RESOLUTION ACCEPTING EASEMENT FOR STREET,
SEWER AND WATER PURPOSES OVER THE PROPERTY
OF LOUISE C. WODKE
WHEREAS, in connection with the Tilsen's Highland
Heights Water Improvement Project previously completed (more
particularly known and designated as Improvement No. 2, Project
No. 1), it was necessary for the Village to obtain a permanent
easement for street purposes over and across the northerly
fifteen (15) feet and the westerly fifteen (15) feet of the
Louise C. Wodke property located on the Southwest corner of
Clement Street and Third Avenue in the Village of Mendota
Heights, and
WHEREAS, in connection with said improvement project
it was also necessary for the Village to obtain an'easement for
sewer and water purposes over and across the southerly five (5)
feet of the northerly twenty (20) feet of said property, and
WHEREAS, Louise C. Wodke, the owner of said property,
is willing to grant said easements to the Village on the con-
dition that no assessment be made against said property and her
property immediately adjacent thereto by reason of said water
improvement project (more particularly known and designated as
Improvement No. 2, Project No. 1) or by reason of the laying,
construction or extension of the Village's sanitary sewer system
until such time as she requests such service to said property
from the Village water system or until such time as said property
is, in fact, serviced or required to be serviced by the Village's
sanitary sewer or water distribution systems, or until such time
as said property or any part thereof is platted or is otherwise
improved or developed other than for a single family residence
for said Louise C. Wodke or until said time as said property is
sold or is otherwise transferred by Louise C. Wodke whether by
death or conveyance, and
WHEREAS, the Village Council has fully reviewed the terms
and conditions contained in said proposed easement agreement, and
WHEREAS, it appears 'to be in the best interest of the
Village of Mendota Heights to acquire said easements on the con-
ditions hereinabove stated.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village
Council of the Village of Mendota Heights as follows:
1) That said easements, subject to the terms and
conditions hereinabove set forth, are hereby in all re-
spects accepted and approved, and
2) That the Village Clerk take any and all steps
necessary to cancel the assessment heretofore levied
against said property by reason of said Improvement No. 2,
Project No. 1 in accordance with the terms of said easement
agreement.

1966.
