommendation for the City Council. These By-laws may be amended or suspended with the approval by voice vote by a majority (four) of the members of the Planning Commission. 4.2 — Adoption. LOCATION: 2431 Lexington Avenue ZONING: I — Industrial GUIDE PLAN: CC — City Hall/Public Works/Fire Hall Background and Description of Request: Mark Hemstreet of Insite, Inc., on behalf of Verizon Wireless, is requesting approval of a Conditional Use Permit (CUP) to install wireless accessory equipment on the existing water tower site located at 2431 Lexington Avenue. The parcel is zoned I, Industrial. The project will include the installation of a back-up generator at the Verizon Wireless facility to ensure that Verizon's equipment will receive adequate power in instances where its main power is interrupted. According to the Zoning Ordinance, Section 12-lJ-6.C.3, If both the applicant and the city consent to mounting the antennas on the city's water tower or other municipal building, a developer's agreement may be necessary at the discretion of the city in addition to a conditional use permit. Analysis: Accessory Equipment. Verizon is proposing the placement of a 50KW Katolight Diesel Generator with Crystal Quiet Sound Enclosure and Spill Containment. A photograph of a similar generator has been included in the application materials. The generator is proposed to be located to the southwest of the water tower and directly P. C. #10-04 P1 northwest of the existing 16 foot by 52 foot concrete equipment building. In order to install the generator, an additional lease area of approximately 12 feet by 15 feet (180 square feet) is needed. The generator will be enclosed by a chain link fence that will connect to and match the existing chain link fence on the north side of the Verizon equipment shelter. Screening will consist of vertical privacy slats that match the screening in the fence surrounding the AT&T equipment located to the east of the water tower. Wireless Telecommunication Review Standards. Wireless telecommunication towers, antennas, and accessory structures are allowed as conditional uses in all zones within the City. These uses are regulated by Section 12-1J-6. The purpose of this section is to protect the public health, safety, and general welfare of the community while accommodating the communication needs of residents and businesses. The Ordinance outlines standards, including, but not limited to the following: Agreement To Mount On City Property: If both the applicant and the city consent to mounting the antennas on the city's water tower or other municipal building, a developer's agreement may be necessary at the discretion of the city in addition to a conditional use permit. The existing lease for wireless equipment at the water tower shall be amended to address the additional ground equipment. Compliance With Building And Electrical Codes: All antennas, freestanding antenna towers, and accessory structures shall conform to all building and electrical codes. This shall be added as a conditional upon approval. Details shall be provided with the building permit application. Bond: A successful applicant shall provide an abandonment bond to the city equal to one and a half (1 1/2) times the current cost of removal and disposal of all antennas and accompanying apparatus as estimated by a consultant selected by the city and paid for by the applicant, which bond shall be used by the city to remove the antennas and apparatus should they become unused or obsolete and the applicant or its successors or assigns become disbarred or otherwise fail to remove said antennas and apparatus. This shall be added as a condition upon approval. Compliance With FCC Regulations; Noninterference Required: All new or existing telecommunications service and equipment shall meet or exceed all federal communications commission (FCC) standards and regulations and shall not interfere with any other communications, computers, laboratory equipment or manufacturing equipment, including television and other home electronics. Staff is unaware of any FCC regulations pertaining to a generator. FCC compliance for existing equipment is included in existing lease. 2 P2 P. C. #10-04 Other Required Licenses: The applicant most submit proof of any applicable federal, state, or local licenses to the council prior to receiving a building permit. The applicants shall be asked to submit copies of any applicable licenses for review. Comprehensive Plan. The subject parcel is guided as CC — City Hall/ Public Works/ Fire Hall in the 1999 Comprehensive Plan. The request is consistent with this land use category. Adding additional accessory ground equipment to the City's water tower does not infringe upon the intent of this land use category. Action Requested: Following a public hearing, the Planning Commission may consider one of the following recommendations: Approval of the Conditional Use Permit as requested based upon a finding that the proposed accessory equipment installation meets all of the Zoning Ordinance requirements and is consistent with the intent of the Conditional Use Permit criteria allowing such features, and subject to the following conditions: 1. Lease shall be amended to reference the additional ground equipment. 2. A building permit must be obtained prior to construction and installation. 3. The applicant shall provide an abandonment bond to the City as required by Section 12-1J-6.H.1.b of the Zoning Ordinance. 4. The applicant shall abide by all other regulations in Section 12-1J-6 of the Zoning Ordinance. 01N Denial of the Conditional Use Permit based on a finding that the proposed accessory equipment use is inconsistent with the Zoning Ordinance and/or the Comprehensive Plan. Staff Recommendation The City strongly encourages new personal wireless service antennas to be located on existing towers or support structures in Section 12 -1J -6A4 of the Zoning Ordinance: Minimize the number of freestanding antenna towers needed to serve the community by utilizing collocation. This proposal meets this objective of the City as it is adding accessory equipment to an existing wireless site. Based on the review of the applicable Zoning Ordinance requirements, our office recommends approval of the CUP to locate accessory wireless equipment on an existing telecommunications tower site as illustrated on the submitted site plans and subject to the above-mentioned conditions. 3 P. The applicant requests a wetlands permit to allow installation of a ground source heat pump in the rear yard of the property. The ground source heat pump is needed for the geothermal heating and cooling system being installed on the property. According to the applicants, the State of Minnesota's Office of Energy Security is offering a rebate program for these extremely energy efficient heating and cooling systems, which is estimated to reduce their home energy costs by approximately $1,500 per year. The project involves excavating a trench that shall be 28 feet from the wetland at its closest point, installing plastic piping, regrading, and laying new sod. According to the applicant, silt fence will be placed between the disturbed area and the wetland prior to any work being performed. The silt fence will remain in place until all excavation and re -grading is complete and new sod is placed. The work is expected to be complete in less than one week. The applicant plans to maintain an improved area of lawn immediately surrounding the home (see site plan). The rest of the parcel shall remain in its natural state, along with some native vegetation plantings that will serve as a buffer to absorb and prevent undesirable runoff from reaching the wetland. History. The applicant requested a wetlands permit back in July of 2008 in order to place a fence in the rear yard of the property. Wetlands Permit. The Wetlands Ordinance requires that any land alteration or construction within 100 feet of any designated wetland requires approval of a Wetlands Permit. The purpose of the Wetlands Ordinance is to ensure that alterations within the buffer area adjacent to wetlands do not degrade or threaten the water quality of the wetland area. Engineer Review. The Assistant City Engineer has reviewed the permit application. He has stated that all construction/excavation work must be located outside of the platted easement area (as shown on the attached plat) and all construction activities must follow the City's Land Disturbance Guidance document. Action Requested: Following a public hearing, the Planning Commission may consider one of the following recommendations: 1. Approval of the wetlands permit for the proposed installation of the ground source heat pump, based on a finding that the heat pump will have little or no 2 P2 10-05 negative impact on the existing wetland and that the request is consistent with the Wetlands Ordinance, and subject to the following conditions: a. There are numerous other changes to the text, most of which are technical, clerical, or for clarifying purposes. This memorandum is intended to complement the original table format, which summarized all of the various comments received, including those for which no change is proposed, and the most recently -updated Zoning Ordinance draft. Article D. General Zoning Provisions 1 D-1: Nonconforming structures/uses (page 2). Changes in this section reflect recent amendment to State law regarding the rights of nonconformities, including the right to rebuild within specific timeframes, regardless of the cause of the discontinuance. Formerly, the code required an "act of God" type of loss, and prohibited replacement if more than 50% of the nonconformity were destroyed. Now, any nonconformity may be replaced if a permit is requested within 6 months, and replacement is done within 12 months. ID -3: Accessory Structures (page 3). This section replaces the accessory structure regulations that are scattered throughout the ordinance in various places, including both the performance standards sections and the individual zoning districts. The intent here is to recodify the existing regulations, and does not make substantive changes to the standards. The principal exception is that the garage door number and height regulations have been applied to all garages, rather than only those oversized attached garages that require a separate CUP. ID -4: Front Yard Encroachments (page 8). Proposed language would allow covered and/or enclosed entryways to extend into the front yard setback through a conditional use permit, following specific regulations (cannot extend more than 5 feet; limited in size to 50 SF; and may not extend above the height of the ground floor level). 1 D-4: "String Rule" (page 9). Proposed language would change the string rule to permit some encroachment ahead of the current strict string line. The proposed change would average the adjacent setbacks and the required 30 foot setback to establish a modified front setback. For instance, if the average setback of the adjacent structures is 50 feet, and the required setback is 30 feet, the modified string line setback for the middle parcel would be 40 feet. The intent is to permit some forward encroachment allowing for remodeling projects without completely abandoning the string line concept. A figure will be inserted to illustrate the revised rule. 1 D-6: Fence regulations (page 15). Adds a requirement for industrial fences requiring compliance with residential fence regulations when abutting residential property. 1 D-9: Land Reclamation (page 16). Changes the requirements to refer to the City's land alteration regulations in other code. 1 D-10: Mining and Soil Processing (page 17). Delete these requirements in this Section, as the city has adopted other regulations pertaining to grading, drainage, etc that make this language obsolete. 1D-13-2- Exterior Surfaces (page 20). Adds a requirement for roofs to be included in the building construction review. 1 D -13-2D: Landscaping Requirements (page 23). Adds six (6) species to the list of trees not allowed to be planted within the City. 1D-13-3- Motor Fuel Stations and Motor Fuel Station Convenience Stores (page 24). Moved these requirements to this section from Article J — Special Zoning Provisions. Synchs the parking lot lighting section with the general site lighting standard proposed at 0.2 foot candles at the property line. 1D-13-4- Drive In and Fast Food Restaurants (page 28). Moved these requirements to this section from Article J — Special Zoning Provisions. 1 D-13-5: Outside Storage in Residential Districts (page 29). Moved these requirements to this section from Article J — Special Zoning Provisions. Adds a requirement for compliance with the City's Property Maintenance Code relating to recreational vehicles. 2 1D-14: Wireless Antennas, Towers, and Accessory Structures (page 31). Moved these requirements to this section from Article J — Special Zoning Provisions. 1 D-15: Signs (page 36). Moved these requirements to this section from Article J — Special Zoning Provisions. 1 D-16: Off Street Parking and Loading (page 41). Moved these requirements to this section from Article J — Special Zoning Provisions. Provides for a revised standard for office parking that relates the amount of usable floor area which is common in suburban office parks (1 space per 200 square feet net usable area). Provides for a revised standard for retail parking that relates to gross area, and is consistent with predominant retail standards (1 space per 200 square feet gross floor area). Article E — R Residence Districts 1 E-1: Screening of materials (page 2). Corrects the amount of unscreened firewood storage to coordinate with Property Maintenance Code. 1 E-3: Conditional uses in the R-1 District (page 4). Adds reference to the allowance for 7 -person assisted living facilities as recently adopted. 1 E-8: Structure setbacks in the R-3 District (page 13). Proposes a slight increase in the setback requirements for multiple family buildings. Article F — B Business Districts 1 F-1: Side yard setbacks in the B-1 District (page 5). Proposes a slight increase in the side yard setback for B-1 buildings that exceed the height allowances (only allowed through a specific provision in the code for certain structures). 1 F-3: Side yard setbacks in the B-2 District (page 11). Proposes a slight increase in the side yard setback for B-1 buildings that exceed the height allowances (only allowed through a specific provision in the code for certain structures). Article G — I Industrial District 3 1 G-2: Conditional Uses in the I District (page 3 and 4). Removes Contractor's Yards and Rental Units on a Motor Fuel Station from the list of potential conditional uses. Adds Accessory, Enclosed Retail Sales to the list of potential conditional uses as recently adopted. Article H — Planned Unit Development Districts These regulations have been merged with the other PUD regulations into Article K. Article H is now "Reserved." Article I — Performance Standards 11-1: Compliance with provisions (page 1). Makes a series of additions to MPCA standards to add language related to nuisance in addition to MPCA thresholds in the event MPCA will not provide enforcement assistance. 11-15: Lighting (page 3). Adds an objective lighting standard of 0.2 foot candles at shared property lines. It is common for commercial building projects to have a lighting "photometric" plan prepared by their lighting consultant/contractor. This plan can ensure that the intent of the language is met, and that properties do not create too much glare or light "spillage" onto adjacent parcels. Article J — Special Zoning Provisions These regulations have been merged into Article D: General Zoning Provisions. Article J is now "Reserved." Article K — Planned Unit Developments 1 K-1: Planned Unit Development. Several sections in this chapter designed to merge the two PUD sections into a single article. The current Article K is utilized as the base (this section specifies most of the standards for general PUD application), and the Article H language (relating to PUD zoning districts) has been imported into this new chapter. There are only a few technical corrections to the text necessary to merge the two. 4
