INTRODUCTION
The Council will meet at 6:00 PM on Tuesday, June 6rh, for the purpose of discussing two items.
BACKGROUND
l. MNDOT will have two representatives, Molly Kline and Dale Gade, in attendance to
provide background for a process known as "municipal consent". This will be presented
for City Council consideration following a Public Hearing to be held at the June 20rh City
Council meeting. This relates to the Dodd Road project, which is schedule for 2018.
The workshop will provide the Council with an opportunity to get into more detail than
would otherwise be possible at the regular meeting, and will look at individual parcels for
which easements and rights-of-way will be needed for storm drainage and construction
related to the proj ect. These actions are separate from the trail easements which are
currently being negotiated along Dodd between Marie Avenue and TH 110.
We expect the MNDOT discussion to take up to 30 minutes.
2. Earlier this year, the City Council approved changes in the City's Fire Code, which were
a result of new State Fire code changes. What was not included at that time were changes
in the Appendices of the State Code.
Fire Chief Dave Dreelan will be in attendance to discuss Appendices changes which
should be considered by Mendota Heights. Some of these are technical in nature, but
others, including barbeque changes, will be of interest to a broader audience.

A summary of the proposed changes and recommended actions, and the applicable
sections of the Code is attached.
Any consensus for changes will be presented for formal action at a future meeting.

Dear Mr. Ruzek,
MnDUT is proceeding with plans to complete State Project 1917-45, w�ich includes Highway 149 pa�ement,
drainage infrastructure repa�r, and replacemenf as well as ADA updates. Bn accorc€ance with Minnesota Statute
� 61.164, 1 am submitting for �ity approvaf the project's Layout and associated ri�ht-of-way acc�uisition
locatians for S.P. 1917-45.
Mur�icipal car�sent is required due to acquisition af permanent right-of-way associated wifh drainage
infras#ructure. Municipaf consent af MnDOT projects is described en Minnesota Statutes 161.162 thraugh
161.167 (attached).
Approval or disappro�al of municipal consent is by resalution af the Cify Co�ncif. (A sample reso[utian is
attached). However, if the City neither appraves nor disappra�es within 90 days of the public hearing, the
layout is deemed approved (per MN 5tat�te 161.164).
The City's res�onsibilities regarding municipal consent (per MN Statute 161.164) are as follows;
• Withen 15 days of recei�ing the request, schedule a public hearing.
• W�thin 6� days of receiving the request, eonduct the public hearing.
• Provide at feast 30-days' notice of the public hearing.
• Within 90 days af tf�e public hearing, approve or disa�pro�e by resolution.
MnDOT will attend the public hearing fo present the final layout and associated right-of-way acc�uisition
locations and answer questions, as required by statut�. MnDOT would also be a�ailable to attenti a City
Council work session at the requesf of the City of Mendota Heights.

f�roject Purpose
This project is being de�eloped to improve mu[tiple aspects flf Hig�tway 149. The pavement structure will be
restored and the ride smoothness increasecf by resurfacing the roacEway. Pedestrian safety and ADA
impro�ements v+riil be made by u�dating infrastructure to meet current ADA guidefines. Drainage infrastructure
will be improved I�y repairing or r�placing deficie�t infras�ructure.
Project Descript+on
This project is located on Highway 149 from I-494 to George Street. The project lirrtits within the C�ty of
Mendata Heights are from 1494 to Delaware Ave. The layouf include5 areas with geametric changes. The
included right�of-way exhibits show the permanent right-of-way acquisi�ion locations.
Planned Project Schedule
The letting for this project is scheduled for January 2Q18, with consfructian anticipaied during the summer of
2Q18. The construction may rec{uire uveek�nd and short term closures at various locations to facilitate drainage
pipe repair and/or rep[acement. Canstruction staging and detour routes are still being d"rscussed with the City's
Public Works Direc#or.
City's Est�mated Project Costs
The City's trail project is anticipated to be tied to the MnDOT roadway project. This additian is at the City's
request and ex{�ense. In order for MnQOT to t�e �he City's trail project ta the roadway project, a cooperative
constructian agreeme�rt and associated Caunci[ resolutian are required. In order for MnDOT ta 4et and
administer the City's traii projec# in conjunction with the roadway project, a fee of 8% of the trail estimate will be
added. The 8% co�ers the MnDOT construction inspection and adm[nistra#ion.
City's Maintenance Resp4nsibiliiies
The City's trail segments located wifhin MnDOT right-of-way will require City maintenance. This includes in-
place and to-be-constructed trails, and will be addresseci in the trail LUP's.

Appendix A Board of Appeals
A board of appeals shall be established within the jurisdiction for the purpose of hearing
applications for modification of the requirements of the International Fire Code pursuant
to the pro�isions of Section 108 of the International Fire Code. Not Recommended
This is the current appeals process in the 2015 Minnesota State Fire Code
Minnesota State Fire Code
108.1 Appeals to state fire marshal. As outlined in Minnesota Statutes, Section
299F.011, subdivisions 5 and 5b, any person may appeal an order issued to them by
the state fire marshal or action taken by the local governing body on issues
regulated by this code. Appeals can be made to determine the suitability of alternate
materials and types of construction, to provide for reasonable interpretations of the
provisions of this code, and to grant variances from orders issued by representatives of
the state fire marshal. Persons wishing to present matters for appeal shall do so in
writing and, in the case of persons who have received written orders, applications for
variances shall be made prior to the expiration of the orders. Orders shall not be
considered to be expired until any time extensions granted by the state fire marshal
have elapsed. The state fire marshal shall not accept applications for variances after
criminal action for noncompliance has been initiated pursuant to Minnesota Statutes,
Section 299F.011, subdivision 6.
This is the current city code regarding appeals.
Mendota Heights Code 7-2.5
B. Appeals: Any person aggrieved by a written order pursuant to section 108.1 of the
state fire code may, within fifteen (15) days after service of said notice, appeal
therefrom to the board of appeals by filing a written notice of appeal with the city clerk.
The appeal shall be heard at such time as may be established by the board. The city
council of the city of Mendota Heights shall serve as and constitute the board of
appeals. The board may, upon the hearing, affirm in whole or in part or deny the
existence of a violation. Pending decision of the board of appeals, the order of the code
official shall be stayed unless there is an immediate fire hazard to life or property. (Ord.

Appendix B Fire-Flow Requirements for Buildings
The procedure for determining fire-flow requirements for buildings or portions of
buildings hereafter constructed shall be in accordance with this appendix. This

7-2-11: FIRES OR BARBECUES ON BALCONIES OR PATIOS:
A. Fire Or Open Flame: In any structure containing three (3) or more dwelling units, no
person shall kindle, maintain, or cause any fire or open flame on any balcony above
ground level, or on any ground floor patio immediately adjacent to or within #if#ee+� eight
feet {�'}(8')of any unit.
B. Fuel Storage Prohibited: No person shall store or use any fuel, barbecue, torch or
similar heating or lighting chemicals or devices in the locations designated in subsection
A of this section.
C. Exception: Listed electric or gas fired barbecue grills that are permanently mounted
and wired or plumbed to the building's gas supply or electrical system and that maintain
a minimum clearance of eighteen inches (18") on all sides, unless listed for lesser
clearances, may be installed on balconies and patios when approved by the fire chief.
Appendix L Emergency Responder Coverage
Existing buildings that do not have approved radio coverage for emergency responders
within the building based upon the existing coverage levels of the public safety
communication systems of the jurisdiction at the exterior of the building, shall be
