Village of Mendota Heights Dakota County, Minnesota ,/0 —/ �'-6�5_ RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR IMPROVEMENT NUMBER 2, PROJECT NUMBER 1 (CONSTRUCTION OF WATER DISTRIBUTION SYSTEM { Mendota Heights, Minnesota BE IT RESOLVED by the Village Council of the Village of Mendota Heights as follows: il WHEREAS, the Village Clerk with the assistance of Edward Kishel, Engineer for the Village of Mendota Heights, has calculated the proper amount to be specially assessed for Improvement Number 2, Project Number 1 (construction of Water Distribution System) against every assessable lot, piece or,parcel of land affected thereby upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Chapter 429, M.S.A., and particularly of Section 429.051 thereof; and WHEREAS, the proposed assessment roll has been on file with the Clerk and at all times since its filing has been open for public inspection; and notice thereof has been duly published and mailed as required by law, Said notice stated the date, time and place of such meetings; the general nature of the improvement; the area proposed to be assessed; that the proposed assessment roll has been on file with the Clerk; and that written or oral objections thereto by any property owner would be -considered; and WHEREAS, said hearing was held at 8:00 o'clock P.M. on October 7, 1965, in the Mendota Elementary School at 1025 Highway #110 (formerly #100) in the Village of Mendota Heights, Minnesota, and WHEREAS, the Mayor announced that the hearing was open for the consideration of objections, if any, to said pro- posed assessments, and WHEREAS, all persons were then given an opportunity to present said objections, and WHEREAS, said hearing was then continued until Octo- ber 12, 1965, at 8:00 o'clock P.M. in the Village Hall,_and WHEREAS, said hearing was reconvened'at 8:00 o'clock P.M. on October 12, 1965, in said Village Hall, and r WHEREAS, said hearing was then continued until Octo- ber 1965, at 8:00 o'clock P.M. in the Village Hall, -and WHEREAS, said hearing was duly reconvened on Octo- ber (, 1965, at 8:00 o'clock P.M. in the Village Hall, and WHEREAS, the Mayor announced that the hearing was open for the consideration of objections, if any, to said -pro- posed assessments, and WHEREAS, all persons present were then given an op- portunity to present oral objections, and all written objections theretofore filed with the Clerk were presented and considered and all such objections were tabulated as follows: NOW, THEREFORE, this Council, having heard and con- sidered all objections so presented, and being fully advised in the premises, and having made all necessary adjustments, finds that each of the lots, pieces and parcels of land enum- erated in the proposed assessment roll was and is specially benefited by the construction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and that such amount so set out is hereby levied•against•each of the respective lots, pieces and parcels of land therein des- cribed; and BE IT FURTHER RESOLVED, that the proposed assessment roll is hereby adopted and confirmed -as the proper special assess- ment for each of said lots, pieces•and parcels of land respectively, and the assessment against each parcel, together with interest at the rate of six percent (6%) per annum accruing on the full amount thereof from time to -time unpaid, shall be a lien con- current with general taxes upon such parcel and'all thereof. -2- r The total amount of each such assessment shall be payable in equal annual installments extending over a period of nineteen (19) years, the first of said installments, together with in- terest on the entire assessment from the date hereof to Decem- ber 31, 1966, to be payable.with general taxes for the year 1965, collectible in 1966, (now designated as real estate taxes payable in 1966) and one of each of the remaining installments, together with one year's interest on that and all other unpaid installments, to be payable with general taxes for each consecu- tive year thereafter until the entire assessment is paid; and BE IT FURTHER RESOLVED, that prior to Al my e m Wa 15 1965, the owner of any lot, piece or parcel o and assessed hereby may at any time pay the whole of such assess- ment, without interest, to the Village Treasurer; and BE IT FURTHER RESOLVED, that the Clerk thereafter shall prepare and transmit to the County Auditor a certified duplicate of said assessment roll, with each then unpaid in- stallment and interest set forth separately, to -be extended upon the proper tax lists of the County, and the County Auditor shall thereafter,collect said assessments in the manner pro- vided by law.
