Res 67 - 80 Authorixzing Mayor & Clerk to Enter into License Agreement with the Chicago, Milwaukee, St. Paul & Pacific Railroad Company & the Chicago & NW Railway Companyt W Village of Mendota Heights Dakota County, Minnesota RESOLUTION N0. RESOLUTION AUTHORIZING MAYOR AND CLERK TO ENTER INTO LICENSE AGREEMENT WITH THE CHICAGO, MILWAUKEE, ST., PAUL AND PACIFIC RAILROAD COMPANY AND THE CHICAGO AND NORTHWESTERN RAILWAY COMPANY WHEREAS, in the construction of the proposed Village Master Sanitary Sewer Trunk System it will be necessary that the Village secure permission to cross certain property and/or. right-of-way of the Chicago, Milwaukee,'St. Paul and Pacific Railroad Company and the Chicago and Northwestern Railway Company situated in Dakota County, Minnesota, and WHEREAS, the said railways have submitted a proposed license agreement to the Village authorizing the Village to place, construct, maintain and use the Village Sanitary Sewer lines upon the property and under the tracks of said railways in accordance with the specifications shown on those certain maps dated April 17, 1967, attached to said license agreement, and WHEREAS, the railways require a payment to them of $25.00 to cover their expense in preparing said license agreement, and WHEREAS, it is necessary and in the best interests of the Village that the Village enter into said license agreement. NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights, Minnesota, as follows: 1) That the Mayor and Clerk of the Village of Mendota Heights be and are hereby authorized and - directed to execute said license agreement on behalf of the Village of Mendota Heights. 2) That the Village pay to said railways the total sum of $25.00 in consideration for the grant to it by said railways of said license agreement. i 3) That the Mayor and Clerk be and are hereby authorized and directed to execute any and all additional papers or documents that may be required or necessary in order to consummate said license agreement.
