Road & Kensington Street Improvements
COMMENT:
INTRODUCTION
The Council is asked to preside over an assessment hearing and adopt the assessment roll for the Mendota
Heights Road and Kensington Street Improvement Project (201409 & 201616).
BACKGROUND
Council ordered the Mendota Heights Road & Kensington Street Improvements at their February 7, 2017
meeting, and directed staff to prepare plans and specifications for this street reconstruction project. The
plans were approved and authorized to bid at the March 28, 2017 meeting. Council accepted bids and
awarded the project to Valley Paving at their May 16, 2017 meeting.
DISCUSSION
The Public Hearing for the consideration of special assessments for the Mendota Heights Road &
Kensington Street Improvements was advertised for the city council meeting at 7:00 P.M. on October 30,
2017. The project has been substantially completed with only the signage replacement, Mendota Heights
Road final paving (spring 2018) and miscellaneous punch list items remaining.
BUDGETIMPACT
The total construction contract cost for the Mendota Heights Road & Kensington Street Improvements is
$1,837,010.20, not including, signage replacement and indirect costs for legal, engineering,
administration, and finance.

All proposed assessments are payable over a 10 year period at an interest rate of 4.1055 percent.
RECOMMENDATION
Staff recommends that council conduct the required Public Hearing and adopt the attached assessment roll
as prepared, or amend them if council deems it appropriate to do so.
ACTION REOUIRED
If Council wishes to enact the staff recommendation, it should pass a motion adopting A RESOLUTION
ADOPTING AND CONFIRMING ASSESSMENTS FOR THE MENDOTA HEIGHTS ROAD &
KENSIGNTON STREET IMPROVEMENTS (PROJECT #201409 & 201616). This action requires
a super majority vote.

RESOLUTION 2017-92
A RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR THE MENDOTA
HEIGHTS ROAD & KENSINGTON STREET IMPROVEMENTS (PROJECT #201409 & 201616)
WHEREAS, pursuant to proper notice duly given as required by law, the Mendota Heights City
Council has met and heard and passed upon all objections to the proposed assessment for the
improvement to rehabilitate Mendota Heights Road (from Lexington Avenue to Dodd Road), Bedford
Court, Claremont Drive, Concord Way, Condon Court, Lockwood Drive, Stockbridge Road, and
Whitfield Drive referred to as the Mendota Heights Road & Kensington Street Improvements.
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that:
1. Such proposed assessments, copies of which are attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein, and each
tract of land therein included is hereby found to be benefited by the proposed improvement in the
amount of the assessment levied against it.
Such assessment sha11 be payable in equal annual principal installments extending over a period
of 10 years. The first of the installments shall be the annual principal plus interest calculated from
the public hearing date to the end of this year plus twelve months of the next year and shall bear
interest at the rate of 4.1055% per annum from the date of the adoption of the assessment
resolution. To each subsequent installment when due shall be added interest for one year on all
unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to
the county auditor, pay the whole of the assessment on such property, with interest accrued to the
date of payment, to the City Finance Director, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of this resolution. The property owner may,
at any time thereafter, pay to the City Finance Director the entire amount of the assessment
remaining unpaid, excepting the installment portion appearing upon the current year's property
tax statement.
4. The City Clerk shall prepare and transmit to the County Auditor a certified duplicate of said
assessment rolls with each then unpaid installment and interest set forth separately, to be
extended upon the proper tax lists of the County, and the County Auditor shall thereafter collect
said assessments in the manner provided by law.
Adopted by the City Council of the City of Mendota Heights this thirtieth day of October, 2017.

COMMENT:
INTRODUCTION
The Council is asked to authorize a purchase order for the signage replacement in conjunction with the
Mendota Heights Road & Kensington Street Improvement Project.
BACKGROUND
Street signs throughout the city were installed as each neighborhood was developed. Many of the street
signs are in need of replacement due to their diminishing reflectivity and legibility. Street signs are
typically replaced in conjunction with street reconstruction or rehabilitation projects to be compliant with
State and Federal regulations.
DISCUSSION
The current street signs in these neighborhoods are in need of replacement. The current shape, text (size
and font) and color of the current signs no longer meet specifications prescribed within the Manual on
Uniform Traffic Control Devices (MUTCD).
Staff requested proposals from two signage companies and received proposals from both of the
companies. Advantage Signs & Graphics, Inc. provided a quote with an estimated cost of $18,432.89 to
complete the signage replacement for the Mendota Heights Road & Kensington Street Improvements.
The other quote received had a price of $18,750.00. Staff has worked with Advantage Signs & Graphics,
Inc. in the past and staff feels that they will complete the work to our satisfaction.
BUDGETIMPACT
Signage replacement was included in the feasibility report for the project. The cost for this replacement is
within the amount of indirect costs allocated to the project.
RECOMMENDATION
Staff recommends that the council authorize staff to execute a purchase order for the signage replacement
to Advantage Signs & Graphics, Inc.
ACTION REQUIRED
If city council wishes to implement the staff recommendations, pass a motion by simple majority vote
authorizing staff to execute a purchase order for signage replacement to Advantage Signs & Graphics,

on the property located at 2535 Condon Court, Mendota Heights, MN.
BUDGETIMPACT
The city will carry the special assessment until payment per terms on the attached resolution.
Payment may occur prior to or after the allotted repayment period.
RECOMMENDATION
Staff recommends that Council adopt the resolution deferring the sanitary sewer assessment at
2535 Condon Court.

WHEREAS, the City Clerk, with assistance of the Public Works Director has calculated
the proper amount to be specially assessed for the Mendota Heights Road & Kensington Street
Improvements (Project No. 201409, 201616); and
WHEREAS, the assessment roll for said improvements has been filed with the City
Clerk and at all times since its filing has been open to public inspection; and
WHEREAS, a hearing on said assessments was duly held at 7:00 p.m. on October 30,
2017, at the City Hall in the City of Mendota Heights, MN; and
WHEREAS, Condon Court Exchange, LLC, is the owner of certain property more
particularly described as Parcel No. 270350080021, the legal description of which is following
described property situated in Dakota County, Minnesota:
Part of Southeast quarter commencing at Intersection of South Line & Centerline of
Trunk Highway 149 then West 450 feet, then North 819 Feet to point of beginning then North
113 Feet, then East 306 feet to Centerline highway 149, then south along centerline 114 feet to a
point on a line parallel with south line and passing through point of beginning then West 319.48
feet to point of beginning except part of the highway 149, Section 25, Township 28, Range 23;
and
WHEREAS, Condon Court Exchange, LLC. has requested that the making of an
assessment against said property by reason of said improvements be deferred until such time as
the assessment term has expired, the property sold, utility connected to or otherwise transferred
in Title Ownership.
NOW THEREFORE BE IT RESOLVED, by the Mendota Heights City Council that:
That the assessment roll for said improvements (Project No. 201409, 201616) be
corrected to defer the making of an assessment at this time against the property of
Condon Court Exchange (Parcel No. 270250004022) for the Sanitary Sewer portion of
said assessment.
2. That upon completion of the assessment term of 10 years, connection to respective
sanitary sewer or upon the future sale of title transfer of said property there shall be
levied an assessment in the principal amount of $42,644.18 plus interest at the rate of
four point one zero five iive percent (4.1055%) per annum from October 30, 2017.

citizen, permanent and total disability, military service and green acres. The city determines if
an assessment will accrue interest and the associated rate and if interest is due annually or at the
time of payment.
DISCUSSION
Mendota Heights received a deferment request for the street assessment on the property located
at 2455 Visitation Drive, Mendota Heights, MN (Visitation Monastery). Visitation Monastery
owns property on the north and south side of Mendota Heights Road as separate parcels. The
southern parcel (PID 270350081010) is an undeveloped piece of land between Mendota Heights
Road and I-494. Deferment of the assessment to this parcel is in conjunetion with League of
Minnesota Cities guidance and State Statutes. The property is proposed to accrue interest in the
deferment period which will expire in 10 years. At that time, Visitation would need to request an
eXtension of this deferment of payment would become due. The city also has the option of
requiring accrued interest to be paid annually.
The northern parcel (PID 270350078010), is one of six parcels that comprise the housing and
campus. A majority of this single parcel is undeveloped with the eXception of a small portion of
a parking lot along Visitation Drive and the southern half of the soccer field. Generally, an
assessment of this nature to similar parcels is not differed but it would meet the State
requirements. The same repayment terms would apply to this parcel.
Attached are two resolutions with the same resolution number. The first resolution would defer
the assessment to both lots and not require an annual interest payment. The second resolution
would defer the assessment to just the southern lot and also not require an annual interest
payment. If Council desires that interest be collected annually, the resolution would need to be
amended.

1. That the assessment roll for said improvements (Project No. 201409, 201616) be
corrected to defer the making of an assessment at this time against the property of

WHEREAS, the City Clerk, with assistance of the Public Works Director has calculated the
proper amount to be specially assessed for the Mendota Heights Road & Kensington Street Improvements
(Project No. 201409, 201616); and
WHEREAS, the assessment roll for said improvements has been filed with the City Clerk and at
all times since its filing has been open to public inspection; and
WHEREAS, a hearing on said assessments was duly held at 7:00 p.m. on October 30, 2017, at
the City Hall in the City of Mendota Heights, MN; and
