Res 68 - 137 Authorizing Acquisition of Land for Park PurposesVillage of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 137 RESOLUTION AUTHORIZING ACQUISITION OF LAND FOR PARK PURPOSES WHEREAS, the Village Council of. the Village of Mendota Heights has determined to acquire for park purposes a park site located at the Northeast corner of Wagon Wheel Road and the proposed Highway No. 35E, and WHEREAS, included in said park site will be all of Lot Twenty -One (21) and Lot Twenty -Three (23) of Caroline's Lakeview in said Village, and WHEREAS, a part of said Lot Twenty -One (21), and Lot_Twenty=Three (23) of said Caroline's Lakeview is to be taken by the Village for the purposes of the Village's sanitary sewer system, and WHEREAS, condemnation proceedings have heretofore been 'commenced for the acquisition of a part of said Lot Twenty -One (21) and'Lot Twenty -Three (23) for said sanitary sewer purposes, and WHEREAS, it is in the best interest of the Village that all of said Lot Twenty -One (21) and said Lot Twenty-Three•(23) of Caroline's Lakeview be acquired by the Village at this time. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Village Council of the Village of Mendota Heights, Minnesota, as follows: 1) That the Village Attorney be and he is hereby authorized and directed to acquire fee simple title to all of said Lot Twenty -One (21) and Lot Twenty -Three (23) of Caroline's Lake- view situated in the Village of Mendota Heights, Minnesota, said property to be used by the Village for park and sewer purposes, and 2) That the Village Attorney be and he is hereby further authorized and directed to commence condemnation proceedings for the acquisition of said property and in connection therewith to apply to the District Court of Dakota County requesting that the existing condemnation proceedings covering a part of said property for sanitary sewer purposes be amended so that the Village may acquire all of said Lot Twenty -One (21) and said Lot Twenty -Three (23) Caroline's Lakeview in fee simple title.
