Res 2017- 93 Deferring Assessment Sanitary Sewer 2535 Condon CtCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2017-93 A RESOLUTION DEFERRING THE MAHING OF ASSESSMENT ON THE SANITARY SEWER AS TO THE PROPERTY LOCATED AT 2535 CONDON COURT FOR THE MENDOTA HEIGHTS ROAD & KENSINGTON STREET IMPROVEMENT (PROJECT #201409, 201616) WHEREAS, the City Clerk, with assistance of the Public Works Director has calculated the proper amount to be specially assessed for the Mendota Heights Road & Kensington Street Improvements (Project No. 201409, 201616); and WHEREAS, the assessment roll for said improvements has been filed with the City Clerk and at all times since its filing has been open to public inspection; and WHEREAS, a hearing on said assessments was duly held at 7:00 p.m. on October 30, 2017, at the City Hall in the City of Mendota Heights, MN; and WHEREAS, Condon Court Exchange, LLC, is the owner of certain property more particularly described as Parcel No. 270350080021, the legal description of which is following described property situated in Dakota County, Minnesota: Part of Southeast quarter commencing at Intersection of South Line & Centerline of Trunk Highway 149 then West 450 feet, then North 819 Feet to point of beginning then North 113 Feet, then East 306 feet to Centerline highway 149, then south along centerline 114 feet to a point on a line parallel with south line and passing through point of beginning then West 319.48 feet to point of beginning except part of the highway 149, Section 25, Township 28, Range 23; and WHEREAS, Condon Court Exchange, LLC. has requested that the making of an assessment against said property by reason of said improvements be deferred for a period of one year, due to the hardship created by the lack of the sanitary sewer to which to connect; however, during that time, interest will accrue. NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that: 1. That the assessment roll for said improvements (Project No. 201409, 201616) be corrected to defer the making of an assessment at this time against the property of Condon Court Exchange (Parcel No. 270250004022) for the Sanitary Sewer portion of said assessment. 2. That upon completion of the deferral period of 1 year, or connection to respective sanitary sewer, or upon the future sale of title transfer of said property there shall be levied an assessment in the principal amount of $42,644.18 plus interest at the rate of four point one zero five five percent (4.1055%) per annum from October 30, 2017. 3. That the City Clerk is hereby directed to correct the assessment roll for said improvements as set forth above. Adopted by the City Council of the City of Mendota Heights this thirtieth day of October, 2017.
