RESOLUTION NO.
RESOLUTION AUTHORIZING MAYOR AND CLERK
TO ENTER INTO LICENSE AGREEMENT WITH THE
CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC,
SRA ILROAD—C-Oi�IPAN- '
WHEREAS, in the construction of the proposed Village.Master
Sanitary Sewer Trunk System it will be necessary that the
Village secure permission to cross certain property and/or
right-of-way of the Chicago, Milwaukee, St. Paul and Pacific
Railroad Company situated in Ramsey County, Minnesota, and
WHEREAS, the said railroad has submitted a proposed license
agreement to the Village authorizing the Village to place,
construct, maintain and use the Village Sanitary Sewer lines
upon the property and under the tracks of said railroad in ac-
cordance with the specifications shown on that certain map
dated March 17, 1967, attached to said license agreement,
and
WHEREAS, the railroad requires a payment to it of $35.00 to
cover its expense in preparing said license agreement and
the additional payment to it of $100.00 as consideration for
the grant of said license agreement, and
WHEREAS, it is necessary and in the best interests of the'
Village that the Village enter into said license agreement.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of
the Village of Mendota Heights, Minnesota, as follows:
1) That the acting Mayor and Clerk of the Village of
Mendota Heights be and are hereby authorized and directed
to execute said license agreement on behalf of the Village
of Mendota Heights.
2) That the Village pay to said railroad the total sum of
$135.00 to cover the railroad's charge for preparing said
license agreement and the consideration to be paid by the
Village for the grant to it of said license agreement.
3) That the acting Mayor and Clerk be and are hereby
authorized and directed to execute any and all additional
papers or documents that may be required or necessary
in order to consummate said license agreement.
