CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA AIRPORT RELATIONS COMMISSION MINUTES May 12, 2004 The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday, May 12, 2004, at 7:00 p.m., in the Large Conference Room at City Hall,
1101 Victoria Curve, Mendota Heights, Minnesota.
The following Commissioners were present: Scott Beaty, Gregg Fitzer, Vern Edstrom,
Liz Petschel, Mike Povolny, and Ellsworth Stein. Staff present; Jim Danielson, City Administrator; Sandra Krebsbach, Council Member and NOC Representative; and Bonita Sullivan, Recorder. Ms. Sullivan took the minutes. Not Present: Commissioner John Roszak. Approval of Minutes
A. April 14, 2004 Minutes
A motion was made by Commissioner Edstrom second by Commissioner Povolny to approve the April 14, 2004 minutes as presented. Motion carried 6-0 Public Comments Mike Kosel stated that he would like to provide the Commission with a brief update on where he and Guy Heide are at in their appeal process. He stated that he, Mr. Heide
recently had an informal lunch meeting with two Representatives from the NOC. He
explained that the purpose of the meeting was to meet and get a better feel on who they
are and where they are going. He reviewed their meeting discussion with the
Commission noting that they were also informed that the City of Mendota Heights could have a second alternate representative on the NOC. He stated that it appears that some of the NOC Representatives also have some of the same concerns regarding good representation for Mendota Heights. He stated that in view of that fact he would like to suggest that a member of the ARC consider representing the City of Mendota Heights as the second alternate. He stated that he also learned that not only the NOC Representative, but both alternates are allowed to attend all meetings, which includes the preliminary
meeting where the agenda is determined and the public meeting where issues are
discussed. He provided the Commission with a brief overview of the NOC meeting
process.
Mr. Kosel indicated that both he and Mr. Heide would like to see an ARC Commissioner represent the City of Mendota Heights as the second alternate. He stated that a representative from the ARC would provide good representation for the neighborhood Commission Meeting May 12, 2004 Mendota Heights Airport Relations Commission issues and concerns. He indicated that it was very difficult for neighborhood groups to get their concerns heard adding that it is their hope that their presence on the NOC would
provide the Rogers Lake East Neighborhood group with an avenue of support that would
bring their issues to the NOC. He stated that the meeting with the NOC Representatives
went very well noting that they had a lot of good discussion and information.
Chair Beaty clarified that Mr. Kosel was stating that Mendota Heights could have a second alternate, in addition to the alternate already on the NOC. He also clarified that all representatives would be able to attend all of the meetings. He asked Council Member Krebsbach if she was aware of this. Council Member Krebsbach indicated that she was not aware that both representatives

could attend all meetings. She acknowledged that Council Member Vitelli has had very good attendance at the NOC Public Meetings. She noted that the meeting schedule is a bit difficult to manage due to other obligations. She expressed her agreement that a second alternate could be very beneficial. She stated that she would not have an issue with it noting that she would prefer not to state anything further reserving her decision at
the Council level.
Chair Beaty stated that there has been some discussion with regards to where the alternate
should come from noting that it appears to be only from the City Council. He stated that it is his feeling that representatives should not be limited to only City Council members. He stated that there are a number of individuals with a variety of backgrounds that could be interested in participating on a Commission like the NOC. Council Member Krebsbach acknowledged that currently representation has been limited to City Council members. She stated that she is in support of this decision due to the
accountability, their knowledge of City issues, influence and ability to readily inform and
update the Council as needed. She acknowledged Mr. Kosel’s conversation with some of
the NOC Representatives stating that she has also been contacted by members of NOC
with the same concerns expressed by Mr. Kosel. She noted that she had asked the Highland Villager to attend the last NOC meeting stating that they did a full report of the meeting in their last issue. She stated that they provided a good, balanced coverage of the meeting adding that the article was very informative. Chair Beaty asked for further clarification of the concerns expressed by the NOC Representatives. Council Member Krebsbach explained that NOC Representatives
contacted her for clarification regarding her role as an alternate for Mendota Heights. She
noted that it was due to a key issue currently under consideration that is coming up for
vote at the next meeting. She reviewed her discussion with the Commission noting that
she was also contacted by a representative of the Highland Villager and asked to comment on their previous article on the NOC meeting. She stated that she encouraged them to also contact Mr. Leqve for his perspective on the issues. She indicated that she has mentioned to City Administrator Danielson that a second alternate would definitely give her the confidence that there would be a backup for the NOC meetings in the event Commission Meeting May 12, 2004 Mendota Heights Airport Relations Commission that she could not participate. She wanted it stated for the record that she has no issue
adding a second NOC Alternate adding that she would like to reserve further discussion
regarding this issue for City Council.
Commissioner Petschel expressed concerns stating that currently there is no one representing Mendota Heights who does not have a steep learning curve when it comes to airport issues. She stated that a second alternative from the ARC could be very helpful to the NOC Representative as resource in helping them to understand the general issues and concerns of the citizens of Mendota Heights when it comes to airport noise issues. Commissioner Edstrom suggested that the Commission discuss possible candidates from
the group and submit a recommendation to the City Council.
Council Member Krebsbach clarified the selection process stating that only City Council
members are involved in the decision process when selecting a new Commissioner. Chair Beaty clarified the ARC Commission’s intent would be to request and recommend to City Council forming a subcommittee that would consist of two City Council members, two ARC Commissioners, the Mayor and the City Administrator. He explained that the subcommittee would meet to discuss potential candidates for the Second NOC Alternate and based on that discussion make a recommendation for a
candidate to City Council for final consideration and approval. He further explained that
the ARC Commission fully understands that the City Council would have final approval

noting that the Commissioners want input in the NOC Representative selection process. Council Member Krebsbach stated that she would like to reserve her decision for the NOC Representative selection process for City Council. She suggested that any further discussion at this time should be tabled until her portion of the meeting has been
completed.
The Commission agreed to table discussion until later on the agenda.
Mr. Kosel provided the Commission with a brief update and status on the Rogers Lake East Neighborhood appeal process that he and Mr. Heide have been involved with. He reviewed the issues with the MAC and reviewed the administrative process they have taken to date with the Commission. Unfinished/New Business
A. NOC Position Description - Tabled
Chair Beaty reviewed the issues and concerns around the NOC Position Description noting that he had several discussions with the Council and Mayor. He reviewed his discussions with the Commission and suggested that the ARC table the discussion for now and take it up at a later date. Commission Meeting May 12, 2004 Mendota Heights Airport Relations Commission B. NOC Issue Identification - Tabled
Chair Beaty noted that Council Member Vitelli is not present. He stated that this agenda
item should include his input. He suggested that the ARC table the discussion and
include as an agenda item for the June meeting. He stated that this would allow the opportunity for both Council Member’s Vitelli and Krebsbach to attend. He stated that the Commission would prefer that they be a part of the discussion and decision process. Council Member Krebsbach referenced the ARC Plan of Action and clarified that the discussion involves identifying key issues from the Plan of Action. She reviewed the City Council process with the Commissioners.
Commissioner Petschel explained that every year the ARC submits an Airport Relations
Commission Plan of Action for Council to review. She stated that the Plan of Action
clearly outlines the ARC’s prioritized issues of concern noting that it would be a very helpful tool for the NOC Representatives in determining the key issues that should be presented to the NOC. She suggested reviewing and utilizing the ARC Plan of Action noting that it is her feeling that the NOC Representative should be familiar with the ARC Plan of Action and should be responsible for identifying the key issues, within that plan, that should be brought to the NOC. She stated that the ARC Plan of Action is their recommendation. She stated that with respect to the agenda item regarding the NOC
Issue Identification process, Council Member Vitelli requested this discussion. She
stated that the ARC has identified their issues and documented them within the Plan of
Action. She stated that she would like to recommend that the NOC Representative be
responsible for identifying the issues, from the ARC Plan of Action, that they can advocate and support. Chair Beaty agreed with Commissioner Petschel. He stated that the Plan of Action should be a joint venture where the NOC Representative and the ARC work together on a plan of action that the NOC Representative would then help to monitor and take key issues to the NOC as needed. He stated that this is the process that should be used with
future NOC Representatives. Commissioner Petschel agreed stating that the NOC/ARC
relationship should be a collaborative effort.

Chair Beaty explained that the Commission is suggesting that the NOC Representatives review the ARC Plan of Action, identify the items they believe to be key/top issues that they want to advocate and support, bring these issues to the next meeting for further discussion. He asked City Administrator Danielson to provide Council Member
Krebsbach with a copy of the ARC Plan of Action.
Chair Beaty stated that the Commission has identified at least three key issues that should
be brought to the NOC for further consideration. He reviewed the issues noting 1. Flying tracks not headings; 2. No planes north of 110; 3. Crossing in the Center. Commission Meeting May 12, 2004 Mendota Heights Airport Relations Commission C. MAC P&E Part 150 Chair Beaty stated that this was to be an update from Council Member Vitelli. He stated
that this discussion would be tabled and included on the agenda for next month.
Commissioner Petschel asked if the Commission should make a recommendation to City
Council that the Council forward a letter to Tom Foley expressing their support for Mendota Heights on the compromise agreement. She stated that the meeting is scheduled for either June 15th or June 22nd noting that it would be proactive to make that recommendation now versus waiting until just before the meeting. She explained that they would be voting on the P&E Part 150 Sound Compromise and suggested recommending that City Council contact their MAC Representative, Tom Foley, to ask for his support of Mendota Heights in the voting process. She reviewed her concerns
with the Commission noting that the Part 150 was mandated by the Legislature adding
that at some point this issue could end up back in Legislature for resolution.
Chair Beaty reviewed the areas that could be affected by the decision noting that if the MAC is not willing to compromise then their position could be to go back to the original agreement. City Administrator Danielson explained that the resolution does acknowledge the original agreement noting that this is their preference. He stated that it also supports the compromise.
A motion was made by Commissioner Petschel, seconded by Commissioner Povolny, that
the Airport Relations Commission recommend to City Council that a letter be sent to the
Mendota Heights MAC Representative, Tom Foley, advocating for his support of the sound insulation compromise as brought forward by the P&E Committee of the MAC. Motion carried unanimously. D. NOC Alternate Chair Beaty asked if the Commission was in agreement on the having a Second NOC
Alternate. The Commissioners agreed that a Second NOC Alternate would be a good
idea and held a general discussion regarding the selection process and representation for
the City of Mendota Heights.
Commissioner Petschel suggested that the ARC make a recommendation to City Council that they add a Second NOC Alternate to represent the City of Mendota Heights. Chair Beaty agreed noting that the selection process should also apply to the Alternate Representatives. The Commissioners agreed jointly that they should continue to follow the process they

Chair Beaty referenced Mr. Kosel’s comments regarding the fact that both Alternates would be able to attend the NOC meetings. He reviewed the NOC meeting process with the Commission stating that there are two meetings held each month. He explained that the first meeting involved only the NOC members and is held to decide on the agenda items for the NOC public meeting. He stated that the second is the NOC Public meeting
noting that the public can attend but does not have an opportunity to speak without prior
approval by the NOC membership.
A motion was made by Commissioner Fitzer, seconded by Commissioner Petschel to recommend to City Council that a Second NOC Alternate be selected through a selection process and consider utilizing the ARC recommended selection process. Motion carried unanimously. E. Introduction Packet
Chair Beaty noted that the Introduction Packet is looking really good and suggested
reviewing the order of the documents for final approval.
Commissioner Petschel agreed stating that all documents approved for the packet would be placed into a 3-ring binder, in the order outlined by the Commission. She stated that the documents would also be made available on the City website and reviewed with the Commission. Commissioner Edstrom suggested that the document also include a cover letter and index. Commissioner Petschel agreed stating that City Staff has agreed to develop the index
based on what is outlined by the ARC.
The Commission reviewed the packet and determined the order for indexing.
F. NOC Update – Sandra Krebsbach Council Member Krebsbach stated that the recommended NOC Position description had been reviewed by City Council and reviewed the discussion with the Commission. She referenced the NOC Issue Identification and the ARC Action Plan noting that the
ARC Action Plan is very different from what is reported at a City level. She clarified that
to her document appears as an endorsement without any action from City Council and
that the ARC is asking the NOC what items they want to advocate and support. She
agreed that there should be a meeting that would focus on how the NOC Representatives and Alternates would carry forward issues identified by the ARC. She stated that she would encourage an alignment between the City Council and the ARC Commission with respect to their goals and priorities that are in alignment with what would be best for the City of Mendota Heights. Commission Meeting May 12, 2004 Mendota Heights Airport Relations Commission Chair Beaty asked if the NOC has held any meetings since last ARC meeting. Council
Member Krebsbach reviewed the NOC meeting schedule noting that the May 20th
meeting has been cancelled.
Commissioner Petschel noted that the June NOC meeting would be an important meeting to attend as they would be considering and voting on the P&E recommendation. She reviewed the issues under consideration and urged the Commissioners to attend. G. City Administrator Update City Administrator Danielson provided following update:
• Pilot Knob Road EIS – He stated that oral arguments were present to the Judge on
April 22nd. He stated that they feel good about the presentation noting that several

presented throughout the proceedings. He noted one issue raised during the opposition presentation addressed the EIS deadline. He reviewed the EIS process with the Commission noting that the City provided a Letter of Analysis and the 280-day deadline with EIS has been stayed. He stated that he would provide further updates as they become available.
• Golf Course – He stated that the City Attorney has submitted the required briefs
and reviewed the process with the Commission. He stated that this is currently
going through the appeal process, which has a 60-day window for response to the
brief. He stated that he would provide further updates as they become available. Acknowledge Receipt of Various Reports/Correspondence: Commissioner Stein noted that the numbers are stacking up pretty high again. He stated that the airlines guaranteed 40,000 flights for the year and it appears that they will be going over that number. He noted that the MSP Airport is rated Number 8 in airport
growth.
Chair Beaty referenced the Airport Noise Report dated April 9th stating that an article
regarding the mitigation beyond the 65DNL references a white paper that was submitted to the Planning and Environment Committee of the MAC regarding construction materials used on the homes around the MSP airport and asked if anyone else was familiar with or had seen this White Paper. He noted that it appears to be related to the NOC issues they discussed earlier. Commissioner Stein referenced the Airport Noise Report dated April 9th, page 48
references a new guide on Airport Noise Use Restrictions. He stated that the guide is free
and suggested that the ARC request a copy for their review.

OTHER COMMENTS OR CONCERNS The Commission held a general discussion about what appears to be flight pattern changes flying north of Highway 110 near Henry Sibley. The Commission discussed the 110 corridor noting that the flights have increased tremendously and expressed concerns. Commissioner Petschel asked the Commission for suggestions on how to address these
concerns. Commissioner Fitzer suggested issuing a letter to Ms. Green outlining the
complaints the ARC has received regarding possible changes in operations and flight
patterns and ask for clarification.
Chair Beaty clarified that the letter to Ms. Green should include the following concerns: 1-concern because so many planes are using the 090 heading; 2-concern regarding the fact that the crossing in corridor procedure is not being utilized as much as possible; 3-concern as to what amount of progress has been made in identifying and utilizing aircraft with track capability versus using headings.
City Administrator Danielson stated that he would draft a letter outlining the ARC
concerns and request for update and forward for their review.
