The regular meeting of the Mendota Heights Airport Relations Commission was held on
Wednesday, March 9, 2005, at 7:00 p.m., in the Large Conference Room at City Hall,
1101 Victoria Curve, Mendota Heights, Minnesota.
The following Commissioners were present: Scott Beaty, Brian Linnihan, Liz Petschel, Mike Povolny, John Roszak and Ellsworth Stein. Staff present; Jim Danielson, City Administrator; Ultan Duggan, NOC Representative\City Council Member, Sandra Krebsbach, NOC Representative\City Council Member and Bonita Sullivan, Recorder. Ms. Sullivan took the minutes.
Not Present: Commissioner Vern Edstrom.
Approval of Minutes
A. February 9, 2005 Minutes Commissioner Petschel stated that she had corrections: • Page four, first paragraph, second sentence reads: How have footprints changed;
Should read:
How noise footprints might change;
• Page four, first paragraph, sentence three and four reads: Where will the jet fuel and de-icing runoff go?; add more pervious with additional gates?; Should read: Where would the jet fuel and deicing run off, particularly with a more pervious surface; A motion was made by Commissioner Roszak, second by Commissioner Petschel to approve the February 9, 2005 minutes as presented/amended. Chair Beaty welcomed Brian Linnihan as the newest member to the ARC Commission.
B. MSP Corridor Definition
Chair Beaty explained that during a discussion at the January 2005 ARC meeting with Chad Leqve & Cindy Green the Commission realized that it is really 90-degrees at wheels up, which means that the newer planes are getting off runway and making the 90-degree turn earlier. He stated that in an effort to try and determine where the 090 start is defined he asked City Administrator Danielson to research and provide past documentation that would help define the actual start point. He provided the Commission with a brief

overview of the documentation included in the packet and asked for feedback. Commissioner Roszak asked if the appendices referenced in the document are available noting that it would be good to review the documents to see if they include pertinent information.
Commissioner Povolny asked if there is a way that the MAC could be pressed to further
clarify the definition. Chair Beaty explained that it is their hope to be able to pull
together information put out by the MAC that clearly states the definition. City Administrator Danielson stated that the current Part 150 document shows the end of the runway and all references indicate that the 090 is north of 110 and yet the maps show that the 90-degree is angled right on 110. Council Member Duggan referenced the Eagan-Mendota Heights Corridor Perspective,
page four, Item 4.4, Departure Corridor Compliance indicates that the FAA was
interested in exploring the corridor operational compliance and reviewed the process
used. He asked if it is possible that the 090 might be an assumption. Commissioner
Roszak stated that there is a reference that it is an accommodation for the south boundary. Chair Beaty asked if Council Member Duggan had brought the end of runway\wheels up concerns to the NOC. Council Member Duggan stated that he presented the question formulated by Commissioner Roszak to the NOC. He stated that the NOC did not have time to address his question.
Commissioner Petschel stated that Chad Leqve has indicated that the northbound
boundary would be part of the discussion at the March 17th meeting. Council Member
Krebsbach stated that she plans to attend the March 17th meeting along with
Commissioner Petschel. Commissioner Petschel stated that she would like to ask if the operations on the north end runways are also wheels up. She stated that she would like treatment to be consistent with all neighborhoods. Commission Meeting March 9, 2005 Mendota Heights Airport Relations Commission - 3 -
Commissioner Povolny asked if they stretched it five-degrees to the south in Eagan.
Chair Beaty stated no and explained that they have to follow the center line of the runway
for three miles before they can make any turns – north or south.
Council Member Duggan asked if Mendota Heights has received a memo from the FAA stating that they are going to relax the noise contour enough to where previously ineligible homes in Mendota Heights would now receive insulation. He stated that it is his understanding that letter explains that there was an error in determining the contour and that more funds would be made available for the insulation. City Administrator Danielson stated that he was not aware of the memo adding that he would research and
provide the Commission with an update.
Commissioner Roszak noted that page three of the 1998 handbook shows that the
corridor refinement recommendation was originally submitted to the FAA in two separate proposals. He asked if the City has copies of the dual track planning information. He suggested that they contact the FAA and request a copy of the corridor refinement recommendation and the FAA approval. Commissioner Povolny asked why the City has never sent a letter clarifying the reports and requesting that the airport comply with the agreements. Council Member Krebsbach
indicated that at one point funds were being maintained for potential legal action and
reviewed.

Council Member Krebsbach stated that there are financial impacts on the property values in southwest Minneapolis and suggested that the City review home values to determine if they are rising or have been depressed due to the airport noise levels.
Council Member Duggan stated that there is documentation available that may show that
the properties in the southwest areas of Minneapolis have decreased in value to a certain
degree. He noted that this could be expected in Mendota Heights too given the current
situation. Commissioner Povolny stated that he has recently observed several private turbo prop planes taking off near the tower and asked what these planes are doing. He stated that they should find out what the actual capacity is for the airport. Council Member Duggan agreed that the question ‘what is the capacity at the airport’ is a legitimate question to ask.
Council Member Krebsbach suggested placing their energies at a political level in trying
to communicate the issues and concerns.
Council Member Duggan suggested developing a plan of action that would address the ARC’s current questions regarding the 90-degree definition. He urged the ARC to keep at the same point until an answer is provided. He agreed that the ARC should review the appendices and suggested discussing their concerns with past participants in order to gain a historical perspective and information. Council Member Krebsbach suggested inviting Jill Smith to an ARC meeting to review
their position and point of view. She suggested getting information out to the community
and working with the local press, such as the Highland Villager, that would include a letter that asks what other Cities are doing to address the noise levels within the entire service area. Council Member Duggan suggested that Council Member Krebsbach and Commissioner Petschel work together to develop the letter. Chair Beaty suggested asking MAC for their definition and copies of the FAA materials.
Commissioner Roszak suggested clarifying the Land Use Plan and the impact noise levels
would have on the planning process as part of the tack they could use. He asked what the
St. Paul zone is and suggested getting a definition of the area.
Council Member Krebsbach commended Council Member Duggan and Commissioner Petschel for the good job they did with the Mendota Heights Town Hall meeting. She stated that she attended the Bloomington Town Hall meeting noting that there was good legislative turnout but very few residents were in attendance. Council Member Duggan stated that the Minneapolis Town Hall meeting was very well
attended and went very well. He noted that Mayor Ryback was also in attendance and
that postcards were sent to all of the residents.
Council Member Krebsbach stated that the City of Minneapolis is willing to take the lead adding that they want to work together with Mendota Heights on these issues. Commissioner Petschel confirmed and reviewed her discussion with Laura Suther. She stated that the 20/20 issues are the biggest concerns for Minneapolis and reviewed. Commissioner Roszak clarified that one of the goals for the City of Mendota Heights is to
further explore issues around capacity at the airport and not Part 150.

Chair Beaty stated that the City look for the appendices, the corridor refinement recommendation submitted to the FAA in 1996, and the Part 150 map and forward copies with a letter, to the FAA, asking if there was ever an approval of the final submission for the corridor refinement recommendation.
C. Airport Noise Plan of Action
Chair Beaty stated that the ARC has been very active and involved with many of the
issues identified in the ARC Noise Plan of Action. He suggested that the Commission continue to monitor the adherence to all agreements. He asked when the planes would be upgrading to the Stage 4 hush kits. Commissioner Stein stated that they have indicated that they are beginning to utilize the newer technology and plane to be complete with the upgrades by 2007. Chair Beaty suggested adding the 20/20 to the list of priorities.
Commissioner Roszak suggested adding the concept of asserting that Mendota Heights
Land Use planning hinges on the limitations of the corridor and the inverse condemnation issues. Commissioner Petschel stated that the City of Bloomington is going to build a very large, 20-story condo project. She noted that the project is either located in the 69 or 70 contour and expressed concerns that this project went totally unchallenged by the MAC.
Commissioner Povolny stated that the MAC and the FAA developed the current
guidelines and expressed frustration that they are no longer following their own
guidelines. Chair Beaty agreed stating that there is a need to find the actual guidelines.
Chair Beaty suggested that the Commission identify the high priority items and asked if Staff could help draft the remaining issues and action steps. High Priority Items to include: • Land Use Planning\Inverse Condemnation • Explore possibility of joining Minneapolis litigation.
• Working proactively with other communities to mitigate the affects of the 20/20
plan upon the residential areas surrounding the airport.
• Define Capacity.
• NOC – Continue dialogue and input with NOC Representatives. • Monitor MAC and FAA accommodations to communities affected by 17/35 operations for consistency with treatment of Mendota Heights and adherence to the EIS. • Add a sub-goal to advocate sufficient staffing and training for Tower personnel. • 17/35 – Update actions steps to include determining what is being used. • Item 13 – Include Federal along with FAA.
• Tracking HF 1063 and HF 1064 – hold discussion with authors of bills.
Commissioner Petschel suggested brainstorming for ideas on how they could get the
community more involved and informed. Chair Beaty suggested a news article in the City Bulletin regarding the 20/20 concerns. D. HF 1063 and HF 1064 The Commission discussed HF 1063 & HF 1064 that Rep. Rick Hanson provided to the
City for review. Commissioner Petschel stated that she would like to provide clearer
supervision over sound abatement monies to the Cities. Chair Beaty explained that HF

1064 would require the City to develop a mitigation plan. He further explained that mitigation noise zones would be created. He indicated that he is not clear on the tax Commission Meeting March 9, 2005 Mendota Heights Airport Relations Commission - 6 - process adding that he has mentioned to the Mayor that they should learn more about the
bill and its’ process.
Chair Beaty suggested inviting Rick Hanson to an ARC meeting. Commissioner Roszak
suggested including Federal Representatives in the invite. Regarding HF 1063 the city attorney reviewed that bill. It looks like the bill does expand control of the Zoning Board and lessen the control of the development and redevelopment of land within 2 miles of the airport. Chair Beaty asked if anyone from the city is responsible for monitoring the progress of these two bills.
City Administrator Danielson stated that he contacted the League. He stated that both
bills are still very new adding that they did not believe that the bills would go anywhere in
this Legislative session.
Chair Beaty stated that he would like to know the authors for both bills, specifically HF 1064 and further clarification of the mitigation areas. He provided the Commissioners with a brief overview noting that the plan is to tax all vendors located in the airport. Commissioner Roszak clarified his understanding that the tax would only involve the airport area vendors. He stated that this is the type of issue that the ARC could become
more involved in by opening communication with local Representatives.
Chair Beaty asked how they could monitor this issue. Commissioner Roszak suggested
connecting with the authors of the bills, provide the authors with their feedback and ask that they keep the ARC informed of their progress with the bills. E. Australian Air Noise Plan Chair Beaty thanked City Administrator Danielson for providing the information on the Australian Air Noise Plan. He explained that he is interested in the Australian Plan due
to the format of their noise reports. He stated that their report is very people friendly and
easier to understand. He suggested that the Commissioners review the reports and plan
on discussing at the next ARC meeting.
F. City Administrator Update City Administrator Danielson provided the Commission with the following update: • Status update on the golf course. • Ecolab has been to the City Council and the Planning Commission to review their
concept plan for housing.
• Ecolab held a neighborhood meeting at the Mendakota Club to discuss with area
residents.
Commission Meeting March 9, 2005 Mendota Heights Airport Relations Commission - 7 - Acknowledge Receipt of Various Reports/Correspondence: The Commission briefly reviewed the following documents: Commissioner Stein referenced the January 2005 Technical Advisor Report, page nine,
shows the top 15 actual nighttime jet operations by type noting airport noise has increased
approximately 26 percent.

Chair Beaty referenced the February 14, 2005 Airport Noise Report, ‘In this Issue’ the last paragraph states that the FAA invites public comment on the application by Minneapolis-St. Paul airport to impose PFC for various projects and reviewed with the Commission.
Commissioner Roszak referenced the February 14, 2005 Airport Noise Report stating that
the Long Beach article about the City Council refusing to expand capacity is a very
