Planning Commission Minutes October 26, 2010 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA PLANNING COMMISSION MINUTES October 26, 2010 The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, October 26, 2010, in the Council Chambers at City Hall, 1101 Victoria Curve at 7:00 P.M. The following Commissioners were present: Chair Povolny, Commissioners Field, Hennes, McManus, Norton, and Viksnins. Those absent: None. Those present were Assistant to the City Administrator Jake Sedlacek, Public Works Director/City Engineer Mazzitello, and NAC Planner Stephen Grittman. Minutes were recorded by Carla Wirth. Approval ofSeptember28 2010 Minutes COMMISSIONER HENNES MOVED, SECONDED BY COMMISSIONER NORTON, TO APPROVE THE MINUTES OF SEPTEMBER 28, 2010, AS PRESENTED. AYES: NAYS: Hearinffs PLANNING CASE #10-30 Daniel and Jodi Saltzman 1921 Glenhill Road Critical Area Permit to enclose an existing second floor deck Planner Stephen Grittman presented the application of Daniel and Jodi Saltzman for a critical area permit to allow the construction of a home addition in the rear (west) yard of their property at 1921 Glenhill Road. The subject site is zoned R-1, Single Family Residential, and occupied by a single family home_ The property is within the critical area so any land alteration or construction that changes the bulk of structure requires a critical area permit. The intent of the ordinance is to protect the environment surrounding the river corridor and primarily of concern are views of the river, from the river, and natural conditions adjacent to the bluff lands. Mr. Grittman displayed a site plan depicting the subject site and explained the applicants wish to enclose an existing second floor deck converting it to interior living space for a master bathroom addition. The existing deck measures approximately 200 square feet. The building would meet all setback requirements and create no bluff or land impacts. Staff finds the application meets the intent of the critical area ordinance and recommends approval as submitted. Commissioner McManus noted the open deck already has a roof so there should not be much difference in impervious surface. Mr. Grittman concurred. Commissioner Viksnins referenced a condition to clarify impervious surfaces. Mr. Grittman explained that when the staff report was written, the site inspection had not yet occurred. The site inspection has now been completed and it was determined there would be no difference in impervious surface. Daniel Saltzman, 1921 Glenhill Road, applicant, explained this project would enclose an upper second floor deck to create more living space. Chair Povolny opened the public hearing. Seeing no one coming forward wishing to speak, Chair Povolny asked for a motion to close the public hearing. EXTERIOR FINISH MATERIALS OF THE PROPOSED HOME ADDITION (DECK CONVERSION) MATCH THE EXISTING HOME IN COLOR AYES 6 NAYS 0 Chair Povolny advised the City Council would consider this application at its November 2, 2010, meeting starting at 8:30 p.m. PLANNING CASE #10-31 Richard Nelson 796 Havenview Court Wetlands Permit for a fence Planner Stephen Grittman presented the application of Richard Nelson for wetlands permit to install a fence in the rear yard of his property at 796 Havenview Court. The subject site is zoned R-1, Single Family Residential, and occupied by a single family home. The applicant is completing a landscaping project in the rear portion of the property. He used a map to identify the edge of the wetland and explained that the wetlands ordinance requires that any land alteration or construction within 100 feet of a designated wetland requires a wetlands permit approving the construction to assure no activity would negatively impact the water quality or function of the wetland. Mr. Grittman displayed a site plan depicting the subject site and location of the proposed fence. He also displayed photographs of the intended fence design and location of the fence and wetland. The engineering staff recommended the area between the fence and wetland remain in natural native plantings and landscaping. The applicant has completed a number of those plantings. Mr. Grittman stated the fence will have little impact on the land and is consistent with the requirements of the wetland ordinance. Staff recommends for approval subject to the conditions detailed in the staff report. Richard Nelson, 796 Havenview Court, applicant, introduced himself and indicated the fence will be about 50 feet removed from the pond and reside on the top of the hill that slopes to the pond. He stated that he had applied for and received a wetlands permit in 2006 to plant native wildflowers on the hill. This fence will be on the grassy area and only enclose the upper area of the hill, tied to the house. Commissioner Hennes referenced the applicant's submittal that mentioned two Dakota County court appearances. Mr. Nelson explained that he had moved to Mendota Heights from Georgia in 1995 and was oblivious of the need to apply for a permit to do landscaping. He had spent about eight years, on weekends, moving dirt and one of his neighbors turned him in. That lead to the court appearances and subsequently he made application for and received the wetlands permit. Mr. Nelson stated he had hired Minnesota Native Landscape Company to complete that proj ect. Commissioner Viksnins asked Mr. Nelson if he supported the condition of approval requiring native plantings. Mr. Nelson answered in the affirmative. Chair Povolny opened the public hearing. 2 Planning Commission Minutes October 26, 2010 John Deslauriers, 790 Havenview Court, stated he lives to the east and does not like the appearance of a fence in the proposed location. Scott Beaty, 800 Havenview Court, stated he lives to the west, did not move to Mendota Heights to see a fence, and is not sure why the fence is needed. He asked if there is any other way than to install a physical fence because it will interrupt his pond view from the ground level. Mr. Beaty stated he understands there are property rights but would like consideration of an underground fence if the intent is to contain a dog. Commissioner McManus asked if he had made that request of the applicant. Mr. Beaty stated he had not because the applicant has not lived there for the last year. Commissioner Norton noted the applicant has the right to install a fence if it meets code requirements but the neighbors could speak to the applicant in an attempt to reach a friendly resolution. Seeing no one else coming forward wishing to speak, Chair Povolny asked for a motion to close the public hearing. AYES 6 NAYS 0 Chair Povolny advised the City Council would consider this application at its November 2, 2010, meeting starting at 8:30 p.m. PLANNING CASE #10-32 Robert and Katherine Thompson 979 Caren Court Critical Area Permit for a fence Planner Stephen Grittman presented the application of Robert Thompson for a critical area permit to allow the installation of a fence within the rear yard of his property at 979 Caren Road. The subject site is zoned R-1, Single Family Residential, and occupied by a single family home. The property is within the Mississippi River Critical Area so construction of a fence requires a critical area permit. Mr. Grittman displayed a site plan of the subject site and explained that the fence is proposed along the west property line to the rear yard area. The critical area ordinance encourages the use of natural materials and the applicant proposes to construct a cedar -style fence with one inch spacing between slats. Mr. Grittman stated staff finds the proposed fence construction consistent with the critical area ordinance and that it will not create any impacts to slopes. Staff recommends approval subject to the applicant verifying with the building official that the fence meets the code requirement to be at least 30% open. Robert Thompson, 979 Caren Road, applicant, stated they have a small miniature dog that needs to be contained within a fenced yard. Since the dog is so small, the veterinarian recommended against an underground electrical fence. Mr. Thompson advised that one inch spacing will comply with the code requirement for 30% openness. 3 Planning Commission Minutes October 26, 2010 Commissioner McManus urged the applicant to be sure the fence meets code requirements because it will be enforced. Mr. Thompson stated they will assure the fence complies. Commissioner McManus thanked the applicants for the tour of their property. Chair Povolny opened the public hearing. Commissioner Hennes asked if the Council had made any comment about the Planning Commission's concerns with variance issues and if they would consider a joint discussion. Mr. Sedlacek advised that the Council would prefer to meet after the first of the year when the newly elected Council is seated. He stated he will be asking all Council Members, Planning Commissioners, and planning staff to attend the League of Minnesota Cities web training regarding variances to reduce the cost to the city in the event of a legal case. Chair Povolny asked if receiving this training will reduce the city's insurance premiums. Mr. Grittman explained that if enough people from the city complete this training, a discount on insurance premiums will be offered. Chair Povolny asked how long the training sessions will last. Mr. Sedlacek stated he does not know and will provide additional information to the Commission as it becomes available. Election of Planning Commission Vice Chair M Planning Commission Minutes October 26, 2010 Commissioner Field commented on the need to appoint new officers with the resignation of Chair Joe Lally. He noted that Mike Povolny has assumed the office of Chair but would suggest that a Vice Chair be elected in the event of Chair Povolny's absence. The school is located at 1315 Mendota Heights Road and zoned Industrial. Restaurants (not drive-in or fast food type) are allowed as conditional uses in the Industrial Zoning District. The building permit for the construction of Le Cordon Bleu was approved in 2004. At that time, the applicants also applied for and received a conditional use permit to operate a restaurant facility as a part of Brown College's Le Cordon Bleu culinary school. However, the restaurant portion of the school never materialized. According to Section 12-1 L -6E of the Zoning Ordinance, a conditional use permit shall be void after it has ceased for a period of six (6) months, thus requiring the need for a new application. Analysis: The Le Cordon Bleu school is located on a total of 10.12 acres and is zoned I, Industrial. The restaurant and cafe are proposed to be located in the existing Le Cordon Bleu Culinary building, in the northwest corner of the backwards L-shaped building and will be open to the public. The space is currently being used as storage as it was never finished with the rest of the building. The conditional use permit application includes: a restaurant with indoor dining space, a kitchen, and an outdoor dining area, along with a cafe facility with indoor dining space and outdoor dining also. As a part of the overall project, they are also planning to add new classroom space, a storage area, and restrooms to this portion of the existing building. The entire project area will encompass 8,200 square feet of the approximately 70,000 square foot building, which equates to 12% of the existing building. The restaurant and cafe portion of the facility will provide seating for 108 indoor guests in an approximately 2,600 square foot area. Two outdoor patios will provide seating for 28 guests in an area of 440 square feet combined. A total of 136 seats will be provided for restaurant and cafe patrons. Black wrought iron fencing three feet in height is proposed to surround each of the outdoor dining areas. The fencing will contain integral bollard lights, along with built-in flower boxes. A new door to each of the patios is also proposed. Two new concrete walks are also proposed from the main entrance doorway to the sidewalk and from the exit -only doorway to the sidewalk. Hours of Operation. The proposed hours of operation for the restaurant are Monday through Friday 11:00 a.m. to 10:00 p.m., Saturday 6:00 a.m. to 10:00 p.m., and Sunday 6:00 a.m. to 10:00 p.m. The proposed hours of operation for the cafe are Monday through Sunday 6:00 a.m. to 10:00 p.m. At the time of the original approval in 2004, the City approved the hours of operation for the restaurant to be limited to 11:00 a.m. to 10:00 p.m. from Tuesday through Sunday. At that time, however, the cafe portion of the facility was not a part of the project proposal. 2 Parking. The existing parking lot consists of 536 parking spaces, eight of which are handicapped spaces. According to the Ordinance regarding parking calculations, the existing parking is more than sufficient to accommodate the school, restaurant, and cafe. At the time of the original approval in 2004, the City added as a condition that the school reserve adequate parking spaces for the exclusive use of restaurant customers. This has been added as a condition upon approval. Landscaping. The site plan indicates that landscaping is proposed around the outdoor dining patios. The Ordinance does not require specific landscaping elements for outdoor dining, but the proposed landscaping appears to be sufficient in acting as a screen or buffer. Lighting. Exterior illumination will be provided by 30" to 36" metal halide bollards integrated into the black wrought iron fencing surrounding the outdoor patio areas. Four exterior decorate wall sconces are also proposed for the front of the restaurant and cafe areas, along with west elevation. At the time of the original restaurant CUP approval, the City required that a Lighting Plan be submitted for review and approval in order to show that no lighting would spill onto neighboring properties, particularly as a part of the construction of the original parking lot. Staff does not see the new lighting as a concern, but this could be considered as an added condition upon approval. Signage. The applicant is planning to add signage, but no sign plans have been included in the application materials at this time. Trash Storage. The existing trash enclosures in the rear of the building, directly behind the restaurant, will be utilized for the restaurant and cafe. Letter of Intent. According to the applicant, the restaurant and cafe will both be student run. Students will perform the essential functions of the restaurant and cafe with instruction and oversight from the LCB Chef Instructors. The teaching of restaurant services portion of the course is a progressive course in the fundamentals of formal fine dining service. According to the applicant, training will emphasize customer service, work ethic, product knowledge, organization, and supervision of daily operations for an on -campus fine dining restaurant and cafe. The restaurant cooking portion of the course is designed to provide hands-on cooking experience in an actual restaurant setting, staffed by students under the guidance of a chef -instructor. The cafe preparation portion of the course is designed to provide hands-on deli food prep and coffee prep experience Because the restaurant and cafe are being proposed as a teaching component for the culinary trade school, staff would recommend that this CUP, if approved, would terminate in the event that the culinary trade school ceases operation at this site. CUP Review. Section 12-1G-2 of the Zoning Ordinance requires that a conditional use permit be obtained for a restaurant within the Industrial District. According to Section 12- 1L-6, in considering an application for a conditional use permit, the Planning Commission and City Council shall consider the following factors: • Effect of the proposed use upon the health, safety, and welfare of occupants, surrounding lands, or community; Staff Comment: The proposed restaurant and cafe should not affect the health, safety, and welfare of the occupants, surrounding lands, or community. • Existing and anticipated traffic conditions including parking facilities on adjacent streets; Staff Comment; The restaurant and cafe should have no impact on traffic conditions or parking facilities on adjacent streets. • Effect of the proposed use on the comprehensive plan; Staff Comment; The Comprehensive Plan has designated this parcel as Industrial. A restaurant is considered a compatible use within this designation. • It must be determined that the proposed use will not seriously depreciate the surrounding property value; Staff Comment; There is no reason to believe that the proposed restaurant and cafe would seriously depreciate the surrounding property value. • Proposed use is in harmony with the general purpose and intent of this chapter. Staff Comment: The proposed use as a restaurant and cafe is in harmony with the general purpose and intent of the Ordinance. Action Requested: Following a public hearing, the Planning Commission may consider one of the following recommendations: 1. Approval of the Conditional Use Permit as requested based upon a finding that the proposed restaurant and cafe meet all of the Zoning Ordinance requirements and they are consistent with the intent of the Conditional Use Permit criteria, subject to the following conditions: a. The restaurant and cafe CUP would terminate in the event that the culinary trade school ceases operations at this site; b. The hours of operation for the restaurant shall be limited to: Monday through Friday 11:00 a.m. to 10:00 p.m., Saturday 6:00 a.m. to 10:00 p.m., and Sunday 6:00 a.m. to 10:00 p.m. The 11 proposed hours of operation for the cafe shall be limited to Monday through Sunday 6:00 a.m. to 10:00 p.m.; c. The school shall reserve adequate parking spaces for the exclusive use of restaurant and cafe customers; d. The applicant shall apply for and receive a sign permit prior to any new signage being placed on the property; and e. The applicant shall apply for and receive a building permit prior to any construction work. 2. Denial of the Conditional Use Permit based on a finding that the proposed restaurant and cafe do not meet the Zoning Ordinance requirements and are not consistent with the intent of the Conditional Use Permit criteria. Staff Recommendation: Planning staff believes that the proposed restaurant and cafe uses are consistent with the site, surrounding area, and the existing use of the property. The existing building, site, and parking areas appear to be sufficient to accommodate the new uses in the building, subject to the above-mentioned conditions. The existing building is 69,460 square feet in area of which 8,200 square feet are in the proposed work scope. This work scope equates to 12% of the existing building. The restaurant and cafe portion of the facility will provide seating for 108 indoor guests in an area of approximately 2,600 square feet combined, or 40 of the existing building square footage. Additionally, two outdoor patios will provide seating for 28 guests in an area of 440 square feet combined. The restaurant kitchen and indoor seating area comprise a total of 5,500 square feet which is 8% of the existing building. The remainder of the work scope will house classroom space and some storage. The site consist of approximately 8.7 acres and is currently zoned `I - Industrial'. The existing parking lot consists of 536 parking spaces. For the existing schools and the proposed restaurant, approximately 450 parking spaces are calculated to be necessary during peak hours. 75 of these are anticipated to be necessary for restaurant and cafe parking. Exterior materials for the proposed patio at the Restaurant and Cafe are concrete slab on grade with a black wrought iron fence.
