CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA AIRPORT RELATIONS COMMISSION MINUTES November 10, 2004
The regular meeting of the Mendota Heights Airport Relations Commission was held on
Wednesday, November 10, 2004, at 7:10 p.m., in the Large Conference Room at City
Hall, 1101 Victoria Curve, Mendota Heights, Minnesota.
The following Commissioners were present: Scott Beaty, Liz Petschel, Commissioner Povolny, John Roszak, and Ellsworth Stein. Staff present; Jim Danielson, City Administrator; Ultan Duggan, NOC Representative, and Bonita Sullivan, Recorder. Ms. Sullivan took the minutes. Not Present: Commissioners Gregg Fitzer and Vern Edstrom.
Approval of Minutes
A. October 13, 2004 Airport Relations Commission Minutes Commissioner Petschel stated that she had the following corrections: Page 2, Item B - NWA Terminal Proposal, third paragraph, should read: ‘Commissioner Petschel referenced an article she recently read in the Star Tribune regarding airport capacity that indicated that they have far exceeded at this point.
She reviewed with the Commission noting that it is obvious that the airport would
not exceed the total number of operations and that the maps would not be
accurate.’
Page 2, paragraph 10, change from ‘Governor Aplenty’ to ‘Governor Pawlenty’ Page 4, paragraph four, should read ‘Chair Beaty suggested that the ARC Commission invite the Governor and State Legislative Representatives to the December ARC meeting for a discussion on some of the issues and concerns raised by the Northwest Airlines Terminal proposal.
Commissioner Roszak stated that he had the following corrections:
Page three, second paragraph, first line should read:
‘Commissioner Roszak suggested including a general outline of the issues they the ARC would like to discuss.’ Page three, sixth paragraph should read: Commission Meeting November 10, 2004 Mendota Heights Airport Relations Commission ‘Commissioner Roszak suggested that they the ARC not include the Part 150 issues noting that Minneapolis would be addressing the majority of the Part 150
concerns. He stated that the capacity issue and noise factor should be their main
themes for discussion. He noted that the noise factor amounts to a subsidy of the
airport and land planning and reviewed with the Commission.’
Page three, eighth paragraph, second sentence should read: He stated that many of the court airport issues are FAA issues not just MAC issues. and reviewed with the Commission. Chair Beaty stated that he had the following correction: Page four, eight paragraph, should read:

Referenced the sentence ‘noted that Delaware and Highway 110 is the appropriate four mile mark’ and clarified that it should read at ‘Dodd and Highway 110’. He explained that it would be three miles just past 35E. A motion was made by Commissioner Roszak, second by Commissioner Petschel, to
approve the October 13, 2004 minutes as amended. Motion carried 4-0
Public Comments
NONE Unfinished/New Business A. NOC Update – Ultan Duggan
Ultan Duggan, City Council Member and NOC Alternate Representative, stated that he
attended the last two NOC meetings and asked the Commission if they receive copies of
the NOC minutes. Chair Beaty stated that the ARC has received minutes in the past
noting that they have not received the last two sets of minutes. Council Member Duggan stated that he would ensure that copies of the minutes are forwarded to the ARC for their review. Council Member Duggan expressed concerns regarding the lack of representation for the City of Mendota Heights at the NOC meetings. He stated that the Community has indicated that they are not happy with the lack of representation at the NOC meetings and
suggested tightening the requirements for the notification process to the Alternates when
the NOC Representative is not able to attend. He stated that if the appointed NOC
Representative is not able to attend the NOC meeting the NOC Alternate should be
notified at least four to five days in advance of the meeting. Council Member Duggan explained that the NOC is primarily comprised of Community Representatives. He stated that he reviewed his understanding of the NOC Mission Statement, noting that all members of the NOC mutually agreed upon the Mission Commission Meeting November 10, 2004 Mendota Heights Airport Relations Commission Statement and asked the NOC members how they measure their success. He indicated
that the group appeared a bit uncomfortable with the question noting that the NOC
discussed disbanding the Commission altogether. He stated that the NOC discussed
concerns including the issues and inability of the co-chairs to come to agreement on
several items including the meeting schedule. He reviewed with the ARC Commission noting that the NOC has addressed the inability of the co-chairs to come to an agreement on the meeting schedule. Chair Beaty asked how they plan to fix the agenda issues and the problems between the co-chairs. Council Member Duggan stated that the issues between the co-chairs are a significant factor that would be worked on. He stated that approved Comprehensive
Plans have been in place for metro area Cities affected by the airport since the 1960’s.
He stated that if they were to examine and combine the common noise issues from the
Comprehensive Plans for the Cities of Richfield, Bloomington, Mendota Heights, Eagan
and Minneapolis, which have all been approved through 2030, it could provide better leverage in an effort to address the common concerns. He stated that the Met Council has approved many of the plans and proposals and he indicated that the NOC Representatives are interested in the idea of reviewing the Comprehensive Plans. He stated that the NOC discussed what they could do to help make the area more comfortable to live in and the NOC Commission members suggested setting a goal to try and achieve a 5-10% reduction in noise levels.
Council Member Duggan stated that the recommended by-law changes were introduced

and discussed by the NOC Commission. He reviewed the proposed changes and meeting schedule with the Commission. He indicated that the Community is very unhappy about the lack of representation stating that in the future this would change, Mendota Heights would be represented at the NOC meetings.
Commissioner Petschel noted that insulation for the 60/64 was part of the last document
generated between the Airport and the Met Council and is part of the basis for
Minneapolis lawsuit. She stated that the ARC saw an enlarged copy of the Met Council
document that includes language that the Airport’s plan for expansion was approved under the proviso for insulation in the 60/64 areas. Council Member Duggan suggested that the ARC issue a letter of invitation to the Met Council to attend an ARC meeting to discuss the approved plan. Commissioner Roszak stated that it was his understanding that the Met Council has no
jurisdiction over airport. Mr. Duggan clarified that the Met Council does have some
jurisdiction with respect to the transportation issues. Commissioner Roszak expressed
doubts that the Met Council has any jurisdiction over the operations adding that Mendota
Heights’ issues of concern involve 17-35, EIS and crossing in the corridor. He stated that the Part 150 is irrelevant at this point noting that it is important that the ARC lend their support to the Community. Commission Meeting November 10, 2004 Mendota Heights Airport Relations Commission Commissioner Petschel stated that the potential for airport terminal expansion could change the noise impacts noting that the parameters for the sound footprint were managed by the MAC. She stated that there were lower, medium and higher projections for
number of operations but MAC chose the middle projection. She noted that the new
projections show the airport exceeding these projections for number of operations.
Commissioner Roszak asked if there was a reaction to Council Member Duggan’s suggestion for a 5-10% reduction in noise levels. Council Member Duggan stated that the NOC was not very comfortable with the suggestion and reviewed. Chair Beaty thanked Mr. Duggan for the update noting that the ARC appreciates his attendance and suggestions.
Council Member Duggan stated that the next NOC meeting is scheduled for November
18, 2004. He stated that a new set of bylaws would be reviewed and discussed at the next
NOC meeting that could provide a stronger sense of ownership noting that the NOC
would also be setting their agenda for the year. He reviewed the NOC pre-meeting process with the Commission stating that Vern Wilcox would be chairing the next NOC meeting. He stated that he would try to attend the next NOC meeting and assured the ARC that they would receive copies of all NOC meeting minutes going forward. B. Guy Heide Update
Mr. Heide provided the Commission with a brief update on the Rogers Lake East
Neighborhood Groups activities.
C. NWA Terminal Proposal Chair Beaty stated that City Administrator Danielson has drafted a letter of invitation to Governor Pawlenty to attend an ARC meeting. He reviewed the draft letter with the Commission and asked for their input and feedback. Commissioner Petschel suggested stating that the ARC’s main concern is the increase on
capacity and suggested striking the sentence about insulating homes.

Commissioner Roszak suggested clarifying that the ARC’s stance is based on the Noise and Environmental Impact Study and zero tolerance. He suggested striking the last sentence in the first paragraph of the letter. Council Member Duggan suggested providing several meeting dates as a schedule option.
He suggested including a statement that explains that the City of Mendota Heights has
created the Airport Relations Commission to address airport issues as it relates to the City
of Mendota Heights.
Commission Meeting November 10, 2004 Mendota Heights Airport Relations Commission The Commissioners reviewed the draft and provided City Administrator Danielson with the recommended changes for content. City Administrator Danielson stated that he would make the recommended changes and place this on the next City Council agenda for Council’s review.
D. Gregg Fitzer Replacement
Chair Beaty stated that Commissioner Fitzer is not seeking reappointment. He noted that
Commissioner Fitzer, an airline pilot, has been with the Commission from the beginning. He stated that it has been great having Commissioner Fitzer’s perspective, as an airline pilot, on the Commission noting that his perspective has been a real asset. Council Member Duggan suggested Jack Huber and John Campbell as potential ARC candidates noting that Mr. Campbell is a retired airline pilot. He stated that he would contact both of them to determine their potential interest in becoming a member of the
ARC.
Commissioner Roszak stated that he is aware of a neighbor who is interested adding that
Council Member Krebsbach mentioned that the head of the League of Women Voter’s is also interested. Chair Beaty suggested that the open position be publicly advertised. City Administrator Danielson agreed stating that all Commissions would be contacted to identify all openings. He stated that all open seats would be advertised in the newspaper and reviewed the process with the Commission.
Chair Beaty asked when the announcements for the openings would be advertised.
Council Member Duggan explained that the announcements are made in the
November/December timeframe, with interviews in January and ready to take office in February. E. Updates for Introduction Packet Chair Beaty stated that the Commission has been provided updates for the ARC Introduction Book. He stated that the updates included:

Acknowledge Receipt of Various Reports/Correspondence: The Commission briefly reviewed the following documents: Chair Beaty noted that flight operations have increased considerably in comparison to last year.
Commissioner Petschel referenced the September 2004 Technical Advisors Report, page
one, shows a high percentage of air noise complaints coming from Mendota Heights in
the area north of Highway 110. She reviewed with the Commission noting that this is a new phenomenon. a. September 2004 ANOM Technical Advisor’s Report. b. h. Letter from Cindy Greene regarding ARC Meeting, dated November 9, 2004. OTHER COMMENTS OR CONCERNS Council Member Duggan asked if the ARC had received a copy of the Part 150 documents. He suggested that the ARC contact Chad Leqve for copy of the report noting that the report is also available for download from the MAC website.
Chair Beaty suggested including a magnet in the next City mailing that would encourage
Residents to contact the MAC with any noise concerns or issues. Council Member
Duggan stated that he would also talk to the local Cable TV Company in regards to incorporating a small notice for Residents that would include contact information. The Commission agreed, by consensus, to adjourn the meeting at 9:10 p.m. Respectfully submitted, Bonita Sullivan
