CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA AIRPORT RELATIONS COMMISSION MINUTES October 13, 2004 The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday, October 13, 2004, at 7:00 p.m., in the Large Conference Room at City Hall,
1101 Victoria Curve, Mendota Heights, Minnesota.
The following Commissioners were present: Scott Beaty, Vern Edstrom, Liz Petschel,
Mike Povolny, John Roszak, and Ellsworth Stein. Staff present; Jim Danielson, City Administrator; and Bonita Sullivan, Recorder. Ms. Sullivan took the minutes. Not Present: Commissioner Gregg Fitzer. Approval of Minutes A. September 8, 2004 Minutes
Commissioner Petschel had the following correction:
• Page 2, Item B – Northwest Fleet Mix, first sentence, ‘75% of the fleet mix’ should read ‘over half’. Chair Beaty had the following corrections: • Page 2, Item B – Northwest Fleet Mix, second sentence should read ‘in the sky’. • Page 2, Item B – Northwest Fleet Mix, second paragraph, last sentence, should
read ‘He stated that the planes ‘may actually be’ louder in flight overhead than at
takeoff’.
• Page 3, Item C – Potential Grant Application, third paragraph, last sentence,
should read ‘which could be expensive’. A motion was made by Commissioner Roszak, second by Commissioner Edstrom, to approve the September 8, 2004 minutes as amended. Motion carried 6-0 Public Comments

Unfinished/New Business
A. NOC Goals Commission Meeting October 13, 2004 Mendota Heights Airport Relations Commission Chair Beaty referenced the NOC Work Goals White Paper Study stating that City Administrator Danielson has put together an outline of the recommended work goals for the NOC Representative and Alternates. He provided the Commission with a brief overview of the study stating that the next step is for the Commission to approve the
document and the process they want to take to present it to City Council.
Chair Beaty reviewed the issues stating that he is basically fine with the document.
The Commissioners reviewed the document and agreed that the document clearly outlines the goals and issues that should be addressed. Commissioner Edstrom noted two typos: Page 2, Issue Two, first sentence and fourth sentence: ‘plans’ should read ‘planes’.

A motion was made by Commissioner Petschel, second by Commissioner Edstrom, to accept the NOC Goals as amended and forward to the City Council for review and approval. Motion carried 6-0. B. NWA Terminal Proposal
Chair Beaty reviewed the Northwest Airlines Terminal proposal with the Commission.
He stated that Commissioner Roszak has put together an outline of suggestions for the
Commission to consider that would address some of the issues and concerns raised by the Northwest Airlines’ proposal. He provided the Commission with a brief overview of the outline and asked for feedback from the Commission. Commissioner Roszak explained that he sees this as an opportunity for leverage that would include the NOC Representative as an advocate for the same issues supported by the ARC. He referenced airport capacity concerns noting that in 1990 an Airport Noise
Capacity Act was put into place to protect areas from the airport noise levels. He
suggested including this issue as a work goal for the NOC.
Commissioner Petschel referenced an article she recently read in the Star Tribune regarding airport capacity that indicated that they have for exceeded capacity at this point. She reviewed with the Commission noting that it is obvious that the airport will exceed the total number of operations and that the maps would not be accurate. Chair Beaty stated that he has issue with the exclusivity of the terminal for Northwest Airlines. He expressed concerns that this would create a monopoly in addition to
considerable transportation issues if there were a flight cancellation.
Commissioner Petschel suggested inviting Governor Pawlenty or a Representative to one
of the ARC meetings to discuss the proposal. She stated that it could provide the Commission and the Community with a good opportunity to provide their feedback regarding the current terminal situation and proposal by Northwest Airlines. Commission Meeting October 13, 2004 Mendota Heights Airport Relations Commission Commissioner Roszak suggested including a general outline of the issues the ARC would like to discuss. He stated that this would provide them with a good sense, in a general
way, of the issues they are concerned with and would like to discuss. He stated that he
would like to see a limited capacity that takes into consideration the affect of noise on
surrounding communities.
Commissioner Povolny expressed concerns regarding the affect this would have on competitiveness. Chair Beaty agreed stating that this could also affect the consumer. Commissioner Stein noted that MSP is starting to follow the format of several other terminals across the country. He stated that this same layout exists in other airports such as Atlanta, Georgia and reviewed with the Commission.
Commissioner Petschel stated that her two biggest concerns are increased capacity and
noise; and the expense, especially when they have pleaded no funds available for
individuals located in the 60/64 areas. Commissioner Roszak suggested that the ARC not include the Part 150 issues noting that Minneapolis would be addressing the majority of the Part 150 concerns. He stated that the capacity issue and noise factor should be their main themes for discussion. He noted that the noise factor amounts to a subsidy of the airport land planning and reviewed with the Commission.
City Administrator Danielson stated that he would put together a letter of invitation for

the Commissioner’s review. Commissioner Roszak suggested that they include their State Legislative Representatives in the invitation noting that this would be a multi-faceted effort. He stated that many of the airport issues are FAA issues not just MAC issues. He suggested that the ARC
consider amending their NOC goal recommendations to incorporate and include the
NWA Terminal issues and the fleet mix. He suggested that the ARC should begin
discussions with all of the appropriate individuals involved in or affected by this proposal
in order to get their feedback on the list of concerns. He explained that with the feedback the ARC could then formulate a position of recommendation to the Council. He noted that this process would also provide a full list of issues to their State Representatives and Government officials. Chair Beaty clarified that this would only be if the City Council agrees. Commissioner Roszak agreed stating that if this does move forward it should be with specific conditions
noting that the debate would then move forward and occur at a different level.
Commissioner Petschel agreed and suggested that they determine the level of interest
with attending one of the ARC meetings and then put together a solid agenda. Commission Meeting October 13, 2004 Mendota Heights Airport Relations Commission Commissioner Roszak stated that the agenda should be included with the invitation as a brief outline that includes noise level and airport terminal management concerns. Commissioner Edstrom reviewed the terminal capacity concerns between Humphrey Terminal and the MSP terminal noting that the expansion of the terminal would have the
largest impact on traffic.
Chair Beaty asked where concerned citizens could go to provide feedback regarding
issues such as lack of competition and potential price increases. Commissioner Petschel stated that they should start with their Legislative Representatives. Chair Beaty suggested that the ARC Commission invite the Governor and State Legislative Representatives to the December ARC meeting for a discussion on the Northwest Airlines Terminal proposal. City Administrator Danielson stated that he would put together a draft and provide for their review.
C. Rogers Lake East Law Suit
Chair Beaty stated that the US Court of Appeals has made their ruling on the Roger’s Lake East Lawsuit. He provided the Commission with an update on the rulings stating that the Courts decided that the Petitioners did not establish their standing or show any demonstrated injury due to the departure procedures that were approved by the 2003 order. He stated that based on these reasons the petition was dismissed and they also denied all pending motions. He stated that Mr. Heide and Mr. Kosel plan to appeal and have asked to meet with the ARC Commission to discuss their appeal. He suggested
inviting them to the November ARC meeting.
The Commission held a brief, general discussion regarding the Court’s decision and the
appeal. Commissioner Povolny referenced the flight patterns occurring along Delaware and Highway 110 noting that it appears that the planes are definitely flying north of the corridor. He expressed concerns regarding the accuracy of the documentation and suggested that the Commissioners visit the area to observe the number of take-offs that are occurring.
Chair Beaty noted that Delaware and Highway 110 is the approximate four-mile mark.

He stated that the planes can begin to make their turns at 3 miles, which is around 35E. He further clarified that the planes could be north of Highway 110 at Dodd and TH110. He suggested including Commissioner Povolny’s concerns as a discussion item with Ms. Green for next month’s ARC meeting. D. City Administrator Update
City Administrator Danielson provided the Commission with a brief update on the
following: • Operations North of the 90-Degree Corridor Boundary • Cindy Green Contact Invite Ms. Green to the November ARC meeting for an update. Invite Roger’s Lake East Group. • Email from Diane Miller
Mayor Huber agreed to sign the joint letter sent to Senator Mark Dayton
regarding the current proposals underway at the MAC.

g. Airport Noise Report, October 1, 2004 OTHER COMMENTS OR CONCERNS Chair Beaty announced that Commissioner Fitzer would be resigning from the Commission at the end of this year.
Commissioner Petschel clarified her understanding of the recruiting process for
Commissioners and suggested that they consider looking for a replacement soon. She
stated that Commissioner Fitzer’s contributions would definitely be missed.
City Administrator Danielson stated that he would provide the Commission with further clarification of the replacement/selection process for their review. The Commission agreed, by consensus, to adjourn the meeting at 8:30 p.m. Respectfully submitted,
