RESOLUTION ORDERING CONSTRUCTION OF EXTENSION OF VILLAGE WATER DISTRIBUTION SYSTEM TO SERVE PROPERTIES IN THE SOMERSET PARK ADDITION AND THE WILLOW SPRING ADDITION AND AREAS ADJACENT THERETO WHEREAS, a public hearing was held on the 13th day of September, 1966, at 8:00 o'clock P.M. at the Village Hall of the Village of Mendota Heights, Minnesota, pursuant to resolu- tion adopted by the Village Council of the Village of Mendota Heights on August 2, 1966, on the question of the proposed con- struction of a water distribution system and incidentals there- to (including the construction of service connections to said water system and reconstruction of streets) in an area situated within said Village of Mendota Heights as more particularly de- scribed in the notice of said hearing; and WHEREAS, the Village Attorney presented an affidavit of the West St. Paul Booster showing due publication of notice of the public hearing on said proposed construction; and WHEREAS, the Village Attorney reported that mailed notice of said hearing had been mailed more than ten days prior to the date of said hearing to the owners of each parcel situated within the area proposed to be assessed, all in accordance with the ap- plicable Minnesota statutes; and WHEREAS, the Village Engineer reported that the proposed improvement and construction thereof was feasible and desirable, and further reported on the proposed costs of said improvement and construction thereof; and WHEREAS, the Village Council then proceeded to'hear all persons interested in said improvement and'all persons were afforded an opportunity to present their views and objections to the making of said improvements; and WHEREAS, said hearing was upon motion duly made and seconded and unanimously carried thereupon continued until Tuesday, Septem- ber 20, 1966, at 8:00 o'clock P..M,'in the Village Hall in said Village; and WHEREAS, said hearing was duly reconvened on Tuesday, September 20, 1966, at 8:00 o'clock P.M. in the Village Hall; and WHEREAS, the Village Council then proceeded to hear all per- sons interested in said improvement and all persons were afforded an opportunity to present their views and objections to the making of said improvements; and WHEREAS, said hearing was upon motion duly made and seconded and unanimously carried thereupon continued until Tuesday, January 17, 1967, at 8:00 o'clock P.M. in the Village Hall in said Village; and WHEREAS, said hearing was duly reconvened on Tuesday, January 17, 1967, at 8:00.o'clock P.M. in the Village Hall; and WHEREAS, the Village Council then proceeded to hear all per- sons interested in said improvement and all persons were afforded an opportunity to present their views and objections to the making of said improvements; and WHEREAS, no objections were made to the construction of said improvements. TNOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights, Minnesota, as follows: 1) That it is advisable, feasible, expedient and necessary that the Village of Mendota Heights construct said water distribu- tion system within the area described in said notice of hearing on said improvement, and it is hereby ordered and directed that said improvements be made. 2)- That Edward Kishel, Village Engineer, be and is hereby instructed and authorized to proceed with the preparation of plans and specifications for said water distribution system. 3) That the Village Engineer and Village Attorney be and are hereby authorized and directed to enter into such negotiations as may be necessary with the City of Saint Paul for the furnishing by said City'of said water to said area. 4) That said water distribution improvement project shall hereafter be_ known and designated as Improvement Number 4, Project Number 5. ` 5) That all prior acts or actions taken by the Village Council of the Village of Mendota Heights relative to said water distribution improvement project be and are hereby in all respects ratified and confirmed.
