RESOLUTION NO. 134
~RESOLUTION APPROVING PRELIMINARY PLAT
FOR HIGHLAND HEIGHTS SOUTH ADDITION AND
IMPOSING CERTAIN TERMS AND CONDITIONS WITH
RESPECT THERETO
WHEREAS, a preliminary plat of the area to be known as Highland
Heights South Addition has been presented to the Village Council
of the Village of Mendota Heights for its review and approval, and
WHEREAS, said preliminary plat meets with the Village Council's
approval subject to the terms, conditions,' and understandings
hereinafter set forth.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the
Village of Mendota Heights, Minnesota, as follows:
1) The preliminary plat of Highland Heights South
Addition presented to this meeting is hereby approved
subject to and conditional upon the following terms,
conditions and understandings:

A) The developer will forthwith file with the
Village its petition requesting the installation
,and construction of municipal sanitary and storm
sewers,;water, bituminous surfaced streets and
'concrete curbs -and gutters for said area.

B) The final plat for said area will provide
for a drainage easement over the northerly twenty
(.20) . feet of Lot" One ' (1) , Block Five ( 5 )1 thereof
plus a temporary or construction easement over
a sufficient area immediately to the south thereof.
C) That the developer, at its own cost and expense,
will construct and maintain a drainage and/or storm
sewer system to handle the drainage from and over
the westerly portion of said platted area until such
time as a Village storm sewer system has been constructed
along Marie Avenue; the developer's plans and specifica-
tions for said drainage and/or storm sewer system for
said westerly portion of said platted area shall be
subject to the prior written approval of the Village
Engineer.
D) That upon petition of the developer, the
Village will undertake to construct a storm sewer
system to handle drainage from and over the easterly
side of said platted area; that said storm sewer
system will run across Victoria Avenue and across
land to the east of Victoria Avenue; that there
shall be an assessment levied against the property
contained in said Highland Heights South Addition
for said Village storm sewer at the rate of $.05
per square foot or in the amount of the total cost
of said storm sewer project (including but not
limited to all engineering, legal and easement
acquisition costs), whichever is the lesser. That
except as herein provided, there shall be no additional
assessment for storm sewer improvements levied against
the property included in the plat of said Highland Heights
South Addition.
E) That upon acceptance of the final plat for said
Highland Heights South Addition, the developer will
be deemed to have satisfied its obligations with respect
to the balance due the Village by the developer for its
park contribution with respect to its Eagle Ridge
Subdivision.
Adopted by the Village Council of the Village of Mendota Heights this
3rd day of October,'1967.
