2005-11-09 Airport Relations Commission Mintues2005-11-09 Airport Relations Commission Mintues.txt[1/25/2018 4:19:06 PM] CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA AIRPORT RELATIONS COMMISSION MINUTES November 9, 2005 The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday, November 9, 2005, at 7:00 p.m., in the Large Conference Room at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. The following Commissioners were present: Vern Edstrom, Brian Linnihan, Liz Petschel, and Mike Povolny. Staff present; Jim Danielson, City Administrator; and Bonita Sullivan, Recorder. Ms. Sullivan took the minutes. Not Present: Chair Scott Beaty and Commissioners John Roszak and Ellsworth Stein. Approval of Minutes A. October 12, 2005 Airport Relations Commission Minutes Commissioner Petschel had the following correction: • Page 7, NOC Update, 3rd Bullet - Cindy Green, 5th Bullet reads: ‘the new procedures would be implements September 10, 2005.’ It should read: ‘the new procedures would be implemented September 10, 2005. Acting Chair Edstrom had the following clarification: • Page 7, NOC Update, 3rd Bullet -Cindy Green, 5th Bullet, second sentence, should be clarified as follows: ‘The new procedures now require that the plane has to go to the end of the runway prior to making their turn north.’ A motion was made by Commissioner Petschel, second by Acting Chair Edstrom, to approve the October 12, 2005 minutes as amended. Motion carried 4-0 Public Comments NONE Unfinished/New Business A. Chauncy Case Presentation City Administrator Danielson referenced the Augusta Shore Phase 1 development noting that the Developer recently approached Staff regarding a proposal for an Augusta Shores II Development. He stated that noise zones are shrinking noting that currently noise zone 4 does allow for single-family homes. He stated that the first phase is located between Commission Meeting November 9, 2005 Mendota Heights Airport Relations Commission noise zones three and four adding that the Developer had to approach the Metropolitan Council for approval with the proper noise mitigation. He stated that multi-family homes are currently allowed with one entrance noting that in this case each townhome would have their own private entrance. He stated that it was recommended that the developer work with David Braslow, a noise expert from the Metropolitan Council, to help design townhomes with a higher noise mitigation level. He stated that the Developer would also have to file a notification, through Dakota County, for prospective homeowners, identifying the noise level concerns. He indicated that the information would be listed on the title and reviewed with the Commission. Commissioner Petschel stated that they have received two inquiries from the townhome association asking when Runway 17/35 would be up and fully operational. She explained that the inquiry came about a year ago and that they were only asking in the hopes that it 2005-11-09 Airport Relations Commission Mintues.txt[1/25/2018 4:19:06 PM] would bring them some relief from the noise. She stated that no one from the Association has attended any of the meetings and no other phone calls have been received. She stated that she did have a conversation with the President of the Association noting that she did not indicate that there were any open issues or concerns. City Administrator Danielson reviewed the map and location of the proposed development with the Commission. He indicated that a comprehensive plan amendment would be needed adding that he, Peter Coyle and the developer, Pat Hoffman, visited with Chauncy Case, Senior Planner with the Metropolitan Council, to discuss the shrinking noise zones and the impacts it could potentially have on Mendota Heights. He stated that the City Council has also requested a copy of the Comprehensive Plan from the Metropolitan Council noting that the Mendota Heights zone ordinance allows single-family homes in noise zone 4 yet the Metropolitan Council’s Comprehensive Plan no longer does. He stated that Chauncy Case is present this evening to discuss the new Part 150 Land Use Compatibility Guidelines with the Commission. Chauncy Case, Senior Planner with the Metropolitan Council, stated that the new Transportation Policy Plan, which was adopted by the Metropolitan Council in December 2004, incorporates the standalone Navigation Guide into the Transportation Policy Plan in an effort to place all modes and guidelines under one plan. He stated that this was accomplished during the last Legislature session. Mr. Case explained that they focused on a couple of specific areas that really needed to be changed including the Land Usability Guidelines. He stated that the changes were incorporated and the amendment was passed in 1999 changing all airports to the DNL60 guidelines. He explained that the change was implemented because they are beginning to see more urban development and the ambient noise levels are high enough now that they felt the DNL guideline could be upped. He indicated that the City of Eagan is currently the only City that is considering using this formally within their guidelines. Acting Chair Edstrom asked how they determine a 5db delta. Commission Meeting November 9, 2005 Mendota Heights Airport Relations Commission Mr. Case explained that it basically captures what the 55 would be plus it gives some flexibility if they want to use a TIF district. He stated that it would depend on each City noting that noise levels are bigger issues to some Cities more so than others. Mr. Case reviewed the updates to the Part 150 program noting that a former adviser from the MASAC/MAC had requested a change in the guidelines to the 2005 Noise Contours. He stated that this used to be managed at a Federal and a State level control noting that they have been slowly moving away from using both guidelines to using the 2007 DNL mitigated contour. He stated that additionally a change was implemented that enabled the Council to have some form of corrective program where they could get funding for structures outside the DNL60 guidelines. Mr. Case reviewed the Metropolitan Council’s response to the City of Bloomington’s request for a separate EIS Study noting that a copy of the response was included in the Metropolitan Council’s October meeting packet. He stated that the FAA has outlined specific requirements that would have to be followed in order to obtain additional funding for anything outside the Part 150 guidelines. Mr. Case stated that the changes include land-use categories; a new contour; and DNL60, which are all metro-wide\area-wide policies. He stated that the FAA has asked them to examine and document the land use noting that this would be the last piece of information that would have to be updated in this process. Commissioner Petschel asked what the DNL would be for the proposed Augustus Shores development. City Administrator Danielson stated that phase 2 would be somewhere 2005-11-09 Airport Relations Commission Mintues.txt[1/25/2018 4:19:06 PM] between DNL 62.6 to DNL 63. Commissioner Petschel asked if it would be considered incompatible according to the new guidelines if the proposed development were located between the 60 and 64 DNL. Mr. Case confirmed that based on the new guidelines the location would be considered incompatible. He provided the Commission with an overview of the codes used on the map. City Administrator Danielson stated that previously they were between noise zone 3 and 4 and described as multi-plex buildings. Commissioner Petschel stated that the new guidelines indicate that both single-family and multiplex would now be considered incompatible. Commissioner Petschel stated that she has a couple of concerns, first being that this information was based on a different fleet mix that is no longer going to be used; and secondly, the City is not going to know until January whether they are going to receive the abatement. She agreed that the 0-2 contour looks good on paper adding that they won’t really know anything until January. She noted that this issue would be discussed at the next NOC meeting. She stated that she was very discouraged when she heard about the fleet mix in addition to the contour and abatement issues. She stated that she plans to Commission Meeting November 9, 2005 Mendota Heights Airport Relations Commission attend the Eagan meeting on Thursday, November 10,2005 adding that she would update the Commission at the next meeting. Mr. Case stated that he too has concerns about the contour adding that he is a bit hesitant to change contours too quickly or too often. He stated that the suggestion was made that they take their time with making any changes to or shrinking of the contours, as it could go through another growth period in the future. He stated that generally speaking, the situation was very similar with the Augusta Shores Phase 1 project noting that there were a number of conditions put in place for the project in order for the project to be approved. He stated that Phase 2 would probably require further documentation and reviews with the Council. City Administrator Danielson clarified that this is the 2007 plan and that the NOC would review the document before adopting the plan. Mr. Case stated from Metropolitan Council’ perspective the plan has already been adopted and is in effect. He stated that they have incorporated some of the Part 150 type issues and blended a Part 150 approach in looking at land use measures adding that from a preventative perspective, the contour, as far as they know and can ascertain, is the best contour available. He indicated that the FAA has not approved it yet adding that the last time this was discussed they were aware that they were shifting from a fairly old contour to a new one with some fleet mix changes. He noted that this project is similar but not as clear yet. Mr. Case stated that the plan is to finish the technical cleanup and then distribute. He indicated that the updated Planning Handbook is now available on the website for viewing and can be used as a tool for local planning guidelines. He stated that the Builders Guide is also included on the website as a planning assistance tool. Mr. Case stated that they would be working to fill in the buffer zone column and also include some explanatory text to further clarify the guidelines. He indicated that this would be done prior to distributing the document adding that their intent is to distribute the document and ask for feedback as to whether the guide would be used or not. He stated that the Council also discussed various stages of the process noting that the next question to address is where they think they want to go with respect to the airport. Mr. Case stated that one of the firms in the business has a proprietary software that translates the ARTS 3 flight track data directly into the I&M model adding that it is their belief that they have reached the level of sophistication with this model that they could utilize the software noting that it would be a good tool for the planning process. He stated that long-term it would be a good tool to utilize for further metrics work. He stated that from a regional perspective he would like to know where they are balancing out with respect to the noise levels when banking, especially at various times of the day. He stated Commission Meeting November 9, 2005 Mendota Heights Airport Relations Commission that it would also be interesting to see how much of the sideline noise has gone down with the contour changes that were made post-bankruptcy. Mr. Case stated that when the Metropolitan Council reviewed Airport South there was an agreement that there would be no residential units inside the DNL70. He stated that there is some form of project going on in this area and it is his plan to investigate. Commissioner Petschel stated that there is a new condo development that is being built within the DNL70 adding that this is the reason why they are utilizing a new form of construction materials and windows to address the noise mitigation. City Administrator Danielson referenced the Pilot Knob land noting that this area is currently guided for residential. He stated that a Comprehensive Plan amendment, similar to what was required for Augusta Shores Phase 1, would be necessary. He clarified that the developer has only approached the City about the potential for this project and has not made any applications at this time. Council Member Krebsbach asked for clarification on the buffer zone. Mr. Case explained that if a community has a value system that requires quiet and wants to extend their ability to control land use they could adopt the ordinance. He stated that this is what the City of Eagan is doing and explained that they would continue to develop but the area would be treated as if it is located in noise zone 4. He further explained that it would give them the ability to let builders know that any development in this area would require the extra step and that guidelines would apply if they choose to develop in noise zone 4. Acting Chair Edstrom and the Commissioners thanked Mr. Case for attending and providing them with an update. B. 2006 POA Preparation Acting Chair Edstrom stated that the only change he would suggest is in the Part 150 Study, Page 7, Issue 4, Item 2 – add ‘monitor the City of Minneapolis and City of Bloomington lawsuits. He commended City Administrator Danielson stating that he did a great job pulling the document together. Commissioner Petschel had the following suggestions: • Page 2, List of Items, include: Monitoring Center of Excellence and approach. She explained that her reason for this suggestion is that in the course of a study they could find collateral items that could be a residual affect. • Page 2, Adherence to the Environmental Impact Statement, noted that it shows completed and is deleted, she suggested that the ARC continue to monitor, as it is relevant to Runway 17/35. Commission Meeting November 9, 2005 Mendota Heights Airport Relations Commission • Page 5, Issue 12, Defining capacity at the airport; include: ‘ARC and Staff should have a dialogue with the NOC, the FAA and the MAC. 2005-11-09 Airport Relations Commission Mintues.txt[1/25/2018 4:19:06 PM] • She asked if the Commission would want to consider eliminating Issue 7. She stated that they are now using distant departure at both ends of the runway and asked if there is anything to monitor at this point. She stated that the Technical Advisor’s Reports do not monitor distant departures adding that it is a mute point and suggested eliminating it from the ARC’s Plan of Action. The Commission agreed by consensus to delete Item 7 from the ARC Plan of Action. City Administrator Danielson stated that Chair Beaty would present the ARC Plan of Action to the City Council on January 17, 2006. A motion was made by Commissioner Petschel, second by Acting Chair Edstrom, to adopt a Resolution to recommend approval of the Mendota Heights Airport Relations Commission Plan Of Action as amended and recommend presentation to the City Council on January 17, 2006. Motion carried 4-0. C. City Administrator Update City Administrator Danielson provided the Commission with a brief update on the following: • PAR 3, still have not heard anything, no updates at this time. • Town Center Update – had grand opening for Wine Market last Thursday. Was well attended and business is doing well. Following businesses plan to open in the next two weeks: Caribou Coffee Coldstone Creamery Vera’s Hair Salon Fantastic Sam’s No restaurant at this time, still working on it; Market/Deli broke ground on other building, footings are in; • Provided Commission with copy of Bloomington lawsuit for their review. Acknowledge Receipt of Various Reports/Correspondence: The Commission briefly reviewed the following documents: Commissioner Petschel noted that the $3 million allocated for the residential sound insulation pilot probably won’t be spent and the Humphrey Terminal expansion most likely will not happen. She stated that she is not sure how accurate the information is in the report for this month noting that it was her impression that the project had been moved back a year, yet it still shows that it is scheduled for 2006. OTHER COMMENTS OR CONCERNS Commissioner Petschel reminded everyone about the NOC and Community meetings. She stated that she plans to attend the Eagan Community meeting on Thursday, November 10, 2005. She stated that the NOC meeting is scheduled for November 16, 2005 and asked if any of the alternates plan to attend. Council Member Krebsbach stated that she would attend as the second alternate. The Commissioners reviewed the term limits for each Commissioner. Chair Beaty’s term ends in January 2005 Commissioner Povolny and Commissioner Petschel are up for reappointment.
