RESOLUTION 2017-105
RESOLUTION APPROVING A CONDITIONAL USE PERMIT
AND WETLANDS PERMIT FOR PROPERTY LOCATED AT
2260 WAGON WHEEL COURT
WHEREAS, Gonyea Homes, acting on behalf of Jason and Thomasine Eggers (the
"Applicants") have applied for a Conditional Use Permit and Wetlands Permit under Planning
Case No. 2017-29, for the property generally located at the southeast corner of Wagon Wheel Trail
and Wagon Wheel Court, addressed as 2260 Wagon Wheel Court, and legally described in attached
E�iibit A (the "Subject Property"); and
WHEREAS, the Subject Property is guided LR-Low Density Residential in the 2030
Comprehensive Plan, is situated in the R-1 One Family Residential District, and is located adjacent
to an established wetland and Rogers Lake; and
WHEREAS, the Applicants seek permission to construct a new 4,440 sq. ft. single-family
dwelling with an attached 1,427 sq. ft. garage on the Subject Property, and
WHEREAS, pursuant to Title 12-2-1 of the City Code, all new construction, related
improvements, grading, and/or removals made within one-hundred (100) feet of a wetland or water
resource-related area requires a wetlands permit; and
WHEREAS, pursuant to Title 12-1D-3, Subpart C. of the City Code, any attached garage
more than one thousand two hundred (1,200) up to one thousand five hundred (1,500) square feet
in a residential zone is allowed by means of a conditional use permit; and
WHEREAS, on November 28, 2017, the Mendota Heights Planning Commission held a
public hearing on this matter at their regular meeting, and whereupon closing the hearing and
follow-up discussion on this item, the Planning Commission recommended unanimous approval
of the Conditional Use Permit and Wetlands Permit for the property located at 2260 Wagon Wheel
Court, with certain findings of fact and conditions of approval as noted herein.
NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Councii that the
requested Conditional Use Permit and Wetlands Permit for the property located at 2260 Wagon
Wheel Court, as proposed under Planning Case No. 2017-29, is hereby approved with the
following findings of fact:
A. The use of the subject parcel as a new single-family residential dwelling is
consistent with the City Code and Comprehensive Plan.
B. The planned development of the new dwelling with an oversized garage of 1,427
sq. ft. is considered a reasonable request, and is consistent with the City Code and
Comprehensive Plan.
C. The proposed residential home and large garage easily meet the required setbacks
and other standards established under the R-1 One Family District.
D. The proposed garage and residential structure will be compliant with the conditions
included in the City Code that allow it by conditional use permit.
E. The proposed over-sized garage will not be detrimental to the health, safety or
general welfare of the community; should not cause any serious traffic congestion
nor hazards; wi11 not seriously depreciate surrounding property value; and said use
appears to be in harmony with the general purpose and intent of the City Code and
the comprehensive plan.
F. The proposed new residential home project and any related construction activities
will not cause or create any negative impacts to the ecologically sensitive area of
the wetlands or Rogers Lake area, due to the proximity and separation of the
structure from said water features.
BE IT FURTHER RESOLVED, by the Mendota Heights City Council that the
Conditional Use Permit and Wetlands Permit proposed under Planning Case No. 2017-29, is
hereby approved with the following conditions:
1. Since access is being proposed off Wagon Wheel Court, a Public Utility/Improved
Public Right-of-Way Fee of $21,390.86 is paid to the City prior to issuance of a
building permit.
2. If any utility connection is made on to Wagon Wheel Court, a utility connection fee
of $17,609.33 must be paid to the City prior to issuance of a building permit
3. No grading or construction activity on the subject site will occur on slopes over
25%.
4. The Applicant/Owners shall submit a final grading plan, utility plan and a
dimensioned site plan with associated easements, subject to review and approval
by the City Engineering Department as part of any building permit application.
5. All grading and construction activity will be in compliance with applicable federal,
state, and local regulations and codes, as well as in compliance with the City's Land
Disturbance Guidance Document.
6. No disturbance, grading work or any type of construction activities shall occur
within 25 feet of the established wetlands edge.

7. A detailed Landscape Plan must be submitted for review to the Planning
Department showing tree replacement and all new vegetation to be re-planted
within all disturbed areas of the subject site.
8. The proposed 16" wide trench drain inside the new garage must be tied-in to the
sanitary service line (per State Plumbing Code) or if day-lighted outside the
structure, the Applicant/Owners must provide a barrel, tank, dry-well, or natural
"rain-garden" feature to capture any immediate water drainage pollutants from
flowing directly out from the structure and impacting nearby lakes or wetlands.
